''. right now at 11:00, a rainy start to our tuesday. umbrellas were everywhere in north philadelphia this morning and let's take a live look at the blue cross river rink at penn's landing. the rain is starting to taper off. it's also getting warmer in parts of our area. good morning, i'm lauren mayk. it was a damp and dreary start to the day. nbc 10 cameras were in lehigh county this morning where there was no snow but the rain still made for a messy morning commute. drivers had to be cautious on the slick roads out there. nbc 10 meteorologist sheena parveen is here with the forecast for the rest of the day. how is it looking? >> it's improving across the area which we expected around

this time of the day. the snow is up into parts of maine. the icy mix, that wintery mix, is following, shaded by pink. we, though, only have the rain around so a closer look, not much going on along the major interstates from trenton to philadelphia down to wilmington. we're seeing spotty sprinkles so still misty, a few light sprinkles here and there but a majority of the rain has moved out now. parts of atlantic county may be spotty showers but as we go through the rest of today it will continue to clear up. temperature now in allentown is 40 degrees. 51 philadelphia, 63 in wildwood so quite a temperature range from north to south and it's going to stay like that this afternoon. quite a temperature difference the farther south you go it could be warming to close to 70 degrees, believe it or not. so for the rest of today, by noon still the chance of a shower but overall conditions are improving. 55 degrees. 56 by 2:00 p.m. and cloudy and by 4:00 p.m. mostly cloudy around 56 degrees as well. coming up, i'll show you what it looks like as we go

he put heavy criticism on house republicans who were close to a deal on december 23 but he says they left town before a final vote. >> i am going to exercise my constitutional right to line-item veto this ridiculous exercise in budget futility. i'm calling on our legislators to get back to harrisburg, back to the work they left unfinished last week. in the meantime, i'm vetoing their $95 million cut to education. i'm also vetoing other items that they don't pay for in their so-called budget. this budget that they gave me does not balance. at the same time, i'm allowing emergency funding for our schools to get out. i'm also letting funding go out to our human service agencies and to our counties. but this is on an emergency basis only. in doing this, i am expressing the outrage that all of us pennsylvanians should feel about the garbage the republican legislative leaders have tried

to dump on us. >> reporter: the governor says the emergency funding will be released to schools and social service agency. i reached out to one agency, the director of the women's center says the damage to that agency has already been done but money should help them get back on track. many questions asked of the governor but he only answered a few questions. his staff says federal funding will be released to allow the schools to open on time but he made it clear this is emergency funding only and he still stresses that the state needs a budget. reporting live from digital operations center, deanna durante, nbc 10 news. >> thanks, deanna. now to an nbc 10 exclusive. a viewer shot this video in center city. you can see a man with a sledgehammer pounding away at the rainbow crosswalk. this happened at 13th and locust around 10:30 last night. the witness tells nbc 10 the man walked up to the crosswalk and started hammering the ground as other people passed by. >> i came to grab dinner and there was a man in the middle of the road with a sledgehammer

beating the rainbow sidewalks with it and another guy came up behind him and started chiseling with them. i didn't want to get involved so we called 911 and a cop was out in less than a minute but the guy started walking down the road. >> reporter: the rainbow crosswalk is a new addition to this intersection. it was painted over the summer in support of philadelphia's lgbt community on behalf of philly pride presents and the city. we have new information about a double shooting in chester overnight that left one man dead and another injured. police tell us it appears this happened as part of an attempted robbery. the men were shot around midnight on killeen street. the man shot multiple times, died at the scene. police found the other man about a block away, someone shot him in the leg. detectives are speaking to witnesses right now. a warning from police in philadelphia. a serial armed robber is preying on women at bus stops. and what you're carrying could make you a target. police say there have been six of these armed robberies in the

west oak lane area just this month. you can see the locations on this map. they're all near thouron avenue. the first robbery happened on december 6. the most recent one was yesterday. in each case, the suspect robbed the victim of her cell phone while she waited for the bus in the morning. police say the attacker is a unanimous in his early to mid-20s, 5'6" to 5'8" with a medium build. he was wearing a dark hooded sweatshirt and dark pants. to a story we broke here yesterday morning. a couple faces a list of charges, accused of attacking a man with a tire aaron in montgomery county. police arrested sergio gullo and amy oaka. police say this happened at an apartment complex in cheltenham township. a man confronted them as they were trying to steal his tires. the injured victim managed to

