>> containment lines are holding. each hour that goes by we are making better progress. >> reporter: firefighters say the blaze is not threatening any homes but extremely dry conditions thanks to no measurable rain for at least two weeks have made the battle against this fire especially challenging. >> the bigger dead fuels like logs, large branches, they are completely consuming down to ash so that's pretty dry. it's very labor intensive to put the fire out. it takes a lot longer, a lot more effort, lot more water, lot more man power, lot more equipment. >> reporter: with the dried-out brush so vulnerable to fires, authorities are urging everyone to use extra caution. >> cigarettes out the window is a no-no. it doesn't take much to get the fire going. >> reporter: luckily no injuries have been reported. the cause of the fire is still under investigation but officials say it does not appear to be suspicious. i'm ted greenberg, nbc 10 news.

rain on the way to help with dry conditions but first, more heat. this is the second week of september and 90 degree temperatures are still the norm. this is a life look at the schuykill river boardwalk from our camera atop the mellon building. the sun was beating down this afternoon. monday after labor day it still feels like summer. it should. fall doesn't officially begin until the 23rd. today is shaping up to be the hottest day of the week. >> first alert meteorologist sheen yacha parveen is tracking. >> relief is on the way and i think you will like the way the seven-day forecast looks. we are at 95 or 93 degrees in philadelphia, 95 northeast philly. low 90s to mid 90s through parts of the lehigh valley. 92 allentown. 94 in reading. it is hot across the area. even closer to the shore, temperatures about the mid 80s which is above normal this time of year. so the heat, the dry weather all helping to fuel the fires in new

freedom this afternoon for the kentucky clerk who refuses to issue marriage licenses to same sex couples. kim davis taking this victory walk right here from jail about 20 minutes ago. davis' refusal to obey the united states supreme court has reignited discussion about same sex marriage. davis is out of jail but her case is far from closed. nbc 10's keith jones is joining us from the digital operations center with the latest. keith? >> we have been following this story the last few hours. and now kim davis has been released from jail. a judge ordered her to be freed under the condition she stop interfering with deputies issuing same sex licenses. she addressed the crowd. >> i just want to give god the glory. people have rallies and you are a strong people. we serve a living god who knows exactly where each and every one of us is at. just keep on pressing.

>> hundreds of supporters crowded outside the jailhouse earlier today chanting and singing "amazing grace." davis' lawyers say nothing has been resolved here. this is some of the action outside that jailhouse. republican presidential hopeful mike huckabee, ted cruz had also planned to visit with davis in jail this afternoon. it's been a contentious battle. davis has said she refuses to authorize same sex marriages because they violate her christian beliefs. just a few minutes ago, her lawyer refused to say if davis would be returning to work. she has been in jail since thursday on contempt of court charges. davis smiled and nodded when asked if the jail time was worth it shortly after her release. live in the digital operations center, keith jones, nbc 10 news. nbc 10 has new information about the taxi crash that killed two people in philadelphia for the made in america festival. police say the taxi driver likely had the green light and

witnesses say he struck the victims as they were crossing broad street on red. nbc 10's george spencer is live at the accident scene north of city hall. investigators are still trying to piece all this together. >> reporter: yeah, piece together those details and verify the witness accounts. it seems the two victims were crossing broad in this direction when they were hit by that taxicab. up in phoenixville today, the hometown of one of the victims, we encountered an entire workplace community in mourning. 25-year-old amanda digirolomo studied exercise science as an undergrad and when the time came for an internship and job, the phoenixville native joined her mother and two sisters working at their local ymca. today that entire workplace is in mourning. >> she was a wonderful, vibrant young women. >> reporter: the director tells us digirolomo was a wellness center attendant here.

