>> first our top story. new this is morning that hillary clinton reversed course and turned over her personal e-mail server. federal investigators looking into whether it contains classified information. while jeb bush goes on the attack blasting clinton's time as secretary of state and laying the rise of isis at her feet. we've got it covered this morning starting with andrea mitchell on this e-mail controversy. good morning to you. >> reporter: good morning, savannah. more controversy for hillary clinton today. despite her repeated past denials the intelligence community's inspector general says two of her e-mails should have been classified top secret, the highest level of u.s. intelligence as the fbi finally gets control of the private server. hillary clinton in new hampshire tuesday as aides confirm she turned over her private server to the fbi. in addition her attorney david kendall gave the fbi two thumb drives containing her e-mails. this as the intelligence

community watchdog contradicted clinton's repeated claim that nothing on the private e-mails was cla was classified. >> i did not e-mail any classified material to anyone on my e-mail. there is no classified material. >> reporter: clinton said there were no classified markings on any of her e-mails. >> i am confident i never sent nor received any information that was classified at the time it was sent and received. >> reporter: the inspector general has told congress two of clinton's e-mails should have been classified top secret with code words indicating electronic eaves dropping from satellites, so sensitive it could not be shared with foreign allies. raising serious questions about the security of the private system, set up in her home. >> a server at a house probably wouldn't have the security monitoring you would expect at a fwo government facility where you have cameras and staff watching the systems around the clock.

>> reporter: the controversy has been a huge distraction for clinton's campaign and fodder for republicans. >> it's sad to think but probably the russian and chinese government know more about hillary clinton's e-mail server than members of the united states congress. >> reporter: clinton said she deleted more than 30,000 of the e-mails from the private server that were purely personal, she said, before turning them over. thousands more to the state department. now the fbi could recover the deleted e-mails. in any case this is a controversy that's not going away any time soon. matt and savannah? >> all right, andrea mitchell in washington, thank you. >> in the meantime, clinton's biggest republican rivals in the presidential race are taking direct aim at her this morning. nbc's kristen welker has that part of the story for us. kristen, good morning. >> reporter: matt, good morning to you. for jeb bush and donald trump tuesday was aimed not only at laying out policies and attackiattack ing hillary clinton but looking

at theirs head on. >> president of the united states donald j. trump. >> reporter: trump flexed his muscles in michigan. >> she'll make a beautiful fist lady. >> reporter: and declared a truce with fox news. >> i think i won the debate. i don't think i was treated fairly. these are minor details. >> reporter: when asked to respond to hillary clinton who called his remarks about megyn kelly offensive. adding nothing is off the table including bill clinton's scandals with women. >> he would have had a much different presidency without monica and all the things that happened. >> reporter: at the reagan library in california a different attack against the democratic frontrunner. >> she was secretary of state for four years but it is a failed record. >> reporter: in his first major

foreign policy speech bush blamed the rise of isis on president obama and by extension his former secretary of state. >> isis grew while the u.s. disengaged and i ignored the threat. where was secretary of state clinton in this. >> reporter: the strategy is a risk for bush whose brother started the iraq war and who struggled to articulate his own iraq policy. on tuesday, bush got specific, calling for more support for the iraqi military, ousting the syrian president and a change in leadership here. >> the president and secretary clinton, the storied team of rivals took office. so eager to be the history-makers, they failed to be the peace-makers. >> reporter: the clinton campaign called bush's speech a bold attempt to rewrite history arguing isis is the result in part of former president george w. bush's decision to invade iraq in the first place. a poll shows bernie sanders leads clinton 44% to 37% among

likely democratic primary voters although it is a small poll it's the first time he's over taken her in that key state. savannah? >> kristen welker, thank you very much. a lot of political developments. now to mark halpern, good morning to you. >> good morning. >> let's start with the e-mail controversy. you have hillary clinton's e-mail server in the hands of a federal investigator. if nothing else it will follow her into the fall campaign. >> politics can be fun and exciting and important. this is important. it's august of 2015. between the poll with sanders and this e-mail development the clinton campaign is in a tough position. they could find more secret information. they could recover her personal e-mails they deleted. what if they do that and find either more secret information or government information she didn't hand over? this is peril for her. she's now sworn under oath she's handed over everything she was supposed to. >> potentially a legal problem. >> and just the political

