nbc 10 breaking news. >> car slams into a group of children walking on the street tonight. just moments ago, we learned one of them has died. >> nbc 10's reporter just arrive at scene, denise, what can you tell us? >> reporter: well, jacqueline and jim, we just confirmed through state police that has a young child, maybe three or four years of age was killed in this crash. police have shut down budtown road and are keeping us at a distance. i ran into family members, three children and an 18-year-old were struck. sky 4 10 over the road in burlington county, you can see the debris in the center of the

road, it happened around 8:30 tonight. emergency crews had the scene of the crash surrounded and the road closed. several medical helicopters were flown in to air lift those hurt. it appears the car involved did stay at the scene. family members gathered nearby, were rushing to the hospital. they told me four members of their family were hit, including three children, one as young as four years of anyone, and an 18-year-old. all four were taken to cooper medical center, two are in critical condition, and just learned late tonight that a three or four-year-old had died in this crash. live in burlington county, nbc 10 news. developing news involving former subswai sandwich spokesperson jared fogle. he is preparing to pled guilty in connection to a child pornography case. according to our affiliate, a source says fogle's legal team may have struck a deal. he is under investigation following a raid at his indiana home six weeks ago.

months before, the executive director was arrested on child porn charges. the source says the plea deal may include only conspiracy charges. the reports and announcement will be made tomorrow. subway suspended the relationship after the raid. the search for rosie o'donnell's missing daughter ended in ocean county today. we have new video from the show, 17-year-old chelsea o'donnell hopping into an suv at the township police department. officers say they found her at a nearby house. it's unclear the relationship she had with the people who lived there. chelsea o'donnell was last seen leaving her family's home north of new york a week ago. authorities say she suffers from mental illness. a spokesperson learned that chel sifs located, but the spokesperson did not offer details about where the teen had been or who found her. new at 11:00, south jersey hospital is turning away ambulances tonight. a spokesperson for kennedy

university hospital tells us that's because they are testing a patient for malaria, we were above the scene after 9:00 tonight. health workers were wearing protective gear outside the hospital tonight. turning to weather, a nice evening to be outside. nbc 10 on south street where people before enjoying the night. >> but tomorrow, our heat wave continues. and there's also a possibility of storms. let's get the details from our meteorologist. >> yeah, jacqueline and jim, the heat wave continued today, and we expect it to be borderline continuing as we go into tomorrow. average high temperatures actually 85 degrees over this past weekend we were in the 90s, yesterday we were in the 90s, today we hit 92 degrees. so the heat wave still going on. and tomorrow, we could be borderline still in the heat wave, still around 90 degrees, but then we get some relief. it'll come in the form of rain as well. thursday and friday, we expect

temperatures to be dropping out of that heat wave closer to where they should be this time of the year. through the overnight, we stay warm and humid by tomorrow morning, we could be dealing with patchy fog. more clouds move in for the morning commute, 7:00 a.m., temperatures in the 70s and patchy fog possible. and i think around the morning commute time we could also have some showers starting to develop. this is noon tomorrow, but even before that, we could have rain around for part of the area for the morning commute and more thunderstorm chances before the week's over. coming up, we'll look at that and also a new tropical storm in the atlantic. that's straight ahead. kathleen kane is expected to relie release e-mails. that's according to a lawyer. this comes after the state's supreme court unsealed a pair of documents related to the scandal today. the attorney said the documents are critical to proving she is

innocent of perjury, obstruction, and other charges. a ten-year-old boy shot in the head, and tonight wilmington police have a man in custody, but the investigation is not over. >> they're still trying to figure out what led to the shooting and whether it was intentional. nbc 10 reports. >> reporter: by the time wilmington police left the crime tape behind, they had arrested a 24-year-old man and charged him with keeping a gun he wasn't supposed to have that injured his girlfriend's ten-year-old son. >> great kid, athletic, go-getter, a fighter, never liked to lose. so he's going to fight through it. ♪ >> reporter: they all knew the boy had made it through surgery for a bullet wound to his head. >> oh my gosh, this really touches our heart more because it is a child. a ten-year-old. >> reporter: overnight, crime scene detectives photographed and dusted for prints, not sure whether the shooting was accidental or deliberate.

