bus nearly hit by a speeding suv. police are asking for your help to track down that driver this morning. tuesday, a >> announcer: from nbc news this is "today" with matt lauer and savannah guthrie live from studio 1a in rockefell. >> good morning, everyone. welcome to "today" on a tuesday morning. matt has the morning off. hoda is here. what a night in baltimore. >> it was so chaotic and there was so much chaos overnight. you hope it calms down today. >> absolutely. there's a telling piece of video that seems to say it all. of a mom seeing her son in the streets and saying get back inside. we'll have more on that moment in just a little bit. >> it makes you wonder why schools are closed today. you want the kids to be somewhere. >> so many questions being asked. let's get to it. it has been a night of chaos, violence lawlessness in the protests over the death of

freddie gray. 15 officers injured in clashes. >> right now the national guard is on the scene trying to restore peace. as we said all public schools are closed today. also a mandatory daily curfew is in place at 10:00 tonight. >> we have the coverage by law enforcement that's getting criticism. let's start with ron allen. good morning. what's the latest? >> reporter: good morning. the latest is that baltimore is still smoldering and there are areas of the city that literally look like battlefields with glass and debris littering the streets. that's what's left of a community center that was under construction. it's still smoking this morning. firefighters just raced to the scene here to deal with more hot spots that were still burning. it's a complete loss. a very intense night here in baltimore with pockets of the city engulfed. outrage exploding on the streets of baltimore.

police and firefighters under attack they say. bricks and bottles flying. fire hoses slashed. as they battle the flames and the community's fury. this massive inferno was a center under construction. so close the orioles postponed a major league baseball ga this appears to be the end of the police operation. they were down at that intersection down there to secure it while the firefighters came in to put out the fire. you can see it's still burning a bit. in this direction, they're moving out of here but their night is probably not done. a violent night after a peaceful morning. thousands at freddie gray hours later, police say the trouble started when a crowd, many of them high schoolers, squared off with police near a local mall. a protest fueled by social media. officials blame thugs, gangs

that threatened to quote, take out law enforcemen. maryland's governor sent in the national guard. on the streets while police trying to maintain order, residents vented their grievances. more demanded to know why gray died. >> it's about not feeling heard. it's about the fact that freddie gray is gone. >> reporter: gray's family pleaded for peace. >> i want justice for my son but don't do it like this here. don't tear up the whole city. it's wro. >> reporter: but well into the night, a city of some 600,000 burn. this morning there's a very heavy police presence across this city. there are some 5,000 police officers from out of town who have come here. there are some 5,000 more national guard troops who may be deployed on the streets of the city at some point during the day depending upon how things

go. throughout much of all this last night, the city was completely shut down. today's schools will be closed. there will be a curfew in effect across the area at 10:00 p.m. tonight. for now everyone here is just hoping >> what a night. ron allen, thank you so much. we want to show you a map of where these clashes took place between the rioters and police. the violence bro near a mall on the west side. then it spread towards downtown baltimore. a cvs drugstore was set on fire a check cashing store, a senior citizens center. and all of this just miles from the location where police put freddie gray into a van. >> while officials take action to control the situation, some are saying they waited too long to step in. tom costello has that part of the story. good morning. >> reporter: good morning. the mayor is under fire accused of perhaps encouraging some criminal activity as she seemed

to misspeak over the weekend. the police are under fir moving faster last night. and for the first time since 1968 the national guard is on the streets here. with baltimore in historic riots, the mayor and police departments are accused by some for losing control of the streets. >> i've been in contact with our governor and i've requested and he has agreed to deploy the national guard. >> reporter: monday maryland governor larry hogan seemed to suggest the mayor's request came a bit late. >> when the mayor called me which quite frankly we were glad she finally did, instantly we signed the executive order. >> reporter: mayor stephanie rawlings-blake grew up balt she's been under fire for these comments when she meant to say the police officers were trying to give the protesters space. >> we also gave those who wished to destroy space to do that as well. >> reporter: to some it sounded like she was encouraging destruction. overnight in the midst of the