call police after they attacked them. officers found the couple. the victim is in the hospital in serious condition. car owners beware. authorities say there is a new trend among thieves and you can be a victim even if you do lock your car doors. they don't have to break a window, they are opening locked doors with an electronic remote but it's not yours, it's a high-tech device that mimics the signal of your remote. take a look at this video. a man walking back and forth in front of someone's car in fishtown. he waves the device and the doors unlock. once he got into the car, the thief stole cash and lottery tickets. >> looked at the vehicle and pretended to have that device thing but i don't know if that's actually a device that opened that vehicle because you don't see flashing lights from the headlights which is usually what happens with some of those keyless entries. >> to counteract these thieves, some people are cutting their car remotes in microwaves and refrigerators once they get home to presumably cut off the signal. a pennsylvania appeals court

has 60 days to respond to the philadelphia district attorney's request to take another look at the case against monsignor william lynn. lynn's conviction and the coverup of sex abuse cases was overturned last week by a three-judge panel, granting him a new trial. yesterday, d.a. seth williams asked the full nine-member state superior court to hear this case. he remains behind bars until that time. the district attorney's office promises to use all of its resources to keep him in state custody. >> had to show all these other act, all these things that showed monsignor lynn knew how dangerous it was to put a pedophile into a school with children. williams says he will appeal the findings to the state supreme court if necessary. in 2012, lynn became the first church official convicted over the handling of sex abuse allegations against priests. for the first time, we're hearing the 911 call from last week's bear attack in north

jersey. a boy scout made the call after a bear went after his scout master. take a listen. >> the attack happened a week ago sunday in a cave entrance at rockaway township's split rock reservoir. the scout master had been hiking with three of his scouts. rescue crews were able to locate the group. the scout master is recovering from minor injuries. another bear sighting in north jersey is creating delight and wonder. this is pedal the bear. the animal gained fame on social media when it was caught walking due to an upright. pedals hasn't been seen for several weeks but wildlife officials confirmed someone spotted him in west milford passaic county a few days ago and the bear appeared to be healthy. the eagles do not have a shot at making the playoffs but

check out this video of a fire chief rescuing a man from a burning car. it happened in york township york county. it was caught on a dash cam. when the chief arrived the man was unconscious. he pulled him out before crews arrived to put out the fire. the man in the car is being treated at the hospital. authorities in belgium have arrested two people they were were trying to plan attacks in brussels during the holidays. they say the suspects with taken into the custody after they were found with military uniforms, isis propaganda during the searches. they say they don't believe the plot was connected to the november 13 terrorist attacks in paris. president obama's motorcade was stopped yesterday in hawaii after a drone was spotted flying on the route. the secret service says the pilot was aware the presidential motorcade was in the area and immediately grounded the drone after being confronted by law

enforcement. no charges were filed. the consumer product safety commission is investigating 22 reports of hoverboard fires in 17 states. overheating batteries are the main concern here. the latest incident occurred on monday when a hoverboard caught fire at a mall in texas. several u.s. airlines have banned hoverboards and amazon has yanked some brands. one of those fires happened in new jersey. this 11-year-old boy had just gotten the smart balance wheel as his christmas gift it was charging sunday night at their home when it exploded and burst into flames. craig says he was terrified. >> it was just on fire and it was huge flames and i was really scared so i ran outside. >> it sounded like an actual bomb went off. >> no one was hurt. the fire marshal says if there's no address or manufacturer listed on the hoverboard manual

that's cause for concern. experts say you should charge the boards in dry open areas and never leave them unattended. the upper merion township police department offers these safety tips. always wear protective gear like a helmet and knee pads and when charging the board, use the cord that came with the device. never leave the hoverboard plugged in overnight. sand know the law in your town. for example, if you love in upper merion township it's illegal to ride them on sidewalks. a local teen recently won a $10,000 prize to develop an app. here to tell us more is sierra duback. she won a national vote to become an s.a.t. teen innovator. also joining us is david hutchison, senior vice president for s.a.t. north america. welcome to you both. sierra, i want to ask you first about what you came up with

