this is one of the scariest things i've ever seen. this guy tried to execute the police officer. the police officer had no idea he was coming. ambushed. a philadelphia police officer is shot while sitting in his cruiser and the city's new police commissioner says he is amazed the officer was able to survive. good morning, i'm vai sikahema. officer jesse hartnett is recovering at penn presbyterian hospital. around 11:40 he was driving his patrol car in west philadelphia when a gunman started shooting. officer hartnett was shot three times.

officers apprehended him, he is also in the hospital. nbc 10's katy zachry is live outside of penn presbyterian medical center where officer hartnett is being treated. katie, how is he doing? >> vai, i spoke to his dad not long ago and he said he's out of surgery, he's in good spirits. as you said, the injured officer was brought here to penn presbyterian hospital. since then he's undergone hour hours of surgery. he's spoken to detectives in his hospital room about being ambushed and shot while sitting in his patrol car. one of the first people philadelphia police officer jesse hartnett saw when he woke up from surgery -- his dad. >> i love him. i'm very proud of him. he's an excellent person. >> reporter: robert hartnett gets choked up thinking about the close call his son had while patrolling streets of west philadelphia thursday night. 33-year-old officer hartnett was stopped at an intersection when police say a gunman walked up to his patrol car shooting rapid fire at him. here's the radio call. >> shots fired!

officer has been shot! i'm bleeding heavily! >> we look at the video, we have video we captured of this, this is one of the scariest things i've ever seen. this guy tried to execute the police officer. the police officer had no idea he was coming. it's amazing he's alive. >> reporter: officer hartnett, who's been on the force for five years, was hit several times in the arm. he still managed to fire his own gun, hitting the suspect who was caught a few blocks away. >> tough road. he's a tough guy, he's an excellent philadelphia officer. >> reporter: when officer hartnett was rushed to the hospital, his colleagues say he was alert and coherent. they tell us he has a broken arm and severe nerve damage but his spirits are good. officer jesse hartnett's family is meeting this morning here at the hospital behind me. he grew up just outside of philadelphia in east landsdown. reporting live from university city, katy zachry, nbc 10 news. philadelphia mayor jim kenny is talking about the shooting this morning. he said it demonstrates the need

to keep guns out of the wrong hands. >> it's amazing the number of weapons available to people who are criminals, mentally ill. >> reporter: the mayor says more laws are needed at the state and national level to keep guns away from dangerous people. and we have a team of nbc 10 reporters and photographers working to gather more information on this story. you can get updates any time on the nbc 10 app. more breaking news where a police officer in dorchester, massachusetts, has just been shot. we're looking at a live picture from that area. we're told this happened in the past 30 minutes and the boston police officer was taken to the hospital. there were reports he was shot in the leg, we'll keep you updated on this breaking news. happening now, sentencing is under way for two people convicted in the deadly market street building collapse. a jury convicted griffin campbell of six counts of

involuntary manslaughter back in october. his construction company was in charge of the demolition. during that project in june of 2013, a four-story brick wall fell under the sell separation army thrift store next door at 22nd and market. six people were killed and more than a dozen hurt. a subcontractor hired by campbell pleaded guilty to involuntary manslaughter charges. sean benschop is scheduled to be sentenced today. deanna durante is live in the courthouse. look for her updates live on nbc 10 news at 4:00 this afternoon. a pregnant mother and her two-year-old son after this early morning fire in north philadelphia. nbc 10's monique braxton has been on the scene all morning. she joins us live now with details of this heartbreaking story. monique? >> yeah, vai. it was very tough being out here most of the morning but we can tell you that family members have identified the mother as elizabeth perez and they say she passed away while trying to help her toddler nathaniel escape.

we're showing you live video of the activity on the block here. you can see some relatives and neighbors have come out to look. the home has been boarded up lni has been here as well as the fire investigators. they tell us one of the first concerns were portable heaters inside the home. >> not a pretty sight. it really is not pretty. >> reporter: an emotional fire commissioner derek sawyer says initially the family who fled the inferno told them all six inside had escaped. but they didn't realize elizabeth perez had gone back for her son nathaniel. >> the mother of the child had the child in her hands. she was desperately trying to get out. >> reporter: firefighters discovered the mother, visibly pregnant, cradling her toddler near the doorway of the front second floor bedroom. investigators also found several portable heaters inside this gutted two-story structure.

