ruling against the congressman. investigators can now look through seven years of fattah's personal account. fattah also used the account for work. it's something congressmen are permitted to do. the judge didn't agree with fattah when it came to who can read the e-mails, ruling it should be lawyers who aren't associated with the criminal case. the democratic congressman is accused of misusing his congressional influence and stealing taxpayer money and charitable donations. h he is also accused of taking a bribe from a lobbyist who wanted to be an ambassador. fattah denies all charges. congressman fattah is married to nbc 10 anchor renee chenault-fattah. renee is referenced in the criminal complaint, labeled as person e, and quote, an affiliate of the fattah enterprise. the feds allege she took part in a scheme to fraudulently sell a car in order to pay closing costs on a vacation home. renee is not charged and denies any wrongdoing.

renee is on leave from nbc 10. turning to weather and the holidays. lots of people getting an early start on the labor day holiday weekend. nbc 10 is at the jersey shore and delaware beaches this summer's last hurrah getting underway. here's a look at camel beach water park where people are trying to cool off. relief ois on the way. so's the chance of rain. a much different picture, the schuykill expressway, not as relaxing this afternoon as people start to head out of town. many people do have tomorrow off so the long weekend starts tonight. >> we have live nbc 10 team coverage at the shore, in philadelphia, where it will be a musical weekend and in the nbc 10 first alert weather center where sheena parveen is tracking changes. let's begin with nbc 10's drew smith live on the ocean city boardwalk. that will be a popular spot. >> reporter: yeah. if you needed any incentive to

get here early, how about this weather. feels more like the middle of summer than the end of it. a lot of people on the beach said it was perfect out there, the water just right. it wasn't even crowded though they expect that to change in a big way tomorrow. some families are calling this a bonus week of summer. >> the water temp's beautiful this time of year. >> reporter: with labor day falling later this year. >> we were going to take advantage of the fact we hoped the crowds would lessen a bit. we were thrilled. >> reporter: some parts of the beach were closed in ventnor city because lifeguards began heading home or back to school last week. in ocean city, this boat came back early today. the back-to-school factor causing a midweek dip in business. >> been slow now. no different for me. i didn't really count on this week being that busy because kids are going back to school. >> reporter: joel richards says he already knows this holiday weekend will be big. it caps off a season which he credits as busier and better than the last two summers.

>> maybe the gas lower, the weather has a lot to do with it. >> right now, three best things about being a local on new jersey beaches, september, september, september. >> reporter: rocco is here year-round and says this late labor day probably won't discourage crowds because the weather is so nice. >> we got beautiful days like this, where else would you be? it's great. after that, mine. all mine. >> reporter: if you were hoping last minute to find a place to stay you may be out of luck. we called around to realty offices and hotels. they are booked solid. i'm drew smith, nbc 10 news. in delaware, the town of lewes got ready for the holiday weekend. the great weather had people out and about in the main shopping district, leaving the beach to others. several businesses tell us sales are up as we edge closer and closer to the start of a long weekend. so what about the weather? >> first alert meteorologist sheena parveen is tracking the chance of showers and relief from this heat.

>> yeah, we are tracking relief from the heat. first it will come with the rain but i think it is pretty welcome at this point. take a look at how the week has really shaped up. we are still in the heat wave. temperatures right now in the mid 90s. for the past few days we have been ten degrees above average which is now 82 degrees. if you are starting your labor day weekend tomorrow, you will be seeing a bit of a break from this heat. temperatures more like the 80s because we do have rain in the forecast. i don't think this will be for everybody but some rain in the forecast will cause temperatures to not get as hot as we go into your friday. so the temperatures will be mostly in the 80s as we see rain moving through and the rain mostly starting in the middle of the day. so we will see that move in. we could have a couple thunderstorms, too. then we go into the weekend and conditions really start to change. we will take a look at that forecast coming up. if you are hitting the roads, there will be a welcome sight at the gas station when you fill up. >> that's right. gas prices are dropping.

