beginning. good morning to you, steph. >> reporter: good morning. gene palmer is a 28-year veteran prison officer. he worked on the honor block. he's accused of giving them tools in exchange for their art work and burning the art work and burying it when he found out they escaped. early this morning he plead not guilty to the charges and posted bail. this is the second arrest in the investigation into this escape and right now the convicts are still very much on the run. 57-year-old gene palmer faces multiple criminal charges, tampering with evidence and official misconduct. >> we pleaded not guilty. >> reporter: palmer is charged with accepting a number of paintings from matt and sweat in exchange for providing them with tools on four separate occasions going back to november 2014. earlier this week the d.a. told

nbc news palmer didn't know there were tools stuck inside hamburger meat he passed along to david sweat and richard matt. the d.a. said joyce mitchell told him she put the tools in the meat. two hacksaw blades drill bits and a whole bunch. >> it's unraveling in front of us all at the same time. there's allegations that he conned multiple people. >> reporter: mitch. plead not guilty to charges she helped matt and sweat and sits behind bars waiting for her trial. as the search continues in the area around the hunting cabin, there's new concerns that the escapees may be armed with rifles. state police admitted that weapons may be missing. >> a number of people cycle through the cabins and they don't have a definitive number of weapons. they cannot tell us what is missing and what is not. >> reporter: mitchell's husband

believes other prison workers knowingly helped the convicts. >> there's something more they're not telling us. how did they cut the hole? >> reporter: even more questions will be asked about the honor block where palmer worked and sweat and matt were housed. working there is considered a privilege. >> that's a plum job. you get it with seniority. the reason it's a good job is because prisoners go there don't make trouble, supposedly. >> reporter: palmer's lawyer said they are caught off guard by the charges and his client is devastated. the next hearing in this case is later today. >> all right, stefanie thank you very much. nbc news analyst clint van zandt is a former fbi profiler. good morning. >> hi matt. >> let's talk about what gene palmer is accused of doing. in one report he's accused of giving sweat and matt the two prisoners, access to the cat walks behind the walls of their prison blocks. why would anybody do that if not to help them escape.

why would no one else noisetice that the two prisoners disappear? >> three things. he gave them access to the cat walk supposedly so they can get behind their cell where the electricity was shorting out to the hot plate. he said let us get back there we can fix it. while on the cat walk they hot wired the lights back there so they can turn the lights on and work in the dark. number two, he gives them access to tools, and number three, he brings in paint. you remember when the guys first escaped there was a card board cut out over the hole. where did the paint come from to match it? it looks like the guard probably supplied it to them willingly or not willingly. >> wait there's more. it appears that gene palmer was receiving art work from richard matt in exchange for the favors

and gene palmer allegedly destroyed some of the art work when the investigation started to heat up. >> yeah i think this was kind of a panic reaction on his part. all of a sudden he put two and two together. now we're told he passed the polygraph test. some of us are fans. others are not. i think what we're going to find out is just like investigators have told us from the beginning, there is more people that were somehow complacent in this other than joyce mitchell. now we have the second domino to fall. how many more within the prison either willingly or unwillingly provided support for the convicts. >> let's talk about the manhunt. authorities have dna every dayidence from inside a cabin. they have articles of their clothing socks and underwear. are you surprised the canine units haven't been able to track them down? >> in a way.

we know they likely switched clothes. hunting cabins we might have extra clothes, boots, unfortunately the people a apparently have left guns in the cabins too. it's like the third time law enforcement has said we're right there. we can reach out and touch them. so far they haven't touched anybody, and now the biggest fear is that even though they think they can run them to the ground this time, they may have guns. are they going to give up or fight to the death? >> clint van zandt, thank you very much. an investigation is underway this morning into the crash of an f-16 fighter jet in arizona. jim miklaszewski is at the pentagon. what are you hearing? >> this was international guard f-16 fighter jet. it had just taken off on a night training mission near douglas, arizona overnight when suddenly without warning it fell out of the sky. it exploded into a fire ball when it hit the ground igniting

a nearby wild fire. now as of this morning, u.s. military officials cannot say whether the pilot survived the crash. there are no early indications as to what may have caused this terrible incident. now investigators are on the ground this morning. and this is just another grim reminder that on or off the battle field u.s. service-members often find themselves in harm's way. >> very dangerous. jim mick receive jim, thank you. heavy winds are fuelling dangerous wild fires. they're sweeping through parts of california forcing homeowners to flee. nbc joe fryer is on the scene. good morning to you, joe. >> good morning. the fire came dangerously close to some homes. it is nearly 50% contained and the evacuation orders have been lifted so people are returning home but the fire is still burning this morning. it's a reminder this year in california fire conditions are the worst on record.