investigators are focusing their attention on a kerosene heater in the living room that may have ignited a blanket. >> we were told there were at least five heaters in the home. that's the number one issue. on monday i tweeted out if you're going to use space heaters, space heaters need space. >>. >> reporter: the commissioner's office have updated their numbers now. four children were taken to a local hospital along with two adults and then the two people who passed away here. initially the mother was counted among the six people. there were no working smoke detectors inside the house. the american red cross has arrived to assist the family. we've also reached out to the family and other than sharing pictures with us, they tell us they are too distraught to talk but they will be revisiting the neighborhood as the day progresses and no doubt we'll stay on top of this

investigation and stay here in the community and have more at 11:30. live from north philadelphia, monique braxton, nbc 10 news. skiers are enjoying the dry weather at the slopes at camelback this morning. they opened for the season yesterday as we take a live look at the resort in the poconos. first alert chief meteorologist glaur glenn "hurricane" schwartz is here with the forecast. hey, glen. >> we have another day with more clouds around. temperatures way above average. you can see they're thickening up as we look back to the west and we're looking at the live radar and there's nothing on there so it's just the clouds. the rain and precipitation is back in west virginia and into ohio. a little bit of a wintery mix on the leading edge and that is possible up in parts of the poconos later on tonight.

but the daytime hours are going to be dry, on the mild side, not especially windy and as we go towards the late evening, you see a couple blips here in monroe county, for example, in the middle of the night and even then the atmosphere is warming up so anything by 7:00 a.m., even in the poconos, is going to be rain. and, of course, more significant rain will be on the way later in the weekend. right now it's 42 in philadelphia, 31 in mount pocono, 37 degrees in allentown and 46 degrees in atlantic city. the temperature not going up a whole lot but it's still above average. cloudy skies, not a whole lot of wind. i'll have the timing on some of the rain and some of that rain could be on the heavy side this weekend with the seven-day in just a few minutes. >> thank you, glenn. time for a check on the roads with jessica boyington. jessica, what are you seeing out there? >> looking like a friday, which is a good thing. roadways are empty.

so i picked this camera on the schuylkill expressway because earlier around 30th street westbound we did have a disabled vehicle that had it backed up to here but you can see that's clear and you're good to go so no delays. the schuylkill was the heaviest this morning. 95 still looking great as well. drive times are still in the green, back down, but watch out for ramp closures on 95 northbound and 95 southbound: there's an accident in upper merion on country line road and devon park drive and in cherry hill, new jersey, there are fallen power cables on church road tying it up in both directions tying it up in maple avenue and haddon town road. no delays. you can take septa, patco, new jersey transit or dart and you'll be fine. vai? philadelphia police say a man is dead after stealing a car, driving the wrong way on the roosevelt boulevard and crashing. in an effort to escape he jumped off an overpass in east false. >> laying on the exit ramp

having cpr performed on him at this time. he ain't going nowhere. >> police radio captured the molt officers found the suspect laying on the ground after falling more than 30 feet. authorities say he was speeding northbound in the southbound lanes of route 1 before the crash. the accident sent three other people to the hospital and caused massive backups during the evening rush hour. >> how long did you wait? >> like two showers in. >> been an hour and forty minutes. i cannot believe it took this long. i've never seen the bridge closed. it must be a horrific accident. >> reporter: the suspect's family tells nbc 10 they don't know why he was driving the wrong way or why he tried to get away but they say he leaves behind a young daughter. embattled allentown mayor ed polowski will deliver his state of the city address in an hour. community and business leaders will join with city officials to listen to the speech which comes amid an fbi investigation into how allentown awarded city contracts. new jersey lawmakers will

decide next week whether to increase the legal age to buy cigarettes to 21. the vote is scheduled for monday. if it passes, it would still need the governor's signature. health advocates argue raising the age from 19 to 21 for all tobacco and e-cigarette products will make it less likely for young people to become addicted to nicotine. nbc 10 spoke with a sponsor of the bill. >> we know that young minds don't develop till much later and if they adopt addictive behaviors early on in life then they will continue with these sort of addictive behave yors. >> reporter: opponents of the idea include the association of gas stations and convenience stores. they say it would decrease profits and cost the state millions in tax revenue. hawaii is the only state with a tobacco age of 21. you can advil nova to the long list of schools now banning overboards. the school sent out an e-mail to students saying hoverboards are banned from residence halls.

