>> mummers under controversy. tonight the city's next mayor slamming what some call a hateful performance. and one man says some mummers beat him while shouting homophobic slurs. but first, darkness brings desperation in the search for a missing 5-year-old boy who has autism. good evening, i'm jacqueline london. >> i'm keith jones. the boy has spent a full 24 hours outside alone in frigid temperatures. he ran away barefoot without a coat. >> nbc 10 lehigh valley bureau reporter randy gyllenhaal is live tonight. police are asking the community

to help tonight. >> reporter: they are asking for help from neighbors here in the east side of allentown. this is the neighborhood where the boy disappeared from. as you can see behind me, police have set up a command post here. i'm told this search will go nonstop throughout the night. and that police also found surveillance video, showing the young boy out in the street, but where he went next is the question that needs to be solved as soon as possible. from high above allentown, helicopters scour the lehigh river. it's a focus of this search, because kids with autism are often attracted to water. on the ground, bloodhounds and k-9s pick up the boy's scent but the trail runs dry. >> you don't want to yell his name. >> volunteers gather with flashlights for how to best approach the missing boy, who may be hiding and afraid. they're asked not to shout his name. >> seeing a lot of people will scare him.

so we're trying to keep it in small groups. >> 5-year-old jayliel batista vanished during a new year's eve party. he left without a coat, shoes or socks. >> he was playing with all the other kids, and he left out of nowhere. i don't even know what he's going through. i'm really scared. >> reporter: for 24 hours now, crews have combed forests and train tracks. professional search teams arrived with dogs, but the air is now freezing cold. night has fallen again, so police are asking neighbors to look inside sheds and porches. >> that's the best way they can help out. we're trying not to have any interference with the multiple k-9 searches take place at this point. >> a desperate search and a community coming together in the cold with time quickly running out. >> this is a little 5-year-old boy who is out there with no coat, no shoes, and we need to get him home. >> reporter: back here live in

allentown, you can see some of those search dogs warming up, taking a break inside this car, because it is frigid out here. meantime, police are asking the public not to go out by themselves searching in the woods around this area for a few reasons. they don't want people to get lost. but they also don't want to contaminate the k-9 scent messing with smells which could lead to a more difficult situation for the dogs. sometimes they'll see a rumor something has been found and they go running off. so far at this point in the night, nothing has turned up. up a day of pageantry and protest for the mummers. they performed at the pennsylvania convention center. ♪ >> earlier today the mummers strutted down broad street for

the new year's day parade and the philadelphia division designed to add diversity included two new hispanic performance groups, a black drill team and the lgbt ms. fancy brigade. >> i hope to be a part of this parade for, you know, the next year and more years coming up. >> the philadelphia division kicked the parade off this year. they hope to get even more people out next year. protesters joined the parade route. they marched and chanted in the name of the black lives matter movement. some clashed with police. there is a reason the protesters chose the mummers. it's more than disrupting a philadelphia tradition. >> i was a mummer. i've been a mummer twice. and i love it. but at the same time, there are things inside of it, systemic racism, that go on that i'm just not okay with, that simply aren't okay. >> two people were arrested today, one for disorderly conduct, the other for

disrupting a procession. and that wasn't the only controversy today. a man says some mummers attacked him, shouting homophobic slurs. >> city leaders are calling for change after two performances that some are calling hateful, and insulting. >> nbc 10's drew smith has the story, new at 11:00. >> reporter: john holtz is taking care of his parents' dog this new year's day. he says he was out walking it at south and broad streets when men in mummers gear began to make fun of the dog and it escalated to homophobic slurs. >> they seemed like drunken idiots, in the alley, being offensive. >> reporter: he says he asked the men to stop and he claims that's when he got clocked. you can see what his face looks like now. another incident shared online upset some people. this man, who we have blurred until we can reach him for comment, is holding signs

referencing caitlyn jenner, part of a larger mummers act. mayor elect kenney called it hurtful. the party continued tonight as mummers danced their way down the street. plenty of happy faces of people who told us the actions of a few should not reflect on the whole event, especially this year, when the mummers included a new division focused on diversity for the first time. >> it's our tradition. it's all of our tradition. i think the party poopers have been pushed out. people aren't making that big of a mess this year. >> reporter: john holtz says he told police he did not want to make a report but just make a difference. >> maybe just a tad bit safer for the next time around. >> reporter: i spoke with the director for the mayor's office of lgbt affairs tonight. she says one of the first thing she plans to do is speak with mummers organizers about acceptance and understanding so hateful things do not happen

here. in center city, drew smith, nbc 10 news. another mummers group is facing criticism for performing in brown face. the performers wore ponchos and sombreros. some dressed as tacos. tonight fans are remembering natalie cole, the grammy winning singer died of complications from ongoing health issues last night. ♪ virtual duet with her late father. the legendary nation king coal. she had four decades of hits, including "this will be" and "our love." she struggled with substance abuse for many years and received a kidney transplant in 2009 after developing hepatitis. she was 65 years old. and her family released this statement. natalie fought a fierce, courageous battle, dying how she

