elected official i have never been involved in illegal activity. >> reporter: the indictment says in part he took laundered money from a wealthy lobbyist. in the unsealing of the indictment, federal prosecutors say the indictment was the result of a 2013 tip into the congressman's finances. >> i saw in the press conference they said they are only investigating me for two years. everyone in the media in philadelphia every major law firm in our town knows that this investigation has been going on for at least eight years. so for them to have a national press conference and say they have been doing this for two years, i think should raise some concern and interest. >> reporter: he says he will not leave office or any committees while the case plays out. even with the allegations you think it's important to be on the appropriations committee, to be spending taxpayer money? >> absolutely. because first of all, taxpayers pay the money from our region and we happen to be one of the very few places in the country that have a member on the appropriations committee and we have a chance to impact how

those dollars are invested in our community. >> reporter: fattah said multiple times the charges against him are not a distraction, that he can continue to do his job. i did ask him if he regrets that 2007 run for mayor. he said no. deanna durante, nbc 10 news. >> congressman fattah is married to nbc 10 anchor renee chenault-fattah, who is referenced in the criminal complaint against her husband. she is labeled as person e and an affiliate of the fattah enterprise. the feds allege renee participated in a scheme to fraudulently sell a car in order to pay closing costs on a vacation home. she is not charged and denies any wrongdoing. renee is on leave from nbc 10. turning now to the colorado movie theater massacre jurors have decided not to eliminate the death penalty as they move towards sentencing james holmes. about 90 minutes ago the jury said holmes' lawyers haven't presented a strong enough case to rule out execution. the jury's decision clears the way for another round of

arguments before choosing between capital punishment and life in prison without parole. the same jury found holmes guilty of opening fire in a crowded movie theater in aurora in 2012 killing 12 people and injuring 70. look at the crowds of people trying to keep cool down the shore. this is a live look from the cape may camera. the water is definitely where you want to be on this hot, humid day. let's bring in nbc 10 first alert chief meteorologist glenn "hurricane" schwartz. >> i know you would say cape may is one of the best places locally to try to cool off if you do have to. >> yeah. cape may was right around ten degrees cooler than what we were like in philadelphia today. we have hit 90 degrees for the seventh day in a row. 92 degrees right now, upper 80s to the north and west near 90 central delaware and parts of south jersey. but the humidity has not gone up that much so the feels-like temperature right around the

same as the air temperature. that humidity will be changing as we go into tonight and tomorrow. you can see we have had many days, started last tuesday, at 93 degrees. so far we are 92 and tomorrow yeah, we may do it again. we have a few buildups of the clouds to the north and west just one or two light showers up there, but we do have more showers in the forecast and also the end to this heat wave. i will tell you when with the seven-day. heavy smoke and flames in old city this afternoon. sky force 10 was above firefighters on the roof of a building on third street right near market. this is the scene from the ground. the fire broke out around 1:00. fortunately, firefighters were able to put it out quickly. no one was hurt. there is no word yet on what caused the fire. today is the only chance for septa riders to score regional rail passes for the pope's visit in september. septa's one day lottery is going

"american idol" auditions before the crash. state police say she and five other people were in the jeep when it lost control in lower makefield township. she died at the hospital. another victim was treated for head injuries. the other four victims are expected to be okay. police arrest a bucks county man accused of sexually abusing two girls in the 1990s. hilltown township police say they got a tip about the suspect, boyd wallace, of sellersville last fall. police spoke to two women who claimed he abused them when they were between the ages of 5 and 15. wallace has been charged with endangering the welfare of children and indecent assault. he's scheduled to appear in court monday. it was a rude awakening for a lostt of car owners in south philly. someone slashed the tires of more than two dozen vehicles overnight. many had to change their tires before they could leave for work. witnesses told police the tire slasher made his rounds between

1:00 and 1:30 this morning. he was reportedly carrying a rambo style hunting knife. a suspect was arrested near broad and christian. >> just found that tire slashed. >> unfortunately, it's the bad side of living in the city. it does happen occasionally. >> police say they are preparing to file charges against the 29-year-old man. to this now. a tractor trailer crash created a haz/mat situation in port richmond. police say a car collided with a truck at richmond and westmoreland streets around 11:30 this morning. the truck's tank ruptured causing diesel fuel to spill. no one was hurt. developing right now in california. wildfires continue to burn out of control threatening some 6,000 homes. the so-called rocky fire nearly tripled in size over the weekend. it has burned 60,000 acres so far. it's only 12% contained.

