nbc 10 news starts now. new from overnight, tension remains high in ferguson, missouri after police arrested more than 100 people yesterday, a state of emergency is in place this morning as more protesters plan to hit the streets today. and right now a very active nbc 10 first alert radar showing rain moving across the area. rain that could be around still for your morning commute. and we will track that rain for you in just a moment. welcome to nbc 10 news today on this tuesday. i'm chris cato. let's get straight to it. meteorologist bill henley is standing by watching that rain on an active radar picture this morning. how about it? >> we're seeing steady rainfall move through the philadelphia area, in fact a lun of showers extends from the pocono

mountains through the allentown area, the lehigh valley, from philadelphia into delaware and south jersey. that's where some of the steadier, more moderate showers are. you can see the heavier rain is starting to approach south philadelphia now. glassboro, that will increase in intensity in the next few minutes. the abington area, it's on its way to you, too. the steadiest rainfall to start with and it tapers off with showers and a chance of scattered showers for the rest of the day. let's see how the roads are beingç affected with jessica boyington. >> we are dealing with wet and slippery conditions out there. we're on 95 around state road. you can see through the work zone, shiny roadways. all lanes up, southbound from woodhaven road up towards the vine street expressway, a 13-minute trip.

out on the schuylkill expressway, you can see rain actively falling through the conshohocken curve airy. all cars green, though, 13 minutes if you're heading into the center city area. eastbound from the blue route up toward the vine street expressway, currently no problems or delays for mass transit. if you have to take new jersey transit, septa or patco, you'll do just fine. no weather delays at the philadelphia international airport. a driver took off after running over a man on a street in gloucester county. matt delucia is live in glassboro. you have new details for us, right. >> reporter: the man was taken to cooper trauma. we're working to find out more about his condition at this hour. here's what we know. this happened shortly after 1:00 this morning on the 600 blook of quincy port. this is the area where this

happened. the police have since left this scene. neighbors on the block did not want to talk about this hit and run when we got there. we are making phone calls. the man was taken by ground to duper, not by air. more details to come from this investigation, we'll be sure to pass along any updates as we get them. live in glassboro, matt delucia, nbc 10 news. police found a 28-year-old man shot in the back inside an suv. you see it there in philadelphia's lawncrest neighborhood. it happened around 1:00 a.m. police have taken a 34-year-old woman into custody. we don't know yet if she's been charged with anything. the man who was shot is in critical condition. we'll stay on top of that one for you. now to ferguson, missouri, where a state of emergency is in place more than 24 hours after police shot an 18-year-old man. he remains in critical condition this morning.

nbc 10 tracy davidson is live in our digital operations center watching the new developments from overnight in missouri. >> overnight police arrested two dozen people as protesters flooded the streets of ferguson, hundreds of people gathered, surrounded by police in riot gear. the protests followed a police involved shooting. st. louis county authorities say they're being extra vigilant to the prevent another outbreak of violence in the community. >> what is required in this situation is a pro-active response. and i think we need to get out ahead of this and, you know, last time, you know, around last year, we saw a city burn. we are not going to see that again. >> he's talking about the violence that followed the shooting of michael brown. in this latest shooting, they

think there were six shooters in all. live in the digital operations center, tracy davidson, nbc 10 news. 4:05 now. wilmington police still have not arrested the gunman who killed a woman, wounded her 4-year-old daughter and left her 9-year-old son screaming for help yesterday. police say yesterday afternoon the woman's boyfriend got into an argument with a man outside their home on west 7th street. that man opened fire, killing the 25-year-old woman, injuring her daughterç and another woma. witnesses say the victim's 9-year-old son ran down the street screaming, "my mom is dead." >> when i got to him, he was saying my mom is shot, my sister, can you go get my sister. >> the boy's sister was shot in the leg. she's in stable condition. again, she's 4. the family friend also in stable condition. police are questioning the mother's boyfriend to see if he can help them track down the shooter. happening today, some voters

in philadelphia, probably very few of them, will head to the polls for a special election born out of a corruption scandal. michelle brownlee resigned her post in june after pleading guilty to taking braibes in exchange for favors. three candidates want to replace her, including democrat donna bullock, republican adam lang and judith robinson who's not pictured here. two other legislative districts in philadelphia, the 191 of the and the 194th. polls will be open from 7:00 this morning until 8:00 tonight. happening today out of our delaware bureau, governor jack markell will sign into law a new bill honoring the legacy of beau biden. the former attorney general died from brain cancer may. the joseph r. bow biden child

