monitoring what questions they're asking. income 10 news at 5:00 starts right now. >> good evening, i'm keith jones. >> i'm rosemary connors. jurors in the chaka fattah jr. trial wrapped up their first day of dleliberations and headed home. george spencer has been in the courthouse in philadelphia all day. >> rosemary, the judge just dismissed jurors at 4:45 this afternoon. they had come back into the courtroom shortly before that with their third question of the day but told the judge they wanted to address that question when they return tomorrow morning. now, chaka fattah jr. insisted earlier today, recently as this afternoon, that he remains confident about all of this, saying he defended himself as best he could against the massive resources of the federal government. now before that final question today, the jury had asked two previous questions, the first question just procedural.

the second question, though, a series of secret recordings which captured fattah conversing with his former friend for 90 minutes this afternoon, the jury listened to recordings for a second time. you hear fattah talking about high dollar gambling sprees, luxury cars that he and his girlfriend were driving as well as bank loans which prosecutors say he obtained illegally. come back live, as we were watching up in the courtroom, you could tell the jury was listening closely to recordings. again, hearing them for the second time. but with the final question tonight. they admitted to the judge, this was too much for them to take care of today. they will be returning here at 9:30 tomorrow morning to address that question and get back to deliberations. live at the federal courthouse, george spencer, nbc 10 news. >> thank you. new at 5:00, police in bethlehem looking for three masked men caught on video

robbing a store. employees threatened with a knife and forced to handover cash. doug shimell watched video with the police. here's what they had to say. >> it's not normal for somebody to come into the establishment with a mask on. >> reporter: first one, bandanna and sunglasses, second in a fright mask, the third, a gorilla mask. right at closing time, monday at family dollar store, on easton avenue in bethlehem township. >> initially, unshore if it was a joke or if it was somebody coming in with a mask. then unbeknownst to them and shocking and terrified they realized they were being robbed. >> reporter: customers sense something is wrong and leave. clerks realized they better put the cash tray in the safe. the masked robbers show workers a large bowie-style knife and empty out the till. >> they had the masks on enough to keep people at bay. i know when speaking with some of the employees at the scene

the main concern was just cooperate and go 'do what they were told so nobody got hurt the. >> reporter: lead robber points to the open safe and shoves the manager out of the way and gets cash. area police departments onc3ñár alert after two masked robbers shot and killed by store owners two days earlier on halloween. >> it's a noticeable and distinctive sweatshirt. >> reporter: in the bethlehem township knife robbery, mc and 02 on the sweatshirt may be what breaks the case. >> we have multitude of tips coming in and following all to catch them. >> reporter: investigators say clerks and customers did everything right and that is why no one got hurt. if you have any information on this case, call bethlehem township police in bethlehem township. i'm doug shimell, nbc 10 news. new at 5:00, students at philadelphia's frank further

high school went home an hour earlier after reports of two guns on campus. someone called the school before noon and reported guns. the school placed on lockdown and dismissed early so police could sweep the school with canines. no guns were found. investigators are calling a fire in mercer county suspicious after flames ripped through part of an abandoned home. sky force 10 over the house in hamilton right after 1:00 this afternoon. one firefighter was hurt but will be okay. the fire was contained to the second floor. in philadelphia, police are trying to identify a young girl, hispanic, found dead in the delaware river. over the scene of the lyndon avenue boat ramp in torresdale. the medical examiner is performing an autopsy to determine how the girl died. today, jim kenney spent his first full day as philadelphia mayor elect after his landslide victory to be the city's 99th

mayor. kenney walked through some plans at a south philadelphia school, fitting location, too, with education being a top priority. the former city councilman tells us he's working with people on his plan to give all children access to pre-k. >> we're going to get money, find the money, we're going to find money in our current budget and also go out and philanthropy and corporations and whoever else wants to help and we'll cobble it together and make it happen. >> he plans to have town haulz with neighborhoods before releasing a transition report in january. tomorrow we should find out who's heading up his transition team. pennsylvania voters make history of the election for the state supreme court. we'll talk to a legal expert about what the democrats' sweep of open seats means for people all across the state. to a developing story in the lehigh valley. kraft-heinz downsize, closing the plant in upper macungie with

six others in the u.s. and canada. kraft and heinz merged earlier this year. lehigh county plant make a1 steak sauce, mustard and coffee products for keurig. >> thanks to the south port project at the port, the governor hopes to add between 600 and 7,000 well-paying jobs. crews in the midst of dredging the delaware river in an effort to attract more business by allowing larger ships to stop at the port with cargo. the work is on track for completion 2017. >> need to make investments but need to make investments that are wise. this is not something that where government is trying to push water uphill. this is a great resource already and all we're trying to do is nudge the market to recognize we already recognize. >> the port has had another

