[ bleep ]. >> this video went viral on facebook, claiming to show a pregna pregnant woman being attacked. tonight the story behind the video and why the woman taking a beating might be the one facing charges. plus, local school threatened with a legal battle for having kids say "god bless america." but first, a bitterly cold blast. people are bundling up against bone-chilling temperatures. and animal control is trying to make sure pets are not left out in the cold. good evening, i'm jacqueline london. >> i'm jim rosenfield. winter is back with a vengeance. it's not just the cold, it's the wind making the weather feel even worse. just take a look at this flag on

top of the air mark building in center city, it's getting a workout there in the wind. >> tonight we have live team coverage beginning with nbc 10 first alert chief meteorologist glenn "hurricane" schwartz. how cold is it going to be when you wake up tomorrow? >> a lot of us facing single-digit temperatures and windchill temperatures, feels like to exposed skin, below zero. making snow like crazy in the poconos. this is blue mountain right now. they can make snow 24 hours a day under this kinds of conditions. the temperature there zero. 10 in allentown. 11 in pottstown. 15 in philadelphia. now, if that isn't bad enough, we've still got significant wind out there. 21 mile an hour sustained wind in philadelphia. making it feel like it's 2 below zero. 6 below in allentown. 19 below in mt. pocono. windchill advisories in effect up there. it is just brutal. and as we go through the rest of

the night and into the morning hours, what are you going to find? at 6:00 a.m., 13 degrees. a windchill of zero. by 10:00 a.m., it only gets up to 18. still feeling like single digits. i'll tell you when it really is going to start getting warmer with the seven-day in a few minutes. >> all right, glenn. our team coverage continues with nbc 10's keith jones live in south philadelphia. >> keith, it is a shock to the system, i'm sure, right? >> reporter: yeah, jim, jackie, it is freezing outside. "hurricane" schwartz hit the nail on the head. look behind me here at the bank sign. it used to say 14 degrees. now it says 13 degrees out here. with this windchill, it feels more like zero and it's not just cold for us. you've heard of man's best friend. these guys are a dog's best friend, officers from the philly animal care and control team. >> right there. >> reporter: tonight they noticed this makeshift doghouse, a blue tarp and cardboard. the owner answers but doesn't

speak english. >> chihuahua. >> reporter: a relative translates. >> you don't want to wake up in the morning they be frozen. >> reporter: or worse, it's a warning before they issue a citation. in the worst cases -- >> we refer those calls to the pennsylvania spca for possible cruelty. >> reporter: tara directs these officers who respond at all hours of the night, they look for adequate shelter, the doghouse has to be weatherproof. it's got to be raised off the ground. there also has to be a flap and there has to be bedding, straw, hay, or cedar chips. they work better than cloth which gets wet. >> we recommend in temperatures like this you bring your dog inside of the home. that's the best place for the animal to be. >> reporter: inside your home is the best place for us. >> we're just making sure that everything is in an operable fashion. >> reporter: get your heater checked now, but keep in mind, some people don't have a roof over their heads. others have to work like these construction workers in the ben franklin parkway and this man who works as a valet in center city.

tonight, thousands of people have watched this video at first glance appears to show a pregnant woman under attack. she's beaten while she screams, my baby, my baby, but police say not everyone is as it seems. >> nbc 10's denise nakano is live at camden police headquarters. denise, what's going on there? >> reporter: well, definitely much more to this story. police are now calling the alleged victim the person of interest. >> hey! >> reporter: camden county detectives are talking to witnesses and those involved in a disturbing attack caught on video december 28th, and shared 50,000 times on social media. >> that's just wrong. >> reporter: the video shows a woman screaming, my baby, as a group of four to five women hurled blows at her head. >> my baby! >> reporter: the attack sparked concern for the woman and what she claimed to be her unborn child. >> people being violent and evil and disrespectful toward a pregnant woman. >> reporter: police say the video is only a snapshot of

actual events. the woman drove to camden from philadelphia armed with a cane or crowbar to carry out threats of violence in an ongoing dispute. she sprayed mace at the women. see one woman wiping her eyes. then threatening to grab a gun from her car. authorities also believe the woman is not actually pregnant. >> it was terrible. terrible situation. >> reporter: the woman did not file a police report following the attack on westminister an pfeiffer streets in camden. while the group of women are said to be cooperating with the investigation, police say it was the woman originally believed to be the victim who actually instigated the fight. still, some are asking whether it had to go this far. >> they didn't have to initiate with her. they could have just called the cops and said that she was giving threats, anything. >> reporter: the woman did drive herself to cooper university hospital for cuts and abrasions but she was not admitted. police are still looking to talk to her tonight and are asking for her to come forward. reporting live in camden, denise

