nbc 10 news starts now. new at 11:00, a dangerous mistake. a little boy receives ten times the amount of chemotherapy he was supposed to get. the error his family blames on the doctors. >> but what happened to brandon? the 3-year-old was found dead in south jersey. tonight we're hearing his father's side of the story. i'm jim rosenfield. >> i'm jacqueline london. police say there was no sign of forced entry when the boy disappeared and he was not sexually assaulted. >> but it's still unclear how the toddler died and the family now has a lawyer. denise nakano is live at the camden county prosecutor's

office. >> reporter: well, he refused to have an attorney represent him when he was first questioned by police the day his son was found, but the attorney said that all changed because he's acting as a go-between between his client and investigators. >> the camden county investigators told me he's not a suspect. >> reporter: philadelphia-based attorney richard fucino junior represents the father who is the last person to see his son alive before putting him to bed october 12. >> he's trying to answer the question. but he has the added burden of already having gone through the loss. he happened to look in the boy's room when he woke up. typically the baby wouldn't be up for another hour or so. >> reporter: he said that creato called his mother. the case turned from hope, to sadness, despair and confusion

when a k-9 found brandon's body eight blocks from his home. camden county prosecutors revealed there was no signs of forced entry into the home. >> it's not clear to me whether or not the door was locked. there is a handle lock, which isn't exactly that secure. >> reporter: as the creato family prepares for his funeral just hours from now, there's a need for the boy's family and the community to know what happened. >> it's rocked this town. how he got out, i don't know. that's still a mystery. >> we just want closure here. my client wants closure and his whole family wants closure. >> reporter: investigators are waiting on toxicology results which could take several more weeks. brendan's funeral is private and scheduled for tomorrow. reporting live in camden, denise nakano, nbc 10 news. new at 11:00, a woman found dead in lehigh county and the coroner calls it suspicious.

her body was found before noon at her home in whitehall. police say the woman was 26 years old. tomorrow authorities will perform an autopsy to figure out how she died. the will he or won't he speculation about joe biden ended today. the vice president announcing he will not be running for president. flanked by his wife jill and president obama at the rose garden, the vice president officially closed the door on a white house run but said he won't be silent. biden, who made his decision last night, said the grieving process over his late son beau was pivotal. >> beau is our inspiration. unfortunately, i believe we're out of time. the time necessary to mount a winning campaign for the nomination. >> recent national polls showed biden, if he ran, a distant third behind both hillary clinton and senator bernie sanders for the democratic nod. >> the super pac backing hillary clinton has released its first

paid tv ad one day before clinton's scheduled testimony before the house select committee on benghazi. >> as secretary of state she stood strong for america, traveling a million miles, never backing down. but now republicans are playing politics over benghazi. >> everybody thought hillary clinton was unbeatable, right? we put together a benghazi special committee. >> priorities usa says the six-figure ad buy will air in the early votes states of iowa, new hampshire, south carolina and nevada. the house freedom caucus said it is supporting paul ryan for speaker. it's almost a guarantee he'll get the job. the caucus is a group of hardline conservatives. ryan had said he would run for speaker only if his party united around him. the new jersey state senate and chris christie are battling over a gun control bill that the governor vetoed. an override vote is scheduled tomorrow on that bill.

it requires law enforcement to be notified when potential gun buyers seek to have mental health records erased. christie wants a broader overhaul of how the state treats mental issues. democrats say republicans should back the initial bill which passed unanimously, 27 votes are needed to reverse the veto. the river sharks are knocked out of the park for good. tonight camden's losing its professional baseball team, and it's all because of the battle over the stadium. >> drew smith is live tonight at campbells field. what's going on here? >> jim and jacqueline, i'm told that camden county's already enacted negotiations to try to replace the riversharks. their name is still up on the banner here. but court documents show the team has had trouble paying its bills for years, now the taxpayers own this field. the time for the riversharks has run out here. camden county considers campbell's field one of its waterfront assets in the shadow of the ben franklin bridge and right across the river from philadelphia.

>> the community's awesome. you can see the whole skyline, the bridge and everything. >> reporter: but after 15 seasons the gates are now locked shut. >> we're really sad to leave. a sad day for us and our ownership and the organization and most importantly the fans. >> reporter: the team's general manager said she did everything she could to stay here but negotiations for a new lease with camden county went nowhere. >> we wanted to stay in camden. great things are happening right now. >> reporter: the waterfront is where developers have been investing money lately, but its taxpayers who took control of campbell's field a few years ago because it was in danger of foreclosure. >> our number one priority is to make sure that the taxpayers are covered for their investment. >> every time there's a game here, i never see much traffic at all. >> reporter: some baseball fans say it will even worse if this space sits empty. they hope a major league baseball farm team would come here because it could attract larger crowds than the independent riversharks. >> if it does happen, who knows what it could do for the city of camden? >> reporter: there's one more thing left to do here and that's

the 70s and seasonably warm as we start out in the morning. you might need a light jacket by 8:00 a.m., noon near 70 rand 4:00 p.m. partly cloudy and mid-70s already. this won't last into the weekend. another cold front moofbs through and temperatures start dropping. we'll take a look at the timing of that and how cool it will get coming up. time's running out for pennsylvania attorney general kathleen kane. in less than an hour our law license will be suspended. it came after she was charged with perjury and accused of leaking secret grand jury information. she could still perform 98% of her job and she'll release more pornographic e-mails linked to a state supreme court justice. she said her political rivals rigged her indictment because she made their e-mails public. pennsylvania ap budget battle is now in its 113th day. political insiders say that governor wolf and lawmakers are not close to a deal.