year, by the way, of double digit growth in cargo movement. today the governor addressed budget stalemate in harrisburg as the commonwealth enters its fifth month with no set budget. the governor told us, budget is a constant topic in harrisburg. progress is being made and lawmakers need to come to a decision soon. >> let's talk about the weather now. calendar may say fall but it feels like spring outside. nbc 10 in dover, look at this, people wearing shorts. some people rolled up their sleeves and for good reason, too. beautiful. >> don't put summer clothes away. take a live look at boathouse row where the sun should be just about beginning to set for the night. but for now, we can handle the shorter daze with the near-record setting weather. >> makes it easier. meteorology sheena parveen joins us now. this could be record breaking toward the end of the week. >> today we got to 80 degrees in

philadelphia. the record high is 81. so we almost matched that record high. we have since dropped down 71. now that the sun has set. temperatures starting to cool off quickly. as we go to the end of the week, we have more near-record temperatures in the forecast and even friday could be a record high or at least matching it. so right now, temperatures mostly around 70 degrees through the area. by 6:00 p.m., clear skies, pretty mild still, 67 degrees. by 8:00, temperatures in the mid-60s, feeling nice. by 10:00, 62 degrees. there are some areas by 10:00 p.m. that should start to see clouds move in or late fog. we have fog in the forecast through tomorrow morning. still, another warm day, though, by the end of the week, that's when we could see record high temperatures. big changes for the weekend. talking about bigger cooldown making it feel finally more like fall. i'll show you how cool it will get after the bigger warm-up coming up. >> looking forward to that.

gunshots, sex in neighbors' yards and bullet holes in homes. >> neighbors in one dover community say a community lodge is causing all of those problems and they're fighting to push it out of their town. >> technically their vote means nothing. but now community leaders are taking action tim furlong explains the problems. >> reporter: a quiet working class dover neighborhood by day. by night, different on kirk wood street. >> loitering. shots fired. fighting. sex. people's yards. throwing trash. >> reporter: the trouble emanates from the international elks lodge in the middle of the block, packed in between two homes. this is trouble. >> right up in here. >> reporter: a few neighbors told me stories involving gunshot. >> lasted -- you can see like we're seeing now the damage. >> reporter: and we checked with police, they say they are here often. they sent me a list of the complaints this year.

neighbors say when this play closes in the early morning hours the street becomes rowdy and dangerous. through the mirrored windows you can see a list of people banned. on tuesday, neighbors voted to have the place relocate. >> it's a nuisance and ready for it to go. you cannot hold a community hostage in their own community. >> reporter: the vote was largely symbolic. a representative of the club tells me, they and guests, they're not the problem. he says bad stuff happens after the club closes. and he says it happens all over the neighborhood. he say his does not believe the club should have to go. neighbors want habitat for humanity to offer to buy the property. until something happens they are sure problems will continue. >> you're just like, all right, time to go upstairs and go to the back and hopefully the police get here in time before anything else happens. >> reporter: in dover, tim furlong, nbc 10 news. new at 5:00, law enforcement officials in delaware are going

insurance coverage has expanded nationally and you may now be covered. contact your health plan for the latest information. >> nbc 10 breaking news. >> we continue to follow this breaking news out of the san diego. the s.w.a.t. team is involved in a stand-off with a man who has been firing a high powered rifle inside an apartment complex. the gunman is holed up in his rooftop apartment right now.

officers were responding to a domestic violence call when they exchanged gunfire with the suspect. the san diego airport had to stop arriving flights for a short time but now operations are back to normal. right now there are no reports of anybody hurt in the incident, and it's unclear if anyone is inside that apartment with the suspect. we will keep you posted. elsewhere, police in northern illinois say one of their own made his death look like a homicide, in real it was a carefully staged suicide. fox lake lieutenant charles gliniewicz's death set up a large manhunt in september. police searched for three suspects gliniewicz said he was chasing. investigators said it was staged to cover up years of stealing from a police youth program. >> thousands of dollars were used by gliniewicz for personal purchases, travel expenses, mortgage payments, personal gym memberships, adult websites, facilitating personal loans and

unaccounted cash withdrawals. >> investigators say the stealing had been going on for seven years. closer to home, case of the police officer in dauphin county accused of murder is in the hands of a jury. the officer shot and killed david kasich in february, prosecutors claim it was murder. the lawyers say it was self-defense. video from the taser shows her shocking kasich, shooting him in the back. defense team thought she was reaching for a gun. the father of a prison guard killed two years ago was in washington. pushing for better protection for officers. his sonn worked in wayne county pennsylvania. 2013, prosecutors say an inmate pushed williams down a flight of stairs and stabbed him to death. williams' father says conditions inside the prison walls need to change to keep guards safe.