protection act will expand background checks to include people that work with children on a part-time or summer basis. the current law applies only to employees of year-round child care facilities. pennsylvania attorney general kathleen kane plans to address those criminal charges against her during a news conference tomorrow. this will be the first time she's spoken about the charges since turning herself in on saturday. as you see here in this video. montgomery county's district attorney charged kane with leaking secret grand jury information to a reporter and then lying about it under oath. kane has not entered a plea but she's insisted many times she is innocent. while we don't know exactly what she will say during the news conference tomorrow, a spokesperson tells us the attorney general has no plans to resign. 4:07. new this morning, the camden county police department wants

to know if you know the guy in this video? they say he burglarized an apartment on july 28th. the video shows him going in through a back window. there he goes. and then moments later, walking right out the front door. anyone with information on that guy should call police. in philadelphia today, a man accused of killing a man and stuffing his body in a suitcase faces a court hearing. the judge will decide if there's enough evidence to put thomas brennan on trial. he's charged with murder and other crimes. authorities say brennan killed scott bernheisel at a home in philadelphia in may, put his body in a suitcase and dumped that luggage near the airport. they say that he had been beaten and stabbed, bernheisel. neighbors discovered the suitcase a couple weeks later when they noticed an odd smell. septa is getting ready for

round two of its lottery as we prepare for a visit from pope francis. a septa second chance. today many people who didn't win the original lottery for the rail passes will get the chance to buy them after all. that's because many of the winners didn't complete their transactions by yesterday's deadline. so today septa will send outç e-mails to people who applied but were not chosen for a chance to buy the $10 passes. they'll have until just before midnight thursday to pay for those. that may not be the only opportunity to get a papal pass. >> if there are any passes remanning we'll sell those passes at the stations that have passes left over. >> the septa says they have about 20,000 passes remaining from the original 350,000 made available for the weekend of the papal visit. of course getting around during the pope's visit will certainly be a challenge as will parking. even as far away as south jersey. ahead at 4:30, why people in cherry hill are concern about a

into the low 80s, something that didn't happen yesterday. rain falling is steady in allentown, a light rain in northeast philadelphia. 71 and 73 degrees, right now in atlantic city. clouds over cape may producing rain there. you can see the streets, beach avenue is damp this morning. the storms, heavy downpours are avoiding most areas. no thunderstorm activity in the philadelphia area. a line of showers moving through philadelphia right now and into south jersey, gloucester county. they'll be heading off to the northeast. we'll see things taper off as the morning goes on. that will not be the end of the showers today. there's a possibility of storms later on this afternoon. the storms in western pennsylvania, we'll be watching their progress later today. 8:00 this morning, heavy downpours in philadelphia and then we'll get a break for much of the rest of the day. breaks of sunshine, too.

area bridges, the walt, tac pal, betsy and ben. watch out for that ongoing construction heading westbound in the city. chris? new this çmorning, not getting much help from the home crowd. a brand new presidential poll is out. a large percentage of people in the garden state don't think he's cut out for the white house. and as we prepare for this wet tuesday that is upon us, unfortunately we -- fortunately i should say we won't see anything like this. next, flooding rain is not the only extreme weather hitting folks out west. we'll have a look.

doing republican white house candidate chris christie any favors. the latest rutgers/eagleton poll shows that 54% of new jersey voters would not describe governor christie as presidential. 29% say he somewhat fits that description. 14% say he fits it very well. about half those polled did say that christie is smart but more than half also see him as arrogant. the poll was taken just before christie qualified for the first gop debate. and then there's also this from decision 2016. donald trump says he deserves an apology. the republican presidential candidate continues to stand firm against what he believes were unfair questions during last week's gop debate. over the weekend, trump fired off a barrage of complaints against fox news moderator megyç kelly. yesterday, trump continued to hold his ground. >> she shoulding apologizing to

me, you want to know the truth. >> trump said he didn't like the debate questions including the one that brought up his use of insults towards women. yesterday, democratic white house front-runner hillary clinton condemned trump for his comments but said he's not the only problem. >> while what donald trump said about megyn kelly is outrageous, what the rest of the republicans are saying about all women is also outrageous. they brag about -- >> clinton says she's looking forward to debating her democratic rivals. the first democratic debate is in october. 4:17. today pennsylvania's governor tom wolf will be in norristown, montgomery county to stress the importance of balancing the state budget. the governor is hosting a roundtable discussion at the montgomery county courthouse. now, the state has been operating without a budget for the past six weeks. wolf says it's time to straighten out the state's finances without gimmicks and bipartisan bickering. we have dramatic new video in here showing floodwaters