witnesses tell police the taxi driver who hit her and her friend, bryan botti, had the green light and the victims were crossing on red around 4:30 yesterday morning. sources also say that drive volunteered to give a blood sample to prove he wasn't impaired. in this neighborhood where digirolomo grew up and at the ymca where so much of her family worked, there are few answers. >> just tragic for everyone involved, especially the families. >> we have a very small family here at the ymca of staff, employees and everybody's just going through a difficult time and just needs a little bit of some peace. >> reporter: the primary lingering question is about the taxi driver's speed. witnesses say he may have been going 50 miles an hour, double the speed limit on this stretch. mathematical analysis to fill in that detail is the focus of investigators now. we asked today whether excessive speed would be considered criminal or simply a traffic

violation. in cases like this, generally it's up to the discretion of both investigators and prosecutors based largely on how excessive that speed actually is. i'm george spencer, nbc 10 news. big changes this afternoon for catholics who want to remarry in the church. pope francis announcing today major reforms in the way the catholic church handles annulments. a new law streamlines rules for bishops determining if a marriage has a flaw that makes it invalid. automatic appeals are also now a thing of the past to speed up the process. catholics must get an annulment if they want to remarry in the church but the annulment process has long been criticized as complicated and expensive. the change comes on the heels of another controversial announcement by pope francis. last week the pontiff said he would allow roman catholic priests to absolve women who have had abortions for one year if they seek forgiveness. we'll have local reaction on the

latest changes coming up at 4:30. big changes from septa. it is doubling the number of stations that will be open. nbc 10's deanna durante is live in city hall with more on what changed and exactly why. >> reporter: septa says now that it knows the itinerary and events planning as well as security planning for the world meeting of families as well as the papal visit, it can now bring more transportation to those who want to move around the city. >> we have added to it. we have actually added 34th street and 8th street on the market frankford line. those are new stops right in what they are calling the francis festival. >> reporter: now you can get even closer to the events taking place on the parkway according to septa. it is doubling the number of broad street line and market frankford line stops for the weekend as pope francis visits the city of philadelphia. >> most of the time we will be bringing people in and out throughout the city all day long. that means people that maybe need to get to work or who want to come down to the papal visit

just for a couple hours, then go back home can do that. >> reporter: for those riders with monthly or weekly passes, you won't be able to use them but septa says look for credit to be applied to those accounts. >> you hold on to that pass. the next month or the next week, you will be able to get credit. >> reporter: there are still papal passes available for the regional rail lines. septa says it has no plans to alter the service being offered by those 18 stations. coming off the heels of what's becoming a city tradition, the made in america festival was sold out the first time that's happened for the four-year-old event but it's combined 130,000 attendees over two days. mayor nutter says lessons are being taken away. portable water supplies will be needed for the pope's visit and world meeting of family events on the parkway. he says he wants to see the grounds washed down to control dust for the event. the mayor says he has been made aware of self-service complaints though no one has contacted his office. we did reach out to the major cell carriers, at & t and verizon tell us they are

analyzing data from the weekend. they say there was some data slowdown. those trying to send text messages, videos, post to social media in the most crowded spots closest to the stage. we have more on what they are planning to boost cell service coming up at 5:00. for now, deanna durante, nbc 10 news. turning to a different kind of ticket for the papal weekend. tickets for the pope's speech at independence mal sold out in two minutes today. >> the free tickets were given out on a first come, first serve basis online and nbc 10's lauren mayk was with one of the lucky few who snagged a few. >> she joins us now on independence mall. >> reporter: those tickets will get you an up close view of pope francis when he speaks here at independence mall. i was with one of those lucky ones who got her hands on a ticket today but i thought of how fast those tickets went and now we are seeing just how expensive those free tickets are getting. within minutes, they were gone.

10,000 tickets to see pope francis at independence hall. no longer available. now we are finding them on craigslist, selling for hundreds of dollars. what do you think about the idea of people making money off of this? >> i think it's not in the spirit of pope francis. >> reporter: anthea butler is a professor of religious studies at the university of pennsylvania. she tried to get tickets herself. >> i actually had two browsers open, i tried both of them. neither one worked. for the lucky people who got one, good luck to you. >> reporter: lucky like nelly logan. >> i'm going to see the pope. i can't believe it! >> reporter: we were there as she got her hands on her tickets. those who didn't, the online marketplace keeps growing with gestures of good will, free tickets and a profit. >> to sell tickets for over $100 to see the pope seems a little bit bad to me. maybe it's not a mortal sin, maybe it's just a venal sin. >> reporter: that's not quite as