nbc/"wall street journal" poll. but the election is actually one year and four days away, what a difference a whole year can make. at this point in the 2008 race a year out, rudy giuliani was the republican front-runner and the front-runner on the democratic side was hillary clinton with a 22-point lead over barack obama. steve handelsman, nbc news, washington. you're not going to believe this. supporting democratic presidential candidate bernie sanders is taking on a new meaning. take a look at underwear sanders' face and the words "feel the burn" online for a man and women. idea came from the "saturday night live" skit with larry david impersonating sanders. in it david complains he owns one pair of underwear and that is billionaire competitors have three and four pairs of underwear. for the record, if you're interested in the quote feel the

burn bernie sanders underwear, sell for $15 a pair. >> now you're nbc 10 first alert weather with meteorologist sheena parveen. >> i'm sure larry david was wearing a pair, too, doing that skit. as we go into the rest of the week, the warmth that you felt today that's going to continue. today we had near-record warmth. the average highs 60 degrees. we got to 80 degrees 20 degrees above form. high is 81. i'll show you the rest of the week with the records. tracking showers as we go into tomorrow and a big cooldown as we go into the weekend. clear skies across center city, nice conditions. 71 degrees in philadelphia right now. so we are still 11 degrees above normal, though the sun set. we hit 80 degrees the actual high was 81. sorry, record high 81. that's why we're close to the record. tomorrow the record high's 80.

we should be around 70 with clouds and showers. look at friday, record highs 79 degrees. forecast is 80. we could match or hit that record high temperature, get warmer than that, as we end out the week. it won't be lasting. we'll get cooler as we go into the weekend. right now most of the area still around 70 degrees. so it's fairly mild for this hour of the evening. we'll stay nice and dry as we go through tonight with milder temperatures. but see more clouds moving in late. down to the south, you see showers, cloud cover and some of the slowly going to try to move in. so tomorrow, regardless of the cloud increase, we're seeing mild temperatures. future weather, warm air sticks around. then overnight, we'll see pappy fog. early tomorrow morning showers starting to move in. so the rain chances go up. for friday, clouds are still here. late showers, still going to be warm to end out the week and notice cold front off to the west, that's going to move in

time for the weekend. saturday we can have showers to our south. we go through the rest of the weekend, colder air starts to move in. colder saturday. even colder for sunday. high temperatures sunday will be in the 50s. compare that to 80-degree temperature that we had today. big difference going into the weekend. tonight, clear skies early. then we'll get cloud increase late, even fog. 56 degrees for philadelphia. 48 areas north and west. tomorrow warm day, around 70. not as warp as today but clouds will be moving in, still a chance of shower for tomorrow. not giving us as warm temperatures as we saw today but friday back around 80 degrees. that would be a record high temperature. saturday drop to 67. sunday, ten-degree drop from that. 57 for the high. next week we start climbing back up again, 67 by next wednesday and then you see average high at the bottom of the screen, 60 degrees. our pattern has been relatively

volunteers from home depot, habitat for humanity spent the day in the burlington county building a duplex. crews put up framing and installed drywall. the homes will help to restore independence for a veteran in need. it's a way to give back to those who of course give so much to keep us safe. >> it's definitely part of our core values and to give back, veterans do so much for us. it's the least we could do. >> good reason, too, the project will take nine months to complete. >> veterans day around the corner, too. one local group serves their military all year round. >> right. tonight asking for your hope. operation gratitude sends care packages to soldiers overseas, wounded warriors, veterans and nursing homes and hospitals and to the families of soldiers who don't make it back. asking for donations like toiletries, nonperishable snacks and clothing. today on nbc 10 news at 11:00, organizer of the program told us

district refuses to move him. deanna durante sat down with the boy and his family today. >> they say that i -- that they were going to hit me so hard i was going to run back to mexico. >> reporter: he's 11 and afraid. we're not showing his face or using his name. the student at eisenhower middle school has not returned to school since the last attack. he says his nose was fractured. >> first time i got hit during computer class the second one hit i got hit not hit, but shoved my face into paint. they bent what? >> bit me. >> reporter: bit you? >> yes. >> reporter: the boy's parents sent letters requesting a transfer and sent supporting letters. the school district won't talk about the letters or the boy's claim. they sent a statement, appropriate action is being taken regarding the specific student and other students that may be involved. >> i'm very angry for two years

