could have you paying the second highest sales tax in the nation. first, a man breaks into a home and rapes a 6-year-old girl asleep in her bed. the suspect has a young child himself. >> that suspect is behind bars tonight thanks to the little girl's stepfather who pinned him down until police arrived. >> we are live in hatfield township. police are saying they have a confession here? >> reporter: well, he admits to breaking into the apartment, but denies sexually assaulting the 6-year-old girl. police and prosecutors are getting the victim's family, including her 11-year-old brother, the credit for bringing the suspect in. he broke into the living room window of a hatfield apartment not knowing the 6-year-old girl he is charged with raping, but so many say he's no stranger to them. this woman says her boyfriend

went to high school with him. >> he's a really great father. that's what blows my mind. he has a kid of his own that same age. how could he do something like that? >> reporter: the victim's 11-year-old brother discovered him naked in his sister's bed. he ran to get his parents, then called 911. the children's stepfather held him at knife point until police arrived. he tried to get away pleading kill me, kill me, or let me go. >> i have to give credit to this 11-year-old boy who had the courage to step up and help his sister and the courage of the family with their restraint. >> reporter: he moved out of the hatfield village apartments where the crime took place, but people know him as someone who frequents the neighborhood. >> it's shocking. i'm very surprised.

>> it could have been anybody. >> reporter: rivera herrera has been held on a million dollars bail charged with the rape of a child. it is shocked and saddened by the news, but thankful that somebody has been american people r-- apprehended. you could be soon be saying the same highest sales tax in the nation. tonight, we're getting our first look at the details under the proposed budget. pennsylvania sales tax would rise to 7.25%. if you live in philadelphia, the sales tax would be 9.25%. it's 8% right now. the governor says he was able to negotiate a record increase in education funding.

the budget isn't a done deal yet. tonight, we have new video from the scene of a jet crash that's killed at least two people in akron, ohio. the death toll could go higher as investigators determine how many people were aboard the ten-seater jet. the woman you're about to see was recording on her phone when crash happened nearby. >> oh, my god. >> reporter: authorities say the jet clipped a power line before it hit the brick building. they don't think anyone was inside that building, but they're still trying to figure out exactly how many people were on the plane. i will quit talking when it is time to quit talking. >> why does she keep interrupting everybody? >> fireworks at tonight's

but in the real world it is about results. >> governor bobby jindal of louisiana criticized christie for not being conservative enough, but christie focused most of his attacks on hillary clinton. clinton is facing more criticism from the gop tonight. it's over her reaction of her comments over carly fiorina. here's what a former hp employee said about clinton. >> she says she's a great ceo. each time i see her on the tv i want to reach through and strangle her. i don't know that doesn't sound very nice. >> i wouldn't mess with you. >> reporters later asked clinton if she took the man seriously, she shook her head no.

8:00. by noon around 60 degrees. philadelphia area from will -- coming up, i'll show you what you can expect through the afternoon and another round of rain before the weekend. when police shoot at suspects, should the department release the officer's names? some pennsylvania lawmakers say the answer is no and they're pushing for a new law. >> we're live at philadelphia police headquarters. people feel so passionately about this on both sides. >> reporter: that's because we're talking about potentially life or death situations for the officers and for the suspects. so for this year, there have been 22 police-involved shootings in philadelphia. more than 400 since 2007.

when a philadelphia police officer is involved in a shooting on the job, their names are disclosed to the public within three days. a report by the department of justice criticized the department's lack of transparency and excessive use of force. >> this was the concern because it puts the lives of the officers and their families in jeopardy. >> reporter: the bill would require mandatory disclosure of an officer's name only if he or she is charged with a crime after an internal information is completed. >> i feel this bill brings the public and law enforcement closer together because there's more information. >> very poorly thought out respect to the consequences. i would venture to say a very dangerous development. >> reporter: an attorney is representing the family of brandon tate brown, a

26-year-old, who was shot and killed by philadelphia police during a traffic stop last december. the family had to go to court to get the names of the officers released. >> we could not investigate the police officers. we could not learn if they had a history of prior violence. >> reporter: as public servants, public scrutiny comes with the job. the concern is this bill will lessen the amount of transparency and trust within communities. this bill has plenty of support from both sides of the aisle. today it passed the judiciary committee and it is headed to the full house for a vote. tonight, we hear from the mother of a philadelphia man shot and killed inside a store full of customers. the victim maurice mcdonald was killed as he waited for an order around 8:30 this morning.

a gunman just ran in and shot him. mcdonald's mother is fed up with the violence. >> i love my son. i know he in god's hands. it is what it is. i'm just tired of these kids dying for nothing. >> family members tell us the gunman, who police are looking for, may be the victim's distant cousin. attorney general kathleen cane will face charges. she's accused of leaking secret grand jury material to a reporter and then lying about it. kane is expected to go on trial next year. jimmy carter has a reason to celebrate tonight. doctors say he is responding well to his cancer treatment. they have no evidence of any new tumors. carter announced his cancer diagnosis in august.

ovation for witten marcellus. from witten's slips through misty copeland's soul, the first african-american to be named a principal dancer at the american ballet theater wowed the audience. each honoring witten marcellus, a man that produced 80 records, sold more than 7 million copies worldwide. he even won a pulitzer prize. they paid tribute to another. the late marian anderson, one of the most celebrated singers of the 21st century and a pioneer for the arts and civil rights. five minutes away, her memory lives on. her face adorns a rec center. >> i do want to make a point

us some showers thursday, and we'll have a colder weekend forecast. wait until you see those numbers. low clouds now. you can't really see a lot of the buildings in philadelphia looking at center city. that's mostly just those misty conditions, but a few light showers around. 57 degrees right now, so we are still fairly mild. we'll be staying in the 50s for most of the area overnight. at 8:00 tomorrow, mid 50s, cloudy conditions. noon some sunshine peeking through. by 4:00 p.m., temperatures topping out around the 60s. at least we do stay dry. right now on radar a few light showers around parts of new jersey right near washington township moving towards winslow. parts of north hampton county up through the poconos light to moderate showers, but this is all moving up to the northeast, so it is going to continue to move away from the area.

then you see the drier conditions down to the south and east. clouds will be hanging around. this is future weather. 8:00 tomorrow morning cloudy skies, but no rain. by the afternoon a little bit of a break of sunshine here and there, so a nice day. thursday, that's when we have that next cold front approaching. that's the next rain chance. cold front swings through. friday, it will get windy and cooler, so to end out the week the winds will be increasing, temperatures will be dropping, and then we go into saturday. for saturday afternoon, we're talking about high temperatures barely reaching about 50 degrees for parts of the area. tonight, though, periods of drizzle, kind of misty foggy outside. that's going to be the rest of the forecast for this evening. then we see improvements tomorrow. cloudy in the morning, some sunshine through the afternoon. 63 through 66 degrees for the high temperatures. then we get showers back in for

thursday. sunny on friday. but windy and cooler. sunday morning we wake up to 37 degrees, but at least it will be dry for the eagles with a high sunday of 58 degrees. john? and the eagles back at practice today without one of their best playmakers on defense. we'll show you why the fliers called another team meeting after tonight's game, hoping to break out of their slump.
