during the night. we'll let you know if it's going to be gone by tomorrow morning's rush, rest of the seven day in a few minutes. >> all right, glenn. nbc 10 is also watching the roads to see if the rain is causing problems for your commute. i have a feeling the answer is yes. here's a look with jessica boyington. >> yeah, normally we're used to right now once it rains problems on the schuylkill, on 95 first, but right now we have a problem on the new jersey turnpike. around exit 4, at the top, tons of police activity, next lane being blocked on the way down. one lane moving through on the northbound side. that's right around route 73 around exit 4 right now. so big backup behind that point. otherwise, our drive times are still okay. 95 southbound into center city a 20-minute trip, eastbound to center city on the schuylkill 25. westbound worse, but just a little volume, not a lot of incidents to report right now.

blue route southbound 25 minutes there. but big problems at the airport and it's been that way since this morning. low ceilings, so they have a traffic management program in effect for arriving flights at the philadelphia international airport, now 46-minute delays and just a heads-up some departing flights may be affected, as well. this isn't weather related, but we have detours. 7, 23, 68, and g due to the u.s. marine corps birthday celebration today until about 10:00 p.m. tonight. >> all right, jessica. you can get weather and traffic updates any time on the nbc 10 app. you can also get alerts for your neighborhood and get those sent directly to your phone. to breaking news now out of montgomery county and the details are disturbing. a man there accused of breaking into a hatfield township apartment and raping a 6-year-old girl. oscar rivera's being held on $1 million bail this afternoon. police released details about

his arrest within the past hour. they say rivera broke into the apartment yesterday morning, drank several beers, and then raped the girl in her bed. her 11-year-old brother called 911. officers say they arrived to find the girl's step father holding rivera at knife point. they also say rivera admitted to breaking into the same apartment several months ago but no one was home. the district attorney's office is holding a briefing at any moment. we'll bring you new details as soon as we get them. and now to more breaking news we're following along the new jersey turnpike and burlington county. state police on the scene after a body was discovered just off the road. this is a live picture from one of our traffic cameras. this is happening in the northbound lanes in mount laurel. the route 73 interchange, you can see all the officers on the shoulder of the road. it's unclear how the person died. we will continue to monitor this situation. 20 minutes of news continuing with a deadly shooting inside a grocery store full of customers.

nbc 10 has learned new information about the victim and how the shooting unfolded. >> doug shimell is live at the store this afternoon. doug, i know you spoke to the owner. obviously, he has to be shaken up but was he able to tell you what happened there? >> reporter: he was, and police say they were able to get enough security video from that store to know that victim maurice mcdonald was targeted. the trip to the store should not have ended like this for maurice mcdonald. >> i know my friend is not here. >> reporter: witnesses say the 22 year old was waiting for an order inside the j and r perez grocery at aspen and 38 around 8:30 this morning. store owner jose duran lives upstairs and heard four shots. he said from his security video the shooting does not look random. he came directly to kill him, he says, because he just came, got out of the car, opened the door, saw him open fire, and went

outside. for maurice mcdonald's family, they say they don't know if this was the result of an ongoing feud, but his mother believes the shooter may be a distant cousin. >> i love my son, you know, i know he's in god's hands, and, you know, it is what it is. i'm just tired of these kids dying for nothing. >> reporter: investigators say they know who they are looking for. live in mantua, doug shimell, nbc 10 news. inappropriate and unsafe. that's how philadelphia police are responding to a picture of two officers sleeping in a police car. take a look. this photo taken early saturday morning in kensington. rosemary connors spoke to a woman who says she walked right past that car and is joining us in the studio. what did you find out? >> the woman and her husband took their dog out for a walk around 2:00 a.m. when they came upon the sleeping cops. that woman later tweeted that picture to the police department, but she does not want to show her face and be

identified in our story for fear of retaliation. she tells me the incident may have been harmless, but somebody could have gotten hurt, especially because of where it happened. >> they were caught sleeping with the windows down. that could have been another cop getting shot. >> reporter: the woman who says she saw these two officers from the 24th district sleeping on the overnight shift explains that it happened near d and cabria streets, a neighborhood known for drug activity and violence. >> we're not going to make excuses for why this happened. bottom line, it happened, shouldn't have happened, and it will be addressed. >> reporter: according to the woman, after a rash of recent shootings in the neighborhood, some of which she captured on cell phone video, police began to patrol the intersection around the clock. today and yesterday were no different when our cameras were rolling. >> i'm not even looking out for the safety of us, it's the safety of you two. because windows down, look what happened in new york. with the cop. he was sitting in the car.

