going to talk like that, we are going to pray on it, make sure mommy's okay. then to finally get the news she is gone, that's sad. >> reporter: neighbors tell us they heard about four or five shots. people they saw running into the home, we are told one of the women was found shot inside that ground floor apartment. two other people, one woman and the child, were found shot outside. no word yet on a motive or who could be behind this. police still looking for that gunman. deanna durante, nbc 10 news. more breaking news, this time at the jersey shore, where a 12-year-old boy is in the hospital after sand collapsed right on top of him. lifeguards and beach goers worked to try to free the boy and the lifeguards performed cpr on him. this all unfolded on the 17th street beach in surf city, ocean county this morning. that's where we find nbc 10 jersey shore bureau reporter ted greenberg. what's the latest? >> reporter: well, that hole was

right here but police have since filled it in and since 5:00, i have learned the boy is from pennsylvania but his family also has a house here in this jersey shore resort. investigators took measurements in a hole on the surf city beach where authorities say sand collapsed on a 12-year-old boy. >> saw a little boy and his eyes were closed and his face was covered in sand. >> reporter: witnesses tell us the boy was digging a hole with other children on the 17th street beach around 1:45 this afternoon when the sand caved in on him. >> he dug really deep and got in there and the children had trouble getting him out. >> reporter: authorities say beach goers and lifeguards helped get the boy out of the sand. beach patrol staffers worked to revive him. >> they did all types of cpr and finally, they were able to get some breathing going at that point in time. >> i was just sitting there shaking. >> reporter: officials say the boy was in stable condition when a medevac helicopter rushed him to cooper university hospital.

they say it's a reminder that sand is unstable and can be dangerous. >> our beach tag checkers and special officers on the beach are constantly asking people not to dig too deep. people don't heed the warnings. >> reporter: it is actually illegal to dig a hole on the beach in this community. that is more than a foot deep. i'm ted greenberg, nbc 10 news. to our weather now. we are seeing the return of wet weather. light showers falling throughout the area and nbc 10 first alert weather radar showing much heavier rain heading our way. taking a live look at boathouse row, it's dreary, much cooler than normal for this time of year. let's check in with nbc 10 first alert chief meteorologist glenn "hurricane" schwartz. where are the showers, glenn? >> we have had some of the light showers right over our area. the heavy stuff is mostly back in ohio and west virginia. but the sky has looked like this for much of the day and we are

going to continue to see the cloudy skies. you can see a little bit of light, light out there. that's the lightest you can see on the radar. this is more like sprinkles than actual significant rain. even that is not falling over the entire area. this, look at that by comparison. lots of reds in here. heavy rain, thunderstorms. it's all moving to the east and it is likely to affect us overnight tonight. in the next few hours, if anything, it will be less and less rain. but not by midnight. there's 11:00 and some of the showers are starting. the heavy stuff back to the west, that is charging through here at 2:00, 3:00, 4:00 in the morning. look at that. that's real downpours, localized flooding in poor drainage areas but it keeps moving. by 6:00 a.m., most of the heavy stuff is actually out of here. the temperature, well, it's been

pretty low, barely getting above 70 degrees north and west. because of all the cloud cover. but we've got warmer weather coming and we've got stormy weather tomorrow as well. more on that coming with the seven-day in a few minutes. >> track the rain and storms headed our way any time thanks to the nbc 10 news app. get live radar and weather sent directly to your smartphone or tablet. it's a free download. turning now to the unrest in ferguson, missouri, here's the latest on developments there. a year after a white police officer shot and killed michael brown, a black man, authorities have declared a state of emergency in st. louis county after last night's peaceful protest turned violent. 18-year-old tyrone harris jr. is accused of shooting at law enforcement. he remains hospitalized in critical condition. meanwhile, police say 56 non-violent protesters were arrested today outside the federal courthouse. here at home, protesters are gathering in north philadelphia in support of michael brown and the black lives matter movement.

they are calling for an end to police brutality. nbc 10's mitch blacher live at the demonstration. set the scene for us where you are. >> reporter: we are in north philadelphia on erie and broad street, where a small but loud group of peaceful protesters has been out here. they are obviously honoring michael brown. they rls out here honoring many women who have been victims of what they call police brutality. they are in the process of just getting started at this point. we have heard a lot of horns honking, a lot of people supporting this group of a little bit more than a dozen people who are at erie and broad street. again, horns honking and we actually have seen more police officers as you can see across the street and down the street than protesters but these people are making their voices heard as we spoke with an event organizer earlier today. >> we are just coming together to stand in solidarity with the

ferguson action and to also just let the public know that we are here, let the public officials know that we are here and that this movement is not something in philadelphia that's going away any time soon. >> reporter: this protest is just about to get started, as you can hear behind me. we actually checked in to philadelphia police-involved shootings and the numbers have continued to fall ever since 2012. in 2012, there were 59 police-involved shootings in philadelphia. that dropped to 43 in 2013, to 29 in 2014. so far this year, there have been 19 police-involved shootings in philadelphia. live in north philly, mitch blacher, nbc 10 news. new at 6:00, an ocean county man appeared before a judge months after his truck plunged through a frozen river, killing a dog inside. andrew mayor is charged with animal cruelty and criminal mischief. he plans to represent himself but today, the judge urged him to find a lawyer.

