they say this is the second shooting in this neighborhood this summer. residents say they are fed up with the violence. >> it hurts. you know, it hurts. bunch of innocent people from your city getting harmed? and no one knows anything, no one wants -- everybody wants to act like they don't know anything? kind of sad. >> reporter: we have seen police going through trash bins. they have towed a car within the last 15 minutes here. they are not telling us if they have a suspect in mind or what motivated this shooting. at this point, we do not believe anyone is in custody but again, a very active crime scene here with police looking for evidence and still talking to a number of witnesses here. that's the latest. deanna durante, nbc 10 news. we are also following breaking news at the jersey shore. rescuers in surf city had to revive a 12-year-old boy after sand collapsed on him. >> nbc 10 jersey shore bureau reporter ted greenberg is following the developments. ted? >> reporter: well, a witness told me she was shaking as she

watched lifeguards work to revive that boy right here on the sand. we are told he was in stable condition when he was airlifted to the hospital. officials say this is an unfortunate reminder that digging in the sand can be very dangerous. >> i saw a little boy, his eyes were closed. like his face was covered in sand. >> reporter: on the surf city beach, fun turned to panic when authorities say sand caved in on a 12-year-old boy while he was digging a hole. >> i was terrified when i saw it. >> reporter: witnesses tell us the boy was digging in the sand with other children when the collapse happened on the 17th street beach around 1:45 this afternoon. >> he must have dug really deep, got in there and they had trouble getting him out. >> reporter: beach goers and lifeguards helped get the boy out of the sand. a lifeguard performed cpr on the child and he began breathing. officials say he was in stable condition when a medevac helicopter rushed him to cooper university hospital. >> probably hundreds of people

around. everyone tried to help as best they could. >> reporter: surf city officials say beach bag checkers and police officers constantly ask people not to dig too deep in the sand. but they don't always heed the warning. >> it points out real vividly, unfortunately, the danger, inherent danger in digging in the sand. it is unstable structure. it will collapse in an instant. >> reporter: police covered up that hole right here after they finished taking measurements in the sand. we are still working to find out where that boy and his family are from. i'm ted greenberg, nbc 10 news. now to your first alert weather. we have seen showers throughout the day but much heavier rain is on the way. >> nbc 10 first alert meteorologist sheena parveen is tracking that rain and has the details on the timing of the downpours. fill us in. >> yeah, that's right. we are talking about downpours through the overnight hours so most of you will be sleeping but we still have the chance for

thunderstorms tomorrow. locally we have a few very light rain showers left west chester near wilmington, near norristown, very light rain that's pretty much coming to an end. the next round of rain will be coming mostly after midnight. here is a bigger picture look. we have heavy showers and storms off to the west. that will start to organize a little more and move through in the overnight hours. future weather here, temperatures right around the upper 70s, near 80 degrees in philadelphia. these numbers will be dropping down to about the mid to low 70s by 9:00 p.m. then the clouds continue building in and maybe a few light showers. otherwise, the bulk of the moisture gets here closer to midnight. now here's midnight tonight. temperatures about the mid 70s. there you see the heavy rain just off to the west. mostly this will be overnight. coming up we take a closer look at the timing through the overnight hours, how much heavy rain we can expect and how it will impact your morning commute. track radar through your neighborhood, get the latest forecast any time as well by

using the nbc 10 news app. it's a free download for your smart phone or tablet. we have new information now about a man shot by police in ferguson, missouri. police say 18-year-old tyrone harris fired at officers. prosecutors have now filed ten counts against him. the shooting happened during protests marking the one-year anniversary of michael brown's death. today, the community gathered again. nbc 10 national correspondent dave wagner has the latest. >> reporter: emotions are high in ferguson as hundreds of marchers took to the streets following a night of violence and unrest. today's peaceful march was in sharp contrast to the violence that erupted here sunday night. as many as 50 rounds fired a year to the day after michael brown was shot and killed by a police officer in ferguson. when the gunfire ended, one man was shot and critically injured by plain clothes officers who authorities say returned fire after the suspect fired on them.

