the developments in this case fkfkhe is live in our digital operations center. fknke, what's the latest? xzézai, i just heard back from philadelphia police. they say the suspect committed the crime using a small handgun with a silver handle. after the crime, the victim called philadelphia police. as a result the special victims unit is now handling this case because the crime took place just south of the temple campus. it's all happening just around midnight last night. philadelphia police officers found the victim visibly shaken in the 1400 block of carlisle street. she told them she and a friend had left the library around 11:15 and after a short walk the two went their separate ways near broad and cecil b. moore. as she walked toward carlisle, she hood footsteps coming from behind. she felt hearse hit with a silver handgun. she was pushed up against a wall and was sexually assaulted and robbed.

temple university sent out an alert and tweeted the information, the message said to use caution and report suspicious activity to the school. >> well, i just got a little text from my roommate and she was like hey, guys be safe today, it's really scary, which it is. because, again, this is one of the better parts of campus. not that any part of campus is lzally bad but usually we heard of the alerts happening in other parts and we're relatively safe here. >> police say the suspect ran @f@fon carlisle towards oxford street. coming up in the next 30 minutes, we'll talk about things @zth member and women can do to be safer on and off campus. @z'll have that at 11:30. live in our digital operations center. i'm jesse gary, nbc 10 news. happening now, the demolition contractor charged in the martin street building collapse is getting set to go on trial. lawyers are selecting a jury right now for griffin campbell. he is charged with six counts of third degree murder, reckless endangerment and aggravated

assault. six people died in june of 2013 when a building under demolition in center city collapsed on to a salvation army thrift store next door. dozens were injured that day. campbell hired the excavator operator who pleaded guilty to involuntary manslaughter and causing a catastrophe. a foggy start the day and now it's really heating up out there. a live look at boat house roe along the schuylkill river in philadelphia. but big changes are coming. first alert meteorologist bill henley is here with the forecast. hey, bill. >> hey, vai. still some sunshine out there. as you mentioned, it's getting warm in a hurry. you can see clouds moving back into philadelphia. still plenty of sunshine in parts of new jersey but that is going to be coming to an end as clouds take over and it will lead to rain developing this afternoon. the heaviest rain should be well

inland during the day. but our area could see heavy downpours later tonight and into tomorrow morning from a system that's going to continue into the morning commute tomorrow morning. radar shows those steadier showers from the pocono mountains into central and western pennsylvania and farther to the south. now, as long as this stays to the west, the warmup continues, even with some cloud cover. we're in the 80s, middle 80s in afternoon. but during the later afternoon hours, that's 4:00 today, futurecast is showing some rain from philadelphia westward. as we go into the evening hours, we'll see spotty showers by 11:00 when the heavier downpours will move into the area. that's late this evening. watch what happens overnight tonight. heavy rainfall from the shore through philadelphia into montgomery, allentown reading, chester county, potentially heavy rain at 1:00 in the morning. the futurecast shows that tapers off tomorrow morning but there will be some showers for the

morning commute. we're talking about quite a bit of rainfall coming in. during the day we could see a third to three quarters of an inch of rain. that's by 7:00 this evening. the heavier rainfall, though, starts to move in at 11:00, an inch on the ground in philadelphia. and watch it ramp up through the night. 3:00 in the morning we could see one, two, three, some isolated amounts farther north and west potentially four inches of rain could lead to flooding in some areas of poor drainage and other spots as well with those heavy downpours. but to start with, we're dry. 82 and warm. 82 at 4:00 with scattered showers and then the steadier showers move in during the evening hours. temperatures start to come down, too. and this won't be the end of the rain this week, vai. we have the seven-day forecast with more rainy days ahead. >> thank you, bill. philadelphia police are looking for a man they believe is linked to a shooting that injured a child in feltonville last night.

a shoots on bowdoinot street injured a girl and two women. police tell us the man they're looking for is likely a boyfriend and he took the gun with him. from our delaware bureau, a wilmington councilman is calling for a federal investigation into a deadly police shooting there. nbc 10 obtained this cell phone video. it shows a portion of the shooting that happened on tulip street last week. we have blurred the victim's face and frozen the video to be sensitive to his family. but you can hear how the shooting unfolded. is [ gunshots ] >> jeremy mcdole was in a wheelchair when he was shot. police say he had a gun and did not obey their orders to put the weapon down. his family is asking why police opened fire. new castle councilman jay street sent a letter saying "the footage in the video is more horrific from the footage from