chaos, she tried to clarify her comments. >> i never said nor would i ever say that we are giving people space to destroy our city. my words should not be twisted. >> reporter: also the police department. how ditu so out of control? stepping into the firing line a group of religious leaders who joined hands to drive the crowd back. did you step in because you felt like the police where are losing control? >> not losing it. they never had it. >> reporter: did the police give the street thugs too much space? should you have given that much latitude over the last two days? >> i don't think we gave them much room or latitude. they just outnumbered us and outflanked us. we needed more resources there. >> r so the curfew going in effect tonight. 10:00 p.m. until 5:00 a.m. why didn't it go into effect last night in the middle of the chaos? the police commissioner said they didn't have the resources

to enforce that curfew and nobody was listening to anybody last night in a position of authority. back to you. >> thanks a lot. now more on the video we showed you earlier recorded by a local station as monday's violence broke out. you can see a mother disciplining her son. she was covering his face. looked like he was takinge ingg part in the riot. she was chasing him from the scene, walked him from the parking lot and towards her car. she was trying to rip the mask off of him. and she probably like a lot of mothers have just had it with their kids. anyway he's following her orders. at last night's news conference baltimore police commissioner anthony batts commended her actions. >> you had one mother who grabbed their child who had a hood on his head and she smacked him on the head because she was so embarrassed. i wish i had more parents that took charge of their kids out there tonight. >> you can imagine how that mother feels. it's a dangerous situation for

everybody involved. >> and a lot of parents can't stay home today because they've got jobs and work and their kids have a day off. >> let's turn to pastor jamal brian who took to the streets last night to try to restore order. good morningo you. in your mind how did it go from mostly peaceful protests to a >> we're still in a daze trying to regroup from that because yesterday we called for a moratorium that there should have been been no protesting or demonstrating at the request of the family in light of the funeral. so imagine the shock of the family coming back from the cemetery met with the news that we were in a code red, five-star alert. and so today we are baltimore, resilient people about to rise from the ashes and move forward to rebuild and turn the page forward. >> do you share this criticism that somehow the city leaders, the mayor, the police chief, the commissioner for not responding more quickly and letting this

get so out of hand? or do you feel their hands were tied? >> well i really don't know what was happening at city hall or the police department. i do know that baltimoreans moved to go on the front lines. what has not been reported on the news is the bloods and cryps came together and signed a peace treaty. and the churches moved towards the streets. we're getting ready to go into the streets to start the rebuilding process now. >> but i also read there was an agreement or a rumor of an agreement among rival gangs to get together and go after police. did you hear anything about that? >> we did. all of that came out strangely and eerily while we were in the funeral. so did this anonymous flier that went through about the purge on yesterday. but last night up until the wee hours of the night, pastors met

with gang leaders so we can start rebuilding our community and give some safe haven. to burn down a cvs and burn down a senior center community center does not reflect the legacy of freddie gray or the movement that we've been a part of over the last week. >> and let me ask you, pastor. you gave an passionate sermon on sunday about the injustices you think happened in this case and gave the eulogy yesterday. it was passionate as well as you led a chant for no justice no peace. my question to you is with emotions running so high do you feel like leaders such as yourself have to look at the tone and make sure that people don't take your words the wrong way and do something like this. >> no. they haven't taken my words the wrong way. number one, those looting weren't in the funeral yesterday. what they've done is taken the police department that's out of

control the wrong way. what you have to look at is not freddie gray and isolation, but look at what the young people have seen over the past 36 months. trayvon martin a george zimmerman walk free. tamia rice in ohio. you see what happened with eric gardner live on television and no police officer held accountable. so these young people really don't have much confidence in the legal system. and so today we're trying to put them back on course to let them know that violence and justice never go together in the same sentence. >> pastor i know you've been out all night trying to restore order and do your part there on the streets of the city you care so much about. thank you for your time this morning. appreciate it. >> thank you for your interest. >> all right. and we are covering another major story. the crisis unfolding in nepal in the wake of saturday's tech. remarkably a survivor was pulled

from the rubble overnight even though the death toll is above 4,000 people. miguel almaguer is in kathmandu. good morning. >> reporter: hoda good morning. just a short time e x county search and rescue team arrived. behind them the l.a. county search and rescue team. this as the number skyrockets to 4,400 and more bodies discovered every day. brick by brick the desperate digd this morning our cameras capturing the moment search teams find another victim. the lifeless body rushed to a nearby hospital. hope here is fading. today we launched our drone for a look at the damage. this section of kathmandu in ruins. and what's still standing is teetering on the brink of collapse. this is what rescue teams are sifting through now. block after block, neighborhood after neighborhood completely destroyed.

