gets ready to announce some tough new rules for the foods so many of us love. "nightly news" begins right now. >> announcer: from nbc world news headquarters in new york this is nbc "nightly news." reporting tonight, savannah guthrie. good evening. there is a storm coming tonight and for the parts of the gulf coast in the bullseye there may be no more frightening words to hear. this is the giant rain-making system heading at this hour toward texas, louisiana and the ozarks. some of the very places drenched by historic rains just a few weeks ago. now the national weather service warning of potentially life-threatening floods. and tonight another dangerous storm system we're watching in the midwest. tornado sirens sounding in chicago. we've got it all covered starting with nbc's janet shamlian in houston. >> reporter: a tropical system targeting the gulf coast. tonight the rush to get ready.

>> wanted to be prepared in case anything bad happened. >> reporter: potentially liefths flooding to hit texas, louisiana, oklahoma and the midwest. officials raising the alert level. this emergency war room now staffed around the clock. >> we need to be able to warn the public and alert the public as to where the danger is. >> reporter: the ground still saturated after historic flooding in houston three weeks ago. interstates underwater. thousands of cars submerged. new video today showing the power of that flooding as it pushed into an austin restaurant. >> it's a scary proposition that we are mentally not ready to face again. >> reporter: betsy kirkland among the hundreds whose homes flooded. just this weekend contractors finished installing new sheet rock. today houston mayor anise parker telling nbc news the city is urgently trying to get ahead of this storm. >> this time we have instituted all of our normal tropical storm, hurricane protocols, and we'll be ramping them up as necessary. >> reporter: experts say it's shaping up to be a rare ocean storm where a tropical

system intensifies as it moves inland instead of falling apart. the coast guard is warning swimmers to stay out of the water and boaters to do the same and tonight voluntary evacuations are already under way near galveston. grocery store shelves are near empty. i saw it myself early this morning and tonight authorities are asking people to heed the warnings, especially if you're out driving. rising water can trap a motorist very quickly. savannah? >> we've certainly learned that janet. thank you. in addition to that storm, there are flash flood warnings and tornado warnings as far north as the chicago area. our meteorologist dylan dreyer is here monitoring all of this. good evening. >> good evening, savannah. a tornado was spotted at midway airport. that tornado warning has expired. but we do have flash flood warning in the chicago area where rain is falling at rates of about two inches per hour. this is part of a cold front that extends right down into texas but folks in texas are really keeping an eye on what could become tropical storm bill.

it's expected to make landfall tomorrow morning. but as it moves over land it is expected to intensify. that brown ocean effect where it actually takes the moisture from the record-setting rain we saw in may and uses it to intensify the rain that we're going to see through the day tuesday, tuesday night and into wednesday. we could see as much as a foot of rain in some areas. this could lead to life-threatening flooding and a dangerous amount of rain is most likely going to spread into the midwest by the end of the week. savannah? >> all right, thank you so much. a lot of fear tonight up and down the eastern seaboard after two young swimmers lost limbs in shark attacks off north carolina in waist-deep water. and look at this from today in shallow waters off saint lucie county florida. sharks close to shore prompting officials there to close all county beaches early. meantime we're learning new details about those north carolina attacks where the beaches remain open tonight. nbc's gabe gutierrez is there. >> reporter: today, in the air and on the water the search for sharks after two

horrifying attack just minutes apart. >> brunswick county 911, what's your emergency? >> we have somebody a shark -- a shark attack. >> reporter: the first paingd panicked call sunday afternoon. >> we're on oak island and there's a girl whose hand has beenabilitien off by a shark. >> reporter: a 12-year-old girl vacationing with her family missing part of her arm. her leg also injured. >> it was like a scene all of a sudden out of "jaws." people are yelling "get out of the water. call 911. shark, shark." >> reporter: steve bowser took these pictures of witnesses rushing to help. a little more than an hour later another call. >> brunswick county 911, what's your emergency? >> oh my gosh 911. >> reporter: this time a 16-year-old boy, most of his arm gone while a dispatcher tells bystanders how to stop the bleeding. >> tell them to take a clean, dry cloth or towel and place it right on the wound. >> reporter: marie hildreth an off-duty paramedic, used a makeshift tourniquet to help the first victim. >> we got some strings

like off of a boogie board and off of a tent and i made some makeshift tourniquet until we could get the proper equipment on scene. >> reporter: this is where the second attack happened about two miles from the first, both in waist-deep water, both life-threatening. >> a shark attack is dictated not by the number of sharks in the water but by the number of humans. if i was in that particular area on that particular beach i would not be in the water today. that's just a prudent thing. >> reporter: but locals like fishing charter captain wally trayoff says sharks are common here. >> can't be scared of the ocean but you do need to respect it. >> reporter: so for now the beaches remain open. >> we made the decision to try to voluntarily ask people to get out of the water. >> reporter: a request many beachgoers like young ellery bryant are taking seriously. >> you don't want to go out there and get hurt. >> reporter: the 16-year-old who was injured has just been upgraded to good condition. the family of the 12-year-old girl who was injured has asked that her name and condition not be