problem will linger. >> let me ask you about the poll. it is a small sample size, but what a headline. bernie sanders beating her in new hampshire. >> and the trend has been in that direction. he's gotten closer and closer, drawing tens of thousands of people, big crowds. his authenticity and heart showing identification with the democratic base. she's in pressure in new hampshire which, remember, in 2008 was her best state. it is also a strong state for sanders. she has to fight to beat him. >> jeb bush now on the attack. a lot of his supporters wanted him to do that. interesting he chose to take on her foreign policy, specifically the rise of isis and by extension iraq policy. >> he goes to the reagan library and goes to his biggest weakness, association with his brother and the unpopular iraq war. he needs to prove to republicans he can take on hillary clinton in areas like iraq that are bush family weaknesses. he was good last night. he's fighting for his life, too. he's declined in the polls since the debate.

he needs to fight like hillary clinton, the legacy candidates. >> who won -- trump versus fox news? >> trump. hard to beat fox news as a republican. trump did it with confidence. >> good to see you very much. >> another story breaking overnight, a u.s. black hawk chopper makes a hard landing off the coast of japan that injured several on board. jim miklaszewski is at the pentagon. good morning to you. >> reporter: good morning to you. it was a scare this morning when it was reported that a u.s. military black hawk helicopter crashed into the ocean off okinawa. instead, the military now says this helicopter with seven people on board made a hard landing on a u.s. navy supply ship off the coast of okinawa. now all seven of those military individuals have been flown ashore for treatment. i would like to dispute the call that this was a hard landing. this, if you look at the video, was a crash.

a hard landing is when a helicopter is approaching a ship and rough seas suddenly push the deck of the ship upward into the helicopter. that's a hard landing. this helicopter didn't land on any kind of platform. it appears to have had perhaps some kind of mechanical tiff cull -- difficulty and landed forward amidst some cargo. this was an emergency landing that ended in a crash. luckily, nobody was seriously hurt according to the reports we are getting, matt. >> thank you very much. jim miklaszewski at the pentagon this morning. now new fallout tied to the brazen escape from a new york prison by two convicted murderers. now the question -- did officers cross the line with other inmates trying to track down the fugitives and find out how they got out? craig melvin has the story. good morning. >> reporter: good morning to you. according to new information from the "new york times" inmates claim it was within hours after the prison break

they were beaten, choked, slammed against walls by guards in a frantic search for information. the "new york times" calls it a campaign of retribution following the three-week man hunt for richard matt and david sweat the times reports prison guards abused dozens of inmates looking for information about the escape. the times quoting two inmates who worked in the prison tailor shop. one said a guard tied a plastic bag around his neck, tightening it, until he passed out. the other inmate who supervised the tailor shop said corrections officers put him in solitary for three weeks and threw out most of his belongings including his wedding ring and family photographs. following the escape more than 60 prisoners filed complaints with an organization that helps indigent prisoners. >> the amount of complaints we have received lately and the descriptions that we are hearing about tensions within the prison, in particular in

clinton, it's very concerning. >> reporter: the prison came under fire following the escape. some say the relationship between prisoners and prison workers was too friendly. former prison tailor shop worker joyce mitchell pled to aiding the fugitives. any findings of misconduct or abuse against inmates will be punished to the full extent of the law. according to the times one inmate said after being beaten during interfwags he was pressured to sign a report stating, quote, i was not assaulted. left with no other choice, he wrote, i signed. >> if what they say is true and things did happen that they say, why. why was it handled this way? >> cassidy told us many prisoners making claims of abuse feel they are blamed for what happened. he added it is important for

prisoners to have a voice and the ability to file grievances. he said the fact that some may have been denied the right is a concern. we should also note here that so far the only folks accused of wrongdoing are the corrections officers. none of the inmates have been charged so far. >> it will be interesting to see the inspector general's report when it comes out. >> indeed. >> thank you very much. >> now to new developments on the toxic spill in colorado. >> good morning, everyone. signs of progress this morning in the cleanup of the massive spill that sent millions of gallons of mining waste into a colorado river. long-term questions remain. miguel alma gar is in colorado. >> we now know some 300 miles of the animas river were soiled with pollutants. the governor says the ph levels in the river have returned to normal. this as in neighboring new