>> he engaged the officers at the time. there were four officers who were in that van. all four fired at the suspect and the suspect fell there. >> reporter: police say the officers-involved shooting happened after a barrage of gunfire erupted in the streets, sending people scrambling for cover. >> we can't sustain this as a community as we move forward. we have other individuals out there who are armed right now. they are part of this group. we need the public's help. we can't do it by ourselves. >> reporter: store owners along one of ferguson's busiest streets are once again cleaning up damage caused by looters. responding officers said they were hit with bricks and bottles. >> i feel sad about this whole situation. it's time to stop the violence now. >> reporter: among the buildings damaged, a family services resource center. >> people are still really raw. there's a lot of strong emotions about what's going on. >> reporter: a community still struggling to heal and rebuild, one year after ferguson was torn apart. in ferguson, missouri, dave

wagner, nbc news. back here at home from the south jersey bureau, new jersey's attorney general is now investigating a police shooting that wounded a 14-year-old boy in trenton. it happened friday night near calhoun street. prosecutors say two state troopers and a mercer county sheriff's officer responded to reports of shots fired. the officers say they tried to stop three males who were making their way in an area where a 14-year-old had started to run away. officers say they opened fire when he started reaching into his waist band. police say they later found a hand gun under a car. the boy was hit in the legs and backside. he's in stable condition. building trust with young people, that's what philadelphia police hope to do tonight on the basketball court. officers from two city police districts will host an evening of basketball and conversation in west oak lane. the speak up, lace them up event is designed to help boost or repair police relations with

youth across the city. the event begins in about a half hour at the simons rec center on wolfson avenue. pennsylvania attorney general kathleen kane will speak to the press on wednesday and answer questions about the charges she's facing. this is kane's mug shot taken on saturday. she is charged with leaking secret grand jury information to a reporter and lying about it under oath. kane has not entered a plea. a preliminary hearing is set for later this month. according to kane's spokesperson, the attorney general has no plans to resign from office. voters in philadelphia and delaware county will head to the polls tomorrow to replace two state representatives who resigned after a corruption scandal. michelle brownlee and ron waters resigned after pleading guilty in connection to a cash for favors sting operation. a third special election is

being held. the polls for all three elections are open tomorrow from 7:00 in the morning until 8:00 in the evening. today, checks are being handed down to victims of hurricane sandy who weren't paid what they were owed. the federal government says new payments are going to storm survivors whose insurance policies were given a second look. it turns out many people weren't paid what they were due by the national flood insurance program. fema sent letters to 150,000 policy holders after discovering some of their damages were underestimated. the deadline to apply for review is september 15th. lot of money was spent repairing the damage done by these vandals in philadelphia's queen village neighborhood. take a look at this. this was around 2:00 in the morning on july 26th. investigators say these two guys slashed the tires of about 30 cars on queen, south swanson and south third streets. if you recognize either of the two of them, call police. a sussex county man is under

arrest after state police say he shot a man and his nephew by accident. troopers say 21-year-old juan chyree was standing outside a house in lincoln yesterday with a gun. he was handing the gun to his mother when it went off. the bullet traveled through a nearby home, hitting the almost 2-year-old boy in the leg and his uncle in the hand. both are okay. there's a new push to bring rail service to the lehigh valley. mayors of allentown, bethlehem, easton and phillipsburg are behind the effort. an earlier study found that rail service wouldn't be profitable in the area. the lehigh valley planning commission is working with those mayors. the executive director of that group told us the plan is in its very early stages and would take years to establish. speaking of the rails, local train riders could be facing more delays. the reason, this tunnel. it's more than 100 years old. how new jersey is in a battle over who is going to fix it and who is going to pay for it.

local schools are taking action now to be ready for the pope's arrival in philadelphia next month. >> today, temple university became the latest college to announce that it will close for the papal visit. >> nbc 10's jim rosenfield is live in the digital operations center. >> jim, when is temple planning to close? >> reporter: here's the information. the latest, temple's campuses will close down friday, september 24th and that means a total of six local colleges are now making adjustments because of the pope's visit. drexel university and the university of pennsylvania are also planning to close. rutgers university's campus in camden will also shut down. so will community college of philadelphia. villanova university will operate on an adjusted schedule on friday, september 25th, as well as saturday, the 26th. faculty members can either reschedule their classes or they can arrange to have classes held