>> nbc 10 at st. margaret's this morning. kids were in their uniforms for the first day. it was a hot start to the school year. in delaware county, a brand new charter school opened its doors to students. vision academy charter held a ribbon cutting ceremony this morning. the school will serve grades kindergarten through fourth grade. it will eventually grow to include grades five through eight. high schoolers in camden were greeted by a special group of men as they walked into school this morning. dozens of men lined up at two of the largest schools in camden in an effort to condemn violence. alumni, veterans, even elected officials were there to greet students on their first day. they offered flowers to the female students and hand shakes for the guys. add woodrow wilson and camden high schools. an update on the nuclear deal with iran as congress returned to session today. democratic leaders have now secured enough votes to stifle

those who don't support the deal. the united states, iran and five other countries are trying to reach an agreement that would limit iran's nuclear program in exchange for lifting some economic sanctions. the eesh has divided lawmakers. the majority of democrats support the deal. republicans are against it. former vice president dick cheney ripped apart the deal calling it a national security risk. >> what president obama is asking the united states congress to do is unique. historically and dangerously unique. the results could well be catastrophic. >> on the other side, senate democratic leader harry reid announced his support for the deal. >> today i'm gratified to say to my fellow americans our negotiating partners and our allies all around the world, this agreement will stand. america will uphold its commitment and will seize this opportunity to stop iran from getting a nuclear weapon. >> president obama has threat

threatened to veto a republican-led resolution to shut down the deal if passed by the senate. a new push to suspend the law license of pennsylvania attorney general kathleen kane comes as kane faces criminal charges. the state's attorney ethics office is calling for the suspension of kane's law license arguing a conflict of interest. kane is facing charges for allegedly leaking information from a grand jury probe and lying under oath. we have reached out to kane for comment. she hasn't responded today but has denied wrongdoing in the past. the family of a man paralyzed while in police custody has reached a settlement this afternoon. the deal is centered on the death of freddie gray in baltimore. that agreement would pay the gray family $6.4 million to settle all claims about gray's death. baltimore's spending board will consider the deal tomorrow. the 25-year-old gray died in april after receiving a severe spinal injury in police custody. the mayor of baltimore says a settlement is in the best interests of the city to avoid

drawn-out lawsuits. back to work for the minnesota dentist who killed a beloved lion and sparked global outrage. reporters, protesters and others were there as dr. walter palmer arrived at his dental practice this morning. palmer briefly waved but said nothing as he went inside. he kept a low profile after being identified as the hunter who killed cecil the lion in zimbabwe two months ago. officials in zimbabwe say cecil was lured out of a national park and shot with a compound bow. the landowner and guide have been charged in cecil's death. the african country says it wants palmer sent back to face charges. from our nbc 10 jersey shore bureau, big night tonight in atlantic city. the miss america paneligeant wi kick off. nbc 10 was there as the contestants arrived last week. today they unveiled the shoes they will wear in the show us your shoes parade. events and competitions will continue throughout the week.

this year's winner will be crowned inside boardwalk hall sunday. now to new information about the made in america music fast val. we learned this year's event in philadelphia was a record breaker. the city announced more than 130,000 people came out to hear the artists over the holiday weekend. everyone from beyonce to nick jonas and meek mill. this is also the first time both days sold out. too soon here, it's beginning to look a lot like halloween at eastern state penitentiary. twin gargoyles were hosted at the empty prison today to mark the official start of halloween season. terror behind the walls returns september 18th for the first of 30 straight nights of scaring. it marks the 25th straight season at eastern state penitentiary. proceeds from ticket sales support the prison's year round museum.

the only thing is it definitely does not feel like halloween weather. it feels a lot like summer still. it will keep feeling like summer as we go into tomorrow. we are looking at a possible heat wave again. this would be heat wave number six. today we already made it into the 90s so tomorrow would make it a heat wave. other than that, we are tracking thunderstorms with some heavy rain as we go into thursday, mostly. i will show you the timing in just a minute. once all the rain moves through, a cooler air mass moves in just in time for your weekend. then it will start feeling maybe a little bit more like halloween weather. right now in philadelphia, 93 degrees. mostly sunny, feeling like 95 with the humidity. the humidity will stick around tonight and tomorrow, too. mid to low 90s through the lehigh valley. 94 in reading, 92 allentown, 95 degrees right now in bensalem. low 90s for glassboro. mid 80s for dover. millville, 88 degrees. the coolest spot is along the shore even though it's still warm. that's where you want to go this afternoon to get relief.

