a dark day in philadelphia's recent history moves into the courtroom today. the contractor charged in that 2013 building collapse that killed six people goes to court. and taking stock post papal visit. mayor nutter calls it a big success but hear the harsh words for the media about the turnout. and check out nbc 10 first alert radar. we're seeing something there we haven't seen in a while, rain moving this way. also tracking fog in parts of the area. good morning. this is "nbc 10 news today" on this tuesday. i'm chris cato. any coincidence our chance of rain returns as bill henley returns. >> it was a request from my

lawn. we do have a chance of rain, no rain on the radar for the area yet but we are dealing with areas of fog. it's a warm muggy start, light fog in doylestown and blue bell. visibility has been down to zero at coatesville, that's dense fog, going to make for slow going. burlington county, mount holly, wrightstown with fog that will likely get thicker. mainly dry but into the afternoon that's when we'll probably see the first showers arrive. 70 at 6:00, 9:00, not much warmer at 73. mostly cloudy. a warm one, 73 is the normal high temperature. we're heading to 79 and climbing by lunch time today. we'll go through it hour by hour when i'm back in ten minutes. right now jessica boyington has your first alert traffic. >> bill, it's finally great to be basically back to normal where the biggest thing we're worrying about here is ongoing construction on the schuylkill expressway. these are around girard avenue on the eastbound side in here.

you can see we have lane restrictions up in this direction, so we're losing that right-hand lane, part of that right shoulder. we do have signs and crews in the area. 13 minute drive time. if you're heading out the door, 22, no problems there, everything green. eastbound from 29 to the schuylkill expressway where we typically see jams in this morning hour. eight minutes. when i come back we're going to check in with mass transit. chris. 4:02. happening today, the demolition contractor charged in that deadly market street building collapse of two summers ago is set to go to trial. lawyers will select a jury for griven campbell charged with murder, reckless endangerment. six people died when a building under demolition collapsed on a salvation army thrift store that was crowded with shoppers at the time. dozens were injured along with

the six killed. campbell hired the excavator operator who was operating the machinery at the time of the collapse. that man pleaded guilty to involuntary manslaughter and causing a catastrophe. we have new information on a gas leak in northeast philadelphia that's put people out of their homes. sky force 10 over the scene of this apartment complex at grant and bluegrass street. that leak forced people out in the streets last night. overnight we learned that everyone has been allowed back in their homes. no one was injured. philadelphia police are still looking for a man they believe is linked to a shooting that injured a child last night. gun fire in a home wounded an 8-year-old girl, also wounded two women. all victims are in stable condition. police tell us the man they are looking for is a likely boyfriend of one of the women and they say he took the gun with him. 4:03. bucks county a man is charged with murdering his girlfriend,

we don't know how she was killed. been salem police arrested andrew messner. a judge arraigned him on criminal homicide. the victim's mother found her dead. police still haven't told us how she died but say messner was still in the apartment at the time the woman found her daughter's body. we spoke with neighbors. >> they put tape on my railing. no. still here. >> police have not revealed a possible motive for the murder. it's 4:04. supporters of planned parenthood will hold rallies in philadelphia and across the country. the organization says it wants to call attention to the services it provides from birth control to screenings for std's. organizers say this is a response to a summer of attack by pro life advocates. those advocates want state and

federal lawmakers to pull funding because of its alleged distribution and sale of fetal tissue. the rally is set for noon. today we expect to get an update how the pennsylvania budget battle is affecting school districts. governor wolf a democrat is at odds with the republican led legislature over the budget. the state has been operating without one since july 1. today wolf's auditor general will reveal the results of a study how schools have been impacted by the delay in funding. the next scheduled payment to school districts on thursday is also expected to be delayed because of the lack of a budget. 4:05,swñnow. pope fran sills' message of peace and unity may not have resonated with everyone. philadelphia restaurant owners are calling out mayor michael nutter over the lackluster business.

and as they pointed fingers at the mayor, he pointed his at the media. >> i think that in some instances you all scared the [ bleep ] out of people with some of the stories. >> well, many business owners say the expected crowds did not live up to the hype. 1.5 million were forecast to hit the parkway, numbers early numbers well below that. some business owners say they lost money this weekend. >> we were thinking that we were going to get a very nice spill over, we were anticipating nice crowds in the area, we geared up for that. brauft in extra supply, we brought in extra grocery supplies. >> stock wise we brought in so much liquor and beer and food that we wanted to make sure we made it through the weekend and we have plenty left over. >> some of the business owners say they will donate the leftover food to the needy. while businesses may not have hit it big over the weekend the pilgrimage by tens of

thousands could pay off in the future. katy zachry is live in fairmount park to explain. >> reporter: hi, chris. reflecting over the weekend people who live and work in down town philadelphia say they didn't know exactly what to expect for the weekend but now they have high expectations for the future. with the eyes of the world on philadelphia for two days and hundreds of thousands here on the ground, those who call philadelphia home say it did itself proud. while some are critical of things like tight security and long lines to see pope francis, most agree the coordinated effort on every level worked and worked well. it overall improved people's opinion of philadelphia. coming up business owners will share their experiences of the weekend and throughout the morning you will hear people who live and work in philadelphia weigh in on if they think tourism will now benefit. reporting live, katy zachry, "nbc 10 news."