philadelphia, 59 in millville. big temperature difference from north to south and this is the way it will stay today. is we'll have the temperature difference with that colder air sitting to the north, the warmer air in the south but we'll see temperatures still above normal for this time of year even in the coolest spot. here's future weather so as we go through the day the rain keeps moving offshore. this is 1:00 p.m. more clearing taking place but we'll see the clouds locked in. by the evening commute clouds could break. temperatures around the mid-50s for the philadelphia area. overnight tonight we stay dry and going into tomorrow morning for the morning commute we still stay dry. we'll be dry tomorrow. nothing like this morning with all the rain. through the afternoon tomorrow the afternoon commute will be dry but tomorrow evening around 8:00 p.m. we could be seeing some spotty showers late tomorrow and even late tomorrow night. we go into thursday for your new year's eve and conditions will be improving so it will be a dry new year's eve today rain

the world health organization has declared the west african nation of guinea to be ebola-free two years after an epidemic began there. the u.n. organization is holding a ceremony today to mark the step forward. more than 2,500 people died in guinea from ebola when the worst outbreak in history started in december of 2013. a new study finds having asthma may increase your risk of developing shingles. researchers found adults with a history of asthma were 70% more likely to develop shingles than

those without. shingles is caused by the same virus responsible for chicken pox and can reemerge in adults with weakened immune system. experts say the findings should bolster the need for shingles vaccines among adults with asthma. new research finds more than 90% of patients with chronic pain continue to get prescription painkillers after an overdose. the study also shows 70% got the prescription from the same doctor who ordered them prior to the overdose. these patients were twice as likely to have another overdose within two years than those who stopped taking the drugs. a surprising discovery out west. a drought is revealing a piece of the past in one lake. we'll show you what has been uncovered there. a live look at the blue cross riverrink in philadelphia where we will ring in the new year with fireworks. we'll get a preview of the big night coming up. ce company

it's a rainy morning around our region. windshield wipers were getting a workout in wilmington, new castle county. sheena parveen is here with the forecast for the rest of the day. sheena, i hope it will get better out there. >> we're seeing improvements, the rain is drying up and temperatures are slowly warming. it's part of the big weather system. we have snow in maine, an icy mix to the south of that but we have been dealing with the rain. temperatures have been too warm for anything else: locally across the philadelphia area, to trenton in parts of wilmington the rain has come to an end. maybe a few sprinkles but a lot drier than this morning. for parts of atlantic county south of atlantic city near egg harbor light showers there and that extends to cape may county.

temperatures are in the low 50s philadelphia, 51 wilmington, 51 washington township. areas north and west through the lehigh valley around 40, 32 in mount pocono and much of south jersey and delaware upper 50s to 60. we'll see a big temperature difference through the afternoon from north to south. so by noon a couple showers left over, mid-50s by 2:00 p.m. and 4:00 p.m. i expect the commute to be nice and dry for the area. as we go into the rest of the week, another chance of showers returns before colder air moves in for 2016. we'll look at that forecast coming up. >> thanks, sheena. the northeast is bearing the brunt of a winter storm that went quit. tornados, blizzards, ice and heavy rains pounded much of the middle of the country in recent days, now it's taking its toll on the northeast. ron mott reports. >> reporter: this morning, the northeast and new england

getting hit with snow and sleet while millions of americans elsewhere are digging out and drying out from the mess left behind over the past several days. in iowa, whiteout conditions, wind, and ice making for treacherous travel. in missouri, major flooding and record-breaking rainfall claiming at least 10 lives. the going tough to say the least. >> it has been a difficult several days and this threat is not over. >>. >> reporter: next door, a school bus was swept away in floodwaters. emergency responders rescuing the teenagers aboard. a state of emergency in oklahoma after freezing rain, ice and sleet left nearly 200,000 without power. >> we're doing okay. it could be worse. at least we didn't get hit by the tornados like they did in the dallas area. you have to count your lessings. >> reporter: in texas, a better look emerged at the devastation of nine tornados that killed 11 people. in garland, eudora barnes is picking up the pieces after

riding out saturday's tornados in her bathroom. >> the damage is unbelievable. it's heartbreaking. you've been here so long so to lose practically everything is just -- this is the stuff you see on tv. you don't think it will happen to you. >> reporter: elsewhere around the state, record snow. lubbock saw blizzard conditions, stranding motorists, closing roads. the mayor declaring a state of emergency set to last all week. some areas of new mexico buried under two feet of snow. >> that was nbc's ron mott reporting. most of today's snow is expected to fallout side of boston which broke a record last season with more than 110 inches. an average season bring s 43.5 inches. rain and snow may be falling there now but months of drought has taken a toll in oregon. and the lowest water level at this lake in 46 years has exposed a surprise -- a 19th century town complete with a utility wagon perfectly

