nbc 10 news starts now. >> first on 10, exposed by the flu shot. dozens are getting tested for hiv because a nurse injected them with a dirty syringe. what you need to know to protect yourself. plus, a car and septa trolley bus collide leaving one person dead and 20 others injured. first, amtrak passengers arrived in philly after surviving this derailment that sent their train tumbling into a brook. >> you can see the cars off the tracks here. happened this morning in vermont. investigators say it all began with a rock slide. >> keith jones reports from 30th street station. >> reporter: ironically a fire

alarm welcomed passengers at amtrak train 55 at 30th street station. except this time it was a false alarm. >> we were awaiting previously. it was just -- everyone was waiting. >> reporter: josh is here from london. he got on after the derailment. seven were hurt, one seriously after the train jumped the track after apparently striking rocks on the track. >> all the most able bodied people adopted an older person and got them down the train tracks and out. >> reporter: they found the train's conductor. >> i put him on my back and he held on to my neck like this. i just told him to hold on and just balance yourself. like just stay in line so i can get us out of here. >> reporter: piza was one of the 102 people to board the buses to other trains which took them to several places including philly's 30th street station. it's hard to forget these images

over port richmond just five months ago. investigators say this amtrak train was traveling faster than 100 miles per hour when it derailed, injuring more than 200 people and killing eight. vermont officials are thankful today's derailment wasn't as severe. >> as governor, i know i join vermonters in expressing my relief that no one has died. >> that was keith jones reporting. another big story we're following tonight, one person is dead and 20 others injured after a car and a septa trolley bus collide. >> tonight's crash happened in the frankfurt neighborhood. denise nakano was there. >> reporter: the trolley bus was stopped at the intersection and about to pull forward when it was hit from behind by this car traveling at a high rate of speed. debris from the car littered the intersection as the septa trolley bus sat idle. the 19 passengers and driver on board the bus had no time to

brace for the impact of a car that struck it from behind shortly before 7:30 tonight. >> i came out of the house earlier this afternoon, and i seen the helicopter overhead. i said what the heck is going on. i came out and seen they had eric street blocked off. >> reporter: investigators say speed played a major role in the crash. they're looking into why the driver failed to hit the brakes as the car approached the bus. >> this vehicle behind it just didn't stop. the only thing that stopped it was the fact there was a bus in its path. speed was definitely involved with this accident. >> reporter: the car took on the most damage. air bags deployed. the front half of the vehicle destroyed. police have identified the 34-year-old driver of the car, but are not releasing his name until family is notified. 19 people were injured on the bus including the driver but with nonlife threatening injuries. the driver of this car died at the scene. his 44-year-old passenger was taken to the hospital in critical condition.

in frankfurt, denise nakano, nbc 10 news. from our delaware bureau, a 6-year-old girl is recovering in the hospital after she was shot tonight. skyforce 10 over the scene where it happened around 6:30. the girl was shot in the knee. she's in stable condition right now. no one has been arrested. police say vigilantes attacked a driver who accidentally hit a 3-year-old boy leaving the tadler in critical condition. skyforce 10 was above the scene in the logan section. the boy darted into the streets this afternoon right into the path of the oncoming car. police say the driver stayed at the scene and is expected to be okay after the attack. officers have not filed charges. now to the story you saw first on the nbc 10 app. dozens of people told to get tested for hiv and hepatitis because their flu shot may have put them at risk. >> a nurse used the same syringe over and over again at a flu

shot clinic in windsor county. people are worried about what they may have been exposed to. >> reporter: the people who monitor infectious disease in mercer county say it's something they've never seen here before. a breach in how to give a flu shot safely. >> the syringe should be used once and only once. >> reporter: but at a clinic of otsuka pharmaceutals, that practice was not followed. they are looking into why a nurse would change the needles after each vaccine but continue to use the same syringe. tonight dozens of affected people showed up here to get their blood tested for hepatitis and hiv. >> we feel it's important that they are aware of their health status and that they understand what the risk is and what the potential is. >> reporter: i spoke with several employees who were visibly upset. one of them told us having to now wait for test results is