>> the guns in our community are far too many as we all know. >> god bless these babies, father god. >> reporter: in their prayers, they hoped for a lesson. >> parents, get involved with your children. know what's going on. know where they are at all times. >> reporter: in wilmington, delaware, nbc 10 news. not guilty. that's the plea tonight for congressman chaka fattah since he was indicted. the indictment alleges the congressman misused campaign money and tax payer dollars, the congressman told a judge today, he is innocent, and he told reporters he will fight the charges. >> i fully expect that when we vet these allegations, that we're going to get to a point in which they will no longer represent any cloud on my very good reputation. >> to fattah's associated face a

judge today. robert brand and karen nicholas. they pleaded not guilty. so have bonnie and herbert who are also facing charges in this case. the congress sman married to nbc 10 anchor renée fattah. she is labeled as person e and an affiliate of the enterprise. the feds allege she took part in a scheme to fraudulently sell a car in order to play closie ini costs on a vacation home. renée is on leave from nbc 10. a 14-year-old boy shot by police earlier this month is now facing charges. investigators announced aggravated assault and gun charnls against the teenager today. witnesses say he pointed a gun at officers as they chased him back. state trooper and county sheriff's office shot the boy seven times. the incident led to protests. attorney general's office is

investigating. police they man walked off with four bikes that didn't belong to him. here he is with two of them. cameras capturing the theft august 8th at one market street. the man is walking down the street with the hot wheels. call police if you recognize him. notice no decision just yet. nbc 10 and east norton far zoning board decided to postpone a vote to decide whether a domestic violence shelter can move into the community. that was pushed back to december. it would relocate frb east norton next to st. titus church. some neighbors oppose it, claiming it'll reduce property values. the shelter needs an updated facility with more space. preparing for a visit from pope francis. today, a new school year began at the seminary in montgomery continue, and the new class of seminarians will be among those getting to see pope francis up

♪ my country tis of thieve >> that is marion anderson performing back in 1939, and tonight, nbc 10 has learned the philadelphia church that helped launch her singing career will soon be demolished. the former union baptist church in the section is where anderson first performed as a young teenager. the developer is expected to tear down the church to build townhouses at that site. tonight, authorities at the jersey shore are trying to find out how a two-year-old girl slipped out of her family's house before drowning in their neighbor's pool. the family's tempers flared when nbc 10 arrived at their home today. >> how did she get in the pool? prosecutors say police found the

girl floating in the pool soon after she was reported missing last night. berkeley township ocean county, sources tell nbc 10 say investigators found evidence of heroin and marijuana inside the home. >> supervise your children at all times, take measures to make sure that a child that age isn't able to leave the residence without you knowing it. >> sources say both parents could face charges, as could their neighbor because the toddler was able to gain access to the pool. no one answered the door at the neighbor's home when we went there earlier today. new at 11:00, it was once called the best chinese restaurant in the country, but tonight, an eatery on the mainline is closed after customers found roaches crawling on their plates. the investigation centers on yangming, the restaurant is telling its side of the story. >> reporter: the sign outside the restaurant says closed for renovation, but the official

fine print points to an infestati infestation. customers looking forward had to look elsewhere tonight. >> i have never seen anything ic there that wasn't clean as a whistle. >> reporter: health officials shut down the restaurant after police say a patron found a roach in her noodles last friday, not once, but twice. that apparently led to a dispute between the customer and management, management called the cops who got quite the eyeful when they walked in. >> when the officers walked in there, there were roaches in plain site. >> reporter: once named america's top chinese restaurant, it is now ordered to understood go a top to bottom cleaning. >> it was pretty, pretty dirty. and we need to get that cleaned up and sanitized so that we can get them back reopened. >> reporter: the manager says they've identified the problem which he says did not exist when the restaurant passed inspection july 29th. the roaches called in through a damaged vent in the kitchen, and they're not dishing out $12,000 to make repairs. >> we're concerned about the