some drivers could see them under the $2 mark. imagine that. nbc 10 found gas at $1.97 for a gallon of regular at this gas station in woodbury. the national average could drop as low as $2.44 a gallon. that would be the lowest since 2004. let's check xwgas prices in our area. the average is $2.40 right now. in delaware, $2.29. in south jersey, $2.22. philadelphia will be a top destination for thousands of music fans this weekend. >> it will be packed. the made in america festival starts saturday. here's a look at the ben franklin parkway, where organizers have been working to set up that concert stage. this weekend's music fest will be the last big event in philadelphia before hope francis comes to town. nbc 10's doug shimell is live with more on security and what is new at the festival this year. >> reporter: of course, beyonce, a tried and true staple of this

your smart phone or tablet. apparently all tom brady does is win. unless he's playing the giants in a super bowl. he's the proud owner of four super bowl rings and now the patriots quarterback is scoring a victory in the courtroom. a u.s. district court judge vacated brady's four game suspension. nfl commissioner roger goodell responded saying the league respectfully disagrees. as of this afternoon, the nfl officially filed a motion with the second circuit u.s. court of appeals. the league claims brady conspired with patriots staff members to lower the air pressure in balls used in last season's afc championship game. brady denies any wrongdoing. fans weighed in on both sides of the issue. >> tom brady should give the super bowl trophies back. super bowl ring back. it's tainted. >> i think he should play. it's a nonsensical issue. all of them take unequal advantages when they can. >> today's decision means brady will be the quarterback when the pats host the steelers for the

headed to jail. a federal judge says kim davis will be locked up until she complies with his order to issue the licenses. davis says her christian faith should exempt her from signing those licenses. french prosecutors are confirming that the piece of airplane wing that washed up on a remote indian ocean island in july is from missing malaysia airlines flight 370. investigators were able to match serial numbers from the wing piece with manufacturer's records. the boeing 777 disappeared in march last year with 239 people on board. now to decision 2016. donald trump is once again making headlines. today the republican presidential candidate pledged that he will not run as an independent if he fails to win the party's nomination. he made that announcement today in front of a packed house at the trump tower in new york city. trump signed a pledge to support the potential republican nominee if he doesn't win the

nomination. but trump is under no legal obligation to abide by the document. trump says he sees no circumstance under which he would break the pledge. >> the question was what did i get for signing the pledge. absolutely nothing other than the assurance that i would be treated fairly and i have seen that over the last two months because they really have been very fair. >> trump has 30% support nationwide among republican voters according to today's monmouth poll. that's his highest rating so far. now to democratic front-runner hillary clinton. her aides are urging a former state department employee who set up her private e-mail server to test before a house investigative panel but the staffer says he will use his constitutional right not to testify. clinton is continuing her campaign despite criticism about her use of a private e-mail server to conduct business during her time as secretary of state. meantime, the chairman of the pennsylvania democratic party is expressing excitement at the possibility of a presidential run from vice president joe biden. if biden joins the democratic

field, he will be closely associated with president obama's policies. he was in south florida today meeting with jewish leaders about the nuclear deal with iran. biden calls the deal less than perfect but says it's needed to keep iran's nuclear program in check. he also says anyone in congress opposing the deal is hurting u.s. foreign policy. one marine is dead and nine others in the hospital after the helicopter they were traveling in made a hard landing at camp lejeune. officials are saying the marines were taking part in a training exercise aboard a helicopter when the accident occurred late yesterday. this is file video of camp lejeune. of the nine hurt, one is in serious condition. we are told eight others will be okay. the cause of that hard landing remains under investigation. back here closer to home, pennsylvania state police are searching for the man they say attacked a schuykill county officer wednesday night. investigators say the officer was assaulted after approaching a disabled vehicle along state

road 309 in west penn township. when officers arrived they found her down an embankment near the road. she suffered non-life threatening injuries. investigators are looking now for a tall heavy-set hispanic man who was driving a dark colored nissan maxima. new information about the first court action in the train derailment. a settlement could be in the works. a judge scheduled settlement talks for this month and next month. residents, business owners and the paulsboro school district are part of a lawsuit against conrail. at issue, a train accident in 2012 where seven freight cars derailed over a bridge and leaked vinyl chloride. breathing in the chemical could cause serious health problems. a memorial vigil is happening later tonight for a southampton township student and teacher who were killed in separate crashes last month. 13-year-old jeniah castlebury

was a student at the school where alison mcgillis taught. the student died from injuries sustained in an accident in early august. mcgillis was killed after being hit by a car. the vigil takes place at 7:00 in an athletic field across from the school. we have be taen talking abo this heat wave all week long. the good news is after today's heat, we will be cooling down tomorrow. we have been about ten degrees above normal for the past few days. that will be changing tomorrow. here is a look at the radar. sunny and hot and dry outside. the humidity's up but the only showers are approaching the poconos. we do have a few showers there. wouldn't be surprised if later this evening we had an isolated shower but most of the area will be staying dry. it's really tomorrow when the rain chances start to go up.