this morning firefighters in santa clarita are working to maintain a fast moving brush fire that scorched up to 350 acres on wednesday threatening homes and causing evacuations 30 miles north of los angeles. at the height of the fire more than 500 homes were evacuated. >> we're just in a defensive mode to defend the structures and not get perimeter control because it's so -- it's spreading and it's not a continuous line. >> crews are relying on water-dropping helicopters and retardant-dropping aircraft battling the flames. no injuries were reported. investigators are on the scene trying to figure out what caused the fire. while firefighters in california are busy battling the worst conditions on record in denver a rush hour storm dumped hail and caused wide spread flooding

delivered an impact statement on behalf of her two sons who lost legs. dzhokar tsarnaev finally admits his guilt and apologized. do you believe that apology? did it mean anything to you? >> you know, i was hoping that he would speak, but i was hoping it was earlier, and no. i didn't feel it was genuine. i think it was something he thought about, he was talking about his the religion for himself. i just felt it was, you know, a part of maybe mercy on his soul. >> after sitting in that courtroom day after day, him sitting in silence. what was it like in that moment to hear his voice? to hear him speak? >> i was literally shocked. i actually thought his accent was a little bit different. i thought it might have been -- he would have been more americanized since he's been here for some time now. it was, you know, i was looking forward to hoping that he was

this morning the company is vigorously defending itself. shoppers have sometimes accustomed to paying more at whole foods. perhaps no one was expecting this when the new york city department of consumer affairs tested 80 different types of prepackaged products at whole foods. they found all the products had mislabelled weights. >> sometimes it was $2 or $3. sometimes it was $6. we're talking about significant sums of money which add up over time. the u.s. department of commerce allows some wiggle room when it comes to label discrepancies, but according to the investigationers 89% of the whole foods packages tested fail to meet that standard. >> it's wrong. >> i feel cheated. >> it's sfoipting. >> it makes me think twice before shopping there. >> it isn't the first time whole foods has come under fire for overcharging. 2012 investigation in california

that. good morning. >> good morning. as i said earlier in the week i'm lucky that my parents never compared my twin barbara and me. we went to different colleges, different camps. for many multiples, the path to finding your own identity can be difficult. >> as people we have a different identity but there are many people out there who still kind of put us together as one. >> we were pretty much known as the twins for better or worse. >> people called us "the twins." they wouldn't identify our names. i think that's why we went to separate schools and colleges. >> when you're thinking about being on your own, that whole question of who am i if i'm not a twin i started to ponder about that more and i know she did as well. >> we definitely had to establish our own identity over like, the course of the last five years at different schools. >> separation between us allowed us to rely on each other more. >> for the twins, understanding who they are as individuals has been just as important as

keeping their twin bond intact. >> here we go! >> a fine line that sara and rich have been navigating with their identical 8-year-old tripletts. ally anna, and emily love gymnastics dance, and making each other laugh. their connection hasn't stopped them from figuring out who they are independent from each other. >> i don't think it was intentional at first, but, you know we always said they shouldn't be seen as a set. they are individual people. >> each girl has their own room her own style, and own likes and dislikes. >> i like tuna fish. they don't like it. they said it smells gross. >> mom and dad try to spend one-on-one time with each girl. >> they say i have something to tell you but i'm saving it for bedtime. they wait until we have the time alone. >> all things the psychologist said are spot on. >> i think parents can do a lot of things by recognizing that the twins are very close and you're not going to destroy the

twin bond by for example, separating them in schools or maybe putting them on different teams. >> we share a bank account, a cell phone, a room, a bed, a laptop car. if i lost my driver's license, i would use hers. >> breakfast, lunch, snack everything has to be split equal. >> these two are inseparateble. >> our connection i would say, is like we're one person and two different bodies. aside from finishing each other's sentences, these two ladies live together, work together, and spend all their time together. but now at 24, these two are making an effort to find out who they are as individuals. >> i dream to take myself to the movies without cocoa, without a friend without a date. people do that every day. >> i would say i'm trying to find my image. it's very difficult, but in this

that level of diversity. >> women are embracing 40. what are you excited about when it comes to turning 40? >> honestly i want to go rocketing to 40. i want to climb a mountain on my 40th birthday. i'm going to have a festival of parties. i feel really great. i feel, you know naturally very strong. truly feel physically -- probably stronger than ever. fitter and healthier and all those great things, you know growing older, to me at least, is really empowering and not any way daunting. >> one of the other great things she said how she feels more fit and stronger than ever in her life. she said i realized growing up i never heard any woman say gosh i love my curves strong. she made it a point in front of her kids to embrace that. now her 14-year-old daughter said isn't it great we have curves and we're strong? >> it works.

