the clouds have advanced quite a bit just during the day today. there's still no rain around, but it's getting closer, as you can see, the clouds, of course, have come in and this is a large area of rain that's getting closer and closer to washington, d.c. it's, obviously, going to hit delaware first. and that area is going to be pretty wet by the morning rush, that's for sure. near 60 degrees now, upper 50s in much of the rest of the area. remember the average high is only 59. we've been spoiled last week because of all that warm weather, so these temperatures are more typical for this time of year. 7:00 it's still just cloudy and on the cool side, but midnight the rain starting to move in. probably already raining by midnight in delaware and extreme south jersey, just starting to move into parts of the philadelphia area, and by the morning rush tomorrow it's going to be wet. 57 degrees, not especially cold, but when you combine that rain

with all the leaves that are still going to be on the ground, you can add to slippery conditions. more on the timing of this rainfall, when the heaviest is expected, and where with the seven day in just a few minutes. >> now from our delaware bureau, a 30-year-old murder mystery sends police all the way to georgia to make an arrest. >> officers found joseph braun beaten to death in 1985. nbc 10's tim furlong shows us how they cracked this cold case. >> it was a hot day. >> reporter: linda remembers july 1st, 1985, the day her neighbor, 54-year-old joe braun was found murdered in his fairfax home. the 54-year-old robbed and killed with a hammer, his honda found in philadelphia a week later. >> when they went up the steps, there was blood on the walls. so they didn't go any further, they came down and called police. >> reporter: the crime was never solved but in 1999 two men went to police and learned their relative, who had recently died, had killed braun. that man's girlfriend, police

couldn't find her or link her to the case, but last year two detectives say sander had been arrested in 2001. police used forensic evidence in the national database to link her to braun's murder and his car, they were able to track her down. >> yes, there was some indications she was living in dalton, georgia. >> she was found in a homeless camp in georgia charged with braun's murder. she will soon be brought back here to delaware. >> i'm just totally surprised, and glad. i'm glad they caught the person. >> reporter: it's a big win for the new cold case team, the first of many they hope. >> feels great, to be able to reach out to a family member and say, hey, we're able to give you closure. >> reporter: tim furlong, nbc 10 news. take a look at this scene captured by sky force 10 this afternoon. a temple police patrol car was badly damaged after it caught fire at a gas pump in north philadelphia. this happened at broad and gerard. no one was hurt here. traffic is moving now, but that was not the case this morning

just off route 100. sky force 10 above this overturned tractor trailer. traffic was plblocked until the semi could be pushed to the side. the driver of the truck was not injured. new information for the president of the university of missouri stepping down after a group of players threatened to hang up their pads amid tensions at the university. the announcement comes after months of student and faculty protests. denise nakano is live tracking the developments in the digital operations center. denise? >> jacqueline, the decision comes after black football players at the university with their coach's support threatened not to practice or play again until graduate student jonathan butler ended a hunger strike. wolf announced his resignation as students on campus gathered for a protest. anger and frustration had built after a number of racist incidents on campus, which

included a swastika drawn on a dorm wall. this is the first step in a long journey for this campus. >> the university of missouri is showing itself to be a leader in making things happen and listening to their students. >> reporter: graduate student jonathan butler in the midst of an eight-day hunger strike responded to the resignation that he's ended the hunger strike. no immediate word if the football players will agree to take the field, but if the team does not show up for saturday's game, the university could face a $1 million cancellation fee. live in the digital operations center, denise nakano, nbc 10 news. funeral services were held today for the autistic louisiana boy shot by officers who were chasing his father. state police say 6-year-old jeremy mardis was buckle into his seat belt in the front passenger seat when he was shot. unclear why the officers fired.