online. the world meeting of families has asked the university for its parking spaces from friday through sunday, that weekend. they will be used for people getting on septa's norristown high speed line there. philadelphia public schools are still working out exactly how many days they will be closed. what we know now, the district has requested an additional day off ahead of the pontiff's arrival. schools are closed wednesday, september 23rd for yom kippur and they were already off that friday because of the pope's visit. he arrives on saturday. now the district wants to close on thursday as well. but still no official announcement about that. we will let you know just as soon as we know. live in the digital operations center, jim rosenfield, nbc 10 news. >> i'm sure the students will be waiting with baited breath. traffic troubles during the pope's visit will also be felt miles away not just in philadelphia. new jersey are worried about it. today residents in cherry hill told us they're concerned about congestion. only four of the nine patco

stations in new jersey will be open the weekend of the pope's visit. they include broadway, ferry avenue, woodcrest and lindenwold. some who live and work around the woodcrest station say they remember a similar situation clogging up their streets back in 2008. >> when the phillies won the world series, the people were coming up here and just parking everywhere on this street. so i know it's probably going to be the same. >> cherry hill police are still trying to figure out exactly how to handle that parking situation. for the latest updates on the pope's visit, including parking information, what roads you need to avoid and information on mass transit, go to our website, nbc10.com or check out the nbc 10 app. we have a section called preparing for the pope. how about this. a study kept secret for years reveals some unsettling findings now about the safety of the national air traffic system. the study by the government found that air traffic

controllers' work schedules often lead to chronic fatigue, making them much less alert which puts safety at risk. they found nearly two in ten controllers had committed a significant error in the previous year such as bringing planes too close together. more than half the controllers attributed the errors to fatigue. a new york city mayor now says 12 people have died from a legionnaire's disease outbreak. cases now total 113. the number went up slightly because people were diagnosed after the fact. the outbreak is the largest in the city's history. the disease is a form of pneumonia. it's not clear yet what triggered the outbreak. it seems that a lot of americans are unsure what congress should do about the iran nuclear deal. but more believe that iran fared better than the u.s. according to a new monmouth university poll, 27% say congress should vote to approve it while 32% believe congress should not. 41% say they are not sure what

congress should do. president obama says there was no way to secure a nuclear deal with iran without first inflicting severe sanctions that made life harder for people there. obama also insists that republicans are opposing the iran deal simply because his name is attached to it. meantime, new york senator chuck schumer made his first public comments about his decision to oppose the president's nuclear deal. schumer, a democrat, says that it's one of the most difficult decisions he's had to make. he calls the deal flawed. >> iran will get all sorts of money once the sanctions are lifted and they will use too much of that money in my judgment to create real problems in the middle east. >> the republican-controlled congress has 60 days to review the agreement. republicans have objected to the deal but president obama has said that he will use his veto power to override a disapproval.

a few showers around today but heavy rain moves in as we go overnight tonight. we have some light showers around, not much, and we could see a few more this evening. the heaviest rain will come through the overnight hours, a lot of it after midnight tonight. tomorrow we still have the chance for thunderstorms around mostly in the morning or in the afternoon. so as far as this weather is concerned, we expect about a medium chance of any localized flooding with heavy downpours. if your area is prone to flooding with heavy rain, you might see that through the overnight hours tonight. wet roads mostly for the morning commute tomorrow. lightning obviously with some high wind with any thunderstorms. hail chance is going to be a little lower but as far as any tornado chance, that will stay low, too. we are seeing overcast skies in philadelphia right now. temperatures are pretty mild outside at the moment. but skies are pretty much on the cloudy side. we are not seeing any rain around just yet in the

philadelphia area but there are a few spots of light sprinkles. no heavy rain. through parts of new castle, salem county, a few very light showers. earlier we had a little bit heavier rain but the heaviest is back off to the west. there you see all the showers and some thunderstorms, too. it will organize a little more before it moves in overnight tonight. for the next several hours, i think we will be staying just about cloudy with the chance for light showers. take a look what future weather does. clouds hang around, then closer to midnight, see the heavy rain on the side of the screen? that's what we expect to move if overnight. even by midnight, most of the area should still be dry. then between midnight and about 5:00 in the morning, the big area of heavy rain will move into the western counties, into the philadelphia area, so you see how early this is, new jersey and delaware by 5:00 a.m. seeing the heavy rain, too. by 7:00 a.m., it's making its way out but we could still have heavy showers along the shore with imbedded thunderstorms as well. the middle of the day tomorrow, we should start to see improvement.