>> in this line of work you are a target when you have on identifier such as a uniform or sitting in a marked patrol car. again, we saw this earlier this year in new york, two officers having lunch were murdered. >> it was in december 2014 when a man allegedly motivated by recent police-involved killings opened fire and ambushed nypd officers in brooklyn. >> we're lucky that we're not burying officers today. again, i'm not trying to make that overly dramatic, it's just the reality there is a concern that something could have happened to them. >> reporter: the police spokesman who you just heard from, lieutenant stanford, he said the investigation into the matter is ongoing and discipline for sleeping on the job ranges from a reprimand to a suspension. rosemary connors, nbc 10 news. happening now, fast food workers across the country, earn colluding here in pennsylvania are trading in their aprons for picket signs today. they are joining together as

part of a movement to increase minimum wage requirements. nbc 10's keith jones is live in the digital operations center with more on the fight for $15. >> that's what the group are calling for themselves, pushing for $15 an hour and the protests are happening in more than 270 cities all across the country. let me take you to a live shot now outside city hall where fast food workers are being joined by other low wage workers throughout the city. they are pushing for lawmakers to stand behind their fight for $15 an hour. you see many people gathered outside. of course, they have umbrellas, their signs, they are fighting for the $15 and also union rights. we caught up with protesters this morning outside of the mcdonald's on 31st street and allegheny avenue in north philadelphia. organizers claim this round of strikes will be the nation's largest so far. this was the scene in new york this morning. new york city mayor bill de

blasio says an increase in minimum wage would help local economies. in september the state department of labor approved a $15 an hour wage for fast food workers in new york. fight for 15 is launching a campaign to encourage people to vote next year for candidates who support raising the minimum wage. organizers say there are more than two and a half million workers paid less than $15 an hour. live in the digital operations center, keith jones, nbc 10 news. >> thanks, keith. a man who robbed and killed a philadelphia police officer will spend 20 to 40 years in prison. mcfarland learned his sentence today. he took a plea deal in exchange for his testimony against his co-defendant. he admitted to his role in the robbery and murder of moses walker jr., happened back in august 2012. walker was in plain clothes and walking home from his shift when he was shot and killed during a hold-up. he was a 19-year veteran of the police force. rafael jones was convicted and is serving a life sentence. prosecutors say jones was the

triggerman. police in philadelphia's fairmount neighborhood are looking for the guy right here in this video on the left of your screen. he's wanted for aggravated assault. you're seeing him from behind, but maybe you recognize his clothing here. police say he approached a woman walking down pennsylvania avenue last week and punched her in the eye. then the man just walked away. take a look at these tire tracks on an athletic facility. police say vandals on a track door are responsible. the vandals drove the tractor through a locked gate over the weekend. the worst of the damage is to the gate. call millville police if you know anything about the crime. the delaware national guard headquarters is changing its name to honor former member beau biden. a ceremony for the new major biden iii armed forces reserve center will take place in the spring. biden joined the army national guard in 2003 and rose to become a major. he died of brain cancer in may.

biden's widow releelsed a statement, the family is honor to be associated with the men and women who represent the delaware national guard. continuing with more legal trouble for kathleen kane. today she lost her battle to have some of the charges against her thrown out. nbc 10's deanna durante joining us now. she was in the courtroom today. deanna, what's the latest? >> reporter: kane is charged with perjury and obstruction, and her attempt today by her lawyers to have the charges thrown out was unsuccessful. this all goes back to a case from 2009. that is a grand jury case that was going on as kathleen kane was not in office at the time. she contends she was a stay at home mother, however, several years later information from the case was leaked to a local newspaper and a grand jury investigation last year ensued. in the grand jury investigation kathleen kane told the grand jury she was not under any secrecy oath. in september prosecutors uncovered a secrecy oath that uncovered all grand juries prior to kane's appointment and