4:00, it's a steamy start this morning, the humidity is high and we have fog as a result this morning. some areas of thick fog as the visibility has been down in a couple spots to zero so far. fog won't last all day. dry conditions also will not last all day. tracking some light showers that will develop and then there's a potential for heavy rain coming in to tonight. and possibly thunderstorms for tomorrow. for today we're starting off at 66 degrees, cloudy skies in mount pocono, trenton 68, 70 in wilmington. the clouds making for fairly uniform but warm temperatures. there you can see the fog, this is a view from the pocono mountains, the lights are on, this is a look out the front, you can see the fog that has thickened up in the mountains. that's not the only spot. not just the mountains or western suburbs, new jersey and delaware also seeing that fog. what we're not getting now much in the way of rain. we have clouds overhead but showers are just to the west of

some light showers moving past harrisburg right now. there's more rainfall on the way and there you can see the heavier downpours in western virginia. 10:00, still quiet, dry. most of the fog will be done by then. you can see the rain making some slow but steady progress. this will be light rain at noon time, mainly in the western suburbs, allentown, reading a few raindrops, parts of delaware and into southeast pennsylvania, but most of new jersey at that hour will be quiet. as the day goes on, rain is more likely in philadelphia. we've could see more moderate showers moving through. but i expect the heavier rain to hold off until overnight tonight. by 4:00 this afternoon, likely see some rain for the evening commute. we'll go through the forecast neighborhood by neighborhood when i'm back in ten. >> we'll count on that, sir. we'll see you then. always on time that bill henley. jessica boyington is right on time with a look at 95 this morning. how's it looking?

>> we're looking good so far, chris. in terms of traffic we don't have a lot going on there. we have ongoing construction in between bridge and cottman avenue with lane restrictions, something we're used to. here you can see our cameras at cottman avenue, drive time 13 minutes, southbound from woodhaven to the vine street expressway, watch for the i-95 northbound at cottman avenue off ramp that is closed with that construction right now. we expect that to be lifted at 5:00 a.m. or so, we'll keep you updated. of course cleaning up after the pope. watch out for the ben franklin parkway and small side areas between arch and art museum circle and spring garden westbound between pennsylvania avenue and kelly drive. watch out for those things, we're still dealing with some cleanup. the bridges, no problems if you're heading into philadelphia this morning on the walt, the ben t burlington bristol, the tacony palmyra okay as well. >> call it an unauthorized

deduction. people who do banking at the jersey shore had better check their checking accounts after police tell us someone used this device to skim 50 grand from customers. scary stuff. it wasn't the largest fire first responders in montgomery county will respond to but may be the most memorable. how firefighters came to the aid of pope francis at the seminary and how the pope thanked them.

you in the bill cosby case. the brown university board voted to revoke cosby's honary degree following legal depositions released in which cosby admitted to using drugs to get women to have sex with him. last week fordham and marquette

also rescinded honorary degrees. >> memorial services were held yesterday for the florida deputy shot and killed last week. at least 60 agencies from across the country attended the memorial for bill miers. he was shot in the back of the head after issuing a restraining order. a fellow deputy commented on the sacrifice meyers made. >> remember that we schoos this fight against the dark. if you doubt that resolve and this fight ask who would you send in your stead. >> the fallen officer was said to be well love and devoted not only to his work but also his family. joyce mitchell, the woman who helped the two convicted killers escape from a prison in upstate new york will be spending time in prison herself now. yesterday a judge sentenced the former prison seamstress to up to seven years in prison. mitchell admitted to smuggling

tools to the two convicted murderers to help them cut and tunnel out of the prison. a tearful apology did not soften the judge. >> but i'm hoping you will have mercy on me, your honor. no words can explain how deeply sorry i am. >> the judge didn't buy mitchell's explanation she didn't report the escape plan because she thought they would kill her husband. >> the judge criticized mitchell for the financial and emotional impact caused by the escape. the three-week man hunt -- the state wants mitchell to pay $120,000 in restitution. president obama and russian president vladamir putin could not agree on how to solve a crisis overseas during their 90 minute meeting yesterday. the two met at the united nations general assembly last

night. president obama insists that syria's future cannot include bashar assad. obama rejected the argument calling al assad a tyrant who drops barrel bombs on innocent children. meantime, kevin mccarthy announced candidacy for house speaker. he made that announcement through an e-mail to his house republican colleagues. that news of course comes days after current speaker john boehner suddenly announced that he will resign at the end of october. 4:17. to the age old question, is there life on mars? researchers now tell us there is water available there for somebody to drink if someone was there and so inclined to drink. nasa researchers announced that the red planet does show strong signs of flowing water. we knew that ice exists but this study provides the strongest evidence yet that salty liquid water sometimes flows on mars.