initial reports indicate they were serving a warrant on the boy's father, chris few, but police say no warrant was ever issued and new police body camera video shows the father had his hands up as officers opened fire in the car. the marshals are now being held on $1 million bond, charged with second-degree murder. few survived the shooting but has not been told of his son's death. in maryland, this was the scene of the most difficult crash they've ever handled. it happened just outside washington, d.c., left four people dead, including a child. investigators believe a pickup truck rear ended a car, then got hit by a church van. witnesses tried to put out intense flames with bottles of water. eight people, including four young children, are now in critical condition. this happened yesterday. a fishing boat that was sinking off the coast of the jersey shore made it back safely yesterday, but that's not before it made distress calls that sent the coast guard out on a searching frenzy. >> mayday, emergency, we're

taking on water. something blew in my engine. take the wheel! >> turns out the boat had already made it safely back to shore while crews were out searching. no one was hurt. new jersey governor chris christie vetoed several bills aimed at helping atlantic city and its struggling casinos. he says it's because the bills would do little to put the town on the path to recovery. one of the bills would let casinos make specific payments rather than pay taxes, which could increase each year. the governor did sign a bill giving atlantic city schools extra aid. and it could soon become legal to get high on marijuana in new jersey. a committee plans to meet next week, possibly legalizing recreational pot use. new jersey has already legalized medical marijuana but it's unlikely governor christie will support any changes. speaking of changes, we're following major developments in pennsylvania's budget battle, specifically regarding education

funding. let's get right to nbc 10's keith jones live with the details here in the studio. keith? >> a source close to governor tom wolf tells us state lawmakers have reached a tentative agreement on school funding but doesn't mean we're closer to a final budget deal just yet. the source says they want to increase education funding for grades k-12 by $750 million over a two-year period. to put that in perspective for you, that would be the single largest increase in education funding in state's history. lawmakers have agreed on those numbers, they are still trying to figure out how they are going to pay for all of it and it's possible if they can't agree on that, they could be back at square one again. this comes days after governor wolf expressed hope that a final budget deal could possibly be reached by thanksgiving. pennsylvania has been without a budget for 131 days. keith jones, nbc 10 news. jim, back to you. >> all right, keith. 20 minutes of news continues with two americans killed in jordan today and we now know

they were part of a state department police training program. a jordanian policeman opened fire at a police compound that left two americans and a south african dead according to a spokesman for the jordanian government, which portrayed the shooting z a crime. both jordan and the u.s. say there's a lot more to investigate. >> the investigation is taking place, we take this very seriously, and we'll be working closely with the jordanians to determine exactly what happened. >> president obama made those remarks today during a meeting with israel's prime minister benjamin netanyahu. the president said the leaders are looking for common ground as they discuss the rise of isis and the iran nuclear deal. a drug watch dog group says russian athletes should be banned from next year's summer olympics until the country cleans up its act. the world anti-doping agency panel says the russian government is involved in a coverup by its track and field athletes. the agency says the russian

intelligence agency spied on russia's anti-doping lab to help find some of the problems. because of that russia could face sanctions. seaworld has announced it's ending its controversial killer whale shows. it plans to phase out the shows by 2017. this comes after criticism over the treatment of the orcas. the park plans to replace the shows with a different kind of orca experience that focuses on its natural setting. it's unclear whether the shows at seaworld parks in orlando and san antonio will also be phased out. i love that music, especially when they win. today eagles fans are celebrating the overtime victory against the cowboys. the eagles and the cowboys are rivals already. we noted controversy surrounding the cowboys greg hardy added fuel to the fire in last night's game. >> danny pommells is joining us now from comcast sportsnet. danny, that in a moment, but first breaking news about the eagles.

tell us about it. >> yeah, no doubt about it. we'll get to greg hardy in a moment, breaking news is not good, they have lost jordan hicks for the entire season. hicks was placed on season ending injury reserve with a torn pectoral muscle. he provided a big boost for the season to be sure, including a reception return for a touchdown, before suffering the injury late in the fourth quarter. the eagles face off with cowboys defensive end greg hardy for the first time, he missed the first meeting while on suspension due to a domestic violence arrest while he was with the panthers in may of 2014. the judge found hardy guilty but charges were dropped on appeal after his ex-girlfriend refused to cooperate with the district attorney's investigation, but last week deadspin.com published graphic photos of hardy's ex-girlfriend they say they received from police sources. backlash against the hardy campaign and the cowboys for signing him. he was on the field for the

final play before he threw that game winning touchdown to jordan matthews in overtime to seal the victory. eagles didn't hold back when talking about hardy. >> i definitely, if i had my -- give him something extra. usually quiet and don't try to speak ill of anybody else, but three people i don't really have respect for, it's people that hit women, rapists, and child molesters. for whatever reason, those crimes to me stick out as you're taking advantage of somebody who's defenseless, pretty much. pretty odd to me somebody can play that quickly after, obviously, all the evidence coming out now, whether he should play at all. it's a really bad situation for the nfl. >> hardy did not speak to the media following the game. cowboys owner jerry jones and head coach jason garrett said they have not changed their views on hardy since the release of the photos and everyone deserves a second chance. more on the eagles at 5:00. for now, danny pommells. let's go back to you. >> danny, thank you.