nice and dry across the area right now, dry and hot, but not too far back off to the west, that's our next round of rain. i think some of this could start as early as tomorrow afternoon, maybe some popup showers. but the line is right now moving out of chicago and most of the heavy rain from this will come as we go through the day thursday. here's future weather. tonight we stay dry, could have patchy fog developing late tonight. more clouds early tomorrow morning. we heat up through the afternoon so we could hit 90 degrees. if we do, that would be that heat wave. by 11:00 p.m. tomorrow night, some showers around but by thursday, we have a better chance of seeing heavy rain pretty much through the whole day. then we go through friday and it starts to clear out. for the philadelphia area, we have gotten to 93 degrees today. here's a look at the heat in place all the way up the northeast. 95 in boston so far, 97 in new york. this is going to be the real change coming after the rain. the cooler air mass is still up to the north and west. this will eventually get here once that rain moves through.

the cold front will pull this cooler air in so by the end of the week, we are looking at temperatures back around where they should be this time of year, in the low 80s. tonight, warm and humid, late patchy fog. mid 70s in philadelphia. 67 degrees north and west. tomorrow, hot and humid with a chance for a late shower. temperatures right around 90 degrees for the afternoon. then we go into thursday, showers and storms, some of the rain could be locally heavy. temperatures in the mid 80s by then. we go into the weekend, take a look at the high on saturday. 82 degrees. we could see showers sunday, upper 70s, upper 70s for a high on monday. around 80 on tuesday. so finally we will be breaking out of this hot summer pattern. this local family falls for an alleged mortgage scheme. how the nbc 10 investigators sa saved them from losing their home. they will experiment more. i'm not surprised about it. >> plus the new way teenagers are secretly smoking marijuana

fast track process. >> it's just the latest radical change in the catholic church from the headline-making pontiff. nbc 10 delaware bureau reporter tim furlong finds out what this change means. >> nothing in the bible about annulment. >> reporter: michael didn't know much about annulments when he got one. he just knew he wanted one so he and his girlfriend could get married in the catholic church. he didn't like the whole process or the $600 fee. >> why if i had paid more would they have expedited it and it would have taken weeks instead of six months? it was very intrusive. they got deeply involved, even interviewing friends who knew my wife and i at the time. >> reporter: now pope francis decided to make the process easier. he decided to simplify and accelerate the process. it should take less than 45 days as opposed to months or even a year. the pope will also allow bishops to make independent decisions on granting annulments and calls

for more pastoral concern. it seems the pope is trying to bring more straying catholics back to the table. >> the archdiocese sent a statement saying marriage is still supposed to be permanent but say locally for years they tried to prevent undue burdens on catholics trying to get annulments for what they call valid reasons. michael is no longer catholic. while he says he didn't leave just because of the annulment issues, he says it left a bad taste in his mouth. the pope is clearly trying to change that. >> now i was able to legally according to the catholic church get married in their church again. i was accepted back in the church. >> reporter: tim furlong, nbc 10 news. here are some of the stories making headlines on nbc 10 news at 4:00. a forest fire in south jersey is causing smoking choe choking sm. wind and dry conditions have made the blaze tough to control.