but then those storm chances, those keep going mostly as we go into thursday and especially through part of the day on friday. so show you the timing in just a minute, we're also watching the tropics, its been a quiet hurricane season, but now we have a new named storm, it's still very far away, but it is in the atlantic, and does look to be intensifying too. i'll show you that as well. here's the 8:00 temperatures tomorrow morning, mostly in the mid-70s by 8:00 a.m. mostly cloudy skies, 73 in allentown, there's a chance some could see scattered showers by then. 67 for philadelphia, upper 70s for much of new jersey. 75 degrees for your 8:00 temperature in wilmington. local we're nice and dry, we've been seeing clouds through the evening hours, but that's really about it. we'll stay dry for most of the overnight hours and early tomorrow, again a few showers, what you see back off around chicago, that'll start to move in as we go mainly from thursday into friday, but until then, that humidity is going to stay

up. now here's a look at the tropical storm i was talking about. this is far out in the atlantic. so the cape verde islands off the coast of africa, this is west of that. it's very far away. it's tropical storm danny. now it has been gaining strength through the day today. earlier this afternoon, it was a tropical depression, then a tropical storm, and the winds inside this storm have actually increased to 50 miles an hour. so it is getting stronger. it's moving to the west, northwest at 14 miles per hour, it is heading towards the caribbean. that's where we expect it to keep traveling, models are in agreement with that too, here's the official track by saturday, it'll continue on the same path by sunday, approaching the lesser antilles, possibly on its way into the caribbean, and could be stronger at about a category 2. so by is this time, it'll still be very far away from the united states, but of course, we'll keep monitoring it with any updates that will be coming in. for us though in the meantime, we're looking at a pretty decent

overnight hour period tonight. by 7:00 tomorrow morning, we could be seeing patchy fog around, then scattered showers, start to move through. 2:00 in the afternoon, we could see some scattered showers or thunderstorms. most of that could be west of philadelphia, but by thursday, pretty much the same weather pattern, those clouds continue, still a chance of scattered showers. then we go into friday, and that's when we have a better chance of that heavier rain, so there you see it through friday afternoon, you definitely to want have your umbrella around for that. when it leaves though, humidity drops off big time and we'll have a much more comfortable start to your weekend, so just in time. tonight, warm and humid, patchy fog late tonight, 74 nor the low, upper 60s north and west. thunderstorms around, temperatures still around 90 degrees. humidity is going to stick around for the rest of the week, even though the temperatures will be in the mid-80s, but until we get to about saturday, we're going to keep that in the forecast, a lot of moisture starting to move in, but for saturday though, just this time for the eagles, we have low

humidity, we have more sunshine, we have temperatures getting us out of the heat wave. so that's the good thing. especially as we go into sunday too. so, the further we can look looks good and thursday and friday, breaking out of the heat wave. >> will be nice in the evening, less humidity. >> it'll feel better, that's for sure. >> than last week, yeah. >> oh yeah. >> thanks. traffic stop was just the start of a real roadside emergency in seattle. >> yeah, instead of delivering a ticket, officers helped deliver a baby. >> it's coming out. this baby's coming out! >> police pulled over the driver for speeding and running red lights, but they had a good reason. that's when the driver announced his wife was in labor. officers radioed for an ambulance, the baby was born right there on the side of the road. the girl gave a cry, then began struggling to breathe. >> she's not breathing, please help me. please help me, she needs to get

it out of her mouth. >> i know, i know. >> the officer did help the mother clear the baby's airway, got her breathing again. the ambulance finally arrived and look at this, family was taken to the hospital, everything worked out well. beautiful picture of i assume dad and the baby. everybody's doing fine. >> great picture. >> yeah, amazing story there. now why chase utley could be staying with the phillies, how long will mike be out? maybe good news after surgery. the eagles start practicing against the ravens tomorrow. could this happen? brawl at cowboys camp, that's next.