any hope of finding survivors is dimi with thousands living in tent cities some too afraid to return to their splintered homes, on mt. everest desperation on the world's tallest peak. inclement weather hampering the search for survivors and the rescue of those still . with at least 18 killed here mike church was at base camp when this sheet of snow slammed into the barrier and took the life of his friend eva girawong. >> it was the most terrifying moment of my life. there was no how do you survive that. yo up and where do you go? what do you do? >> reporter: this morning the search on the mountain a nation shattered trying. with more and more bodies being recovered from the rubble every day, there are some repo up to 10,000 bodies may be

questions. can states refuse to issue marriage licenses to same-sex couples and can they he did klein to recognize same-sex marriages granted somewhere else? how'd we get here? 36 states now allow marriages for same-sex couples. but 14 other states ban it including michigan where two nurses each adopted two children some with special needs. they want to be married so they can both be parents to all the children in case something should happen to either of them. >> that's what really scared us the most was that possibility that they could be ripped apart and not see each other again. >> reporter: states with gay marriage bans say only voters should decide a fundamental issue. but a state cannot vote to deny a constitutional right to be free from discrimination. the court is probably split four to four with justice anthony kennedy likely to be the deciding vote. there's no live broadcasting from the s court, but later today the audio recording

of the argument will be released. the decision probably wo l late june. >> i know you'll be listening in for us. pete williams outside the supreme court house, thank you. jurors will be back in court today for day two of the james holmes trial. holmes is accused of killing 12 people and wounding 70 inside a colorado movie theater. in his opening statement, the lead prosecutor described him as a sinister but sane killer. defense attorney said holmes suffers from schizophrenia and mental illness runs through his family. a tragic accident in texas where a helicopter nurse fell to her death. christine mcclain was conducting a rescue in the austin area. she fell from the hoist. now to the frightening close call we showed you earlier on of the suv narrowly missing school children about to board a bus in washington state.

you can see the bus driver open the door three kids start walking by toward it, then that suv speeds right past the bus on the right missing the kids by just a few inches. witnesses say that suv driver passed several other vehicles before he got behind the bus and then sped off. the police are offering a $1,000 reward for any information leading to an arrest. hopefully they try to piece together who that is behind the wheel. >> so frightening. >> that's why the school buses have the stop sign the arm that comes out. you have to stop. >> and on the right side of the bus. i can't imagine that. >> jeff rossen did that on a rossen reports awhile ago. a lot of people ignore it. >> they keep going. >> nothing's worth the minute you might save. let's show you what we've got going on. thinking about our hearts and prayers with everybody that is in nepal and kathmandu and all the rescue workers down there.

and they are going to have problems with the weather over the next 48 hours. tomorrow thunderstorms, a high of about 71. scattered thunderstorms on thursday. and inhospitable weather up on mt. everest. at the peak snow and temperatures of 22 below. windchill of 14 below. here closer to home we've got a lot of wet weather through the gulf. heavy thunderstorms. orlando, you're looking at a lot of wet weather. new orleans looking at wet weather. they had almost 2.5 inches of rain. through today on into tomorrow some areas may pick up up to 4 inches of wet shopping for a used car is so intimidating. i mean, you feel like you have to be this expert negotiator to get a fair deal. i hate to haggle. when you go to a restaurant you don't haggle over the chicken parmesan. why can't car-buying

platforms. has sparked powerful response. nearly 2 million tweets about the city in the last 24 hours and many people are pleading for peace. one post that got a lot of attention is from david simon. he's a former reporter for the baltimore sun. and also the creator of the hit hbo show set in baltimore "the wire." he took to social media and wrote this. there was real power and potential in the peaceful protest that spoke in mr. gray's name initially. but this now in the streets is an affront to that man's memory. he goes on to say, if you can't seek redress and demand reform without a brick in your hand you risk losing this moment for all of us in baltimore. turn around develop home. and by the way, already facebook has started encouraging the people of baltimore to come together and clean up that city. this morning this is the picture we got showing citizens already pitching in and cleaning up the streets >> all right, tamron. thank you so much.