a kentucky clerk who refused to issue same sex marriage licenses was released from jail today. hundreds of supporters rallied around the carter county detention center. davis thanked god and vowed to press on with the presidential hopeful mike huckabee by her side. overnight shooting lands two people in the hospital and one man behind bars. police say a fight broke out after a woman stole someone's purse inside a bar at fifth and olney. a man pulled a gun and shot the woman and a man. the man is in critical condition. the woman is stable. officers chased down the suspected shooter and arrested him. all three people will face charges. a warminster man is out on bail facing multiple charges, including sexual assault. police say he is accused of groping a person last wednesday. the 29-year-old was arraigned and has been charged with indecent sexual assault, harassment and disorderly conduct. a teenager who broke into a middle school had to turn himself in after he became stuck in the school's elevator. police in laurel, sussex county

got a 911 call from the teenager yesterday. they say the 19-year-old called for help after getting stuck in the elevator at laurel middle school. a maintenance person was able to open the elevator where they found him wearing a letterman's jacket that didn't belong to him. he is facing criminal mischief and theft charges. a mississippi youngster is thankful to be on solid ground. >> after he and his dog took a fall down a well yesterday. officials say the 4-year-old was walking with this dog when they both fell down the 25-foot deep hole. it took rescuers nearly four hours to pull both the boy and the dog to safety. they were both dehydrated but both okay. a great white shark that washed ashore on a beach in massachusetts sunday died despite rescue attempts by hundreds of people. this video shows the rescuers pouring water on the shark but despite digging a trench and pulling the shark back into the water, the great white did not survive. according to eyewitnesses, the

the popularity of e-cigarettes is on the rise among teens and turns out they aren't just using them to get their nicotine fix. according to a new study, teens are using the electronic cigarettes to get high. researchers from yale university school of medicine found that teens are increasingly smoking hash oil. hash oil tends to be more potent than an average joint with little to no tell-tale scent. the news isn't all bad for e-cigarettes. another study claims they can actually lower smoking rates among teens. researchers from uc san francisco also credit smoking bans in the workplace and public smoke-free zones as effective deterrents. a staggering number of americans could be at risk for diabetes. a new study estimates about half of american adults either have diabetes or pre-diabetes. african-americans, hispanic and asian americans had higher diabetes rates than caucasians but pre-diabetes was more common among white adults. the researchers did say the

increasing prevalence of diabetes may be leveling off. a south jersey waitress and her two friends were firefighters front and center on national tv this afternoon. >> they brought their uplifting story to the "ellen show." liz is a waitress at the route 130 diner. the firefighters came in after fighting a fire. she paid for their meal and wrote a kind-hearted thank you note on the check which went viral after tim posted it on facebook. the firemen found out liz was raising money to buy her disabled father a transport van. they were able to raise her $30,000 in just two days and today, ellen surprised her by tacking on some more. >> so you paid it forward. i would like to pay it forward to you right now and shutterfly wants to give you a check for $20,000. >> the firefighters weren't left out either.

comcast sports net's john clark is joining us with the details and some specific examples mentioned in this explosive report. >> reporter: yeah, it continues with the patriots. espn released a comprehensive report alleging the patriots have cheated in the 15 years since coach bill belichick took over in new england. we heard that before but the report says the cheating went beyond spygate. the report says a former member of the eagles football operations says many people believe the birds were robbed by the patriots in super bowl xxxix. some eagles players believe the pats knew their signals and were calling out their plays. the espn report alleges not only did the pats tape other team's signals in their games, low-level pats employees went through the visiting locker room before games and took sheets with the visiting team's play calls and went rummaging through the opposing team's hotels looking for playbooks. the report alleges commissioner roger goodell swept the allegations under the rug out of respect for owner bob kraft, and

that some view the deflategate punishment as a quote, makeup call. we will sit down with eagles safety malcolm jenkins getting ready for the season opener at 6:00. i'm john clark. back to you. >> goodell is denying there was any connection there or that this was a makeup call this afternoon. >> reporter: yes. yes. absolutely. >> all right. tom brady and the new england patriots kick off the nfl season thursday night. they take on the pittsburgh steelers at 8:30 right here on nbc 10. well, still feeling like summer out there. temperatures still about ten degrees or warmer above normal for this time of year. and we are looking at the possibility of another heat wave in the forecast. if we hit 90 tomorrow, it would be heat wave number six. believe it or not. but it will quickly end as we have showers and storms moving in. that will mostly be thursday. thunderstorms with some heavy rain possible. it will help cool things down and behind the rain, we have a