transforming a street in colorado into a raging river. here you go. those floodwaters swept away everything in its path, including several parked cars. a viewer shot this video from a colorado springs neighborhood. that's hail you see coming down there. there goes a few of the parked vehicles there. my goodness. there the hail on the driveway. this morning, the national weather service is advising people to move to higher ground. good advice. now your nbc 10 first alert weather with meteorologist bill henley. >> windy and wet this morning, the rain is coming down at 4:18. the temperatures are running warmer this morning. the humidity is higher. clouds in place, we're in the 70s to start with. look at the breeze blowing atop the aramark building. steady rainfall in philadelphia at 72 degrees. showers extend across 95.

you can see south philadelphia getting a soaking to start with. there will be breaks in the rainfall. this line of showers is on the move. it's already cleared wilmington, moving through philadelphia and heading toward trenton. we'll be on the lookout for some of these, scattered pop-up showers and possibly thunderstorms during the day. still a few scattered, lighter showers as the heavier rain has moved into south jersey. middletown getting a break. clouds will be here for most of the day. we'll get breaks in the clouds, get sunshine warm into the 80s. that heat could fuel late-day storms today. the storms already in western pennsylvania. the forecast is calling for a damp start. a chance of some scattered thunderstorms, mostly it's going to be rain to start with and then by midmorning it will start to taper off at noontime, 77 degrees. the weekend, look at that, sunshine, nice and bright for saturday and sunday, no sign of any wet weather. and before we get to the heat, temperatures in the 90s this weekend, got some really sweet

weather ahead. the seven-day forecast in the next half hour. >> that's what we like to hear. thank you, bill, good stuff. 20 minutes after 4:00. hopefully the outlook for the morning drive will be as nice as the early weekend forecast. we've already had an accident on the schuylkill expressway. jessica boyington is back with that. jessica? >> still tieing things up on the schuylkill expressway due to this accident. it's from our cameras around south street. the accident is taking place around university avenue. you can actually see on the westbound side all lanes completely blocked, tractor-trailer involved. another vehicle involved right there. all lanes blocked on the westbound side. we also have police activity on the eastbound side taking out a lane. quite a backup behind that already with rain falling on the scene. a little bit of aç mess out there. we'll have an update coming up in the next ten minutes or so. heading out the door on to 202. 11 minutes if you're heading northbound or southbound. rain actively falling from 30 up towards the schuylkill, no problems there. also an accident scene watching that out in abington, edge hill

road and tyson avenue. mass transit, currently in problems or delays. the idea of rail service in the lehigh valley is picking up steam again. the mayors of allentown, bethlehem, easton and phillipsburg are pushing that idea. they criticized a 2010 study that found rail service in the area would not be profitable. the head of the lehigh valley planning commission is the rail plan is in early stages and would take years to establish. the eagles return to training camp practice today knowing they have another hole to fill in the secondary because of injury. rookie cornerback ja jacorey shepherd is out with a torn acl. the eagles were hoping that shepherd would fill boykin's spot. now that's not an option. we'll be watching to see what chip kelly decides to do. nbc 10 is your official television station of the philadelphia eagles. we're now just five days away

governor jack markell will sign into law two new laws created to protect animals. one will give first responder the right to remove a pet left in a vehicle if they fear for the pet's safety. once signed into law today, a dog that attacks a cat on its owner's property will be taken for evaluation. and from our trenton bureau, new jersey will begin deciding whether to help pay for new rail tunnels beneath the hudson river used by amtrak and new jersey transit. governor chris christie and senator corey booker are set to discuss the proposed project with the u.s. transportation secretary. the tunnels linking north jersey

and new york city date back more than a century. officials say aging infrastructure and damage from hurricane sandy are causing major train delays. yesterday, the federal government said it would pick up most of the tab for the $14 billion project. >> i learn for the first time that the federal government is willing to put up 80% of the funding. >> now, a state and railroad fund would pay for the rest of the project. even with the deal, the new tunnels would not be ready to go for about a dozen years or so. another shark is lurking in the waters along the jersey shore. its every move is being tracked by researchers. meet elias, a 100-pound hammer head. he surfaced less than three miles off the shore in belmar, monmouth county. a 7 foot male has been swimming in the waters between lovellette