police say they found the first victim behind two parked cars. he died at the scene. the second victim was found a block away. police tell us he was shot in the leg. detectives are interviewing witnesses right now. >> oh, my gosh. you can see a man with a sledgehammer pounding away at the rainbow crosswalk. this happened at 13th and locust streets around 10:30. the witness tells us a second man carrying a chisel started chipping away at the paint. both suspects took off before police arrived. the rainbow crosswalk was painted in support of philadelphia's lgbt community. we are learning new information about the capture of the so-called affluenza teen who has been on the run with his mother for more than three weeks. authorities caught ethan couch in mexico yesterday and just revealed they would issue an arrest warrant for his mother tanya on charges of hindering and apprehension. nbc's gabe gutierrez tells us how they found the pair. >> reporter: this morning, the search for affluenza teen ethan couch and his mother tanya is

over. mexican officials say the pair was picked up by immigration authorities around 6:00 p.m. monday in the popular resort town of puerta vallarta. couch's hair apparently dyed black. two weeks ago, the fbi and u.s. marshal service launched an international manhunt, offering a reward after the 18-year-old failed to check in with his probation officer in fort worth texas. >> it's our number one priority. >> reporter: his case drew worldwide attention after he killed four people while driving drunk in 2013. >> i'm going to need some ambulances it's bad. we flipped and -- oh, god. >> reporter: his blood alcohol content three times the legal limit. during sentencing, his attorney claimed the teen did not understand the consequences of his action because of his affluent upbringing. a judge gave him ten years probation, sparking widespread anger. kevin mcconnell's then 12-year-old son lucas was seriously injured in the crash. >> i think he was never taught that actions have consequences

other than the easiest way out. >> reporter: earlier this month, cell phone video of this party surfaced on social media. a spokesperson for the tarrant county district attorney interviewed witnesses who claimed couch was there. alcohol use would violate his probation, although couch is not seen drinking in the video. >> i think that was the trigger. i think that they ran because the video was released and the fear he would finally be locked up. >> that was nbc's gabe gutierrez reporting. authorities say ethan and tanya couch even held a going away party before they took off. they say the u.s. marshal service was working to get the two returned to the united states. the police officer who shot and killed a 12-year-old boy in cleveland last year won't face charges. the garage made that decision yesterday in the tamir rice case. rookie patrolman timothy

loehmann shot the boy as he was apparently reaching for a pellet gun. >> he had reason to fear for his life. it would be unresponsible and unreasonable if the law required a police officer to wait and see if the gun was real. tamir's family is urging people to express their decision peacefully. the u.s. attorney's office is conducting a civil rights investigation. >> stop police brutality! >> protesters in bridgton, cumberland county marched in justice for jerome reid last night. this week marks one year since police shot and killed reid during a traffic stop. in august, a grand jury decided not to charge the officers involved. reid's brother sean wants a federal investigation claiming county prosecutors mishandled the case. >> if i do something, i go to jail. if they do something they get a pat on the back. we still don't get no sleep. there's days i don't eat. >> reporter: police dash cam

things about new year's eve in philadelphia? >> being on the water with everyone else and knowing that everybody is looking at them, thinking about how great 2015 was in so many ways for the city and what's to come in 2016. many times the fireworks marks the end of something. with these fireworks it marks the beginning of something because people will be skating at the blue cross riverrink, they'll be going to winter fest they'll be at the orchestra, going to parties all over town and some of these are big parties. philadelphia is a relatively new concept for people so to be able to start it that day and know the next year is new year's day or what we in philadelphia call mummer's day is a wonderful way to begin the year. >> fabulous. i have been out there and it is so much fun. the lodge is nice and cozy. so it sounds like it will be a great time. thanks so much. >> it is, thank you. once a again, a reminder,

whole foods is paying a half million dollars to new york city to settle allegations it overcharged customers for pre-packaged foods. in june, city officials tested 80 items and found they were all mislabelled. the organic and natural foods supermarket chain will conduct quarterly audits to ensure products are properly weighed and marked. thanks to a historic supreme court decision, 2015 has been a landmark year for lgbt rights. one man who has been on the front lines of the fight for decades is philadelphia gay news founder mark siegel and he has written a new book called "and then i danced, traveling the