lived, with dignity, strength and honor. our beloved mother and sister will be greatly missed and remain unforgettable in our hearts forever. >> bill cosby's wife will appeal a ruling that forces her to appear for a deposition involving her husband. a judge denied a motion by camille cosby's attorneys, fighting that deposition. it was issued in a defamation case brought by seven women accusing bill cosby of sexual misconduct. bill cosby tweeted a thank you to his friends and fans yesterday. it's the first thing he's said since being arrested on sexual assault charges and the next time we might hear from him could be in two weeks at a preliminary hearing in mobility. montgomery county. this scene outside the small elkins park district court. >> mr. cosby, how do you respond to the allegations? >> he was silent when walked in and out of court earlier this week. >> mr. cosby, any comment? >> the media quoted him as

saying, friends and families, thank you. >> it will be a media circus. >> joel bennic has been following the cosby says and says the preliminary hearing will be pushed back at the defense's request. >> chances are they'll continue it, simply because they've got a lot of information to review. >> reporter: he says when the hearing does happen, the prosecution will lay out its case against cosby. it could present evidence and call witnesses but doesn't have to show all its cards. >> the commonwealth has to show enough evidence a crime may have been committed and the accused may have been the one to do it. it's just over 50% of a burden on the commonwealth, meaning the judge decides is there enough for this case to proceed to trial. >> reporter: we spoke with the attorney for cosby's accuser, andrea constant today. she says it's up to the district attorney on whether or not to call her client to testify at the preliminary hearing. bennic says if constant is called, cosby's attorneys will be able to cross-examination her. >> that's the danger of having

her testify. she's subject to cross-examination, meaning mr. cosby's attorneys could precipitatitrip her up or something like that. >> cosby's attorneys will be allowed to present evidence, call witnesses and cosby himself could testify, although bennic says that's unlikely. the aggravated indecent assault charges carry ten years in prison and a fine of $25,000. cosby is now free on $1 million bond. tonight israeli authorities are investigating whether a deadly shooting outside a bar in tel aviv may have been inspired by isis. security video captured the gunmen killing two israelis and injuring several others. there is a massive manhunt for an israeli arab in his 20s. some believe this could be the country's first isis-inspired attack. investigators say the motive may be criminal. tonight we are getting a look at the damage caused by a fire that tore through a high-rise luxury hotel in dubai on new year's eve.

today smoke continued to rise from the building known as the address downtown. a fire broke out at the hotel just hours before dubai was set to ring in the new year. 14 people were hurt. the cause of this fire remains under investigation. we have new information on a story we first told you about last night at 11:00. police have identified a man arrested in an armed home invasion in philadelphia's written house neighborhood. two men tried to force their way into a home on south 16th street. officers say a father and his two sons fought the men off, took their gun and held him until police arrived. the other two men escaped. to a plan that could change the face of the city. we're going to tell you where i-95 could be buried underground. plus, why your commute might be more expensive in the new year. here's something you don't see every day. twins born in different years.

the dry stretch is going to be dry for several days. you can go ahead and wash the car. and a brief arctic blast. the heavy winter coats are going to be needed. let me tell you. not for a real long time, but for a couple of days, we have dry conditions right now. pretty good visibility. 36 degrees. it's west wind at 8 miles per hour. feels like 30. 7 degrees colder than at this time yesterday. so, yeah, the colder air has come in, and it was 52 degrees yesterday, 43 today. and probably through the weekend, as well. sunday is going to be the windiest of the days, so it will feel much colder than that. down to 29 in coatesville. 31 in doylestown. 32 in quaker town. 33 pottstown. we haven't seen temperatures like that at this time of night in a long time. washington township, 31. wilmington at 33. wrightstown 32. this seems warm compared to what we're getting early next week

and the warm spot is lewis, delaware at 41 degrees. the ski season is going to be saved. they're going to be making snow for weeks now. they're going to get natural snow. the weather pattern has changed. so you snow-lovers and cold-lovers, you're going to be happy. but in december, smashing records. nearly 14 degrees above normal, and that beats the old record by almost 7 degrees. that is unbelievable, making it like a normal december in savannah, georgia. that's how warm it was in december. clearing and colder tonight. 30 for the low in philadelphia. 25 north and west. tomorrow the went picks up a bit. we get sunshine. remember that? breezy and cold, high temperatures in the low 40s. right around average. and then more average temperatures on sunday.

the republicans in harrisburg were fighting each other over the state budget. that's right. each other. the republican state senate passed a responsible budget that "begins" to fund education but the republican house of representatives has insisted on a budget that fails to fund education and balloons the deficit. call your legislator, tell them to pass a budget that's right for pennsylvania.

get a load of this. twins born in san diego will share a lot of things, but not their birthday. twin babies jay lynn and louise valencia were born in different years. jay lynn came in the final minute of 2015 while her younger brother was born three minutes after 2016 started. one benefit for their parents, an immediate tax deduction for one baby, and two birthday parties on separate days.