unpredictable winds have created challenges for firefighters. the drought-stricken state has more than 20 large wildfires burning right now. sky force 10 over a fire this morning in kensington that broke out around 7:30 in two stores on kensington avenue. there were apartments above the stores. nbc 10 is making calls to find out if anyone was hurt. a crash on i-95 in delaware county slowed traffic during the morning rush. sky force 10 over the northbound lanes in chester. two lanes were blocked while crews worked to clear the scene. no one here seriously hurt. a traffic alert for drivers taking the schuykill expressway in philadelphia. the eastbound off-ramp to spring garden will be closed until next wednesday for concrete repairs. penndot will post detours for drivers. those repairs are part of a project to rehab the bridges that carry spring garden street over 76 mlk driver the schuykill river and schuykill river trail.

the eagles have wrapped up day two of training camp. >> the team will have an audience for the first time when they take the field tomorrow. comcast sports net's john clark is live in south philly. >> the fans are about to get their first look at the new birds. >> reporter: yeah you said it. you have two days of training camp here at the novacare complex but something's missing. it feels a little empty, because there's no fans here. so tomorrow for the very first time eagle fans can come out and see this new look birds team on the field at the linc. today, we got a behind the scenes sneak peek of what's going to happen tomorrow. >> it's a great day for the team for the fans. >> reporter: those are the words of tony leonard, head of the eagles grounds crew. >> we're painting numbers. >> reporter: he took us on a tour as final preparations were put on this field for tuesday's open practice. >> we always have to do it efficiently, to paint our field.

after attacking a paramedic with a milk crate. he then climbed on to a roof in south philadelphia. nbc 10 at the scene near fifth and mercer streets where this all unfolded before 9:00 this morning. we are told paramedics were called to treat the man but witnesses say when paramedics tried to give him a shot he went on the attack and ran off. >> he wanted to fight the paramedics. they are trying to help him. so they walked away and he picked up a milk crate and threw it at them. he blocked it one of the paramedics blocked it and got cut. >> police saw the man on a roof and he wouldn't get down so they strapped him to a gurney and brought him down. the paramedic is expected to be okay. new jersey's capital city is looking for a permanent law director. trenton's mayor eric jackson appointed the city attorney to the position while the administration looks for a permanent replacement. the law director is one of four

attorneys who make up trenton's law department. drivers in delaware won't have to worry about losing their license if they fail to pay fines from minor moving violations. governor markell signed that bill into law today. it amends the procedures for suspension nonrenewal or nonduplication of licenses if drivers haven't paid motor vehicle charges. another former church in narberth would be converted to office and apartment space if the owner has his way. it is narberth's oldest church. the planning commission will meet tonight to discuss the owner's proposal. the former united methodist church and st. margaret church's gleason center are also under construction to be converted to condos. the longest heat wave of the summer continues. we have been up to 92 degrees so far and we may have at least one

other day coming. we have a chance of some showers in at least parts of the area during the night tonight and a big break coming first in the humidity, then in the temperature. got a lot of blue in the sky out there, at least looking in certain directions, so the humidity on the low side still. 92 degrees, that humidity at 32% so the feels like temperature is the same as the air temperature of 92. southwest wind at 17 miles an hour. we're in the 80s to the north and west 76 in mt. pocono. much, much cooler there. as we head to the shore, you would think it's a little cooler. it's 91 degrees in dover, by the way. let's see just how much cooler it is with that southwest wind. that's land breeze in delaware so lewes is 89 but it's only 82 in sea isle city 81 in atlantic city marina. 82 in beach haven. nice relief there. tomorrow rehoboth will be hot

again. chance of a late shower cape may and atlantic city. you're going to be about 81 similar to today with the southwest wind. the only showers, we have one in berks county and a couple in the poconos here. very light but as you can see it on the camelback camera there, brief shower. that's about it. as we go through the evening, we'll see again some isolated showers, mainly north and west and then later on tonight, the humidity is up a little bit. we could see som will be seeing the showers coming through, there's tuesday, and we go through the day tomorrow fair amount of sunshine and that will allow the temperature to go up to near 90 degrees once again.