nakano, nbc 10 news. jim kenney has only been philadelphia mayor for a few hours now but he's already setting his own traditions. tonight, he passed on an inaugural ball. >> instead he celebrated with a block party and invited the city to join him. >> nbc 10's andrea klecline-tho is live at city hall. the mayor says he's trying to set a new tone. >> reporter: that's right. he didn't waste any time at all. mayor kenney gave a few speeches today but it may be the block party that sent the strongest message of all. >> how do you like our block party? no black ties, no gowns, we're good. >> reporter: he does not want to come across as a politician but instead the guy from south philly who could be your neighbor. >> i think this is for more the people. he's a thoughtful guy. he understands normal day-to-day life. >> reporter: this inaugural block party with local food

trucks a stark contrast to the usual gala. it's meant to reinforce that. so was inviting hundreds of people from all corners of the city. >> i think he can pull a lot of different people from different backgrounds together and just push forward for philadelphia. >> reporter: those partnerships are key to kenney's plan to improve philadelphia's public schools by raising private donations starting with this party. >> it's often about public schools and our students and our teachers and our staff members and so hasn't been like that since i've been here, so this is very exciting to see. >> reporter: the block party continues the campaign for mayor kenney's administration but it's also setting high expectations. >> i want you to have a good time. let's get to work tomorrow, but let's party tonight. >> reporter: now, the block party raised more than $650,000 for philadelphia public schools. mayor kenney says he is not stopping there. he's giving up the mayor's box tickets to local sporting events giving them up to local companies who donate to the fund. reporting live outside of city

hall, aundrea cline-thomas, nbc 10 news. one of kenney's first actions as mayor making philadelphia a sanctuary city. this limits cooperation between philadelphia police and u.s. immigrations and customs enforcement in holding undocumented immigrants. this all comes after federal agents launched a serious es of raids across the country targeting undumgteocumented immigrants over the weekend. we spoke to a spokesperson with the mexican consulate who tried to reassure those who are concerned about the raids. >> the targets are people or families who hold any kind of final removal order and that they didn't comply with it, so we need to keep in mind that it's not like they're trying to report everybody. >> the mexican consulate says it has a 24/7 hotline available for anyone seeking legal advice. president obama is using the powers of his office to change gun laws and in his words potentially save lives.

tomorrow the president is set to announce executive actions designed to curb gun violence. among the changes, all gun sellers will have to register as dealers even those who sell at gun shows and online. and they'll have to run background checks on all perspective buyers. president obama is defending his decision to bypass congress saying these executive actions fall within his legal authority. now to the latest on armed activists occupying an oregon wildlife refuge. the group has taken up the cause of two ranchers convicted of setting fire to federal grazing land. those men already served short sentences but tonight they're back behind bars. a judge ordered them to return to prison for four years because the time served did not meet the minimum sentencing laws. that's not sitting well with the group of members who say the hammonds were treated unfairly. >> purpose as we have shown is to restore and defend the

constitution. >> law enforcement is keeping its distance while trying to defuse the occupation. closer to home now, funeral services are scheduled for a boy with autism found dead over the week in allentown. services will begin at 2:00 p.m. friday at calvary temple on winchester road in allentown. loved ones are are asking you w white to celebrate jayliel vega batista's life. an autopsy was performed this morning. the lehigh county coroner has yet to confirm a cause of death but did say the child did not have any injuries. vega's body was find in a canal saturday. he'd been missing since last thursday. police have said they think his death was a tragic accident. meet the new faces of camden county. this afternoon, the county held its 172nd reorganization meeting where all the freeholders took the office. this is video of one being worn into office. she's the first asian-american ever to be elected to the

freeholder board. is it patriots or promoting religion? the republicans in harrisburg were fighting each other over the state budget. that's right. each other. the republican state senate passed a responsible budget that "begins" to fund education but the republican house of representatives has insisted on a budget that fails to fund education and balloons the deficit. call your legislator, tell them to pass a budget that's right for pennsylvania.