a touching assembly at a school in center city today. students at roman catholic high school honored vets of the vietnam war 40 years later. the teens read letters that reveal the personal sacrifices of those who served our nation, veterans who attended the school, along with current students' family members were invited to take part. in berks county, a 25-foot fir tree will serve as the official holiday tree for the city of reading. professionals cut down the tree in an event today. it will sit in penn square where a tree lighting ceremony will take place in a few weeks. it's a larger tree than last year's, which came to be known as the charlie brown tree because of its sparse branches. the city adorned it with just a single bulb like the tree in the peanuts cartoon "a charlie brown christmas." local students with big hearts get a shoutout today. >> recognized for making life a bit better for other people. a senior at the high school is

winner of the high school leadership award. mia is the brains behind a 12-hour event that raised more than $25,000 for childhood cancer. >> for 12 hours students came to school and they slept over overnight and the goal was to not sit down. it has similar effects children going through cancer have. >> mark pino was also honored for starting his school's think before you speak campaign. that was developed as part of the gay/straight alliance. school officials can nominate juniors from our area for next year's award. >> tap the nbc 10 news app for more information. now your nbc 10 first alert weather with chief meteorologist glenn "hurricane" schwartz. >> yeah, it's feeling more like fall outside today. nbc 10 in montgomery county this morning. a man took advantage of the dry conditions to clean up some

leaves in the yard. you want to get the leaves out of the gutters, because there's going to be a lot of rain. you don't want it to be clogged. let the rain go down into the gutters and probably won't have any significant flood problems tomorrow. we are tracking rain and it's likely to be a wet morning rush and a wet afternoon rush. the morning rush may be wetter than the afternoon one, though. we have cloudy skies now. the clouds have been thickening up all day. 60 degrees, the winds have calmed. two degrees warmer than we were at this time yesterday. despite the fact we're going to be getting a good deal of rain, i think the flood threat is generally only on the medium side at best, and that's the main threat for tomorrow. not expecting thunderstorms, we have an east wind coming in that stabilizes the atmosphere, so the main thing we're watching out for is the rain and especially on top of the leaves creating some of that localized flooding. right now we are in the 50s

across much of the areame. we already have a wind out of the east coming off the ocean but, of course, it's pretty wide as far as the strong winds. 58 in mount holly and washington township, 57 in ricetown, 58 degrees in trenton. and in beach haven, the wind's going to be increasing off that ocean tomorrow. so it's going to add to the chill that we're going to be seeing. it's dry for now, but starting to see some radar down into maryland. not reaching the ground yet, but it's a sign the atmosphere is getting more and more moist up this way and you can see the motion of that rain. very clear and very obvious that it's going to rain around here. no doubt about that. here's what's likely to happen through the evening. some of the rain coming up, especially into delaware and extreme south jersey by about or

before midnight. and getting into the philadelphia area before the morning rush. and then getting heavier as the rush goes on. this area in yellow, band of some pretty heavy rain coming through during the morning hours. may get a bit of a break for a little while, then here we are in the afternoon, still kind of damp. so i don't think we're going to be drying out by the afternoon rush. still be on the wet side. we do dry out tomorrow night, and that sets us up for a dry day on wednesday. then a cold front comes in on thursday. that's a different kind of weather system. it's not going to be a steady rain. we have showers coming in during the day on thursday, and that will also be likely thing to happen. how much rain? here's one of our computer models showing a half inch to an inch of rain, little bit more in parts of delaware than other parts of the area. like i said, a lot of that rain

falling right during the morning rush. so the rain spreads to the north and it's heaviest in delaware late at night. first thing in the morning. 52 for the low. not all that cold tonight. it was down into the upper 20s in allentown this morning. so periods of rain, bit on the heavy side tomorrow, high temperatures only into the low 60s, but average high is only 59. clearing conditions on wednesday. milder on thursday with some showers coming in. friday, we have cold conditions, 53 degrees for the high on saturday, then by the eagles game on sunday, it's dry, but it's chilly. new jersey trying to decide if fantasy sports should be considered gambling. today testimony from industry executives who claim fantasy sports are games of skill. if fantasy sports are considered gambling, voters will have to

now to an important reminder about package delivery thefts, especially with the holidays right around the corner. police are trying to find the person who stole a package right off someone's front stoop in philadelphia's grays ferry neighborhood. if you recognize the person here in this video, call police. to prevent your mail from being stolen, ask a friend or neighbor to receive important mail for you if you can't be home during the delivery day. tell the post office when you'll be out of town so they can hold your mail until you get back. and if your mail is stolen, report it to your local postal inspection service. are you on facebook?