mexico they continue to warn residents not to bathe, drink or cook with the water. the attorney generals from utah, colorado and new mexico will also come down to tour the river to talk about possible litigation. this as the epa director comes here to colorado to tour the river. the epa saying the long-term impacts will have to be measured for years to realize the true results of the spill. natalie? >> thank you. a young mississippi couple charged with attempting to join isis will remain behind bars without bail. the newlyweds were arrested at a mississippi airport with tickets to take them to istanbul. on tuesday a magistrate said though the pair have never been in trouble with the law she believes their desire to commit terrorism is probably still there. surveillance video shows the man arrested sunday night in an officer-involved shooting in ferguson, missouri. police say the man in the video is 18-year-old tyrone harris.

you can see someone take a handgun from his waistband and running toward the street. police say harris fired at least once at the officer's vehicle. they returned fire critically wounding the shooter. they reduced the video to counter claim that harris didn't have a fwun. a runway at orlando international airport had to be shut down tuesday night after a southwest jet went off the runway. no passengers were on board at the time. the boeing 737 was moved from one hangar to another for maintenance. it went off the runway and the nose gear collapsed making the aircraft immobile. ale wild story from the nfl. new york jets startsing quarterback will be out six to ten weeks after an altercation inside the jets' locker room. geno smith's jaw was broken when he was reportedly sucker punched by a teammate. the reserve linebacker was released by the jets shortly

after the altercation. espn is reporting the dispute was all about a $600 plane ticket. smith will need surgery and will be out until at least october. now back to the massive great white shark video at the top of the show. take a look. it's at least 20 feet long. the biggest shark ever filmed. the clip was released on facebook monday by researchers involved in the project. the footage was taken in 2013 near guadeloupe island. the female shark is known as deep blue. she's believed to be about 50 years old, possibly pregnant at the time. does that make her more hungry as she eyes the cage? definitely going to need a bigger cage. >> those fish are so brave. >> she can't move fast enough to get them. she's massive. >> huge. >> she doesn't have to move that fast. just faster than you. >> wow. >> by the way, we are going to show you interesting stuff out of arizona.

take a look at this haboob. this thing coming yesterday into the airport. my gosh. it engulfs the airport. flights theyed. some did take off. in fact, caused big problems for air quality. also for traffic. look at this massive thing. lightning coming out. show you what causes this. we had a big storm system approaching phoenix. as it approaches the area it grew. it produced down bursts and outflow winds coming out of that. as it happened the outflow picks up dirt and sand, turned it into a cloud and pushes it into phoenix. speaking of arizona we have amazing video. look at this lightning display. how unbelievable is that? that's last night over phoenix. we'll slow it down and watch. man, an epic display of

ordered her children back to europe where her ex-husband, german businessman daniel giersch, has raised them since 2012. she kept her kids four days past a european court deadline to put them on a plane back to their father. 8le-year-old hermes and his 6-year-old sister helena weren't with rutherford at the courthouse. another messy chapter in the long custody dispute. when rutherford and her ex lived in the u.s. they had joint custody. after giersch's visa was revoked in 2012 a court ruled the children should temporarily live with him in monaco. rutherford's attorney argued three years isn't temporary. since the children are u.s. citizens they have a fundamental right to live in their own country. earlier this year a judge in monaco allowed the hirn to spend the summer with rutherford in the u.s. after she refused to send them back giersch called it kidnapping. his lawyer saying he's pleased

that the american judicial system has prevailed adding giersch's stance of promoting kelly's time with the children has not changed. let us bring in lisa green, author of "on your case." good to see you. >> good morning. >> kelly rutherford held the children in this country days after the deadline to send them back. yesterday they did get on a plane with their grandmother. did she have another choice? >> really not. it didn't help her case to disobey what a court ordered. doesn't matter if you are a judge in new york, california or monaco. no judge likes it when someone takes the law into their own hands. >> she may have hurt her future ability to see the children. >> yes. she has a worldwide reputation as someone who doesn't listen to judges and judges loathe that. >> what about rutherford's lawyer's assertion that these are american children and they cannot be forced to live outside this country? does that hold up? >> totally sympathetic argument n. the law that doesn't matter as much as you might think.