. we take a live look at the big board on wall street. where the dow has just gone down 3% there. so keeping a close eye on trading. we've had a couple rough days in a row. yesterday the dafgs finished down about 400 point and we'll continue to monitor that situation. japan ended the day with tanking stock prices there. the fifth day of losses in a row in tokyo, marking the worst start of the financial new year since world war ii. the nikkei ended the day at 6,000. it started the year just above the 19,000 mark. kbel january investigators believe the explosives used in the deadly attacks in paris may

have been made in an apartment in belgium. investigators found the fingerprint of a key fugitive inside of one apartment. federal prosecutors say police found material that could be used to make explosives. that leads investigators believe to that the attacks were planned in buelgium. >> women's rights are human rights. donald trump's campaign unleashes an instagram in attacking hillary clinton, insinuating she isn't a supporter of women and raising the issue of her husband's past infidelity. former president bill clinton refused to respond. >> i don't have any response. if he wins the republican nomination, we'll have plenty of time to talk about it. >> hillary clinton will get endorsements today from actress lena dunham and u.s. soccer player abby waumbach.

not everyone who turned out for a trump rally was a supporter. many protesters showed up and some disrupted the rally. and right now marco rubio is holding a town hall meeting in the early voting state of new hampshire. he's in concord getting support from a legislator there. new hampshire's primary is scheduled for february 9. and within the last half hour the so-called affluenza mom made an appearance in a texas room. tonya couch is charged with hindering the apprehension of a felon. authorities believe she helped her son plea to mexico while prosecutors were investigating whether he violated his probation. ethan couch remains in jail in mexico. he's accusing police of violating his civil rights. that case will hold up his extradition to the u.s. couch was on probation for a drunk driving accident that killed four people. take a look at this massive

apartment fire in missouri. after trying to fight the flames, firefighters were told to evacuate the building. they set up a primmer in case of a collapse. two people were hurt: no word on the cause. we continue to see a slow warming trend but the clouds are slowing things down and the clouds, well, that's just cloudy skies today. but we are tracking rain and some of that is going to be heavy for at least a part of the weekend. the warming trend will jump over the week end to near record warmth by sunday but we've got another arctic blast two coming next week. so the warmer weather isn't going to last. cloudy skies continue across the area. then we have a northeast wind at seven miles an hour. that will prevent the temperature from going up very much. still two degrees warmer than this time yesterday.

only 38 in west chester. 39 in trent ton and with the cloudy skies and the northeast wind we can only add a few degrees to these numbers at best. 46 in atlantic city and dover. still above average but not exactly a warm day. it's going to be much, much warmer over the weekend. you can see generally two to five degrees warmer than this time yesterday. but mount pocono is seven degrees colder. that could be a factor for tonight. you can see the clouds coming in and thickening across the area but nothing showing up on the radar close by. the rain is getting closer into ohio, west virginia, down to virginia. it's moving right in our direction. no doubt there will be at least some rain this weekend. now the precipitation will be very light later tonight if we get any and there's a winter weather advisory for monroe

county up in the pocono mountains from 11:00 p.m. to 7:00 a.m. there could be a little bit of light snow or freezing rain as temperatures hover around the freezing mark. is elsewhere well above freezing and probably dry through the evening hours, there's the little pink toward monroe county with a 31 degree temperature. by morning it's just rain and the temperature will be going up. in the meantime, it's well above freezing throughout the area by tomorrow morning. generally dry during the day tomorrow. fairly cloudy again. if we get breaks of sunshine we get clooes into the mid-50s which is way above average. then tomorrow night generally after dinner time for this rain to be coming in. it's going to be quite mild tomorrow night and here comes the rain after midnight. by sunday morning this will be

the rough part of the weekend. 5:00 a.m. sunday look at this heavy rain coming in. but look how warm it is. and look at those temperatures. up near 60 degrees so between 5:00 and 8:00 a.m. we have heavy rain coming, maybe even thunderstorms and then the temperature just keeps going. this model has us up to 64 on sunday which would be a record before we finally dry out. and how much rain? this particular computer model showing an average of a half inch to a little over an inch by the time it's over with. so that's a lot of rain in a short period of time. cloudy and cool today, high temperatures low to mid-40s. still above average and way above average tomorrow with rain at night and into sunday morning. there could be breaks of sun in the afternoon. could be near record warmth but look what happens monday. an arctic last. temperatures down into the 30ñb