giving her incredible anxiety. another man wanted to know why they weren't notified of the breach until late friday when the clinic happened wednesday. >> shortcut. everybody in a hurry. >> reporter: infected patients said their employer would not let them give interviews. the. total wellness, which contracted the nurse for the event said total wellness is dedicated to ensuring all participants receive any and all appropriate screenings, care and counseling until this matter is resolved. the department of health said not only did the syringe reuse expose people to infected blood but they may have used less than the recommended dose of the vaccine so they're recommending anyone that took part get the shot again. i'm drew smith, nbc 10 news. president obama has signed a disaster declaration making federal aid available to south carolina following days of

devastating rain and flooding. at least ten people have died and hundreds forced from their homes. in ridgeville, flooding has forced several caskets to rise from the ground in a cemetery. you can see them floating in the water. the rain has slowed down. south carolina's governor is warning residents it is still dangerous. >> we don't want to have to come out and rescue and we don't want to have you added to this number of fatalities. >> residents are calling this the biblical floods of 2015. >> closer to home tonight it's clear some beaches at the jersey shore took quite a beating from this weekend's weather. this is from ocean city. we found several businesses still covered with sandbags and boarded up in preparation for what rolled through there. officials say things could have been much worse. >> we were fortunate enough not to have any breaches. we didn't have any flooding caused on the ocean side. the beaches held up, the dunes did their job and kept everything safe.

>> ocean city officials say there's no immediate need to truck in emergency sand because a new beach replenishment project is only a few weeks away. all the rain, wind and flooding caused erosion problems at the beaches. they are now 15-foot drops tonight. we found this damage in bethany beach. some streets are still filled with water and the access to the beach is limited. it's a much better situation at the jersey shore and delaware beaches tonight. let's get an update from meteorologist glenn hurricane schwartz. >> it's been days since we've had no coastal flood watches, warnings or advisories. things have calmed down. we have mostly clear skies allowing the temperature to drop. it's already down into the 40s in many of the suburbs. and so it is going to be a chilly night. the wind still out of the northeast. look how light it is. it's near calm after all those days of wind.

just a few clouds at the shore. we still have some moisture coming toward south carolina unfortunately. our weather, 49 degrees at 6:00 a.m. by 9:00 a.m. up to 60. by noon, close to 70. it's definitely going to be warmer than today. we'll see how much warmer it gets this week and when the rain returns with the seven-day in a few minutes. a cargo ship that disappeared during hurricane joaquin is believed to have sunk near the ba hamm paps after four days of searching for "el faro" they discovered a badly damaged life boat and the body of a crew member in a life suit. there were 28 americans on board. more legal troubles for pennsylvania's attorney general kathleen kane. a former top lawyer has filed a lawsuit against her. james barker claims kane fired him in retaliation for grand jury testimony that helped montgomery county prosecutors bring perjury charges against

kane. barker wants his job back as well as damages and his legal costs repaid. kane's office said barker's firing was part of restructuring. a guilty plea from a delaware woman accused of beating her 4-year-old daughter to death. tanasia milligan was arrested last year for the murder of her daughter autumn. she could have faced 15 years to life in prison. last friday the 27-year-old plead guilty to second-degree murder which carries a 10 to 25-year sentence. prosecutors will resume presenting their case in the center city philadelphia building collapse trial. six people were killed and more than a dozen hurt when that four-story brick wall fell on to the salvation army thrift store two years popping griffin campbell faces third degree murder charges in the collapse. his construction company was in charge of the demolition. on the stand for prosecutors was an architect. that architect says he told griffin campbell the building was in imminent danger of

collapse and needed to come down immediately. president obama will go to oregon friday to meet with the families of the victims of last week's mass college shooting. this comes as we're learning more about a manifesto left behind by the gunman. christopher harper mercer ranted about not having a girlfriend and complained that people thought he was crazy. he opened fire at umpqua community college last thursday killing nine people before turning the gun on himself. people on college campuses are breathing a collective sigh of relief tonight after there were no reports of violence today following an alert from the fbi over the weekend. the agency said there was a social media threat made against the philadelphia area university or college with a time of 2:00 p.m. this afternoon. that prompted campus security officials to notify students and take extra safety precautions. temperatures warming up but

how long the nicer weather will last and when shore residents will see the end of flooding. he's accused of posing as a bishop to collect nearly $200,000. how he allegedly stole the money from a local church and why he's no stranger to police. nbc 10 showed you the video of this woman kidnapping a 5-year-old girl from her classroom. what happened today as she steps in front of a judge for the final time.

