and he has no history with police. >> individual where at least as far as what we know at this point, no signs, no reason for him to do this that we know of. i think it just really highlights the dangers out there. >> reporter: herrera admitted to breaking into the same apartment a few months ago when no one was home. the little girl was checked out at children's hospital. herrera has been charged with rape of a child, he's being held on $1 million bail. reporting live, i'm denise nakano, nbc 10 news. a mystery tonight along the new jersey turnpike in burlington county. police found a body along the road today and now are trying to figure out how the person died. officers made the discovery this afternoon in the northbound lanes in mount laurel near the route 73 interchange. most people needed their umbrellas at some point today.

we found some people on st. joe's campus in winfield this afternoon. here's a look at the radar. the rain is not over just yet. >> checking out the live view from center city tonight, it's gray, it's wet out there, even a bit of thunder at some point this afternoon. nbc 10 chief meteorologist glenn "hurricane" schwartz joining us now with his first alert forecast. glenn? >> it is kind of a wet end to a wet day out there. live radar shows we still have rain around. most of it is on the light side. we even had drizzle drops too small for radar to detect, but once in a while we're seeing a little speck of yellow here indicating some moderate rain is coming across chesapeake bay headed towards delaware and then eventually into the philadelphia area this evening, so we're not done with the rain yet. as a matter of fact, it may increase a little bit as this area around washington swings around. you can already see the increase in maryland down to our south and west, so it's going to be a wet evening throughout the area. temperatures holding steady, 53

latest now on a customer gunned down inside a philadelphia convenience store. >> the murder happened this morning in the mantua section of the city. doug shimell joins us live from mantua. >> this happened just when her son was trying to turn his life around. >> reporter: exactly. and the family of maurice mcdonald say they believe the person who killed him might be a distant cousin. >> maurice mcdonald's mother didn't know if it was a vendetta that killed her son. >> i love my son, you know, i know he's in god's hands, and, you know, it is what it is. i just -- i'm tired of these kids dying for nothing. >> reporter: workers inside the store say mcdonald was waiting for an order at j and r grocery in mantua when a gunman ran in. >> started to shoot and everybody just running, because,

you know, everybody got scared when they hear the shot. and the he just left. >> reporter: there were several girls, he says, one almost got struck by a bullet. maurice mcdonald did not survive. detectives tell his family they know who they are looking for. >> get him off the streets, if they don't, i will hurt him. i will hurt him. >> reporter: an employee says the store video pretty much captures the shooting from start to finish, leaving little doubt this was targeted. doug shimell, nbc 10 news. one could have gotten hurt. >> that's the reaction tonight from philadelphia brass after two police officers were caught sleeping on the job. we spoke to the woman who walked past the cruiser as two officers from the 24th district on the overnight shift took a nap. the photo was taken near d and cambria streets. the area is known for drug

activity and violence. the picture went viral. the fear among many, another cop killing. >> we're lucky we're not burying officers today. again, i'm not trying to make that overly dramatic, it's just the reality of it, there is a concern something could have happened to them. >> last year a man opened fire and ambushed two new york police officers while they were sitting in their car. the philadelphia officers could get a warning or suspended for sleeping on the job. attorney general kathleen kane will face trial on charges she leaked grand jury testimony. pennsylvania's top law enforcer lost her bid to have criminal charges thrown out. she spent the afternoon in a montgomery county courtroom. deanna durante spent the day, as well, in that courtroom and is joining us live with the latest from norristown. deanna. >> reporter: kane's lawyers are not interested in a plea deal and say while they lost this battle, they are intending on winning the war. >> the law is emphatically against me. >> reporter: but he claims attorney general kathleen kane

didn't mean to break the law when she testified before a 2009 grand jury. instead, she forgot she signed an oath of secrecy, one that would have barred her from sharing grand jury material from an investigation with reporters. >> this was an honest mistake. >> reporter: prosecutors say not really. they point out kane fought her appearance before the grand jury last year multiple times, arguing there was no oath of secrecy pertaining to her. >> they made an argument that she never signed the secrecy oath. they then took that to the supreme court and said, again, that she never signed it, the secrecy oath, showing how important it was. >> reporter: after losing the bid to have the charges thrown out, kane's lawyers say she was given many things to sign in the first days in office and was overwhelmed with her new duties. the fact this was such a hot topic it came up over and over, it was in the news, wasn't that to jog her memory, that's right, i signed this document. >> because there was nothing that she held, and i brought this out and tried to bring it out with crystal clarity that

when they obtained these documents, it's not like she had the documents in her desk drawer. not that she had the documents on her computer, she didn't. >> reporter: now, district attorney prosecuting the case says it doesn't matter where the documents were found, the fact is she signed that oath of secrecy. he also says kane's trial is expected to begin some time next year. reporting live, deanna durante, nbc 10 news. the delaware national guard headquarters is changing its name to honor former member beau biden. a ceremony for the new major beau biden armed services center will take place in the spring. biden joined in 2003 and rose to become a major. he died of brain cancer in may. biden's widow released a statement saying the family is honored beau will forever be associated with the men and women who represent the delaware national guard. republicans vying for