>> the existence of liquid water gives the possibility that if there is life on mars, that we have a way to describe how it might survive. >> and nasa hopes to put astronauts on the red planet sometime in the next 20 years. 18 minutes after 4:00. we've got a foggy muggy start but not everybody is seeing the fog. look at south philadelphia. it's fog-free right now. and no rain yet. philadelphia international, 90%, 69 degrees. just a light breeze and it's not a cooling breeze at this hour. 3 miles an hour. winds will be staying light, it's fog-free. this view the from the pocono mountains, camelback, left the light on for us, you can see the fog hasn't formed in that spot.

thick fog in coatesville, light fog for blue bell, under a mile visibility in doylestown. hazelton, mount pocono, no fog there but in between there are some areas of fog in the pocono mountains and in new jersey you'll find it as well. mount holly and now wrightstown. both have seen thickening fog. just the last few minutes. dense fog for both of those locations. the fog extends into central delaware and parts of south jersey as well. two-mile visibility in millville. as far as rain is concerned, none yet. i think that's going to change. look at the rain to the west. and a cold front farther north and west is going to bring us cooler weather over the next few days. for most of the day today, though, the cooler weather is way out of the picture for us. this is warm muggy air that's pushing into the area. 4:00 in the afternoon, steadier heavier rain out of the area and to the stout. as we go into the later afternoon and evening and overnight tonight, that's when

we can expect heavier rain and thunderstorm activity to move through the area. during the day today we'll start off dry, then showers developing. camelback, bethlehem, 70s this afternoon. up to 83 in borden town. at the shore might see a break or two of sunshine, then a chance of a shower, not a big spread at the shore. upper 70s. symrna hits 80. you're more likely to see the showers inland for philadelphia, wilmington, the temperatures in >> 4:20. let's see how things are moving on the schuylkill expressway. usually this is one of the best times of the day to travel the schuylkill. nbc 10's traffic reporter jessica boyington is standing by. does that hold true this morning? >> it holds true. the only thing we're dealing with is ongoing construction. we're looking at the schuylkill expressway around gladwyne,

close to belmont as well. right here at gladwyne watch out on the eastbound side for the right lane being closed due to ongoing construction. for the p.a. turnpike, no problems there. you can see everything is green moving along. 23 minute drive times headed westbound from route 1 up toward valley forge, so no problems there yet. all drive times in the clear. for mass transit, checking with everything. no problems patco, dart, new jersey transit, septa, on time with no delays. i'll check new jersey roads when i come back. >> a warning here for bank of america customers on the jersey shore. if you've been to bank of america you may want to check your balance after a series of thefts there. police released these photos of two suspects accused of skimming. investigators say dozens of customers reported unauthorized withdrawals after visiting margate. they stole more than $50,000. here is how skimming works.

criminals plant a device over the card reader. it's difficult to notice because it looks like the real thing. and crooks can skim data from any card that is swiped. they use that to make a duplicate card and gain full access to your account and the funds. for local firefighters, it was like a call from god. really the call came from emergency dispatchers after a small fire broke out at the seminary where pope francis was staying. crews were called out just before 11:00 saturday night. there was a small electrical fire in an elevator. the firefighters who responded were personally thanked by pope francis for their quick work. >> we were invited with the staff as the holy father was leaving and got to kiss his ring and shake his hand. had an effect, called the francis effect. don't know that i ever felt that

way in my life. >> those firefighters were stationed on seminary grounds during the papal visit just in case something like that happened. from the south jersey bureau now, 4:23, american water workers will be showing off green thumbs today at camden about 150 volunteers will plant hundreds of trees, shrubs and perennials as part of a camden city park restoration project. there is more fallout over the deadly shooting of a man in a wheelchair in wilmington. police and the mayor are both calling for calm in the wake of the shooting. ahead what a wilmington city councilman wants to happen. and this baseball brawl that cost jonathan papelbon the rest of his season. what fans are doing to make sure he doesn't play for his current team again.

knocked out. you see him get up and call for help. piscotty, though, waved as he was carted off the field to the hospital. the cardinals say tests were negative and that piscotty suffered a bruise to his head. bruised reputation now. former phillies jonathan papelbon's suspension means his season is over. he choked bryce harper in the dugout. the natts gave him a four-game suspension and three-game penalty for throwing at a batter. washington fans have now started a fund to have papelbon kicked off the team. need a fund for that? a warm muggy start and we're watching for areas of fog. a little bit of cloudiness over center city. 69 degrees right now at 4:27. >> next at 4:30, if you thought we were done talking about the pope you're wrong.