there may be a pretty big break where you may not see any rain tomorrow during the day, then the chance of thunderstorms starts to come back in tomorrow afternoon. late tomorrow night, we see even more clearing and wednesday is shaping up to be nice. wednesday morning, a lot more clearing, drier air moves in. through the day wednesday, you will start to notice the humidity dropping off. as we go into thursday, even less humid. computer model rainfall, we could see about half an inch to an inch. this will mostly be through the overnight hours into early tomorrow. for tonight, we expect rain, heaviest after midnight. 70 for the low in philadelphia. mid 60s north and west. tomorrow, early and late thunderstorm so there's a point during the day where we could get a break. temperatures right around the mid80s through the afternoon hours. you will want your umbrella and you will wake up to wet roads tomorrow morning. wednesday, much less humid. temperatures in the mid 80s. by thursday, really nice. sunny skies, around 83 degrees, very low humidity. thursday looks like a really perfect day, too.

convicted on child porn charges, the former head master of a local school is now filing an appeal. christopher wheeler is serving 50 years in prison on 25 counts of child pornography. wheeler was the head master at the tower hills school in wilmington. today, wheeler's lawyer said that authorities may have tampered with witnesses to get the warrant they needed to search wheeler's computers. according to that lawyer, there is no evidence that wheeler viewed the child pornography stored on the computers or even knew that it was there. the rules are changing in delaware for people working or volunteering to work with children. governor jack markell will sign legislation tomorrow consolidating regulations for background checks. the law addresses inconsistencies in the types of background checks currently on the books. it also adds checks for people who want to work at private schools or youth camps. the new law will be named in

honor of former delaware attorney general beau biden, who died in may. while in office, biden spent much of his career protecting children, creating a child predator unit within his office, prosecuting pedophiles and improving treatment for victims. a revamped diet pepsi without as pertame is popping up on store shelves. the company said it would replace aspertame with another artificial sweetener. the rollout will test the theory that the sweetener is to blame for fleeing customers. some claim it's dangerous to your health. other diet sodas that include aspertame are diet dr. pepper and fanta. tonight, a widower in philadelphia describes the frantic moments after a car came crashing through the front of his house and how he escaped. plus road rage turns violent. it's all caught on tape. who police are looking for after a driver was beaten and stabbed

this house catches on fire after a car crashes right through the front of it but it's not just his belongings that were lost in the flames. so were the memories of his late wife, whom he laid to rest only last week. >> nbc 10's doug shimell spoke to the man today about that loss and the frightening moments he experienced when the car came crashing through his home. he joins us live. doug? >> reporter: it's not often that anyone is asked to endure so much loss in such a short span of time. >> i said what else. what else is going to happen. >> reporter: it was barely five days since carmen adamo lost his wife of almost six decades, phyllis, to breast cancer. >> i buried my wife on august 4th at veterans cemetery. and here's only five days later, this happens. >> reporter: sunday night, the front wall of carmen's home on busleton avenue exploded. >> we saw that car almost fully

inside the home of my next door neighbor. and smoke coming out from all over. >> i just yelled his name, i didn't see him, because he would usually stay in the basement to watch tv and stuff. >> reporter: that's exactly where carmen was. >> it knocked me right out of the seat. when i knocked out of the seat i hit a table with my knee and apparently i got cut with flying glass. >> reporter: the 84-year-old former philadelphia police officer and air force and naval veteran had to be rescued from a rear window. and police have charged 34-year-old katherine ryan with driving under the influence. carmen is convinced the only reason he survived is that phyllis was looking out for him. >> i'm heartbroken. because i don't need this at this time of my life, to be forced out of my own house. >> reporter: carmen will be living with his sister in levittown while the insurance companies go to battle over just if and when he will be able to move back into his home.

i'm doug shimell, nbc 10 news. >> thank you for that. now to a case of road rage that led to violence in ocean county. you can see a man being beaten on this cell phone video. this happened along route 88 in brick township on saturday. the victim told police when the driver of the other car approached him at an intersection he got out and a fight ensued. police say the 39-year-old man was stabbed with a small knife and suffered cuts to his face and body. investigators are now searching for the three people who were inside the other car. turning to weather now, get ready for rain. nbc 10 first alert weather is tracking storms. we have seen a few downpours today as we look at the radar. heavier rain is on the way. >> let's check in with first alert meteorologist sheena parveen. >> we are tracking heavy rain on the way. i think most of you will be sleeping by the time it gets here. a live look at the radar, we are mostly dry right now. we have overcast skies. it looks gloomy outside.