take a look at future weather as we go through the rest of this evening. we still stay warm and humid. then a cold front is approaching from the north. we call this a back door cold front because of the direction it's kind of moving in. normally we see these move in from west to east. this will spark a few showers for friday. we do have some showers in the forecast tomorrow, maybe a couple thunderstorms and the timing of the rain right around the middle of the day, should keep our temperatures mostly in the 80s. that should be breaking us out of the heat wave. either way, the good news is the timing of this will be moving through just in time for your labor day weekend. temperatures right now are still hot. we will see some relief as we go into the weekend. we are in the mid 90s in philadelphia, 96 degrees, 91 right now in allentown and reading. 94 wilmington at the moment. 94 degrees in millville. so it is a hot summer-like day. the average high is actually 82 degrees now. we are more than ten degrees above that across the area. by 6:00 this evening, still in

will run alongside anyone who chooses to walk the bridge. with limited parking, how do you get to the ferry? we asked that question today. officials said they don't know yet. but they hope to know next week. right now, they are encouraging people to take public transit to get there. they are looking into whether people can get dropped off in that vicinity. the river link ferry is running from saturday september 25th through monday, the 28th. with extended hours on saturday and sunday. tickets cost $7 each direction for adults and children. the flourtown farmers market reopened this morning. it's a new location following a fight to stay in business. the market is a unique blend of prepared foods, meat, cheeses, baked goods and produce. it's been operating for 30 years but owners of the old space where the market was located leased the space to someone else, leaving the market without a home. then one man stepped up when he heard about the public outcry from people in flourtown and the surrounding area. >> hearing those stories, it

makes me like really excited to see what the new location can bring. >> he says he recently bought the building on bethlehem pike and needed a tenant so he reached out to the market's operators to bring it back to life. the market is open every thursday, friday and saturday. the popular christmas tradition called lights on the parkway will be a little bit different this year in allentown because of repair work on the parkway. the holiday light show will feature displays at spots throughout the city. renamed allentown lights, it will feature holiday movies, concerts and even free ice skating. it all begins november 28th. this is what thrill seekers can look forward to at six flags great adventure new jersey. keith's not doing that. today the park announced plans to build a 12 story roller coaster named total mayhem. riders will sit in wing seats that rotate during the ride. it's designed to give riders a feeling of weightlessness.

a local family reached out to the nbc 10 investigators after they say a hospital took their dead mother's internal organs against her and their wishes. >> they told investigative reporter mitch blacher they want to know what happened to those organs. mitch, what tdid you find out? >> reporter: s.c. cooper was 85 years old. she was described as a religious woman who wanted to be buried with what god gave her. her children want to know why their mother's organs were taken out of her body against her wishes. >> they took her kidneys, her heart, ever organ she had. >> reporter: her son ed took it hardest. >> they took her brain. that's what upsets me the most. >> reporter: she died at temple university hospital in april.

their children say they were repeatedly asked whether their mother wanted to donate organs. >> four or five occasions they came and asked us do you want to donate the organs. we said no. >> reporter: it was the funeral director who says he discovered cooper's organs weren't there. >> my preparation starting to prepare her body, i noticed that her organs, internal organs were not there. >> reporter: was that surprising to you? >> yes. >> reporter: why? >> typically they are. >> reporter: temple university hospital spokesperson told us he couldn't talk about what happened to cooper because of privacy laws. he did point us to this document. it's a consent to autopsy form which appears to give temple university hospital permission to remove and keep the organs. her son van signed it. >> the first thing they're going to say is he designed that piece of paper. what they're not going to say is the fact that for four or five

hours i told them i didn't want it done. >> reporter: the coopers are suing temple university hospital, asserting temple did not tell them that consenting to an autopsy meant cooper's organs would be disposed of as waste or be used for educational purposes and not returned to her body. the coopers claim this consent form was blank when van cooper signed it. >> the process is restrictions and i never saw that. >> reporter: it says none. >> that wasn't there when i signed it. >> reporter: beyond their issues with the consent form, the coopers want to know what happened to their mother's organs. they say as a devout christian she can "d" ndid not want them removed for any reason. less than 6% of those who die in hospitals have an autopsy. >> in a teaching hospital, they might take more of the whole organs because it's for residents' education and

learning from it so that they're able to know how to do this procedure. >> reporter: the president of the state association, dr. nancy young, said there are medical reasons organs may not be returned to the body after an autopsy. she said it can take weeks to prepare and analyze certain organs. she said that's longer than most families are willing to wait for a funeral. nationally pathologists from the american society of clinical pathology told us that it is rare not to place organs back in the body after an autopsy. for cooper's children, a visit to her grave honors her memory. they say they trying to honor her wishes, too, by finding out why they weren't followed. the coopers are asking for more than $50,000 in damages from temple university hospital, telling us that more than money, they hope the lawsuit helps them find out what happened to the organs. i'm mitch blacher, nbc 10 news. taking a right turn now, we are looking ahead to the labor day holiday weekend.

