when he arrived he found day care workers performing cpr on the little girl. she was rushed to temple hospital, she did not survive. parents say, when they got here, they were not let in. when they asked what happened, one parent said they were told it was none of their business. several parents we talked to said were you going to bring your children back tomorrow? they said they weren't exactly sure but wanted to find out exactly what the ser circumstan were. was it a medical condition? was it some sort of natural cause or something beyond that? that is what detectives are trying to determine. doug shimell, nbc 10 news. >> following breaking news out of baltimore. police and protesters gathering after a judge announced a hung jury in the trial of the first officer prosecuted in the death of freddie gray. jacqueline london following the breaking story. >> fill us in. >> demonstrators are gathering

in baltimore right now, as you said, following announcement of a mistrial in the case of officer william porter. we can tell you, a judge this afternoon announced the jury could not reach its decision after three days of deliberations in porter's trial. porter faced manslaughter charges in the death of freddie gray. that is porter on the right. prosecutors argued porter was negligent for failing to buckle gray into a transport van. and for failing to call a meddingmedic when gray asked to go to a hospital. he arrived with a broken neck. his death a week later set off protests and rioting in baltimore. a hearing scheduled for thursday, to discuss a possible retrial date. five more officers are awaiting trial. live in the digital operations center, jacqueline london, nbc 10 news. at 5:00, when a firebreaks out, seconds count. now a new report says the philadelphia fire department

there was an allegation they were 18 minutes late, how could this happen? and that prompted a review of all statistics. >> reporter: according to the audit compliance with the national fire protection association standard of a 5:20 response time has decreased in the past four years. for some fires, it's taken over eight minutes for the first engine to arrive, that was the case february 2014 in south frazier street. an earl dlderly couple died in flames. they blamed it on rotating crews to different houses. rolling brown-outs and rotations implemented by the city in 2010 and 2013, respectively. is that concerning to you? is that troubling to you? as a commissioner? >> it's not trouble, it's always concerning. it's a matter how we report it. >> reporter: derek sawyer, on the job since last year, insists the department is improving its

policy. he points to an historic low for fire deaths. this time last year it was 31. right now it's 12. he targets at-risk neighborhoods for fire education and smoke alarm installation. >> number one goal is to save lives, protect property and i think we're doing it. >> the rolling brown-outs implemented as a cost saving measure for the fire department. the commissioner says he's willing to reassess the policy in the future. >> taxi and limo drivers brought traffic to a stop around philadelphia still hall. protested uber-x service parking cabs along busy blocks in center city. during the middle of the day, snarled traffic. cab drivers say uber x drivers don't have to follow the same laws they do and it's hurting their business. >> if uber x and lyft are not giving it to them, this shouldn't be here.

>> drivers want a roundtable meeting with the d.a., mayor, and mayor elect with the head of the philadelphia parking authority. delaware family forced out of their home, after a car crashed right into their house. police say the car jumped the curb, went through a fence, into the brick wall of the home in new castle county. a 23-year-old driver ticketed for using his cell phone while driving. no one was home at the time of the crash but officials hadded to condemn the home because of structural damage. look at the aftermath here. left the family without a place to stay for christmas. >> text can wait. you know, when you -- by the time you get home, by the time you get wherever you go, answer the phone or text back when you get there. >> the family says kitchen and the living room was just destroyed in the crash. red cross is helping the family with a place to stay. now to new information on the case against veteran of the pennsylvania legislature. louise bishop from philadelphia

>> it's sad. it's somebody's child. now she's gone, no matter what the circumstances were, you know, i'm a father, grandfather, i feel for them. >> today the victim's family asked for privacy. investigators say her murder was not random. a jury in philadelphia is asking a lot of questions as they decide whether a young woman is guilty of attacking a gay couple in center city. deanna durante has been at courthouse all day. the jury just left for the day without a verdict. >> reporter: not only did the jury just leave but so did the accused, katharine knott walked into a parking garage with family and supporters. she and that group here all day long waiting for a verdict. the jury got the case before lunchtime today. throughout the day they asked questions, asking to see more evidence that he had already seen in the case. several video clips, showing katharine knott around that scene where two men were

assaulted. clips did not show her punching or hitting anyone. you see her briefly in the video running toward the scene but you don't see her after that. and then they also wanted to see surveillance video that police released in the days after the september 11th, 2014 attack. now there is a gag order in the case, no one is allowed to talk to the media about what's going on in the courtroom. also, the jury asked to see still images from the surveillance cameras and cell phones. and they just have asked to see statements of some of the witnesses that prosecutors called in the case, witnesses who were there, witnesses who lived in the apartments above the scene from the attack. they wanted to read those statements. that was a request. the judge granted very late in the day before sending the jury home, just before 5:00. they will be back here again tomorrow. knott charged with assault and conspiracy. deanna durante, nbc 10 news. the battle for pennsylvania budget heats up today with the

of a percent. bob johnson, president and ceo of the american college of financial services and co-author of "invest with the fed." thanks for joining us. start with the impact this decision will have on people's loans. could afferates on mortgages, student debt. not a big jump here. thinking about making a big purchase, what does this mean? should you buy now? >> there isn't an immediate effect. you don't need to immediately make that purchase. i would make the point, thinking of buying a home, mortgage rates are going to increase in the future months and years. the fed clearly signaled today that they raised rates today but that they're planning on a series of rate hikes in the future. planning on buying a home, i would advise them to take out a fixed rate mortgage. if you currently have a variable rate mortgage you may want to think about converting to a fixed rate mortgage.