president will battle it out on stage in milwaukee tonight. there will be eight candidates on the main stage. this is the fourth republican presidential debate. ben carson will likely be on the hot seat after he's taken over as a contender. as for chris christie, he won't be on the main stage. he'll square off with three other candidates at the bottom of the polls. 200,000 comcast customers had to reset their online passwo passwords. the reason, someone stole the information and then tried to sell it online. comcast tells us its system was not directly hacked. it was a nationwide problem and the company doesn't know how many people in our area are affected. comcast is the parent company of nbc 10. new at 6:00, changing up the recipe. tonight camden-based campbell's soup cut artificial flavors and celery from its chicken noodle soup. ten ingredients, including msg, have been nixed. the company is mixing up more recipes and release them when it's ready. campbell's also launched a star

a deal are in place and he hopes to have the deal wrapped up by thanksgiving. the budget stalemate has lasted five months. all new at 6:00, dozens of families in the delaware valley have been trying to get headstones for their loved ones' graves. >> some families reached out to the nbc 10 investigators and now the state is getting involved. investigative reporter harry hairston has the latest on today's developments. >> reporter: this is all that marks the grave site. it's far from what eleanor wanted for her mother's final resting place. >> she was a fabulous lady. she was very strong willed, very fashionable. >> reporter: turner pulled together the money to honor her mother with a headstone. she purchased it here at life stones. >> truly a pretty stone. i can't say it's not a gorgeous stone. has a beautiful sheen to it, well polished. >> reporter: her receipt shows she paid $2,500. she says they agreed to place it in august. >> we're in november.

our calls and messages left with the company's answering service. >> she deserves more. >> reporter: for turner and her family, each day without the headstone is another day they feel their mother is disrespected. >> i want that stone. >> reporter: harry hairston, nbc 10 news. people in atlantic city are frustrated tonight after governor chris christie vetoed most of a package of bills aimed at stabilizing the city's finances. he wants to change a key measure that would allow a.c.'s eight casinos to make set payments in lieu of taxes for 15 years. the aim is to avoid budget busting tax appeals that left the city in the red, along with recent casino closures. governor christie says he plans to sit down to reach a resolution soon. the showboat casino could reopen as a casino. all options are still on the table. he's buying the closed casino for $23 million. blatstein redeveloped the complex into what is now called

the playground. now your nbc 10 first alert weather with chief meteorologist glenn "hurricane" schwartz. >> and i'm sure there wasn't a lot of action at the outdoor playgrounds today, kind of one of those days you want to stay inside. we've had a rainy evening, too, so things are not going to change over the next few hours. we have a break tomorrow for veterans day and some showers return thursday, but not an all-day rain like what we've seen today. and we have a chilly weekend, and a dry weekend coming up. not going to look like this. still can't see the tops of the skyscrapers. the clouds are low, visibility is going to be getting lower as the wind diminishes, which it's already been doing. 60 degrees now in philadelphia, humidity 90%. pretty saturated out there. 53 in allentown, but closer to 60 as you get closer to the philadelphia area and then towards the shore, almost everybody's right around 60

degrees. you get those uniform temperatures when you have cloudy skies and east wind like that. over the past hour you can see definitely more rain coming up from chesapeake bay and maryland, moving into delaware first and into chester county, delaware county, philadelphia. the heaviest rain and thelsóa steadiest rain back way to the north and west. it's not going to be coming here, but you can see this is not all just light either, some moderate rain at least. not talking about thunderstorms or a flood threat. it's just kind of miserable out there and more of this moisture from the washington, d.c., area swings around during the evening. so here we are at 7:00, we start to get some moderate to heavier rain farther to the north areas that haven't gotten as much rain as delaware, for example, around smyrna, estimates of two and a half inches of rain just early this morning. you can see the clouds hang around as we go through the night tonight and into the

morning. maybe a little bit of drizzle from time to time, but we're trying to break out into some sunshine during the day tomorrow. expect it to stay cloudy for much of the morning and then start to see a little bit more sunshine during the afternoon. that will push temperatures into the mid 60s. so it should be a really nice afternoon after a not so pretty start. if we do see any drizzle or fog, first thing in the morning it's not going to last very long because those winds are coming out of the northwest. then on thursday we see clouds advancing and here comes some showers. not like the steadier rain that we saw today, but we're talking about fairly widespread showers just about everybody getting at least some rain during the day on thursday. so we've got periods of rain and drizzle, little bit of fog tonight, 51 for the low in philadelphia, 48 north and west. during the day tomorrow, it's going to start off kind of cloudy, but some sunshine in the afternoon pushes temperatures

into the mid 60s. the average high is 58 now. so that's good bit above average. then thursday with those showers, not an all-day rain, then it's dry for a while. friday and saturday, pretty windy, and chilly over the weekend. should be chilly but dry for the eagles sunday. >> all right, glenn. we have this story just in. the fantasy sports websites draft kings and fan duel are now illegal in new york. >> minutes ago the new york attorney general ruled the companies are illegal gambling websites. they must cease operations in new york. just yesterday we told you new jersey lawmakers are trying to decide whether those same sites are gambling and not a game of skill. comcast is an investor in fan duel. john clark, what's coming up in sports? >> we're going to hear from the new old eagle going to take jordan hicks jordan hicks' roster spot, that is next. patients across the country have spoken.