of the apron which contained the $1500. apple enthusiasts often find it hard to survive without their iphone. mine's right there. >> mine's right here. that's exactly what happened to a college student in california. get this. it saved his life. a fresno area college student's iphone stopped a robber's bullet during a home invasion. the bad guy stole his computer, then shot him on his getaway. but the bullet hit his phone. you can see the bullet completely shattered that phone but the victim escaped injury-free. the victim's roommate who wished to remain anonymous says his friend was shaken up but lucky to be alive. >> he said to me i got mugged and the person who mugged me shot me the leg. he was pointing to his jeans. the jeans were tore open. he showed me his iphone like this. i saw the bullet was really clear on it. >> talk about a great advertisement. the suspect hasn't been caught.

turns out the number of teens taking college entrance exams is up but the scores are going down. a record 1.7 million current college freshmen took the s.a.t.s but fewer than half, about 42%, met the college and career readiness benchmark, an indication of how prepared a student is for a basic college education. s.a.t. scores came down for the fifth year in a row in reading, math and writing. here's how the state breaks down around our area. these are the average test scores from s.a.t. takers from the class of 2015. keep in mind 2400 is a perfect score. new jersey ranks the best in our area with an average of 1520. pennsylvania students averaged 1485. delaware students were the lowest at 1358. when pope francis is in

says the boxes aren't tasteful and the pope isn't into such promotions. he sent the boxes back. the company's marketing director tells nbc 10 they have had positive feedback and had to order more because the boxes are so popular. they aren't making a profit on that design since they already had supplied the boxes, they just have a different look now. she says they were created to be something fun and different from customers. well, it is definitely a scorcher out there today. this is how you cool off. these kids know what to do. nbc 10 was at sister cities park in center city today. we saw a group of children cooling off in the park's fou fountai fountains. that's probably the coolest part of the city to be in. really, anywhere in the area,

unless you're at the shore or a delaware beach. it is nice there, too. we are still in a heat wave, still in the 90s, but we have relief coming from the heat in the form of rain. so showers start to move in tomorrow. the showers will be giving us a break from the heat mostly because of the timing of the rain. should break us out of the heat wave even though in some cases we could be closer to 90 degrees. either way over the weekend, we will see a break from the heat. but the heat returns as we go into labor day monday and for most of next week as well. here's a live look at cape may. a lot of people look like they are already starting their labor day weekend early. i'm sure it will be even more crowded tomorrow. cape may, sunny skies, temperature 84 degrees. the humidity is making it feel like 90 degrees in cape may. it's 90 degrees in pots foutsto. philadelphia still at 96 degrees. the average high is 82 degrees. we are over ten degrees above

that. 94 in wilmington and millville. at least the shore points are getting cooler weather but when you factor in the humidity, still feels closer to 90. locally, nice and dry. the closest showers trying to move into the poconos. just a few near toby hanna and north of carbon county. there's a chance we could see a couple isolated showers later this evening but nothing that should amount. this is future weather. as we get closer to 8:00, 9:00, the models trying to show showers moving in but that's not the rain we are tracking. that's mostly in the middle of the day tomorrow. tomorrow morning, we should be dry for the morning commute. then by about noon, 1:00 p.m., we should already start to see some showers developing, maybe a couple thunderstorms. because of the timing of this, it should help hold the temperatures down. through the afternoon hours, closer to 5:00 p.m., some of the showers start to spread north and west. more clouds around. that will also help hold the temperatures down. then we go into saturday. we really start to clear out.

a lot more sunshine but notice a little farther to the south, parts of delaware, some of the cloud cover for saturday might try to hang on. some lingering showers offshore. if you will be in sussex county on saturday, don't be surprised if you see a couple showers or the clouds still lingering at least to start your saturday. here's the forecast for the shore. and the delaware beaches. we will start with tomorrow, chance of a shower, temperatures in the upper 70s. it will be breezy. breezy for saturday but really clearing up. temperatures around 80 degrees for sunday and labor day monday. low 80s and plenty of sunshine. water temperatures in the mid 70s, too. philadelphia, temperatures mid to upper 80s across the weekend, closer to 90 on monday. the poconos look good, mostly sunny skies with temperatures around 80 degrees through the labor day weekend. tonight, mild and humid, 73 for the low in philadelphia, 67 north and west. tomorrow, chance of showers or thunderstorms. otherwise mostly cloudy. temperatures should stay right below 90 degrees. that should break us out of the