conversation about what it feels like to be in this movement. >> since the series debuted last year what is also different is the greater public understanding of what transgender really means. much because of caitlyn jenner's high profile transition. >> something very brilliant happened. it's about living in 2015. >> and in a twist of reality and fiction colliding, tam boar spoke to jenner unexpectedly before our interview began. >> we just got off the phone with caitlyn jenner who said wonderful things just before we were about to go on. we look at each other and go the world has changed. that's a good thing. >> families at "transparent" center and adult children's are played by amy, gabby, and jay. >> i think the most exciting thing, to me is the normalzation of all of these issues. >> jill said she felt like she made the show at the perfect time. >> excuse me.

to some homes. and good morning, everyone. breaking news from the supreme court this morning. this is a key ruling impacting the health care coverage of millions of people living in this country. >> it all comes down to four words in a statute that are being challenged by people who did not want to have to buy insurance on a federal exchange, all part of obamacare. nbc's justice correspondent, pete williams, is at the court this morning. pete, i know we have the decision. do we know what it says yet? >> reporter: i'm just looking at it, just handed to me. it appears to say that the tax credits -- this is the big question, who is eligible for the subsidies that make health insurance affordable? is it only in the states that have their own exchanges, which would be just a small part of the country, 16 states, or is it available in all the rest of the states that do have insurance through the federal health care exchange?

and my reading of it is that the subsidies are available to individuals to states that have a federal exchange. so it is a big victory for the obama administration. basically, the supreme court has, for the second time, bailed out obamacare. it has rescued it from a legal challenge. you may recall a couple of years ago, there was a constitutional challenge to whether the whole law could live or die. this was a narrower question. but so much was at stake here because the administration feared that if the supreme court said those subsidyies were available only in the states that set up their own exchanges, then the health care costs would go up for everybody else, they wouldn't be able to afford it, they wouldn't have the subsidies and it would go into what the administration called a death spiral, making health insurance more expensive for everybody else and basically causing this health insurance system to collapse. so, this is a very big victory for the administration. the subsidies are available nationwide.

it doesn't matter, the supreme court says, whether you live in a state that has its own exchange or got your insurance through the federal exchange, healthcare.gov, either way, you get the substudy. for the average person, it was about $270 a month, but for many people, it was much more than that. and it made the difference between whether they could afford health insurance or not. so, bottom line here, big victory for the administration. this saves for the second time the obamacare law. it will go forward. now, congress can still change the law, if it wants, but people who feared that the obama administration would lose here hoped that congress might make some changes, but that seemed unlikely. so, the ball does not automatically go back to congress. the administration wins a big one here today. >> yeah, but pete, let's just make hurricane is the headline, you pointed to this very appropriately a second ago, the headline here is that this has not been saved on constitutional grounds.

this is much more of a technicality. >> right. well, yes. i mean, the case three years ago was about the constitutional framework here, did congress have the power to do what it did? this was a much different case. the supreme court basically does two kind of jobs here, interpret the constitution, which is a big deal, or more narrowly, interprets what federal laws mean. this was that latter kind of case. what did the words of the statute mean in the chal? the tax break, the subsidies were only available for insurance purchased on an exchange established by the state. and they said if you just look at those words, then that that means that the subsidies are only available narrowly. but the court said you have to look at a statute as a whole, you have to look at the whole meaning of the law and quite clear what congress meant this whole thing -- how this whole thing was supposed to work. so the insurance is available to everybody. pete, we basically have status quo. you mentioned this 156-3 decision. we remember the chief justice