election to office. her attorneys say she forgot she signed that oath. >> three days after swearing in, probably dealing, you know, dealing with a myriad of issues, and she was doing the best she could. >> reporter: overwhelmed at the time, that what you're saying? >> i don't think there's any question about that, that she was overwhelmed at the time. >> reporter: now, prosecutors are pointing out a change in the legal strategy of kane's lawyers. they talk about the fact that kathleen kane argued all the way to the pennsylvania supreme court she was under no secrecy order or oath. when she testified in front of that grand jury you're going to hear from prosecutors coming up at 6:00. for now, deanna durante, nbc 10 news. to decision 2016 now. the majority of chris christie's constituents want the governor to drop out of the race for president. that's according to a quinnipiac university survey out today. the poll says most garden state

republicans support donald trump, followed by ben carson, marco rubio, then chris christie with only 8%. 63% of voters say the presidential campaign is distracting christie from his duties as governor and 55% disapprove of the job he's doing near his lowest rate ever. meanwhile, voters are split as to whether christie is trustworthy with 46% saying yes, 48% saying no. people in atlantic city are also unhappy with governor christie after he vetoed bills to bail out the city's dismal finances. >> nbc 10's ted greenberg joining us live from our jersey shore bureau. businesses are wondering just how much longer they are going to have to wait for help. >> they are going to have to keep waiting, jim and jackie. the governor's action means these plans now have to go back to the state legislature with his recommended changes. for taxpayers here in atlantic city and beyond, the veto brings continued uncertainty.

since john opened atlantic city's duck town tavern a decade ago, he says his property taxes have doubled. >> business is a struggle. >> reporter: now other taxpayers are left wondering what their future tax bills will look like, following governor christie's veto monday of most of a package of bills aimed at stabilizing atlantic city's finances. >> we're dangling in the wind here at someone else's mercy. again, it's not fair for myself, my 30 floeemployees, or casinos restaurants in the area, as well. >> reporter: passed by the legislature in june would have allowed the eight casinos to make set payments in lieu of taxes for 15 years. the aim is to avoid budget busting tax appeals that have left the city in the red, along with the recent casino closures, but governor christie wants the state to have control over a portion of that money until the city submits a financial

recovery plan that the state approves of. >> this is something that needs to be hashed out now, the longer is goes, the worst it's going to get. >> reporter: atlantic city's fiscal health impacts other communities, including galloway township, where don purdy is the mayor, among local leaders who believe the best solution would be for a.c. to declare bankruptcy. >> right now, the debt that they are in, i don't believe they can get out without somebody writing a very big check. >> governor christie and senate president steve sweeney say they plan to sit together soon to try to reach a resolution here. i was told today that that meeting is expected to happen in the next week or so. live at the jersey shore bureau, i'm ted greenberg, nbc 10 news. to breaking news now on former president jimmy carter. we have word just in concerning carter's cancer treatment. a spokesperson said doctors have found no evidence of new tumors. carter is 91, announced in

august he had been diagnosed with cancer and doctors found tumors on his brain. from our south jersey bureau, there's a new commitment to youth and education in camden to allow families to choose the school they would like to attend. it's called camden enrollment, and it's designed to make it easier for you to enroll in the school you want. before you may have had to go through 17 different applications, but now everything you need is on one website. >> whether it's a district school, whether it's hope, renaissance schools, or another charter school, they are out there. we're going to level the playing field and let all parents know the process. >> open enrollment officially begins in january with a deadline of march 1st. families will be notified of the decision by april. okay, it all comes down to this, get your poker face on. got a good one? >> i don't know. i'll try. >> well, a new world series of

poker champ will be crowned tonight. >> that winner will take on millions and odds are he'll be a local guy. joe mckeon has nearly two-thirds of the chips in play. if he wins, he'll take home more than $7 million. two other players are standing in his way. one is also from our area, some local competition. joshua beckley is from burlington county. cannuli from cape may is out of the competition now, he came in sixth place. whether you have a dog or not, watching all the fanfare surrounding the dog show can all be so entertaining. >> love it. national dog so back again right here in philadelphia. all the primping and prancing taking place this weekend, but we'll see it on television in a few weeks on thanksgiving day. right now crews are prepping the expo center to get it ready for the big hairy weekend. >> i think we're going to have about 1,800 dogs here on saturday, maybe a little bit