[ applause ] we know who we are. we know who we are. we are a free people. >> the memorial also featured a religious speech and this inspirational music. and new at 11:00, a controversy over "god bless america." the aclu is challenging a tradition that a local school started after 9/11. >> nbc 10's drew smith reports from haddon height in camden county where some parents are upset. >> reporter: this is the flag pole where the american flag goes up every morning above glenview elementary school, inside students would recite the pledge of allegiance to the flag and right after say "god bless america" a tradition the school endorsed until this week. >> i think this is typical of the aclu. you're bullying the masses.

>> reporter: gleview's principal wrote parents an e-mail saying the american civil liberties union viewed the reciting of "god bless america" as promoting religious beliefs. the school says it did not want to get into a constitutional fight and pay the legal fees that come with it. so it discontinued the practice. >> we're going to stand up and say that we don't agree. >> reporter: parents are not staying quiet. christy clark and others said "god bless america" as they dropped their kids off today and her son in first grade decided to say it after the pledge. so you said god bless america today? >> yes. everybody did. >> reporter: we called the aclu of new jersey and spoke with its legal director. >> parents, not the government, have the right to direct the religious upbringing of their children. >> i mean, i support the aclu, i support them fighting for people's rights but they're not saying "jesus christ bless america," not saying "allah bless america." >> reporter: some parents called this a silly debate.

some saw the different sides. >> one level i understand it. >> reporter: they all wanted to make sure there is still freedom of speech. >> you know, we're concerned. what's next? is the pledge going to go away alfol altogether? it says "under god" in the pledge. >> reporter: the principal heard who parents who say they want their kids to say "god bless america" every morning. he says he understands the amendme amendment. if you spent too much over the holidays, here's news that might make you spimile. the cost to drive to work and your mohome is dropping. saved $700 at the pump last year and aaa estimates gas prices could drop 10 to 15 cents this quarter. one new homeowner we spoke to today paid $120 for 50 gallons of heating oil. this time last year he would have paid close to $91 more for

the same amount. camelback ski resort is taking advantage of the cold. after weeks of delay, the resort is getting ready to open. snow making machines are filling out the base. the resort is planned to fully open to the public coming up on thursday. glenn, we are back to winter full throttle. >> oh, yeah, we are. step outside if you have any doubts, glenn. yeah, it's kind of brutal out there. we've been spoiled by that record december. yeah, they're still making snow at camelback right at this hour. we've got two arctic nights. tonight and tomorrow night. although it won't be as windy tomorrow night. windchills near or even below zero by the time you get up in the morning, but significant warming by the end of the week and the weekend. that flag is really blowing and the wind continues. it has not let up. 15 degrees right now. 21 mile an hour wind making it feel like it's 2 below zero. the actual air temperature down to zero in mt. pocono. 11 in pottstown. 12 in trenton. 13 in mt. holly.

13 in glassboro. and 16 in atlantic city. the warm spots, dover at 17 degrees. we still have significant wind gusts in parts of the area. 20 to 30 miles an hour. 30 mile an hour wind gusts right now in dover, delaware. and these are the feels-like temperatures. the windchills based on the sustained wind, not just the gusts. 6 below in allentown. 3 below in reading. 4 below in pottstown. it's been a long time since we've seen anything close to this. and as we get up in the morning, morning rush, 13 in philadelphia, windchill near zero. by noon, only 23. feeling like 17. now the wind is going to be diminishing tomorrow afternoon, so it's not going to be quite as brutal tomorrow night as it is tonight. but the low temperatures in the single digits in allentown, reading, pottstown, trenton, lancaster, even wilmington, down

to 9 degrees by morning. this arctic air that's in now has one more day in it and then it escapes right back to canada. that's just a temporary thing, though. temperatures ease up later in the week and over the weekend and then here comes the next round of arctic air. that's going to stay around longer. that's next week. starting next week. bitter cold tonight. the windchill of zero to 5 below. temperature down to 12 degrees. now the record for today is 2. it's not like it's record breaking, but we've just been so spoiled. sunny and bitter cold tomorrow. temperature up to about the freezing point. but not as windy. and then on wednesday, a very, very cold start. 18 in philadelphia. maybe single digits in some of the suburbs as it's calm. and then the temperature starts to go back up to the point where it's above average. as we go toward the end of the week and by the time next storm hits, by friday night, over the weekend, it's warming up for rain, near 550 over the weekend