saving obamacare three years ago. what's the roll call now? who wrote the opinion? who is in the majority? >> it is a 6-3 decision and chief justice roberts wrote this decision. he wrote sort of a deciding opinion three years ago when they bailed out obamacare. and he wrote it again this time, joined by justices kennedy and beginsburg, breyer, soto mayer and kagan. justice scalia filed the dissenting opinion, which thomas and alito joined, 6-3, roberts once again coming to the rescue to for the administration. there were some early suggestions that the court might do this in a couple of other decisions earlier this year, when even the conservatives said you have to read a statute as a whole. so i must say, after hearing the argument, it did seem like the administration got less of a roughing up than would you have expected, if it was going to lose. so, we all thought maybe 5-4,

but to have it be 6-3 is a surprise. >> pete, i remember three years ago, we sat here after the first challenge and the court upheld the affordable care act. i said to you, pete is there anything else in the pipeline that will challenge this in the future, you said, yes, and here we are today. i will ask the question again, is there anything else in the pipeline on obamacare that can bring it back before the supreme court? >> well, yes, absolutely. but i don't know any that had quite the legs that this one did. there is still a continuing turmoil in the courts about who gets a religious exception to obamacare. you know, certainly, churches don't have to provide contraceptive coverage, but there's still a turmoil in the lower courts about how broadly that goes. by the way, speaking of the dissent, now that we have had two times where the supreme court has upheld this, justice antonin scalia said we should start calling this scotus scare, using the abbreviation for supreme court of the united states, instead of obamacare.

>> justice scalia has way with words. we know that stand by with the court. we want to get the political fallout here. nbc's chris jansing is at the white house for us. many years shallz a this case was going through the courts, the administration didn't give it that much credence thinking it is not really going to go anywhere, then makes it all the way to the supreme court, people started getting nervous. what's the feeling there now? >> reporter: obviously, feeling of relief because even though josh earnest said just a couple of days ago that nobody at the white house was losing any sleep over it and the president repeatedly over the last several months, when asked about this, had expressed confidence and confidence in the legal analysis of his team, there was always the possibility. and they acknowledged they didn't have a plan b, that this could throw the health care system into chaos according to a lot of health care experts and experts who work here at the white house. for them, there is a very real logistical outcome to this

moving forward and not having 5 million people who essentially have their health care up in the air. there sis a political intent here. the polls are pretty split on obamacare itself but when you look at should the federal government help people get insurance, about 70 in the most recent poll said yes and the white house has felt all along that this was going to be very much like social security and medicare, that the longer it became entrenched in the system, the more people would like it, the more people would come to depend upon it and they believe that that is already happening. and of course, there is also the issue of president obama's legacy. this is something when it first passed back in 2010, he likened to part of the american dream. >> right. >> and so, this is key for him in terms of his legacy going forward. this is something he very much wants to have when the history books are written. >> as long as you said, you know there is the political side of this, let me ask to you look down the road to the u.s. capitol and how is the republican-controlled congress likely to react?

what's their next move? >> well, their next move has always been, and this is for a handful of people who believe very strongly that obamacare is wrong, they have already voted, i think it's something like 56 times is the latest count, either to repeal or some way undermine obamacare, that it will continue to be on that docket but also, it's going to continue to be part of the conversation as we have this ever-expanding number of republicans who are going to be answering questions. and i can tell you as somebody who has been out there in iowa and new hampshire and these early states, these are questions that are raised. so it's going to be become part of that conversation as well what do we do next? >> chris, for some republicans, it's probably a sigh of relief, as a practical matter, because many of them would say privately, if you throw millions of people off of the health care rolls, as this case had the poe attention to do, then you got to come up with an alternative. >> and they didn't have an alternative. that was the admission that many of them were forced to make in

private. so, you're right. this is, for many, at least privately, a big sigh of relief that this does not create that huge problem for them, savannah. chris, thank you very much. want to go back to pete williams on this. pete, you have had a little more time to read deeper into the decision. anything else jump out at you? >> well, a majority opinion says congress passed this law to improve health insurance markets, not to destroy them. the dissent, justice antonin scalia says it is clear that the supreme court has some favorite statutes. the headline here, obamacare is saved. >> all right, pete williams at the court. so for the second time in three years, the highest court in the land, the u.s. supreme court, has upheld obamacare or the affordable care act law. >> a very interesting road for the obamacare law, first challenge three years ago on the essential constitutional grounds, does congress even have the power to do it, now on something very narrow, very technical and once again, as pete said, the supreme court to the rescue for this law. so things are, as they stood before the court ruled this morning, people remain on the