you can barely see some of the buildings in center city, certainly not the high ones. 60 degrees right now with rain in philadelphia. the wind is out of the east. look at that, gusting to 21 miles an hour, so you have rain, drizzle, fog, and wind. temperatures in the mid 50s to near 60 now. 49 in mount pocono. a lot of 59s there, mount holly, wilmington, westchester 56. warm spot is only 61. not much of a temperature variation in days like this. in the past hour we're really not seeing much in the way of significant rain. certainly not enough rain to cause a flood threat. heaviest rain is up in northern pennsylvania, long way away from here, but we have an interesting situation here this afternoon. just one thunderstorm that raced through the area, even produced a little hail in new jersey, but it moved through so fast, had

some gusty winds and, of course, had some lightning with it. there's another area of moisture back in maryland and down towards washington, d.c. see even a little swirl with that. that's going to be swinging by during the evening hours. that's why i think we're going to be seeing it increase in the activity. even though there's not that much on radar, all these places are reporting either rain or drizzle. mount pocono, allentown, reading, philly, dover, atlantic city, the other areas just reporting cloudy skies. and as we go through the evening, it's going to be more rain. by tomorrow morning, the rain is gone. little bit of fog. cloudy skies. skies break up, maybe a little sunshine tomorrow afternoon. then a few showers on thursday ahead of this cold front. the front comes through and the cold northwest winds come in on friday. and last into saturday and sunday, as high pressure builds in. that's why we're so confident

that it's going to stay dry this weekend. for more specifics, tonight we're going to be seeing most of the rain to the north and west and that's during the evening hours. as we head towards day break, it breaks up. we see very, very little on any kind of radar. and some breaks of sunshine during the day. then on thursday, here comes that next system, not nearly as widespread or long lasting as what we have been seeing today. so for the rest of the night, yeah, it's going to be damp. take the umbrellas with you. it's not going to be that heavy that it's going to cause flooding or anything, but periods of rain and drizzle with fog, 51 degrees in philadelphia, 48 north and west. during the day tomorrow, we start off cloudy. some sun in the afternoon, pushes temperatures into the mid 60s, then northwest wind helps to dry us out. and as we go into the rest of the seven-day forecast, there are those showers on thursday. again, that's not an all day thing like today, and friday is

dry. windy, windy on saturday, too. windy for the eagles on sunday. and a pretty chilly start there in the 30s sunday and then it warms up a little early next week. the school lockdown in delaware has a lot of people puzzled. >> turns out an emu is on the loose. what's being done to capture the big bird and why it could be dangerous to the community. plus, is your car seat safe? why experts say bad booster seats could be on store shelves. and we've been following devin still and his daughter as she battles cancer. now the former nfl player is in our area trying to make a difference for other young people fighting this disease.

he's the football player whose daughter's cancer fight inspired the nation. today devon still made a stop in wilmington. still donated several

playstations and other games at dupont hospital for children. the former cincinnati bengal went to high school in wilmington. he and his daughter leah became known around the world last year. devon put his football career on hold as leah bravely battled cancer at children's hospital of philadelphia. >> definitely try to come back here and give back to the families out here and kids here because you know exactly what they are going through. >> in devon's last instagram post, you see him and cancer-free leah. the cancer reads, "about to knock out another five-day treatment." that treatment is necessary to ensure a clean bill of health. as for devon, he's currently working to get back in the nfl. now a sad update to a story of a terminally ill texas man whose dying wish was to see the latest installment of the star wars series. >> he got his last weekend and this morning bapassed away at h home. her husband is now one with god and with the force. his wife started the social media campaign to allow her

this is nbc 10 news. >> we continue with a live look right now at the interstate. it has been a soggy, messy day and now heavy rain is moving towards our area. >> really looks gray out there. chief meteorologist glenn "hurricane" schwartz tracking the rain and what it means for your neighborhood. glenn? >> certainly means it's not going to improve any time soon. we've got some fog and some very low clouds out there, so you can't see the tops of some of the buildings. and it's going to stay like that throughout the evening. live radar shows patchy areas of rain, most on the light side, but we have heavier cells around cape may county and some just offshore in delaware bay. it's moving to the northeast so cape may county is going to be seeing some of the more significant rain over the next couple of hours, but later this evening this area swinging by washington now looks like it's going to lift out and come our