not quite to 90 at the beaches because of that southwest wind and so we are going to have at least one more hot day. but the mild air is not that far off. just be a little patient. later on during the week it is going to be significantly cooler than what we have been seeing lately. for tonight, more humid, chance of a shower in some spots. 74 degrees in philadelphia. 67 north and west. the winds diminishing tonight, picking up again tomorrow. southwest wind hot and more humid tomorrow so the temperature's about the same. the humidity is a bit higher so it will feel a little bit hotter tomorrow. and a chance of some showers mainly in southern delaware and extreme south jersey down toward the shore like we showed you on those shore forecasts. the seven-day, less humid, much less humid on wednesday. the high temperature about 88

degrees so if we don't break the heat on wednesday, we're certainly breaking the humidity. and we are breaking both on thursday. then we got a system coming in from the west on friday and we will get rain and maybe heavy rain out of that. that will help keep the temperatures down, maybe wind off the ocean as well. that rain could last into at least part of saturday before we start drying out. but look we don't have 90s after tomorrow. to decision 2016. vice president joe biden is in his home state of delaware today as speculation swirls about a presidential run. nbc news confirms biden has not closed the door on entering the presidential race. reports say it was his son's wish to have his father take on hillary clinton and the other four democrats in the primary. nbc 10 delaware bureau reporter tim furlong is following it all and joins us from greenville. the speculation has a lot of people talking.

>> reporter: i don't think it's just here. i think people around the country are talking about this. it looks like joe biden is leaning toward a run but nobody said it for sure. he's in delaware at this point. people in politics tells me if he wants to jump into the race he needs to do it soon if he wants to catch hillary clinton, especially in terms of fund-raising. a lot of buzz around the bidens' property in greenville. even more on the streets of delaware. will he run or won't he. >> i think he has been through a lot and i think he would be a better president than hillary clinton and he would have my vote. >> reporter: there is certainly an element of sympathy for joe biden after losing his son to brain cancer earlier this summer. there are those who just love him because he's a local. >> he's a family man and when he see you [ inaudible ]. >> reporter: there is also a growing concern that maybe hillary clinton shouldn't just be handed the democratic nomination. >> i would vote for him based on what i'm thinking of hillary at

the time. >> reporter: beau biden's long time family friend has signed to to a biden campaign. if this is just an effort to float the idea of a biden run it seems to be working. some say his plain-talking style appeals to people who see donald trump doing at least kind of the same thing. >> he's rude. and he hurts people's feelings. joe biden doesn't. he comes from a better place. >> reporter: kind of feels like 2007 when we were waiting to hear if joe biden would be announced as candidate for vice president. if he wants to jump into the presidential race he might have to do it soon. there's a finite window here in terms of fund-raising. hillary clinton has already raised $45 million at this point. he would definitely be playing catch-up. tim furlong, nbc 10 news. former president jimmy carter had surgery to remove a mass in his liver. a spokesperson says it was an

surveillance video out today

shows a man stealing a car outside of planet fitness. police need your help finding out who he is. you can see him enter the gym near northeast philadelphia airport. the suspect then takes a set of keys, walks out of the building and steals a car. this all happened in late june. he's still on the loose. it appears the hitchhiking robot that met its demise in philadelphia could get a second chance at life. >> talking about hitch-bot, whose story spread quickly through social media. the co-creators have been overwhelmed with offers to revive the robot after he was damaged on saturday. he was created as a social experiment to better understand how man and machine relate. hitch-bot had been two weeks into a cross-country adventure where strangers helped it travel from place to place. nbc 10 at waldrin mercy academy this morning and that's where kids are taking part in something similar. a robotics camp.

>> she joins us from independence mall. what did he have to say? >> reporter: well right now, advisors are working with the pope consulting with him on the speeches he will deliver during the course of this visit to the united states and the homily he will give during mass in philadelphia. they are still working on it. no final documents have been produced yet. but the pope will have the final say. he will put the finishing touches on everything. one of the most important places where the pope will deliver his speech will be right in front of independence hall and visitors tourists, they are excited about it. >> it's going to be crazy packed. >> reporter: on a normal day, independence mall is bustling with tourists and foot traffic. when the pope visits there will be a sea of people eager to hear him speak for the first time at a world meeting of families event in a location that's a tremendous source of american pride. >> birthplace of america. you can't get better than that. >> you have a city that's welcomed all kinds of nations, ethnic groups. what better place?