cooler air mass moving in. the weekend will be cooler relatively speaking, although it will be right around average for this time of year. temperatures through the lehigh valley still hot, still the mid 90s in reading, mid 90s, philadelphia, up to bensalem and trenton. some of the suburbs in south jersey and delaware at about the mid 80s like dover at 86 degrees. mostly sunny skies in center city so here's a live look at philadelphia from the adventure aquarium in camden. we have been seeing the sunshine and dry air all day today. that's really helped to heat things up. tonight we stay dry. satellite and radar nice and dry but the humidity will be up tonight, too, so we could see patchy fog developing. here's the rain we are watching for late wednesday and into thursday. it's around chicago so it's pretty well-defined here. it will be pretty organized as it moves through mostly thursday, when we can expect the heaviest rain. tonight we keep the clear skies in the forecast but more clouds move in early tomorrow morning. here's 9:00 a.m. tomorrow

morning. i think we will be mostly dry. could see patchy fog and through the afternoon hours, we should be warming to around 90 degrees. if we hit 90, it will be heat wave number six, believe it or not. by 5:00 p.m. we could already start to see popup showers, maybe a popup thunderstorm. a majority of this rain will really start to move in overnight into thursday morning, through the middle of the day thursday. here's 11:00 a.m. thursday. heavy rain mostly south of philadelphia but we will track it closely through the day. thursday afternoon, more heavy rain moving in so we will be watching for areas of localized flooding with any of the heavy rain and thunderstorms. now, on the doorstep after this rain moves through, we have a cooler air mass in place. now, again, relatively speaking, it will feel quite a bit cooler, ten degrees or more cooler than it is now, but for this time of year, that's actually where we should be with our temperatures. you will feel it, it will be a very noticeable change going into the end of the week. tonight, warm and humid, late patchy fog developing. 74 for the low in philadelphia.

67 degrees areas north and west. then tomorrow, hot and humid day. chance of a late shower, temperature right around 90 degrees again, so feeling like summer. still ten degrees above normal. the average high is 81 degrees. as we go into thursday, we will get closer to that, mid 80s, but that will be because of the clouds and the rain. that will help hold the temperatures down. by friday, we start to dry out and the high temperatures right around the mid to low 80s. by the weekend, take a look at saturday, 82 degrees. that's going to be a little cooler, around average for this time of year. then we go into sunday. temperatures could be only in the upper 70s. morning lows for many areas i think will start to get into the 50s, especially going into early next week. so yeah, big change if you look at the high temperatures. much cooler air mass. finally moving in. we will break out of the summer heat. >> we will get to average where we should be this time of year. >> where we should be. relatively speaking it will feel a lot cooler to people.

thousands of dollars in a mortgage fraud scheme is getting the help it needs. >> the family was packed up and one day from being evicted. after the nbc 10 investigators got involved, the family has an opportunity to keep their home. investigative reporter harry hairston shows us what changed. harry? >> reporter: the frederick family has fallen on hard financial times. now they get a second chance. >> we are in our house. we get to stay. we're not getting evicted. >> reporter: thins is some of te furniture placed into storage. now their home is starting to look like a home again. >> when your kids are happy and you know you have a second chance, i couldn't be happier. >> reporter: in july the family was forced to put some belongings on the street. a sheriff told them the bank was evicting them for not making payments. >> i got a little blue card in the mail. >> reporter: we first told you about william frederick and four other area families in july. all thought they had a home modification loan. the federal trade commission says the company they trusted was fake. the feds allege it was a

mortgage scheme that duped 500 families nationwide out of more than $2 million. >> i saw your piece and i reviewed it and i just got angrier by the moment. >> reporter: after our story caught the eye of u.s. representative donald norcross, he took action and contacted the bank. >> you were able to keep us in our house and i mean, we are not like saved by any means but we are in our house and we are getting a second chance. a second lease on life. >> reporter: frederick tells us the bank has worked out a plan to help him keep his home. >> we are month to month lease for a year. >> reporter: he says as long as he doesn't miss a payment for 12 consecutive months, the bank will give him a new morning. the ftc tells us the case against five california men accused of running the mortgage scheme is moving forward. we reached out to the men. one man's attorney says his client did nothing wrong. for the investigators, harry hairston, nbc 10 news.