we're back now at 7:30 on this tuesday morning. it's the 28th of april and you're looking at just some of the devastating images out of baltimore this morning as people are picking up the pieces from rioting that happened overnight. and it tops what's making headlines this morning. the national guard is now on the scene as well. protesters took to the streets following the funeral of freddie gray who died in police custody. some attacking police burning buildings, and looting stores. a state of emergency is in effect. and a daily citywide curfew starts at 10:00 tonight. officials in nepal are raising the death toll from saturday's massive earthquake to more than 4,400 people. by the prime minister is warning it could eventually top 10,000.

there was a glimmer of hope overnight as a survivor was pulled from the rubble alive. and bad weather is hampering the search for those boaters missing for three days off the alabama coast. rough seas hit during a regatta over the weekend sending several racers in. meanwhile, coming up a story that will have you looking at your smartphones this morning. do you know they're monitoring where you go when you are there, how long you're there, and it records all of that information. on rossen reports, why one device in particular has privacy experts so concerned. >> that is worrisome. we're going to begin this half hour with more on the terrible situation in baltimore as officials are still trying to restore order. tom costello is on the story for us once again. >> reporter: good morning. let me give you a sense. we're in downtown baltimore and this is the scene setter. through the rush hour traffic, you can see some heavily armed s.w.a.t. team members. they're guarding the federal building the courthouse

building i should say, and police headquarters down the street. this city is very much on edge. to say it was a difficult night last night would be a tremendous understatement. we had a very violent, very volatile situation here in baltimore last night. with about they say two dozen arrests or more. that's surprisingly low, i would say, given the violence we saw with buildings looted and burned to the ground. with police officers in battles with street thugs, i would call them in which they were throwing rocks and bottles at the officers. we had about 15 officers injured here. some of them in the hospital. we also had complete chaos largely in west baltimore with police losing control. today we've got hundreds and we may now be talking about thousands of police officers coming into baltimore from across all of maryland in addition to pennsylvania and the national guard now coming into baltimore for the first time since 1968.

this morning governor larry hogan gave this update on the situation going forward. >> this violence is not going to be tolerat we are going to bring in all the assets and all the support we need to make sure the citizens of baltimore city are safe and that we bring peace back to the city. >> reporter: at least a dozen police officers were injured. several are still in the hospital. there were at least several dozen people who were arrested as well. today there will be -- schools will be closed. there will be a lot of young people out and about. and some trace the origins of these situations to high school students meeting police at a shopping mall after school yesterday. tonight there will be a curfew imposed from 10:00 p.m. to 5:00 a.m. in the morning to try to keep the streets calm. a lot of worry about going forward in baltimore. >> we'll be watching the situation there.

change. so their position on this is head lice is not as contagious that we think it is. it's not just casual contact at school if you bump into a friend that it's easily transmissable. i get letters from the school all the time. you can't bring kids back if they have lice or eggs in the hair. this is something that could be practice changing. >> you never know how kids interact in school whether they're wrestling or playing. i mean how do kids get it then. what kind of close contact do you have to get? >> i should say that most of the transmission occurs outside of the school. they make a strong point to say it's usually the house hold contact or in the community. we recommend not sharing hats, not sharing combs or brushes, you know headphones. things like that where you can really -- because lice don't jump. they actually crawl. you can imagine that you have to be wrestling on the floor or something. it's not it can't happen in school. it's just less likely to than i think most of us think.

about the human side of her family claiming her father was abusive when she was a child. when somebody is public in a family the rest of the family isn't. did you ask their permission? >> everyone said from e begig write whatever you want. my family is just sort of like that. and i was so nervous about my dad reading the book. because there's a lot of painful things about him and abuse during our childhood and his mental illness and how he grew up. and when he read the book, he was the firstn that actually read the book. and i said dad, did you like it? he said i thought the part about me was right on. the only stuff i didn't like was all the sex stuff, that wasn't okay. >> reporter: today the two have worked through the past. so are you hoping that this book will make inroads into being a less judgmental society about sexuality, politics religion all of these things that seem to

taking a look at the headlines, national guard troops are fanned out through baltimore this morning following violence that broke out after monday's funeral of freddie gray. the black man who died after being arrested by police earlier this month. at least 15 officers were hurt and at least two dozen people were arrested during a night of riots and fires. a 10:00 p.m. curfew goes into effect tonight. for the first time in more than 50 years the government is lowering the recommended amount of fluoride added to drinking water. health officials say some people are getting too much of the cavity fighter because it's also found in mouthwash toothpaste, and other products and over-exposure can cause faint white marks on the teeth. and there's also evidence that it can raise the risk for more