in international custody cases what matters is where the kids are resident. the kids are going to school. they have friends. they are bilingual. every passing day is better for dad. >> the couple lived in the united states. then the father's visa was revoked. interesting to note he has not reapplied for a new visa. can he be compelled to do so to bring the family closer together? >> in a way kelly's biggest legal mistake was getting in the moving van and out of california. the california court which issued the order said we have no connection to this family. if no one can enforce the order why would the father go ahead? >> we asked where the battle goes from here. it goes to monaco. september 3, i think, there is another hearing. the kids will be back there. they will start school. they will become entrenched in their schedules. does it become harder for a judge to uproot them? >> especially in monaco. there is a home court advantage for the father. no one is alleging he's a bad

service contracts. beware, the move comes with a catch. >> can you hear me now? >> reporter: remember this commercial? now hear this. verizon is ditching all of its annual cell phone contracts. no more confusing payment plans. no more being stuck for the life of the contract. no more free phones. wait. hold the phone. that's the catch. in return for the freedom of being unchained from verizon, you are free to buy any smartphone you like, at full price. before now you could sign a contract with verizon and get an iphone 6 for $200. you can still get one for the retail price of $649. analysts say you were never really getting a discount, just paying off the phone over the length of the contract. with the new plan you can still do that. but you also have to pay an access fee for the network. t-mobile has been using the model for a while.

70s climbing into the middle 70s in philadelphia international just updated to 75 degrees, 72 trenton, 68 in coatesville, and 70 in roxborough. warming process has begun. we will be in the 80s this afternoon with bright sunny skies. >> new from overnight a barrage of gunfire sends two men to the hospital and narrowly misses a breg nant woman. this happened on 30th street in the grays ferry section of philadelphia. police say two men in their 20s were sitting on the front porch when the gunman unloaded firing two dozen bullets at the house. both men were hit multiple times. they're in stable condition. the bullets just missed the victim's sister who is 6 months pregnant. another woman sleeping inside. more violence in east germantown neighborhood. police tell us someone shot three people, two men and a woman, on crowson street. police are still searching for the gunmen in both shootings. democrats scored a win in yesterday's special election for

taking a look at the headlines, complaints from airline passengers are soaring this year according to the department of transportation complaints about delayed flights, missed connections and lost luggage jumped more than 20% in the first half of the year compared to the same time a year ago. american, united and spirit airlines had the most complaints. at the same time on-time arrivals improved for the nation's biggest airlines. about 75% on time in june compared to 72% last year. a new study is suggesting that uber may be reducing trunk driving deaths. researchers looked at alcohol-related deaths on california roads and found death rates trapped as much as 5.5% in areas covered by uber-x.

trans-fats are linked to an increased risk of heart disease. looking at data from 50 studies, researchers found trans-fats in margarine and snack foods were linked to a 21% higher risk of heart disease and a 34% increase in risk of death from any cause. they found no extra cardiovascular risk from saturated fats from things like butter and milk. experts say rather than eating lots of saturated fats it is best to look for healthier alternatives. your car one day may help you navigate traffic lights on city streets. bmw is working with an oregon tech company on a way to alert drivers when the next traffic light will turn red or green and suggests the best speed to drive before the light changes. it uses the enlighten app already available for smartphones. the bmw system would display on the instrument panel and in the future may warn you if you are about to run a red light. if you are headed to the beach any time soon this video

down. that's dry air that's coming in. as the temperature goes up 74 in cape may, 77 in philadelphia. we will warm into the lower 80s today. >> well if your daily drive includes one of two area bridges get ready to pay more to cross the delaware. commissioner are voting on that issue tonight but looks like it will pass. the burlington county bridge commission will likely raise tolls for the tacony palmyra and burlington briston bridges. tolls would double from 2 to $4 for cash paying drivers and easy pay drivers would pay $3. officials say revenue will pay for safety improvements on the bridges. if approved the tolls would take affect september 15th. the pope not the only religious packing his bags for philadelphia. the dalai lama tickets go on sale. the tibetan leader will be here and appearing at two events you can see him one at lasalle university, one at temple university. you can check out the nbc 10 news app for information on the
