when my sources contacted me to say these charges were going to be coming down this morning, nbc 10 first to report that early this morning. it looked as though the new district attorney he always said when he was district attorney elect, still assistant district attorney, during the campaign, he would look strongly into seeing if cosby should be charged, as you may remembering we reported just earlier this year, back in august, that the current district attorney had reopened the investigation, completed the investigation by august and waiting to talk about what they would do. she didn't want to do it during the time of the election. we're here now. i've got to tell you, it's been a ride for the last ten years. breaking story then. breaking it now. seeing where we are with it. >> harry hairston involved in the very first story ten years ago. we'll try to go back to andrea

still had the fast paced sessions out there. but the players, some of them said chip kelly didn't communicate well and it was a big adjustment coming from college to pros and dealing with professional athletes and treating them like grown men. now, quarterback sam bradford originally said he wanted to return here and be in chip kelly's offense next year. he said he would still like to return here but the head coach will play a role in that. here is sam talking about the firing of chip kelly. >> i had a great relationship with chip. he gave me an opportunity after being injured two years and i'll forever be grateful for that. it's just -- it's tough him not being here. >> we, as players, didn't play as good as we needed to play. i feel bad for all of the coaches that put in all of the work they did for chip. we were all in this together.

. bill cosby's lawyers say they will, quote, vigorously defend against what they're calling an unjustified charge against their client. this morning montgomery county prosecutors filed three count of felony aggravated indecent assault against cosby. accuse him of drugging and assaulting a former temple university employee back in 2004. prosecutors say it happened at cosby's home in elkins park. cosby was arraigned this afternoon.
5:43 pm
he's now free after posting one-tenth of his $1 million bail. his next court date is set for january. in the charges filed against him today, cosby's accused of assaulting a woman in 2004. many are asking, why are montgomery county prosecutors just bringing charges now? let's turn to our legal analyst. thank you for sharing your insight here. the question is, why are the charges coming 12 years later? >> the district attorney's office is saying new evidence came to light. and the evidence they're talking about is back in july a federal judge released the testimony unsealed testimony from the deposition that mr. cosby gave. now, i can tell you, there's going to be a battle coming in this case because the lawyers for cosby will argue mr. cosby had some immunity told to him, therefore, he testified. that civil case. now using that evidence in a civil case against him to say this is new evidence and
5:44 pm
bringing these charges against him. the statute of limitations was due to run up in january 2016 in a couple of weeks. this is why they're waiting they're saying new evidence released from the deposition. >> enrique with the other women accusing cosby of sexual assault be able to testify about allegations they're making in any trial in this case? >> that's a maybe. i can tell you the attorneys for mr. cosby are going to argue that no way should this evidence be allowed for other women to testify. the judge in montgomery county when the case gets to court of common pleas will have a hard decision, he'll have to weigh the evidence, whether or not bringing in evidence from other women that want to testify to the m.o. or method mr. cosby goes about assaulting his victims but you can't use it in this case, you can only use that to say this is how he goes about it and whether or not the testimony is over prejudicial. if you're attorneys for mr. cosby your saying this is
5:45 pm
too prejudice, overpresidential this will inflame the jury and not be able to come in. the prosecution will say this is evidence of how he goes about doing thing and should be allowed to come in to prove the case. >> are you surprised by this? >> i'm surprised. i am surprised he's been charged so late in the game. i thought he was given immunity. i think this case ultimately will come down to lawyers on both sides having very sound procedural arguments what evidence should come in or what evidence should be left out and i think that is how this case ultimately is going to be decided. >> good seeing you. an iconic restaurant in washington, d.c., big mural of bill cosby on it, that's why we're talking about. the comedian has eaten free for decades there. chris gordon from washington checked in with tourists about today's charges.

5:47 pm
allows other women who have sued cosby to testify as well. >> went you're 50, 60 different people who don't know each other putting forth the same allegations ultimately it's not a surprise there's a criminal indictment. >> reporter: some cosby fans remain loyal to him despite the charges filed today. >> honestly, i feel like every man deserves a second chance but, at the same time, i do have a different opinion. i do have a different opinion after knowing certain things. >> i appreciate the positive things he did. i won't try to take that away from him. >> that was chris gordon reporting. nbc 10's coverage continues right now on the nbc 10 news app. you can watch more videos from ko cosby's arraignment and booking. a look back at his career and fall from grace. now your nbc 10 first alert weather with chief meteorologist glenn "hurricane" schwartz. >> just one more day in the