but a few light showers near west chester and parts of salem county, near newark in new castle county in delaware. this is really about it right now. most of the rain will be here after midnight tonight. that's when we will see heavy showers. here's a live look at center city. overcast, pretty gloomy and these clouds will hang around tomorrow during the day also. still the chance of thunderstorms through part of the day tomorrow, too. there you see all the moisture back off to the west and heavy showers and storms moving in this direction. but until about midnight tonight, that's when we expect it to get a little more organized. here's future weather. there you see the rain back off to the west. over the next several hours we stay mostly dry. by 9:00 this evening, temperatures will be pretty comfortable, about the upper 70s with cloudy conditions and the rain still mainly back off to the west. then closer to midnight, temperatures about the mid 70s and the heavy rain right on the doorstep by midnight. again, many of you sleeping when the rain moves through. coming up, i will show you the rest of the timing overnight,

how much rain you can expect and how it will affect your morning commute and through the day tomorrow, straight ahead. right now at 5:00, federal officials say a former new jersey man wanted to form a small army to fight for isis. >> reporter: after the hearing, he was taken to a nearby jail after he was captured overseas in jordan. the 20-year-old was led into federal court earlier in handcuffs and leg irons. the rutherford, new jersey native accused of trying to join isis and allegedly encouraging others to try to do the same. his brother was arrested in june, as was samuel topaz of fort lee. they are among six people arrested in new york and new jersey, some accused of even scouting possible targets here. the fbi says it first got on to him in 2012 when he went online voicing support for isis. he later allegedly praised

vicious killings including the burning alive of a jordanian pilot and the attack on the "charlie hebdo" offices in paris. they say he became increasingly radicalized by watching isis videos. he flew to jordan in may but was arrested by authorities there before he could travel to syria. in court, his defense lawyer declined to comment, saying he just got the case. the two terror conspiracy counts carry up to 20 years in prison. he was ordered held without bail. investigators today not saying how many others might have been part of this alleged isis terror group here. we have seen a few terror arrests at home in recent years. in april, people arrested the young lioness. authorities charged her with trying to aid terrorists. she faces up to 15 years in prison. then there was jihad jane. colleen larose lived in

montgomery county. she was sentenced to ten years in prison for a 2009 plot to kill a cartoonist who mocked the prophet mohammad. we now know the ages of the man and woman killed in a violent suv crash in the lawncrest section of philadelphia this morning. police say the suv was speeding and slammed in a cell phone tower causing it to flip over on adams avenue. family members came to the scene hugging and crying. there was a 24-year-old woman and a 30-year-old man who were killed. take a look. this surveillance video shows the suspect who attacked a cashier and tried to rob a sunoco gas station in strawberry mansion last wednesday. philadelphia police say the man kicked down the door leading to the register and punched the 52-year-old cashier in the head and the face. the man ran off when the worker called 911. visitors to the battleship "new jersey" can now see it like never before. >> they are getting a chance to view a 20 foot brass model of the ship. take a look. in the past the navy used the

model for radar testing on a miniature scale. now the model is serving a different purpose. >> definitely used by the navy. it just hasn't been used in many years. we thought why not get it, bring it out and allow our guests to experience it. >> visitors can look at the model free of charge. eventually it will be on display all around our area. jerry seinfeld will be the headliner at musikfest in bethlehem tonight. the comedian will perform at 8:30 this evening at the steel stage at pnc plaza. the festival runs through next sunday. nbc 10 is working to clear the shelters. why local shelters tell us that they need a lot of help, especially finding homes for cats and kittens. plus the new location where investigators are looking at more possible plane debris. if it could be from the missing malaysia airlines jet.