disclosed. right now it's unclear exactly what type of shark attacked them and whether there was more than one. savannah? >> all right, gabe gutierrez, thank you so much. turning now to a moment on the campaign trail that has been months if not years in the making. jeb bush seized his moment today and declared he is entering the race for president. while he may have the most name recognition in the gop race he still has to make himself stand out in a field with ten other republican candidates and counting. our chris jansing has more. >> ladies and gentlemen, may i present to you the next president of the united states of america, jeb bush! >> reporter: jeb bush launching his 2016 campaign with an exclamation point and a promise for his candidacy. >> we will lift our sights again, make opportunity common again, get events in the world moving our way again. >> reporter: he said no when encouraged to run in 2008 and 2012. not this time. >> i'm a candidate for president of the united states of america. tonight. our hally jackson has more. >> reporter: rachel dolezal announced today she will step down as president of spokane's naacp chapter saying "i will never stop fighting for human rights and will do everything in my power to help and assist whether it means stepping up or stepping down because this is not about me. it's about justice." but dolezal's 35550-word statement didn't contain the two words this activist wanted to see. i'm sorry. >> you may not copy my people's struggle my women's struggle and call them your own when that never happened to you. >> reporter: online reaction was swift and sharp. one person tweeting "but is she going to quit being black?" another, "there is nothing in her resignation that suggests she couldn't have simply told the truth." dolezal's story viral ever since her biological parents said the civil rights activist was born white. >> we just hope and pray that she will be successful in her pursuit to come into a more realistic and

truthful way of living. >> reporter: so far dolezal has not offered an explanation, but that hasn't stopped what's become a national conversation about identity and privilege. >> she may not be african-american but she is black in the sense that blackness is an identification with a set of goals and ideas and practices and the investment in them. >> reporter: late today, reports that dolezal sued howard university for discrimination in 2002 the year she graduated there, claiming the historically black college blocked or denied her opportunities because she was white. the suit was dismissed by a federal judge. dolezal shared her own identity struggles when interviewed by a student last year. >> i know who i am, and my kids know who i am and pretty much i don't think anybody else knows who i am. >> reporter: spokane's former naacp president says he can forgive dolezal but he's not sure if others will. and tonight plans for a demonstration here in spokane, savannah, from people who hope to start the healing process and start the

conversation about where to go from here. >> all right. halle jackson in spokane for us. we should mention rachel dolezal will speak out in an exclusive live interview tomorrow morning on "today." in upstate new york investigators now say they believe those two killers still on the loose had even more help than previously thought. today their alleged accomplice joyce mitchell was in court again. this time the former prison worker in shackles bulletproof vest, and jailhouse stripes. tonight, was there a plot to kill her husband? nbc national correspondent miguel almaguer has the latest. >> reporter: shackled in a bulletproof vest and a jailhouse jumpsuit joyce mitchell looked frazzled as she faced a judge. >> i've gone over the charges with ms. mitchell. >> reporter: the tailor shop supervisor accused of smuggling hacksaw blades and chisels to help convicted killers david sweat and richard matt escape. >> joyce talked to him

about her involvement during the last few days before she was arrested. >> reporter: mitchell's new attorney assigned to the case today says only she's pled not guilty. >> what has she told you? >> can't get into that. >> reporter: multiple sources familiar with the investigation tell nbc news mitchell was investigated for a sexual relationship with sweat. then it was matt who later charmed her. we now know sweat and matt used multiple markings or directions to navigate the complex pipe system before their escape. mitchell was to be their getaway driver says the d.a. but got cold feet and never showed. >> they absolutely were using her. there's no question about it. >> reporter: the d.a. says mitchell planned to start a new life with the convicts saying they would drive seven hours toward the woods to an unknown location. >> if there is a plan b or even a plan c and someone else picked them up they could have got anywhere. >> reporter: on day 10 of the massive manhunt, 13 square miles had been searched for the dangerous duo. now the d.a. says mitchell may not have

been the only one involved. >> i think it's entirely possible if they had the assistance of somebody else or if they had the assistance of you know another individual that was cooperating with them even while joyce mitchell was. >> reporter: a source tells nbc news they are looking into allegations that mitchell may have wanted those two inmates to kill her husband. vargz that's one investigators say that's one of many questions they have. but tonight they say mitchell has a lawyer and they say they still can't find those two inmates who have been on the run now, savannah, for ten days. >> miguel almaguer on the story. thank you. there is mounting evidence that one of the world's most wanted terrorists has been killed. u.s. officials confirm that nassar al wahishi, the number two man overall in al qaeda and head of the al qaeda in the arabian peninsula, was targeted and yemeni officials say he was killed by a u.s. drone strike. most recently aqap claimed responsibility for the january massacre at the offices of "charlie

tonight nbc news has learned that the

fda is expected to announce this week that it will ban all artificial trans fats ingredients found in so many of the foods millions of americans eat at home and at restaurants. they've also been linked to clogged arteries and heart attacks, as nbc's tom costello reports. >> reporter: for more than 50 years trans fats were as common in the american diet as butter and flour. >> chicken pot pie. now, that's a flaky crust. >> it smells great. >> used mostly to improve texture, taste, and shelf life in processed foods and restaurants. but cardiologists warned artificial trans fats especially partially hydrogenated oils can be a killer. raising bad cholesterol, lowering good cholesterol, and increasing the risk of heart disease. since 2003 food manufacturers have been phasing them out. already cutting trans fats by 86%. now the fda is expected to remove nearly all artificial trans fats from the american diet within three years. >> several thousand

fatal heart attacks per year will not occur because of the removal of trans fats from the food supply. >> reporter: foods still high in artificial trans fats include fried foods, donuts frozen pizzas microwave popcorn, rolls, biscuits some stick margarine, cake, sprinkles and frostings. nine years ago new york city banned trans fats at restaurants. now that ban is expected to go national for all foods. >> i can't imagine how much trans fat i ate as a kid. >> and i think in moderation anything is okay. but overall i feel like they should not be part of a child's diet. >> reporter: food manufacturers could still petition the fda for limited use of trans fats. and the grocery manufacturers of america point out naturally occurring trans fat will continue to be in diets from consumption of beef, milk and other dairy products. but artificial trans fats may soon be a taste of the past. tom costello nbc news washington. we are back in a moment with the court's answer to this