other jurisdiction where the department of justice has found it necessary to intervene and investigate. this situation cries out for a fair, impartial and unbiased investigation." the delaware department of justice is already investigating the shooting. wilmington police chief bobby cummings told us he believes the four officers involved in the shooting acted professionally. those officers are on leave during the investigation. new video shows a burglar caught in the very act. philadelphia police released a surveillance video from inside ventura groceries in kensington early sunday. we're told the suspect got inside the store on east hilton street by breaking a hole in the roof. he swiped cash, cigarettes and bus tokens and took off. if you happen to recognize this person, you're asked to call police. and more new video at 11:00, investigators have showing this person robbing a convenience

mart in philadelphia's juaniata. the suspect placed a ladder under an open window. the suspect didn't take anything and took off in an unknown directi direction. an update on the gas leak in northeast philadelphia. this was an apartment complex at grant avenue and bluegrass road. the leak forced people into the streets. we learned everyone was allowed back into their homes and no one was hurt. happening now, we're about to get an update on how the pennsylvania budget battle is affecting school districts in philadelphia and across the state. governor tom wolf, a democrat, is at odds with the republican-led legislature over the budget. the state has operated without a budget since july 1. wolf's auditor general will reveal the results of a study in how schools have been impacted by the delay in funding. showdown over a shutdown.

richards already testified she's proud her organization provides fetal tissue for research. she wa conservatives are threatening a government shutdown. supporters of planned parenthood are holding rallies across the country today. a rally in center city, philadelphia, is set for noon. about 45 minutes from now. the organization says it wants to call attention to the services that it provides from birth control to screenings for stds. meantime, house republicans are positioning themselves to take over for john boehner. majority leader kevin mccarthy announced his candidacy for house speaker yesterday. he made the announcement through an e-mail that his house republican colleagues. boehner is third in line to the president and one of the most powerful republicans in d.c. and analysts say with or without boehner, washington remains a sharply divided place. and there's new information

that could sway vice president joe biden's decision on whether to run for president. an nbc news/"wall street journal" poll shows if biden entered the race today he would be the most popular candidate. 40% of americans have a positive impression of biden. 28% have a negative impression. compare that to hillary clinton's overall favorability rating of 39% positive and 47% negative. hillary clinton is rolling out a new but familiar strategy in her effort to delete the e-mail controversy plaguing her campaign, it's her husband bill clinton. the former president has spent most of his time in the background but friends say he's eager to become more actively involved in his wife's campaign. he's scheduled to attend a series of fund-raisers and events for hillary. is over the weekend, he defended his wife during an interview on cnbc. >> really similar to the strategy that the republicans employed against me with

boat hit a charter bus last week in seattle. ntsb say the victim involved in the crash did not have an axle repair recommended back in 2013. everyone's okay after an aer lingus jet langer made an emergency landing at new york's jfk airport. just after take off from ireland last night, the pilots reported problems with hydraulics. the control -- they control the plane's brakes, landing gear, and the flaps. the flight returned to jfk. responders put out a small fire in the landing gear area. the crews took passengers back to the terminal to arrange for another flight. >> fog is gone but clouds are moving back in and the temperatures are warming up even with clouds. look at millville at 81. even warmer than philadelphia right now at 80 degrees. it's stilly outside but the fog

has disappeared this morning. a little bit of a warm breeze blowing will send temperatures a bit higher. it won't be a lot hotter but warmer than normal. ten degrees warmer than normalle with the breaks of sunshine that's helping with the warmup. but clouds will be taking over on the way. scattered showers or two so far inbe burke's county. the heavier rain is farther to the west and this is where we'll see quite a bit of rain during the day today. into our area this evening and some heavy rain overnight tonight. watching tropical storm joaquin now has increased in strength just a little bit. this morning when we went on the air it was 45 miles an hour winds. there's a very weak steering kwurnt this storm. over the next few days, not

expecting to see a lot of movement. the computer models have a few different scenarios but there's a tendency to take this system to the north as we head toward the weekend and that could bring us additional chances of rain. not just today, tonight and into tomorrow. for today neighborhood by neighborhood forecast. 70s for camelback. 75 fleetwood and morgantown. upper 70s with showers developing this afternoon. you'll see scattered light showers during the early afternoon hours. a better chance of more widespread rainfall during the later afternoon and certainly the evening hours as well. look at the 80s. new hope, bordentown, moorestown. king of prussia up to 83 with clouds taking over the sunshine won't last longer and umbrellas will be going up later today. at the shore, you're more likely to see breaks of sunshine into the later afternoon hours but we're already seeing a few isolated showers in the millville area, 82 degrees this afternoon.