nbc 10 and telemundo 62 are teaming up with dozens of animal shelters in our area to help find homes for pets in need. it's called clear the shelters. it's happening saturday. >> participating shelters will be offering reduced adoption fees in hopes of finding homes for thousands of animals in local shelters. that's the incentive. the philadelphia welfare society is one of the organizations we're working with. right now, their top priority is finding homes for cats and kittens. at any given time they have 40 felines in need of good homes. if you're not quite ready to adopt, the group is also desperate for foster homes. >> there's a way for people to help even if you only have a spare bedroom or laundry room or bathroom. that's all a kitten needs in order to be safe and to grow and you're helping to save lives and helping us save more in the process. >> the application process is simple and quick. the main goal is to match the

here are some of the stories making headlines on "nbc 10 news at 5:00." a man accused of killing eight people, including six children, went before a judge in houston today. david conley walked into court where a prosecutor laid out the capital murder charges against him. the judge then denied him bond and sent him back to jail. a prosecutor told the judge conley broke into his former home and killed eight people. one of which is believed to be his son. elsewhere, malaysia's government says debris has been found in the maldives and they will send a team to the indian ocean island nation to determine whether it came from a plane. the transport minister says it's premature to speculate whether the debris found in the maldives is collect tnnected to the miss flight. meanwhile, crews continue to

search that island for more debris. today, a group of municipal workers combed the beaches of the island's capital for any object that might have come ashore from the crashed plane. flight mh-370 disappeared last march while en route to beijing with 239 people on board. now to decision 2016. former pennsylvania governor ed rendell will chair katy mcginty's run for the senate, saying she has the right priorities and skills and will fight for good schools, good jobs and affordable health care. she served as secretary of the department of environmental protection under rendell's administration. she faces opposition in the primary from former u.s. representative democrat joe sestak. the winner will face pat toomey in the general election. in other political news, donald trump says he deserves an apology. the republican candidate for president continues his offensive against what he believes were unfair questions in last week's gop debate.

but despite his displeasure, trump remains the front-runner in the latest nbc survey. nbc 10 national correspondent chris pallone reports. >> reporter: after launching a weekend barrage against fox news host megyn kelly, gop candidate for president donald trump says it's kelly who should be saying she's sorry. >> she should really be apologizing to me. >> reporter: trump was not happy with debate questions from thursday's fox news moderators, including one which cited his use of insults for women. the debate was a mixed bag for trump according to the latest news nbc news online survey which shows the billionaire continuing to hold a double digit lead in the race for the republican nomination. >> he is tapping into gop discontent but he has yet to put together any kind of policy position. >> reporter: former hewlett-packard ceo carly fiorina is using her strong performance to attack the only other woman in the race, hillary clinton. >> she did lie about benghazi. she did lie about her e-mails.

unveiled a plan today to make college more affordable and reduce student debt. at a town hall meeting in new hampshire, clinton proposed steps to reduce the cost of for-year public schools and wants to make two-year community college tuition free and cut student loan interest rates. the plan is estimated to cost $350 billion. well, the clouds are still around right now. we even have a few light showers but most of the rain we have already seen today has come to an end. still some light showers left over for the rest of this evening but the heaviest rain will get here through the overnight hours. until we get into about the midnight hour, i think most of the area will stay dry. thunderstorms as we go into tomorrow. we have a chance for scattered storms early and later in the day. here's a live look outside right now, near the schuykill river, the art museum, overcast skies, 77 degrees in philadelphia. so the temperatures are

comfortable but we are also tracking rain coming along with the clouds you just saw. here's a live look at the radar. most of the area is dry. i think this is how we will stay the rest of the evening. until most of you go to sleep, then we will have heavy rain moving in. right now, a few very light showers through parts of chester county and lower montgomery county. very small but scattered in parts of new castle county, also near salem. we are still seeing very light rain in the vicinity. the heaviest is off to the west, still pretty far away. we have quite a few hours until it actually arrives. until then, all these clouds are still going to hang around to end out your monday. future weather, as we go through the next several hours we keep the clouds around. most of the area will be dry. heavy rain by midnight. still off to the west but getting closer and moving in while many of you are sleeping. between midnight and 6:00 in the morning, that's when the rain will move in from west to east. philadelphia area, probably around 5:00 in the morning, very early. if you leave at 6:00 a.m. for your morning commute, and you are in new jersey and delaware,

