had a broken you and -- jaw and eye injuries. >> the main thing it said is that katherine knott was not innocent. she was involved. >> reporter: prosecutors won't say what they will ask for but they will point out that knott did not deny 2 victim a trial in the case. >> he has the triegt ask for whatever he wants. use common sense. she exercised the constitutional right. she went to trial. that's her right. i hope it's not at the point in this country where we punish people for doing what the constitution says we can. >> reporter: now knott was found guilty of four out of ten counts. she was not convicted of a felony. both sides are claiming victory in this case. her sentencing is scheduled for february 8. just a short time ago we heard from the victim's camp.

we're told their son's fine with the verdict and they hoped knott would have taken a plea deal. they did not want a trial. we have information about a teenager aiding isis. he's accused of using twitter to build up support for isis in the united states. in one tweet aziz threatened to behead president obama. today the president addressed fighting isis and cracking down on home-grown terror. >> our counterterrorism intelligence, homeland security and law enforcement kmungts are working 24/7 to protect our homeland and all of us can do our part by staying vigilant, by saying something if we see something. >> reporter: the president wrapped up his year in the white house detailing a lot of topics. watch nbc nightly news tonight at 6:30 for a complete report.

this afternoon president obama granted an early prison release to 95 prisons, six from our area.i-the one common theme. most inmates received a life sentence for dealing cocaine or another drug. four men are all from philadelphia. some of them have been behind bars for the past 24 years. most of them will be free beginning in april. delaware residents no longer have to worry about going to jail if they're caught with small amounts of marijuana. starting today marijuana is officially decriminalized in the first state. new at 6:00, delaware bureau reporter describes what this new law means. >> i view it as the same thing as somebody having a glass of wine. >> reporter: the representative is the one who posed decriminalizing marijuana, the 19dth state to do so.

the change went into effect at midnight. >> if we were talking about crack or cocaine or heroin or something like that, obviously, i would not be having this kvrgts. >> reporter: if you're caught with up to an ounce of it, you'd likely face a civil fine. you would pay the fine like a parking ticket. there would be no prison sentence and no criminal record. the law is pretty clear, it would fill be illegal for anyone under 18 to have any marijuana. there are a number of he strikss on where you can smoke marijuana. if you're caught with marijuana and committing another crime, there are still circumstances in which you could find yourself in significant interrogatory numberle. supporters of the law says it allows people to smoke marijuana in the privacy of their own homes. it prevents people in getting a criminal record that could keep them from getting a job years down the road. >> that person comes to me and said i'm trying to find a job.

what's holding you back? i got arrested for pot 15 years ago. >> reporter: some in law enforcement disagree with the changes in the law. some see marijuana as a gateway drug. some supporters of the changes hope they lead to even more changes. delaware already has a medical marijuana dispensary. some are calling for the full legalization and sale to the public. the governor has said that will not happen on his watch. it's something we haven't seen in quite some time. temperatures in the 40s. in the morning, the 20s. but this is what it's supposed to feel like exactly a week before christmas. we almost forget. our meteorologist joins us with more. that's exactly right. now the rm waest december recorded in history. now we have some average weather it feels really cold out there. the rain that we saw earlier,

light showers, they're way offshore so nothing going on there. snow flurries in western pennsylvania, not going to make it. it's just a matter of the temperature and wind. we're down to 39 degrees now in redding, 38 in lancaster, 40 in melville and pottstown. this is the coldest it's been for a while and we have wind on top of that, so it already feels like it's 31 in redding and 29 in lancaster, 32 in wilmington. by morning, it's going to be feeling like it's closer to 20 degrees in a good bit of the area, so we're going to be seeing clearing skies tonight. we're going to be seeing wind all night. it's really going to feel like winter tomorrow. we'll see how much it's going to warm up next weekend with the seven day in just a few minutes. tonight we have new information about a north philadelphia day care shut down following the death of a 10 mohammed girl.

we've uncovered -- 10-month-old girl. our reporter joins us live outside the childcare. what did you find? >> reporter: some issues that appear to have been taken care of months ago have popped up again according to this new report we've gotten hold of. this day care was operating under a provisional license because of the old violations. the state now says conditions here constitute gross negligence. >> the school was great. the teachers was great. >> ralph: he said his grandchildren went to the school until now. a 10-month-old little girl died and officials have shut down the center. no one called 911, instead, walking her to the emergency room. no one on site knew cpr. 39 children that day with four

staffers. we found there had been violations before. more than 0 r 40 sited by the saturday over the last two years. they included those same issues of emergency contact and staff-to-child ratio. . >> most of the time with the children all the time. you know what i mean? you don't want to have too many kids 23 you can't handle them. >> reporter: this is a mother of a one-year-old. what happened is a scary thought. >> i don't know what i would do if it was her. >> reporter: you can see people have left stuffed animals and messages to remember the little girl who died. i asked today whether this could lead to any criminal charges. the state health depth is unclear at this point. police tell me they are waiting for the medical examiner's report. a big test this weekend to try to end the budget battle in harrisburg. the governor's office said it does have the support to pass major tax legislation in the

house. a vote is planned for tomorrow. if it passes, the vote on the main spending bill could come next week. homeowners in montgomery county will have to pay more taxes next year. a bill calls for a 9.8% tax increase. the county says the tax increase is necessary because of the significant increase in the cost of health care at the montgomery county prison. new at 6:00, target shows its new location for its third store in center city. our partners reports the retailer will move into the loeks on pennsylvania avenue. whole foods is moving to a bigger location. target plans to open at the location this summer. wednesday? today we've learned the district attorney will meet with taxi and uber drivers. hundreds of taxi drivers caused gridlock for at least an hour in city center when they left their vehicles. they say uber-x drivers don't have to pay for a license. in delaware county a 17-year veteran is facing theft charges. they say he stole from the evidence room. he allegedly took pills, cash, cell phones and more from evidence. the district attorney said the cases involved should not be compromised by ross's arrest. today a convicted philadelphia cop killer told a federal zwlauj he's received poor medical care. he told a judge when he asked for help fights c drug, he was told he's too healthy and the drug is too expensive to give to

him. he is suing the pennsylvania department of corrections saying they've shown indifference to his health. he has hepatitis c and other health problems. the judge refused to dismiss the charges. he spent years on death row for the death of daniel faulkner. the sentence was overturned and he is serving life in prison. there was a second incident of swastikas found inside a dorm at rowan university. students found the swastikas on the sides of a stair well. we told you about the first case on november 3rd. so far, there are no arrests. today the university issued a statement saying its will not stand for intolerance. next on nbc 10 news at 6:00, dozens of cats removed from a south jeshsy home. tonight the discount now available to give them a new home for the holidays.

new information tonight about a story we first told you about last night at 6:00. the spca now says there were 73 cats rescued from a gloucester home in pittman. we found workers in hazmat suits bringing them out in boxes yesterday. some of them will be available for adoption over the holidays. keeping you safe walking the boards in atlantic city. in order to do that, hundreds of additional surveillance cameras will go up. ted greenburg has the story. >> i just feel safer with cameras. >> reporter: nancy and jerry are comforted by those already focused on him and look forward to many more electronic eyes that will soon go up on atlantic city's boardwalk. >> maybe it will deter people from doing things they shouldn't