smyrna will top out at 83. and some showers during the day should be on the light side for wilmington, philadelphia, and malvern. the heavier rainfall coming in tonight and into tomorrow morning. not only will that give us much needed rainfall, the heavy rainfall will bring temperatures down, 77 for wednesday afternoon. come thursday and friday talk about cooling. windy and wet conditions for later thursday for friday and the rain potential could continue into the week if joaquin makes its way to the north. expected to stay offshore but it could produce additional moisture for friday, saturday, sunday, and even a chance of some showers monday. >> thank you, bill. ho hum holiday season? why some predict this would be the weakest holiday season in year. and digging into your favorite breakfast cereal is costing you more these days. what's causing the sticker shock

who it is, if it's a student or someone who went into that school. this is on the 200 block of west ninth street. we're looking at police activity obviously on the ground. there's two or three police vehicles there. we are working to get information mr. whether there's a lockdown there. you see police officers standing at the door. this is chester high school. chester is in the chester upland school district and, again, this school is on the 200th block of west ninth street. skyforce 10 is over the scene. we're pulling back to get a better idea and a better view of the circumstances here.

we're going to go to a map and show you where this is. if you happen to be in the vicinity, it might be a good idea to stay away because there's lots of police activity here in chester. it's an urban public high school location in delaware county. as we go back here to skyforce 10 overseeing this situation. again, someone has a gun inside of chester high school. we just got this information from police. they did not give us much for information and, again, any situations, we want to be careful with what we show you and try to give a balance of information so that the

perpetrator who is inside may not be picking up clues or anything that may help whatever his attempts are. this is a school between seventh and 12th grade i'm told. and it's a part of the chester upland school district. this is an urban setting, we don't have any idea why or who the person is that entered the school, whether it's a student or someone w.h.o. who entered the school. many of these public school, of course, because of situations that happen like this have tight security around the perimeter of this campus, many of them -- most of them have police

assigned to them we don't have any information right now as to when this happened but it is serious enough that you see an unarmed car there and it appears the entire school surrounded by police in marked and unmarked vehicles those officers there, it looks like they have all got -- they're all wearing protective gear. it appears someone was in handcuffs in that scene. may have been placed in the back of that squad car. we're over the scene and giving you information i'm just talking over these live pictures that we're showing you a school bus is just moving now.

i wouldn't expect any childr children -- any school kids would be in n that school bus given the seriousness of the situation. we think we saw someone getting into that police car right there in the middle of the screen. but we don't know if that's the perpetrator, the person inside chester high school with a gun. the information that we're getting is limit ed but it's obviously very serious at chester high skochool. this is chester, pennsylvania, in the 200 block of west ninth street. lots of police activity.

deescalated. it may have come to an end here. perhaps -- i don't want to speculate. i see kids walking along the sidewalk next to the building and this is on the campus and i can't imagine those kids would be allowed to walk around on that campus as they are if they had not apprehended a suspect inside that building. again, chester high school in chester, pennsylvania. this is an urban inner city public high school located in chester delaware county. this information came to us just minutes ago that a person with a gun was inside chester high school. but we believe we saw someone getting handcuffed and got into

a squad car and was driven away. we see police walking around and we saw some students coming perhaps out of the building but they were walking alongside that sidewalk. didn't seem to be any concern. you see the road at the top of your screen there my producer informed me they have just opened up the roads so people are able to drive past there at this point and our hope is that this has wrapped up. we see those two marked police vehicles driving perhaps away or just pulling in here. the entire campus appeared to be from this angle of skyforce 10 appeared to have been surrounded but we'll continue to make phone calls, try to get information.

weekend -- if it comes up the coast. expected to stay offshore but today we'll get rain that has to do with joaquin. warm and muggy this afternoon, showers developing this afternoon. there could be some brief downpour downpours heavier rain moves in tomorrow night. 77 the high. the cooling trend accelerates as we head into thursday after some sunshine we'll get more showers and the wind will be picking up, too. those winds continue into friday with more wet weather ahead. 50s for thursday and friday and rain is a possibility if joaquin comes up the coast. heads towards the north. we could see rain continue saturday and sunday. expect to see the heaviest rain at the shore where the strongest winds will be as well. monday a chance of showers with highs in the upper 60s. we'll be right back. woman: my mom and i have the same hands.