even possibly lehigh valley, you could be hitting some very heavy rain this early. by 8:00 in the morning, the heaviest tries to move offshore. we could have lingering thunderstorms or lingering heavy showers, even closer to 10:00 a.m. by the middle of the day we could have a nice break across the area. clouds will still be around, still may be a few showers and then by the afternoon, there is still a chance we could have scattered thunderstorms left over before this entire thing moves away. by wednesday, much better clearing by the morning hours. the humidity drops through the day on wednesday and even as we go into thursday, thursday is actually going to be a pretty nice day. take a look at the rainfall models. we are seeing about an inch to half an inch across the area. some of the highest amounts could be a little more than an inch with the rain coming. most of that heavy rain through the overnight hours and very early tomorrow morning. tonight, the rain expected mostly after midnight. 70 for the low in philadelphia, 66 degrees areas north and west. tomorrow, early and late thunderstorm chances still. warm and humid tomorrow. the humidity is not dropping

derailment in philadelphia killed eight people. 89 days later, amtrak is still fighting for funding that it says is necessary to protect passengers. today, the problems with the northeast corridor became even more apparent as officials with amtrak testified before state law makers in new jersey. >> that corridor is the nation's busiest rail line but also has some of its oldest infrastructure and riders through new jersey have been suffering because of that. over the last two weeks, new jersey transit trains have faced major delays because of power problems in the hudson river tunnel. that tunnel is about 100 years old. today, amtrak said fixing that tunnel needs to be a priority. >> but as nbc's brian thompson reports, fixing it won't come easy or cheap. >> i would like to begin by offering my apologies. >> reporter: an amtrak official apologizing for the breakdowns and delays that bedeviled commuters from philadelphia to new york and beyond during the week of july 20th. railroad vp stephen gardner showed off this burned-out cable

from one of the hudson river tunnels that dates to the 1930s. he frankly warned -- >> it's quite possible the delays will become the norm at some point. >> reporter: there was a picture of one of the sandy-flooded tubes from three years ago. the seeping corrosion getting much of the blame for these recent breakdowns. these pictures show structures that literally date back more than 100 years, adding urgency to the need for new tunnels so the old ones can be repaired and capacity increased. >> they do need it badly. >> probably lack of money. it's economics. >> reporter: two riders' take on amtrak's case for billions more to fix what ails it. so where will the money come from? amtrak today said the feds will pick up 80%, leaving the rest to a state and railroad mix. committee chair bob gordon. >> i learned for the first time that the federal government is willing to put up 80% of the funding. >> reporter: that could be music to the ears of commuters. though even if a deal comes tomorrow, new tunnels to new york may not be ready for a

we begin with this breaking news out of wilmington this evening. that's where police are searching for the person who shot a mother, her 5-year-old child and another woman. we are told one of those women has now died. the shootings happened around 2:00 this afternoon near north washington and west seventh streets. nbc 10's deanna durante is live at the scene.

police are still searching for that shooter, right? >> reporter: they are. take a look behind me. still a very large police presence here. the shooting happened near the home where you see police standing on the porch there. we are told that building on the end of the street is an apartment building and those that were shot were outside on the porch. that's all according to witnesses here. police say they know very little about this case. they say they know they were called here at 2:00 for multiple shots fired. two women were shot, one woman they say has died. a 5-year-old child is also being treated. we have talked with a number of people who have come to the neighborhood, people who say they know the victims and they tell us they believe that one of the women that was killed, that her children were here to see what had happened. take a listen. >> when i got to him, he was saying my mom is shot and my sister, can you go get my sister. and i didn't know what to do because the cops wouldn't let nobody up there. that's all he kept saying, my mom is shot, my mom is shot and kept saying my mom is dead.

i kept telling him we're not going to talk like that, we are going to pray on it, make sure mommy's okay. then to finally get the news she is gone, that's sad. >> reporter: neighbors tell us they heard about four or five shots. people they saw running into the home, we are told one of the women was found shot inside that ground floor apartment. two other people, one woman and the child, were found shot outside. no word yet on a motive or who could be behind this. police still looking for that gunman. deanna durante, nbc 10 news. more breaking news, this time at the jersey shore, where a 12-year-old boy is in the hospital after sand collapsed right on top of him. lifeguards and beach goers worked to try to free the boy and the lifeguards performed cpr on him. this all unfolded on the 17th street beach in surf city, ocean county this morning. that's where we find nbc 10 jersey shore bureau reporter ted greenberg. what's the latest?