direction until we may see an increase in the rainfall, not enough to produce flooding, but just enough to keep it damp for much of the night. 60 degrees right now, close to that across much of the rest of the area, but the lehigh valley, 54 degrees in allentown. the temperature dropping very slowly as we go through the night tonight. northeast wind is going to change into the northwest, and eventually clear us out. i'll let you know when that happens and a look ahead at the weekend in a few minutes. >> all right, glenn. pennsylvania leaders say they are making progress on the budget, but even if a deal is reached soon, the damage cannot be fixed overnight. nbc 10's lauren mayk spoke to groups not getting the money they need from the state. lauren, tell us about it. >> reporter: good evening. this senior center behind me is owed more than $100,000, but at this point it's more than just the money, even if the budget was passed today, it could take time to unravel the steps groups

like this have taken to keep the doors open. a hot meal on a rainy day. when it came to making cuts, this was what center in the park was determined to keep. >> a lot of them, this is their only meal, you know, so very important. >> reporter: but if lunches continue, other programs, exercise classes, arts, were not so lucky. and the longer the state's budget impasse goes, the harder it could be to get things back to normal, get teachers back and classes running. >> you know, we'll hold your slot as long as we can, but if it's indefinite or if it's, you know, past time they can afford to do that, we could lose them. >> reporter: lynn is executive director here. >> take a while to recover from the impasse. there are additional expenses we have incurred, interest payments, late fees because we have not been able to pay our -- a lot of our vendors. >> reporter: recovery could also

take time at nonprofit progresso. >> i think there's a misconception a light switch is going to be turned on. a budget passes, state needs to release money to the city. >> and the providers still trying to offer services and lunches have bills piling up each day. >> like at home with your budget, if you don't pay your bills, it's going to take a while then to catch up. >> reporter: and i asked the governor's office today how the dispersement would be handled once that budget is passed. he tells me the hope is that the money would be released in days, but then there is still the question of what about that backlog of cash, that backlog of all that money that they are owed, would that come all at once or in installments? i'm told those details are still being worked out. live in germantown, lauren mayk, nbc 10 news. two bills passed in new jersey by governor chris christie yesterday, one will change medical marijuana laws at schools, the other cracked down

on people who prank call police. new jersey parents will now be allowed to give children medical marijuana at school without risk of arrest. the bill was inspired by a girl named jenny from maple shade township, burlington county, who has severe epilepsy and autism. jenny's school would not allow her mother to give her cannabis on school property because officials feared they'd be breaking the law. schools now must adopt policies to allow parents or caregivers to bring cannabis to give to their child, only if the child is diagnosed with a developmental disability and is a registered patient with the state medical marijuana program. also a bill that increases penalties for people who place hoax calls to 911. it's called s.w.a.t.'ing and the bill comes after several cases where people called police to draw them to a particular location. the new law increases a potential jail sentence from up to five years to up to ten. it also increases fines from up

to $15,000 to up to $150,000. we have new information on a police shooting in trenton. the sheriff's office and state trooper will not face charges for shooting a 14-year-old boy in august. a state grand jury made that decision. authorities say the officer and trooper shot the boy after he pointed a gun at them during a chase and that boy is facing several charges, including assault. opening statements began today in the trial of this man accused of killing his step-daughter and abusing her corpse. prosecutors say gregory graf murdered jessica last november. police found her body in a shallow grave behind a home. investigators say graf shot and killed her, then videotaped himself abusing her body. in kensington, philadelphia police looking for this man who fired shots into the air. you can see him firing shots straight ahead next to his sedan. short time later he runs away.

officers heard the shots and canvassed the scene. they didn't find any victims or witnesses, but if you recognize the man, you're asked to call police. a police officer's own dash cam captures a close call. >> stop! stop! >> who police say was behind the wheel of that speeding car. plus, how do you capture an emu? it's a question most people don't have to worry about, but one delaware community is now on the hunt for this big bird. then all new tonight on nbc 10 news at 5:00, the nation's first historically black college in our area says discrimination has put them in a financial mess. who the school is blaming for low enrollment.

frightening moments captured on dash cam video show an oklahoma police officer being run down by an suv. amazingly, he walked away with only minor injuries. take a look. >> stop! stop!