well, if you're using social media to bring holiday cheer, buyer beware. if you spend time on facebook, you may have noticed people posting and reposting messages about the secret sister gift exchange. it claims you buy one gift for $10 and in return you get 36 gifts sent to you. it may sound enticing, but experts warn users to watch out. they say it's not only a pyramid scheme, it violates federal law. >> also, it's against facebook's terms of agreement, so there's a potential that facebook if they got wind of this, could block your account. >> besides being illegal, scammers can use your information for whatever they want. gift cards could be even more popular for the holidays. the reason, gift card fees are on the decline and card security protections are up. a report released today by bankrate.com found half the cards surveyed now offer the option to add a security code that protects the balance on a

this is nbc 10 news. >> "empire" is one of the most popular shows on television. now a local man claims that concept was his idea and not philadelphia native lee daniels. >> this could be big, right? that man is making his case to the nbc 10 investigators.

harry hairston joining us now with the exclusive interview. harry? >> the story sounds like a tv drama that local actor and writer clayton print. >> i need you to sing like you're going to die tomorrow. >> reporter: empire premiered last january. the hip hop themed show co-created by lee daniels caught the eye of clayton prince. aid, okay. lee daniels, all right. the pilot is a lot like my show. the characters, a lot like mine. >> as an actor on the cosby show and soap opera on "the other world," but it's his idea for a music industry drama that he says daniels store. >> tell me the story, man, that's like a soap opera.

>> prince tells us he took those stories and in 2004 wrote a script for a show called "cream." in 2005 he copyrighted it and produced a dvd. >> i tried to shop it, didn't have a lot of success shopping it on my own. i guess i didn't have enough clout, which is why i went to lee daniels. >> prince said he got his chance to pitch his idea to daniels in 2008 at an event sponsored by the greater philadelphia film office, where writers and potential producers get a chance to pitch their story ideas to a panel of professionals. he showed us this letter from the greater philadelphia film office saying as part of philly pitch prince described the tv concept "cream" to a panel that included lee daniels. the head of the film office confirms to the nbc 10 investigators she wrote the letter. after the pitch, daniels never called him. then on january 7th, 2015, prince saw "empire." >> i should own half of your

company. >> and i want half my company back. >> prince put together comparison videos of "cream" to empire, he believes it illustrates the show's similarity. >> try again, everything you got into it. >> i need you to sing like you are going to die tomorrow. >> could this not all be a coincidence? >> based on the conversations i had with a copyright attorney, three or four things may be considered a coincidence, not ten things in the same one hour of program, no. >> some copying is okay. >> temple law professor gregory mandel specializes in copyright law. >> it's okay to copy fact. it's okay if you take somebody else's idea. >> that's why copyright infringement is tough to prove. he tells the nbc 10 investigators almost all cases settle out of court with no determination of who's right or wrong. >> in order to prevail in a copyright infringement lawsuit,

the plaintiff has to show there was actual copying by the defendant and that the defendant's infringing work was substantially similar to the copyright, to the protected copyright material. >> we contacted daniels agent, creative arts agency, they referred us to his publicist sunshine sachs. sunshine sachs has not responded to our phone calls or written response to a comment. we also reached out to 20th century fox. they responded "no comment in this matter." prince says he wants to see lee daniels in court. >> i want to be treated fairly. i want to be known as the creator of the show. >> prince says he plans on suing daniels in federal court in philadelphia. at least three other people have publicly stated the idea behind "empire" was theirs and say they plan to sue. in an interview with sirius xm,