as additional time passes, more organizations that count on state funding are becoming concerned. one of those organizations that pries educational, health, economic and cultural opportunities to low income visd and families in montgomery county, especially those of spanish speaking heritage. plus the budget impasse is leaving them without the money it needs to continue many programs. >> it's going to end up affecting the teachers. it will affect our children. it's going to affect the program. if aclamo we close the program tomorrow, what will those children do? and what will the families do? >> the organization has some private funding that's helping to keep some programs up and running. congressman patah's son said he's winning his fraud case as he continues to represent himself in federal court. he's accused of tax evasion and miss using money for business

loans to live a lavish lifestyle. heated exchanges between fattah and prosecutors. an earlier roommate said fattah didn't do much in college except eat pizza. >> so do mark zuckerberg and big gates. it's not good so well. they've got a team of people. two experienced people. you saw them blowing up in the courtroom. >> he presented letters from a client that gabe him high marks and says that evidence proves he is a successful businessman. congressman fattah sr. is accused of misusing campaign funds, donations and grant money. he also denies all wrongdoing. his trial is scheduled for next may. congressman fattah is married to anchor renee chenault-fattah.

she's named in the indictment and called person e and an affiliate of the fattah enterprise. she say she fraudulently sold a car. renee is on leave from nbc 10. former first daughter barbara pierce bush will visit philadelphia tomorrow. bush, who is the ceo and co-founder of global health corps, will headline the lecture series. she'll present her personal journey in developing the organization as well as discuss how it has grown and helped to improve health disparities in the area it serves. temperatures unseasonably warm, but that's all about to change. tonight how the forecast is cooling down for your weekend. a 1-year-old boy battling cancer given too much chemo. next why this family says this hospital mistake put their son in danger.

a push to keep a local mall from opening its doors on thanksgiving. workers in gloucester county have started petition on change.org asking that management reconsider opening the mall at 6:00 thanksgiving night. they say it's taking people away from a holiday that's based around spending time with family and friends. we reached out to the mall for comment, but we haven't heard back. also new at 11:00, a life-threatening mistake. the family says the hospital gave their baby ten times the dose of chemo he was supposed to receive. they say it happened at st. christopher's hospital in north philadelphia. now their sick little boy is even more at risk. keith jones reports. >> reporter: an innocent pained face inside a hospital bed fearful of tubes and needles. >> like a nightmare. it's like a nightmare. >> reporter: the father told me it started in august. the doctor told him his little son would only live a week

diagnosed with a rare cancer. >> they told me nobody in this city has it. >> reporter: so he underwent chemotherapy at st. christopher's hospital for children. that's when the family says things got worse. >> they said this is one of the biggest medical mistakes in 35 years. >> reporter: the chemotherapy dose which was supposed to be 3.3 milligrams was allegedly 33 milligrams. a decimal difference, but ten times the right amount, and it was allegedly administered to isaac five days straight. now, isaac is fighting under doctor's care at children's hospital of philadelphia. >> he goes through all these pains and losing hair, crying incessantly from all the pain that he's going through. >> reporter: we reached out to st. christopher's tonight. they declined to comment citing patient confidentiality. but the family provided me with letters. in one, isaac was being treated for a very unusual and serious

cancer. the calculation done was inaccurate. it goes on to say this complication is a cause for gret regret. yet even still this innocent pained face gives his father strength. >> they said it was a miracle for him to even be living now. so it's crazy. so like every day that passes like he's blessed. >> reporter: in philadelphia, keith jones, nbc 10 news. some help for disabled new jersey veterans can be donated, 22 wheelchairs to veterans affairs. the wheelchairs were assembled by more than 100 kennedy managers. the organizations plan to loan out the wheel chairs on an as-needed basis. >> first responders held a safety clinic for kids with disabilities. local k-9 teams the and learned about police and fire fighting safety equipment. the event teaches teens and young adults with autism how to communicate with first responders. >> nearly a half dozen energy

showers maybe later saturday, early sunday. not anything to ruin your plans over the weekend. clear skies across the area. allentown coming in to 50 degrees. it's not very cold o outside, especially not when you compare it to this past weekend. so we certainly had a warmer air mass in place, mid-50s right now in atlantic city. the high this year is 65 degrees. that's where we should be. monday, we were ten degrees below that in the mid-50s. but we climbed up. today we got to 76. then a cold front moves through, friday high temperature only 62 degrees. so when you compare it to how it will feel tomorrow, you mi want the jacket, at least a light jacket throughout the afternoon on friday. right now nice and dry, we'll stay like this as we go into tomorrow. just more clouds moving through. the coldest air is up in canada where you see this snow, but that's really not going to be moving down until we start the weekend. we're not talking about the snow moving in, just that colder air

mass to start off your saturday. so here's what's happening. the cold front is still off to our west. so we are still in that warm air mass ahead of it. tomorrow maybe a couple degrees warmer in some locations than today. but still unseasonably warm. then we go into friday. there you see the cold front moving through friday. that color air moves in from the north and it sticks around for the week. we're talking saturday morning pretty chilly mid-30s around the lehigh valley. mid-40s for the rest of the area. starting off your week, if you have early saturday morning plans, you'll need your jacket for that. clear skies, not as cold. mid-50s in philadelphia. then tomorrow we'll see partly cloudy skies, unseasonably warm again, 75 to 78 degrees. then friday we'll cool to low 60s but that will come with a lot of sunshine. saturday nights dry and sunny but chilly in the morning. mid-60s saturday. saturday upper 60s.