>> i'm shot. i'm bleeding heavily! a terrifying call made by a philadelphia police officer shot in the line of duty late last night in west philadelphia and this morning the officer is recovering. a suspect also shot is in the hospital and police say it's a miracle the officer, jesse hartnett, survived. right now, officer jesse hartnett is at penn presbyterian hospital. he underwent surgery on his arm overnight and he is expected to be okay. here's what we know so far. officer hartnett was in uniform driving a marked car on 60th street in west philadelphia when a man started firing a gun into the driver's side window. the police commissioner says at least 13 rounds were fired at the officer before he managed to get a few shots off at the suspect. that man is in custody in the hospital. other officers caught the man just down the road from the shooting scene. we also know that the fbi is investigating. nbc 10's katy zachry is live outside of penn presbyterian medical center where officer

hartnett is being treated and katie, you spoke to his dad? >> reporter: not long ago i had a conversation with his father outside penn presbyterian hospital. he says his son woke up from surgery around 8:00 this morning and he is in good spirits so he does have a long road ahead of him. now, officer jesse hartnett is 33 years old, he's been on the force of the philadelphia police department for five years. he is not married, he does have a girlfriend, we're told. he was shot several times in the arm. one arm is broken. he also severe nerve damage as a result of the shooting. he grew up just outside philadelphia, delaware county and his father tells me this east landsdowne native always wanted to be a police officer. >> he was in the coast guard and he continued into the academy. >> reporter: do you mind sharing with us what you said to him? >> i love him. i'm very proud of him and he's an excellent person. >> reporter: as you could hear

broken up right now so they've gone. the scene is still very quiet family members going away from the scene to comfort each other but they did share with us this new picture of elizabeth perez and her toddler nathaniel richardson. their bodies were discovered in this gutted home early this morning. i also spoke with an investigator. he says the fire appears to have begun in the living room on the first floor where a portable kerosene heater was discovered. fire commissioner derek sawyer says perez, who was visibly pregnant, was found cradling her two-year-old nathaniel in her arms and hands near the doorway of a second-floor bedroom. investigators also found several portable heaters inside the gutted two-story structure and they say one of them, a kerosene heater, was in the living room and may have ignited a blanket. >> what's very disturbing about

that is that we were informed that there were at least five portable heaters used in this home. that's the number-one issue. five portable heaters. on monday i tweeted out, if you're going to use space heaters, space heaters need space. the second concern is that one of the family members tried to fight the fire themselves. because they were trying to fight the fire, it delayed everyone getting out. >> reporter: there were no working smoke detectors inside this house. the commissioner told us when firefighters arrived they could hear smoke detectors going off in the neighbors' house next door. at 2:00 this afternoon, the american red cross will join firefighters as they return to this block to give out smoke detectors. and when we asked the commissioner about the number of fire fatalities so far last year compared to this year we were told these are the only two people that have passed away and the only child to die in a fire

this year. 12 people died all of last year. that's the latest live now from north philadelphia, monique braxton, nbc 10 news. it's warming up out there. nbc 10 first alert meteorologist glenn "hurricane" schwartz is here now with our forecast. glen 1234. >> vai, we haven't seen much sunshine for quite a while and we won't be seeing any during the day today. it's totally overcast. still not very much wind and with the clouds and the lack of wind, the temperature is going to be jumping up -- isn't going to be jumping up very much during the afternoon. if anything the clouds are thickening up. we still don't have anything showing up on the radar close by.

it is getting close by and that will be affecting us tomorrow night. it's cloudy but dry in the afternoon and through the evening. there is the chance of a little bit of light snow or freezing rain in the pocono mountains above a thousand feet. late tonight but even there by tomorrow morning it should be over with or changed over to light rain. it's 31 in mount pocono now. borderline case up there tonight, no borderline to the rest of the area. too warm for anything frozen. 42 degrees in philadelphia. 37 degrees in allentown. as we go through the rest of the afternoon, cloudy skies, cloudy skies into the night, temperatures leveling off into the mid-40s with that northeast wind. but we do have some heavier rain that's going to be coming in for at least a part of the weekend. i'll have the timing on that with the seven-day in a few minutes. a convicted killer was executed in florida overnight.