road to lgbt equality." it's a memoir of his journey through the movement. he joins us live in our studios. mark, thank you so much for joining us. >> thank you, good to be here. >> i want to ask you about this year in particular about that supreme court decision. what did that represent to you? was that the culmination of things? >> first off, it's a great year for the lgbt community and philadelphia. philadelphia for the third year in a row has been named by hrc which is the leading lgbt national organization as the nation's most lgbt friendly city. that's an incredible record. no other city in america, san francisco, los angeles, new york, can say that. we can, but the supreme court took us from a country which had 30 something states that supported marriage equality overnight everybody in america could get married if they so wish. but that's great but the reality is that while you can get married in one day, the

following day in most states in america you can get fired just for getting married. therefore we have lots of work to do. >> i want to ask you about how you got involved with the movement at a young age. what spurred you to play the role that you have? >> my upbringing here in philadelphia. i'm a philadelphia chauvinist, i love this town. my grandmother was a refugee from the poe grams in russia, she was a suffragette. i marched with people like sacel b. moore and i've been in the fight for equal rights and equality since i was a little kid thanks to my family appreciating the fact that we're americans. that the fight for everybody's rights is a fight for all of us. >> so why write it down now? what made you think okay, now is the tomb i'll put it on paper? >> i'm an old man!

[ laughter ] >> i don't know about that. >> a lot of my friends said "you have an incredible story." the book is a love letter to philadelphia. this is a love letter to philadelphia. it talks about everybody that everybody has been raegd about in the newspapers for the last 40 years and it tells funny stories you'd be shocked at. >> shocked? >> shocked! >> let me ask you about something that happened in philadelphia. i want to get your take on it. you were talking about how far you have come but there was something captured on video, i think we have it here. this video was taken at 13th and locust. this is the rainbow crosswalk and someone was seen hammering into it there. we don't have a lot of information about the circumstances of that, but police were called and the person did walk away from the scene there. what was your reaction when you heard about this? >> my reaction is i'm angered. as far as i'm concerned it's a

hate crime because it's based against the gay community and as the publisher of philadelphia gay news i am personally offering a $5,000 reward for the arrest and conviction of the person or persons who did that. >> have you heard anyone talking about this since you saw the video? have you -- do you know if there is anyone who does know who is responsible? >> i don't know. i can tell you that the pride committee of philadelphia headed by chuck bolts and franny price came up with the idea of doing the rainbow crosswalk in the middle of what is the gayborhood. it's a unity section for the entire community and to take a hammer to that is like throwing a brick through a church wall. again, i am offering a $5,000ry ward for the arrest and conviction to the person or persons who have done that. >> thank you so much for joining us, we appreciate it. and thank you for bringing your book as well.

>> thank you. >> we look forward to it. let's take a look at our weather, sheena joins us for that. >> well, good news, conditions are improving across the area. snow still up into new england but that will change to rain soon with temperatures warming. for us we had the rain this morning. the clouds are still locked into most of the area but for atlantic county very light showers close to the shore otherwise most is offshore. for cape may county, scattered sprinkles around the area says sex county along the beaches. we had rain earlier but that is moving away so conditions will continue to improve as we go through this afternoon and tonight and tomorrow will be a nice day. the evening commute today though will be dry. i'll show you that in a second. big temperature difference from north to south. 40 in allentown. 61 already in wildwood and we'll

keep seeing this big difference from north to south about a 20-degree difference through the afternoon. so here's future weather. the rain moving away. the clouds locked in for most of the afternoon. but 6:00 p.m. clouds but no rain anymore. we go into wednesday, tomorrow morning, the morning commute nice and dry temperatures in the 40s. then we stay dry for the evening commute but by 8:00 p.m. we could have showers move in so late in the day tomorrow showers around even overnight but we go into thursday new year's eve 11:00 a.m. looking good. mostly sunny and a little bit cooler but still in the mid-50s. into new year's day that's when we get a bigger drop in temperatures. rain clears, clouds hang around north of philadelphia. 70 degrees spots in delaware or south jersey so big temperature difference from north to south through the afternoon. then into new year's eve, here's the forecast for that staying

nice and dry. 44 by 10:00 p.m. so you'll probably want the heavy coat because after midnight temperatures will drop off into the 30s so we'll start your new year's day starting 2016 with temperatures in the 30s so it will get colder and new year's day looks good, too. tomorrow will be in the mid-50s. thursday mid-50s. mid-40s into friday and going into the weekend saturday and sunday look at the forecast for the first weekend of 2016. mostly sunny, dry, windy. 42 saturday, 43 sunday. that's closer to where we should be for this time of the year. stay tuned. we'll be right back.