this child has undergone constant physical and emotional abuse and nothing has been done and he simply wants to go to school and be at peace and be transferred. he's asked for that. mom appealed to the state, nothing's been done. >> reporter: the doctor says the family reached out to him for help. he says as an advocate and school principal in new jersey. the district failed the boy who fears returning to school. >> i don't want to get hit anymore there. plus, also in that school that i go to, i don't feel really safe anymore. >> reporter: the boy did dplin school district administrators and teachers after each attack and teach anti-bullying is helping the family appeal to the state. in norristown, deanna durante, nbc 10 news. another case of bullying in south jersey ends with a lawsuit. fired as vice principal and

athletic director, he says because he witnessed the student being bullied by a staff member and reported it. the alleged bully was the boyfriend of the school's founder, he filed a whistle-blower lawsuit. the academy has no comment. update on the baby boy with cancer who received potentially lethal dose of chemotherapy. the parents tell us he's critical, but his condition is improving. it took photos with the 1-year-old infant this morning at children's hospital of philadelphia. transferred here from st. christopher's hospital after the family says doctors at st. chris' gave isaac ten times the amount of chemo needed to treat his cancer. isaac's father tells us, he understands why his son's situation must be troubling for other parents who have children with cancer. >> i knew in the back of their mind they probably wondering, w wow if this can happen to him, imagine my child. i wouldn't want this happening to nobody's child.

>> st. christopher's previously said administrators are deeply sorry about the situation and working to prevent something like this from happening again. it's called one of the biggest shakeups in court history. all three open spots in the pennsylvania supreme court went to democrats yesterday. >> it comes after the most expensive judicial campaigns ever, shifts majority to the democratic party. this, as the state supreme court prepares to decide on several high profile issues. joining us now, live in studio, pennsylvania legal expert and political adviser, james schultz, regional field director for the bush-cheney presidential cam name 2004, plus served as general counsel to the commonwealth of pennsylvania under governor tom corbett and worked in the u.s. attorney's office for the eastern district of pennsylvania. >> live in the digital operations center. the question, i think, everyone is wondering is, how significant is this switch in party majority in the supreme court? by that we mean how does this

affect people? >> well, the issue at hand that comes to mind first what insiders are talking about, the impact that it will have on redistricting in the -- after the 2020 census. the supreme court of pennsylvania makes rulings on the constitutionality of the maps drawn by the legislative apportionment committee. the legislative apportionment committee made up of five members, four of whom members of the democrat and legislative caucus, equal two and two, and republican legislative caucus, and one is elected by the board if they can't come to an agreement on who chairs the board, the supreme court makes the pick, and that's the tiebreaking vote on the commission. >> james, what other important issues will the state supreme court be deciding and how does this impact the fact that we have new people on the court? >> well, i think that the politics of the court, once judges are elected to their positions, the politics really

budget plan to city council as we speak. under the proposal the earned income tax imposed on city residents would jump from point 8.3% to 1.15%. it's an increase that would generate $5.5 million in revenue. >> what a beautiful day to spend some time at the park with the kids. families in doyles town, bucks county, right idea. feels like spring or summer than the start of november out there. >> perfect day to be outside. today in philadelphia we hit 80 degrees. i can't believe that. let's talk to nbc 10 first alert meteorologist sheena parveen. how long is this going to last? >> the warm streak is going to last for the rest of the week. you mentioned we hit 80. average high is 60. we were 20 degrees above normal today. yesterday we were at 76. today we hit 80. tomorrow we'll be around 70. still ten degrees above normal. we go into friday and talking about another 80-degree day.

development to the crash of the russian passenger jet in egypt. >> that's right. explosive device is now suspected of bringing down the airbus jet. all 224 people on board were killed over the weekend. officials from both the u.s. and britain now believe that it was a bomb. the investigation is reportedly focused on the possibility that isis is directly involved. investigators are looking at the possibility that an explosive device may have been planted aboard the plane by ground crews, baggage handlers or others at the airport before take-off. >> we cannot categorically say why the russian jet crashed but we and have been firm the plane may have been brought down as a result of an explosive device. >> coming from the u.s. and britain but russian and egyptian officials have said terrorism did not play a role in this crash. >> think about this now, you soon have to pay a toll to drop people off at the airport? why officials in new jersey at