yesterday after recent repairs. this morning the potholes returned and neighbors say a septa bus nearly got stuck in one. the street department closed the road again. neighbors say they are getting the run-around when it comes to making repairs. >> he told me i had to wait 45 business days for them to fix it. they have come twice. they just put the stones in it and every time it rains it washes them underneath. >> nbc 10 contacted the philadelphia streets department for comment. we did not hear back before our deadline. the trial is under way for a bucks county teacher accused of having a sexual relationship with a student. prosecutors say he and a 17-year-old student would kiss and have sexual explicit conversations. he and the student allegedly met after school hours and outside of the school. he allegedly booked a hotel room with the intention of meeting the student for sex.

montgomery county's health department is cracking down on pesky mosquitos in certain neighborhoods tonight. the health department will spray areas of cheltenham township between 9:00 and 11:00. health officials and the state department of environmental protection are targeting areas where mosquitos tested positive for west nile virus. the heat wave continues and these people have the right idea. actually, we are just taking a live look at camel beach mountain water park. we know the park is down there and the people are at that water park enjoying a break. >> there are people down there. >> way, way down there in the distance. >> tiny people. >> let's talk to nbc 10 first alert chief meteorologist glenn "hurricane" schwartz. >> hot one for them glenn. >> yes. another one into the 90s across a good bit of the area. not quite as hot in the poconos due to the elevation. but the biggest relief is at the

shore. lot of sunshine out there, blue sky across a good bit of the area an indication the atmosphere is still pretty clean. we are not seeing a lot of pollution. 79 in mt. pocono now. there's a shower in the area. 92 in philadelphia and close to that in some surrounding suburbs. a little cooler at the beaches. the feels like temperature not really any hotter than the air temperature because the humidity is not all that bad. that is going to change a bit as we go into tomorrow. we have a couple of showers going through the poconos. one now in northern berks county that is headed right toward kutztown and if it holds together, toward allentown within the next hour. most of the area stays dry so it's pretty sunny. by 6:00 the temperature holding in the 80s for a good bit of the evening, light chance of a shower later on tonight. we will talk more about when the

real relief is coming in a few minutes. wow. look at that! that is something else! >> the national weather service is in western iowa assessing the damage from this ef-1 tornado. the huge twister touched down at adams county last night, it picked up and threw debris and reportedly destroyed a few barns. no one was hurt. elsewhere, investigators will meet in paris to try and solve the mystery of the missing malaysia airlines flight one week after a wing fragment was discovered on an island off the indian ocean. so far air traffic and safety investigators have identified the fragment as part of a boeing 777. that's the same type of plane as the one that disappeared. flight 370 went missing last year with 239 passengers and crew on board. today president obama announced he is pressing ahead with even tougher greenhouse gas cuts on power plants. the plan calls for 32% cut on

carbon dioxide limits by 2030 instead of the 30% cut the president proposed last year. opponents plan to sue immediately and many states have threatened to disregard the plan. ultimately it will be up to obama's successor to implement the changes. and then there were two. >> the world's most talked-about dentist now has some company. this afternoon, there is a second american doctor being sought in the killing of an iconic lion and this doctor practices in pennsylvania. plus caught on camera. a cub, a critter and a cautious cop.

another american doctor is accused of illegally killing a lion in zimbabwe. according to zimbabwe national park representative he illegally killed a lion during a hunt back in april.

this news comes after the death of cecil the lion which sparked outrage last week. minnesota dentist walter palmer is accused in cecil's death. zimbabwe national park says it is cracking down on illegal hunting. speaking of animals, listen to this. a police officer in suburban detroit had a close call with a hungry skunk this weekend, all caught on camera. officer merlin taylor was in his cruiser when he discovered a skunk with its head stuck in a yogurt container. it was hungry. the animal was running around in circles as you can see. officer taylor stepped in removed the container and you saw it right there, he ran away immediately because, well as we all would think, he thought the skunk might spray him. luckily, he says that didn't happen. look at that face-off. that's great. >> that is. he is cute. we know what can happen with skunks but adorable when you see them from a distance. parents trying to decide what to make for dinner every night know kids can be sometimes

a little or a lot finnicky. >> a new study shows that fussy eating could be an early sign of something a lot more serious. today makes seven straight days with temperatures in the 90s. that's about to come to an end. i will tell you when plus a look at possible showers.