co-creator dan strong says the show was based loosely on jay-z's life. for the investigators, harry hairston, nbc 10 news. here are some of the stories making headlines on nbc 10 news at 4:00. three district attorneys told pennsylvania legislators you need a law license to do just about every aspect of their job. they testified today before a senate committee looking into state attorney general kathleen kane. kane's law license is temporarily suspended while she fights charges including perjury. the panel wants to know who's making the decisions in kane's office right now. should immigrants be allowed to legally drive? that question is at the center of new legislation in new jersey. community groups and elected officials held a news conference today to call for the approval of the legislation. they say training and insurance measures would make the road safer for everyone. >> this acknowledges that people are here. they are working hard for their families, they are trying to make a living, trying to do the right thing and children born here now in this country deserve

video right here. whatever the cause here, more than a dozen cars swallowed up in this hole formed in an ihop parking lot in mississippi. witnesses say the ground just gave way with a giant boom. no one was hurt here. officials say it's not a sink hole. engineers are now working to figure out what it is and why it happened. police in alabama are investigating after video showing officers violently arresting college students went viral. >> using a stun gun on a university student. they were pulled from an apartment after a noise complaint. you can see officers repeatedly hit another student on the ground. the video is now in the hands of internal affairs. next on nbc 10 news at 4:00, researchers are telling doctors to rethink the way they treat high blood pressure.

this is nbc 10 news. >> it's a new way to fight an old problem. >> ground breaking new study finds doctors could save lives if they get more aggressive with their approach to high blood pressure. right now doctors typically treat high blood pressure by reducing the systolic reading to 140 or less, but now there's evidence aiming for a much lower reading of 120 or less saves

more lives, especially for adults 50 and up. however, some doctors worry about the side effects linked to higher doses of heart medications, which can include fainting and kidney damage. >> we don't want to ignore these results, but we want to understand these results before we change practice across the country. >> researchers are still trying to figure out if the lower blood pressure had an effect on memory. those results won't be ready until next year. there's a new push today for seat belts on school buses. it's a big turn around for federal safety officials. the head of the national highway traffic safety administration wants to see three-point seat belts on all school buses. in the past federal guidelines left the decision up to state and local jurisdictions due to the high cost of installing the belts. now the safety administration plans to encourage bus makers to voluntarily install them. new jersey already requires seat belts on school buses. volkswagon is trying to make things right after its emission test cheating scandal with gift

in the last couple of hours. 60 degrees. the relative humidity, though, at the surface is very low, only 35%. it will take a while to moisten up the rest of the atmosphere. the clouds are up there, rest of the atmosphere below it is too dry, at least for now. temperatures in the mid 50s to near 60 degrees. of course, philadelphia the warm spot at 60. so far we've had 61 degrees during the day today. you can see that is the warmest one in the area, and it's a little bit above average. average high is 59 for this time of year. the rain getting a little bit closer. the first of the echoes not reaching the ground because of the low level dry air, but you can see there's plenty of moisture surging up this way. there's really nothing to stop it from raining, and it certainly will. as you go into the evening hours, temperatures not dropping a whole lot because of all the clouds, and here comes the rain into delaware, extreme south jersey first, into chester

county and delaware county and philadelphia area, right around midnight, and then continuing to spread to the north. the main area of rain looks like it's coming during the morning rush, as you can see here, some of that heavier rain with the yellows and the reds, and that is occurring right during that difficult time. we also have one of the leaves on the ground, that makes driving even more slippery. we have the rains, also want to make sure the gutters are unclogged by some of those leaves, because you don't want to leave to some localized flooding just because of that as opposed to the heaviness of the rain. may taper off later in the day, but still going to be damp. the roads are still going to be wet, probably for the afternoon rush hour, and it will take a while to clear out. that will happen during the day on wednesday. that allows temperatures to go back up into the 60s, more

comfortably in the 60s, then a cold front is going to be coming in on thursday. wednesday afternoon, that may be the nicest part of the week here as we go through the rest of the week. we actually have a tropical storm today, not that far off florida. tropical storm kate, and 45 mile an hour winds moving to the northwest, general direction of the united states right now, but take a look at what the computer models are saying as far as where it's going to go. every single one of them has that sharp right turn and going out into the atlantic. that storm that's hitting us that's going to push kate out, well, maybe towards bermuda, but eventually out to sea. the rain spreading north, becoming heavy in delaware. late tonight towards the morning rush, 52 for the low in philadelphia, 44 north and west. and during the morning rush, that could be the heaviest of the rain.