the philadelphia woman seen snatching a 5-year-old girl from a philadelphia school knows her fate tonight. christina regusters was sentenced to 40 years to life in prison today. regusters was caught leading the child out of her school in cobbs creek two years poppiago. the jury convicted her of kidnapping the girl and then sexually assaulting her. she was found at a playground the next morning. a woman now wants to change

her plea. linda weston wrote a memo asking the court to change her plea and hold a competency hearing to evaluate her mental health. last month she agreed to accept a life term in the case in exchange for the elimination of the death penalty. police found four adults changed in westin's basement in 2011. she kidnapped them and held them prisoner to steal their social security money. a chester county woman is accused of injecting her 14-year-old daughter and another teen with heroin. riffey's locked up on several charges including endangering the welfare of children and corruption of minors. investigators also tell us the teens snorted heroin that was supplied by riffey's boyfriend. friends and family are mourning the death of jerry

mondesire. he passed away yesterday from a brain aneurysm. he served as chief of staff for u.s. representative bill gray. in 1996, mondesire was elected as the local chapter president of the naacp. he eventually served on the board of the national organization. >> when you're straightforward, when you're fight, you rails you're going to make friends but also foes. and mondesire didn't mind making either. >> last year the national naacp removed mondesire and three board members from office after questions emerged about the financial management of the philadelphia chapter. a philadelphia man's behind bars accused of trying to defraud a local church of nearly $200,000. mark postellwas sdited on wire fraud charges. the 52-year-old impersonated a bishop at the church of jesus christ of latter day saints to cash a $183,000 refund check.

that check was issued to the church by pico. he took it to a north philadelphia check cashing store and once that check was processed, he was taken into custody. >> it's crazy. people will try anything. they don't have no picks. they don't care. >> no morales. >> they don't care. that's crazy. >> if convicted postell could face up to 20 years in prison. he has a lengthy criminal history. now your nbc 10 first alert weather with chief meteorologist glenn "hurricane" schwartz. >> a whole lot of cold air over the weekend, and now, things are returning to normal out there. we're calming down. the wind is down. more sunshine across the area. and we're also going to be warming up. right now we have mostly clear skies across the area. it's 58 degrees. the wind is really down. down to 5 miles an hour. and it is going to allow these

temperatures to drop even farther. 47 in west chester and pottsdown. 48 in glassboro and 49 in millville. we do have a chilly night ahead. we still have a little bit of a northeast wind. delaware beaches not happy about that. but at least it's a light northeast wind compared to what we've seen over the weekend. just a few high clouds left. even those clouds are starting to move out. but we continue to see this upper air storm down off the south carolina coast. spin more moisture in toward the coastline and out there you can see joaquin is still in the picture. these are some pretty heavy showers and storms in parts of north carolina. and if it would continue to move west, it would go into south carolina which definitely doesn't need any more rain. we're down into the 40s throughout the area by 7:00 a.m.

even in philadelphia itself. 42 degrees in allentown says the computer. that's pretty chilly but it's going to warm up fast because of the sunshine. unlike on saturday when it didn't warm up at all. so we're in the 70s tomorrow. no doubt about that. we're in the 70s again on wednesday. and so we've got some real nice weather ahead. there is joaquin. it's still hanging on. still has the eye and is 85-mile-an-hour winds headed in the general direction of the british isles. going to be closer to them than to us by later in the week. clear and cool tonight. 49 for the low in philadelphia. 43 in some of those colder suburbs. it's going to warm up quickly as the sun comes ot. not much wind. it's finally going to be an offshore wind so the seas can calm down. no more including at the shore. low to mid-70s. warmer on wednesday. we cool down somewhat on thursday behind a weak front.