>> police say that suspect intentionally drove straight at officer matt stacey and his car and after getting hit, the officer got up and followed the suspect. police tasered her and officer stacey climbed into the sunroof of her suv and arrested the suspect. there she is. she's expected of dui and other charges. officer stacey is out of the hospital with only a few scratches and is expected to return to work this week. you never know what you'll encounter out there. now a look at a road sign in utah definitely catching eyes. >> it's also causing some controversy. take a look. the sign reads "get your head out of your apps." some say the twist on a similar phrase with a much different meaning missed the mark, but the department of transportation hopes it will save lives and remind people to stop playing with their phones. enunciation has never been so important than that sentence i just said. >> what did it say again? get your head out of your apps. >> my mom is probably watching,

weekend. but a dry weekend. fairly sunny weekend. a lot different than this. we have the low clouds out there, and the visibility continues to go down and we'll be seeing more fog overnight. 60 degrees now in philadelphia. 12 mile an hour wind gusting to 21 miles an hour. this is up in the pocono mountains. it's raining, fog is there, as well. the temperature, 49 in mount pocono. it's in the 50s elsewhere, mid 50s allentown, reading, doylestown, pottstown, coatesville, all those places within a couple of degrees. and within a couple degrees here from wilmington to philadelphia, mount holly. that's what happens when you have the cloudy skies and the wind is blowing generally off the ocean. you get uniform temperatures. that's how you tell if one of the instruments is not reading right. remember how millville reads

differently so often? not when it's raining and with an east wind. nothing wrong with the instrument in millville. and you can see on the radar there's not a whole lot out there, at least not significant rain. drizzle drops are too small for radar to detect them, but we see decent showers in cape may county. and we have one thunderstorm developing in delaware county, moved through bucks county and up towards new york city, even had a little hail with that in mercer county. most of the rain is in central pennsylvania now, but we have another area swinging around washington, d.c., area that's going to come around over the evening hours and keep it wet for a while longer. while the heaviest rain stays up in central pennsylvania, up towards the lehigh valley and poconos, we continue to see the wet weather across philadelphia area and it's just going to be another one of those nights. but by tomorrow morning, i expect the steadier rain to be gone, most of the cloud cover

starting to break up as the wind turns into the northwest. no longer an ocean breeze, and as we go through the day tomorrow, we should be seeing a little bit more in the way of sunshine. that pushes the temperatures up into the mid 60s. not too bad. pretty nice veterans day out there. then some showers come in on thursday and then the colder air comes in. some periods of rain, drizzle, fog tonight, 51 for the low in philadelphia, 48 north and west. once the wind shifts into the northwest, brings in cooler air. cloudy skies in the morning, some sun in the afternoon. like i said, pretty nice day and generally on the dry side. not so dry on thursday. some showers coming in with the cold front, but it will be dry friday, all the way into next week, but pretty chilly, especially on saturday and into sunday morning. and chilly but dry for the eagles on sunday. a delaware school goes into lockdown because of a big wandering lost bird from

there's a big bird causing big problems in parts of newcastle county these days. kind of says it all, doesn't it? emu on the loose. >> there is. an nbc 10 viewer tipped us off to the story after the bird managed to send the school into lockdown, so our tim furlong took off in search of the elusive animal. >> it was a great big bird. >> reporter: drew's grandson didn't know what to make of a story about a school lockdown involving a bird. >> you weren't allowed to go play at school because a giant emu was running around in the playground and being chased by the police? he said, uh-huh. >> reporter: turns out the kid

had the story right. an e-mail from the principal backed him up. this emu popped up. on monday the school went into a soft lockdown as police tried to catch the australian bird that had to be someone's pet at some point. dan runs the three palms petting zoo in clayton, takes care of lots of animals here but has been trying to catch the emu up the road. >> i am getting frustrated. yesterday we were out there a few hours and got closer than ever, had our hands on it physically, fwitwice. >> reporter: the bird is crafty, always getting away. >> this is elle. >> reporter: he says emus are only dangerous if cornered, but he doesn't want anyone trying to get near the bird, they can gore you or cut you with sharpal lon ens. they think it can survive a delaware winter, but animal experts tell me they are mainly concerned about capturing it because they don't want it to