we will get to breaking news in north philadelphia. police are investigating a shooting here. this is a live picture on the ground from fairhill and cumberland streets. police say two men jumped out of a car here a short time ago and shot another man on the street. the victim right now is in critical condition. so far there have been no arrests in this case.

worse than this. the humidity over the last few days has been very tolerable. 92 in philadelphia but it's in the 80s to the north and west. and it has been a good bit cooler as we head right toward the shore, as you can see in north wildwood cape may harbor a lot cooler than just a few miles away off of the ocean. again, just a couple miles inland temperatures close to 90 but there's atlantic city marina, only 80 degrees where again, it's closer to 90 elsewhere in atlantic county. just some isolated showers out there. we had one going through the pocono mountains and another one coming through. you can see perhaps some raindrops in the distance but most of us not getting any of that rain. you can see on future cast one or two little showers coming through overnight tonight. tomorrow generally dry, fair amount of sunshine but there could be some development down

to the south, some showers, maybe even a thunderstorm in southern delaware extreme south jersey. be fairly brief, not widespread. looks like it will be moving pretty fast so it wouldn't be producing flooding. then on wednesday, we will be dry and we are also going to be a whole lot less humid. in the tropics, the only thing to be watched is in the northeast gulf of mexico just torrential rains in the tampa area but so far, no development there. no development out in the main atlantic. this is right along the equator. we don't get tropical disturbances developing there. this is a tropical moisture map and the areas in yellow extremely dry. the blue areas would be moist but this is extra dry this time of year. it's partly related to african dust and partly related to

what's happened with the el nino in the pacific. so far, as we enter the peak months of hurricane season things pretty quiet in our part of the world. more humid tonight with a chance of a couple showers. 74 for the low in philadelphia. 67 north and west. tomorrow going to be another hot one. little bit more humid than today, a chance of some showers or a thunderstorm south and east. highs in the low 90s again. the seven-day forecast much less humid on wednesday. that's the first big break. the second big break is the temperature going down on thursday. you're going to have lower temperature and lower humidity. then the temperature's going to stay down on friday because a pretty strong system is coming in from the west and you may get some heavy rain out of that friday, friday night, maybe even into part of saturday. those of you looking for some rain for your lawns, looks like we are going to get some this week and if you're looking for a

university of pennsylvania cory experiences intense anxiety when faced with consuming anything other than very specific kinds of pizza, pasta or chicken fingers. >> they make it sound simple why don't you just pick something up and eat it. but it's like if i could just eat it i can promise you i would have done it by now. >> reporter: his anxiety is illustrated in a new study of selective eating from duke medicine. researchers found kids who were extremely restricted in their diet were also more likely to be diagnosed with depression or social anxiety. >> these are sensitive kids. they see things more intently they feels things more deeply and that's both in their own internal experience and the world around them. >> reporter: this doctor suggests the kids are sensitive not only to the external world but also to what's going into their bodies. like food. cory says he's trying multiple forms of therapy to get past his food aversion. >> my goal is just to be able to get to a point where i can fit in socially i can go out with

"nbc 10 news at 5:00" starts right now. the boater was struggling to stay above water for four hours after falling out of his boat in a popular fishing area known as elephant trunk. >> that's more than 40 miles from shore. nbc 10 jersey shore bureau reporter ted greenberg joins us with how rescuers helped him survive. this is an amazing rescue.

>> reporter: it really is. but the coast guard helicopter crew couldn't even head straight to the scene right away because of severe thunderstorms that were over the ocean and when they got there, the conditions were still very dangerous. >> i was really concerned about his wellbeing, really because knowing he was out there for that long. >> reporter: rescued from a raging ocean. this coast guard video captured the final moments of a man's ordeal at sea during which he treaded water for four hours to survive. >> said he was praying he would see a helicopter in the sky. >> reporter: the mayday call was made around 10:00 saturday night after a 45-year-old man was tossed off his 39 foot boat some 44 miles east of cape may while fishing with a friend. despite high waves, strong winds and a thunderstorm rolling through, he managed to stay afloat without a life jacket. >> i didn't realize how big the seas were until you're down there in it you