investigators say he drove his truck on to the toms river back in march and his dog was inside and did not survive. prosecutors say he made it to shore but never told anyone, resulting in an hours long rescue operation. a local man just buried his wife of 57 years and now is traumatized again. police say a drunk driver crashed into carmen adamo's house on bustleton avenue and started a fire. he is staying at his sister's home, nursing cuts and bruises. he believes he survived because his late wife was watching over him. the wife of the 84-year-old former philadelphia police officer recently died of cancer. tonight, 34-year-old katherine ryan is charged with dui as a result of this crash right here. happening now, emergency road repair has closed 15th street just south of philadelphia's city hall. craters like this one have road crews scrambling to fill them in. police are warning drivers to avoid the area until the work is finished. no word on when that will happen.

two days from now, pennsylvania attorney general kathleen kane says she will talk publicly about criminal charges against her. it will be the first time kane has spoken about the charges since her surrender on saturday. kane is charged with leaking secret grand jury information to a reporter and lying about it under oath. kane has not entered a plea. according to her spokesman, the attorney general has no plans to resign. now to the jersey jam scandal tonight. governor christie's former campaign manager has been dropped from a civil lawsuit. that suit focuses on the 2013 politically motivated traffic cams in fort lee. his name is not included in a new version of the lawsuit. he has never been charged. we are learning new information about a ymca child care center that was shut down in berks county. according to the pennsylvania department of human services, they began investigating the ymca berkshire center last tuesday. the state issued an emergency removal order after finding

reading had a good bit of rain. we are in the mid 70s in southern delaware and atlantic city right now. with the wind coming onshore, it can't really warm up much beyond this, mid 70s, the ocean temperature in the mid 70s. here are the sprinkles, not much more than sprinkles anymore now. you can see in montgomery county into the philadelphia area so not going to be getting rained on very hard over the next couple of hours. you can see, that's the first rain of the day getting into some sections of philadelphia. some of this is hard and in the reds, that's heavy rain, big thunderstorms there, that whole system is moving in our direction. we can track it hour by hour. we are going to 10:00 tonight, there's practically nothing there. as we go past marylaidnight, yo

see quite a bit of bright colors. that means heavy rain. we are getting downpours out of that, 2:00, 3:00, 4:00 in the morning, maybe localized flooding in poor drainage areas. this continues to move east so by 6:00 a.m., the heaviest of the rain is across much of the area. it's past much of the area. right along the shore, we are getting some of that heavy rain. we may get a few showers after that but the early morning hours is when we get the worst of it. the more intense it is in the morning, the less severe it's likely to be in the afternoon. we are likely to get some showers and storms but this computer model and some others do suggest it will be a lot worse at 4:00 a.m. than at 4:00 p.m. tomorrow. then once this dry air comes in tomorrow night it will stay for awhile and it will be really nice. the rain becoming heavy after midnight. 70 for the low in philadelphia. very humid during the day tomorrow. you will notice that, steamier

than today. some early in the day showers and late in the day showers. you may have several hours of dry weather in between with p k peeks of sunshine but it is going to be humid. it won't be humid on wednesday. much lower humidity. spectacular weather on thursday with the low humidity. even friday is pretty nice. then we start to heat up over the weekend, get more humid and start getting some chances for showers. a hero's welcome today for a local champion. that's special olympian lisa berlin being greeted with cheers at the equestrian center. she is just back from the world special olympics in los angeles. she rode a horse named stormy that she met only two days before the competition. that didn't slow her down at all. she won a silver medal in two events and scored gold in team relay.

or go with a younger player. we will see more tomorrow. chip kelly has been under fire from a few former players he got rid of this offseason. they intimated that some of his decisions could be influenced by race. here is what some current black players on the eagles said anonymously. these quotes were told to bleacher report. chip is not a racist. the notion he is isn't fair. the thing with chip is he just doesn't see you as a person, he sees you as a commodity. the more players get that, the better off they'll be. a second anonymous eagle said quote, chip sets the agenda. you don't follow it, you're dead to him. that's not racial. some guys handle it well, some guys don't. of course, chip spent the offseason overhauling the roster, including on defense. pro bowl linebacker conner barwin thinks the birds will have a big year on "d." >> we added some pieces that will help us on defense and then there's a core group of guys that are going on their third season now. obviously time allows you to

we could be seeing heavy downpours late tonight? >> after midnight. what we're seeing now on the radar is generally very light, as you can see in the lightest color of green coming in through the philadelphia area, montgomery county, bucks county, getting it. in some cases, from the first time today. but the main area of action is in ohio and west virginia and northwestern pennsylvania. that is going to be moving in after midnight. generally between 2:00 and 6:00 a.m. it might make some folks up with rumbles of thunder. once we get through tomorrow, it's beautiful. beautiful weather for the rest of the week. especially thursday. then it starts getting hot and humid again.