>> bob, talk about the impact on credit card rates. is now the time for consumers to be shopping around for a credit card getting a good dealing good term. >> absolutely. because today, immediately on the heels of the fed's rate increase, wells fargo announced 25 basis point increase in their prime rate. and their credit card is tied to the prime rate. so for those card holders who's credit card rate is tied to wells fargo prime rate. they're going to see 25 basis point increase in their rate. it is a good time to shop around. >> any other good news for consumers that comes out of all of this? benefits. >> absolutely. a huge benefit. that is that the fed thinks that the economy is robust enough to withstand a rate hike. fed believes that the economic growth is strong and that we're well on our way to recovery. >> come a long way since '08. bob johnson, thanks for joining us. >> thank you for having me. >> now, your nbc 10 first alert

weather. with meteorologist sheena parveen. >> well, clouds stuck around today. and tomorrow they're going to come with rain. tracking rain for thursday, make sure you grab the umbrella before you leave. we'll see rain throughout the entire day kind of periods of rain through most of the day and some of that will be heavy. then we have cold air waiting to move in. that's going to be here in time for the weekend. friday notice colder and windy, but saturday, that's going to be the coldest day. over at christmas week, we're going to have another big warm-up. we could see some near-record high temperatures. believe it or not that pattern's going to come back in that we had this week so far. philadelphia, right now, 51 is the temperature. we are still above normal for this time of the year. average high is in the mid-40s. today, 53 degrees. tomorrow around 57, that's going to come with rain. friday, temperatures in the upper 40s, that's still above normal, average high is 44.

roads. the plan needs final approval from the state pinelands commission. the commission narrowly rejected it in january of last year. amtrak, septa, partners made plans public for 30th street station. changes, a live look at train station, neighbors got a chance to see a draft of the development. also ask questions. the plan attempts to make the area around 30th street station into an epicenter for community development, economic growth and improved transportation connections. lower marion officials will meet an hour to discuss plans for land use and historic reservation. a judge blocked a lawsuit that tried to stop a construction project in ardmore. developers can move forward upgrading the train station, building a new apartment building on what's a parking lot. residents opposed the plan saying it's too much for the town to handle. meeting begins at 6:00 in the township administration building. warm weather helped fend off

here with a closer look at numbers. >> i'll break down all of the numbers for you. 1900, that is the number of daily records we've tied or broken with december warmth across the nation. it's been above average for at northeast including places like this, philly here at home. here 'i breakdown of other areas for philadelphia, almost 12 degrees above average. allentown, 11.6. 13.6 poconos. 10.1, atlantic city. ten degrees above average in wilmington. if you average the high and low temperature during december it's around 37 degrees. but instead, what we're seeing is our average daily record closer to 51. and the record average daily temperature in philadelphia is 44. 5, set back in 1923, so this year we are on track to completely shatter the old record. and with the basically means when you hear people say, i can't remember a december that's warm, now you can tell them they're probably going to be

watching for tomorrow. so tonight, we'll stay dry. by tomorrow, the rain's going to move in. showers could be around for the morning commute. it not here yet though we've had cloud cover today. clouds are locked in, stubborn when you get these clouds. they're hard to move. but as we go into tomorrow, clouds will be coming with rain showers. early tomorrow morning, right around the morning commute, 8:00, 9:00, we could see showers move in. any of the rain would be on the lighter side this early. closer to lunchtime, noon, notice widespread, yellows and oranges, mostly through south jersey, delaware, some could move into philadelphia. that shows us where heavier rain will be. through 2:00, moving through. periods of heavy rain, possibly new jersey and delaware. evening commute, a lot of the rain could taper off. we could have showers around. it not going to clear up until we go into friday. even early friday morning, there could be light rain lingering along the shore and delaware beaches. saturday, we clear out big time.

after midday, arrived to find day care workers performing cpr on the little girl. little girl was taken to temple hospital. she did not survive. we spoke with several parents who said they hadn't had any indents or problems with the daycare center but are being told nothing about what happened today. >> mom called me and told me that somebody at the school died, that i should get my kids and i called, they can't tell me nothing, just come get the kids. >> i asked, it's none of my business. as long as my son is okay, i'm all right. >> coming back tomorrow? >> i'm not sure. >> no doubt, detectives are going to be looking at pennsylvania department of welfare report, inspect conducted here back in october where they cited the sisters daycare center for lack of emergency planned training, lack of child care training,