oscar ray bolan was pronounced dead by lethal injection at 10:00. he was scheduled to be executed but it was delayed until the u.s. supreme court rejected his final appeal. he was found guilty of killing three women nearly 30 years ago. later this morning, thousands of bells will ring at once in tucson, arizona. this is the five-year anniversary of the shooting that left six people dead and former congresswoman gabby giffords injured. she suffered a severe brain injury after the shooting in a supermarket parking lot. it as a challenge for many in our area to be job ready after high school. barriers to training and other services keep too many people stuck in a cycle of unemployment. one local organization, the work force institute, is turning that around, providing people have limited resources with tools that they need to get a job. the work force institute also helps students prepare for ged or college entrance exams. nbc 10's tracy davidson, my

make a new year's resolution you can stick to this year. john green is the director of community relations for the gift of life and he's hear what john bratton who received an organ transplant several years ago. thank you for being here. let me start with you. you're trying to get the word out for a new registration program. tell us about it. >> we're trying to get more people to register as organ and tissue donors. we have about 5800 people in our region who are waiting if that second chance so as you mentioned, 30 seconds to sign up and help save lives. >> and john, you received an organ donation that gave you another chance. share your story with us. how it happened. >> i was diagnosed with end-stage liver disease. i was fortunate enough to be able to get listed for a liver transplant and i received that transplant in may of '07 and since then i've just been able to have a normal life again.

for me and many others it didn't just make me better it got me to go back to where i was before i got sick. >> we were talking before the segment started, our daughters went to school together so we've seen each other at a bunch of school functions. how has that impacted. at the time of the transplant, my daughter was in eighth grade and she graduated from eighth grade and went on to high school and she's out of the house, just graduated in may. she's in the work force. >> john, why do people seem reluctant to be involved? >> i think there are a lot of myths out there. one is i think people think they may be too old if they're over the age of 50 and there is no age limit to become an organ

donor. sometimes people may feel tear religion doesn't support it but all major religions do. and sometimes if someone has a pre-existing condition like hypertension or high blood pressure, diabetes that wouldn't preclude you from being an organ and tissue donor. >> what would your message be to those who harbor some reluctance. >> get educated. give us a call. we have volunteers like john that go out and speak everyday about the importance because one person can safe or enhance the lives of more than 50 people by being an organ donor. >> has the response been pretty good? really good? >> it's been great. gift of life continues to lead the country. our region is the most giving region. last year we had 483 people say yes. but while we're successful, the need is still greater. 5800 people waiting. that's why everyone needs to register to be an organ donor. >> how do you feel now? >> wonderful.

one thing i should say on this topic is that i don't know much about my donor, i've never met my donor's family but one thing i found out about my donor was that my donor was 74 at the time i was transplanted so my liver is now 82 or 83 and my doctors tell me that i can expect my liver to live to 130 or 140. so way beyond what the rest of me will last. >> that's amazing. john branton, good to see you again. for more information on how you can give the gift of life, head to our web site at nbc10.com. gentlemen, thanks again. >> great, thank you. a new study suggest what is you order when you eat out may be influenced by the appearance of our waiter. researchers watched nearly 500 diners in six restaurants. they found people with heavier waiters were four times more likely to order dessert. they also ordered 17% more

alcohol. in fact the, the heavier waiter or waitress seemed to have the biggest impact on the thinnest diners. interesting. if you're a single guy looking for love, consider buying a dog. a new study by a group of professors finds men who own dogs are more attractive. they surveyed 100 match.com users who included pet info in their profiles. 61% were women. they said owning a pet makes someone more attractive but not just any pet. 39% say owning a cat is a deal breaker. well, no precipitations around that. we're tracking a period of heavy rain over the weekend along with significant warming. close to record warmth briefly

on sunday we have an arctic blast coming up in the middle of next week so we'll be feeling winter next week. cloudy skies at the moment but no precipitation falling 4. 2 degrees. winds northeast at seven so it's a light wind making it feel like it's 38. on wednesday we hit 40, 45 yesterday, about 45 today because of the clouds holding it down but 54 tomorrow and then 62 degrees on sunday pretty close to record levels depending on if we get sunshine or not. big temperature contrast across the area. 31 in mount pocono, 36 in reading. but 46 in dover and atlantic city. it's cloudy everywhere. and you can see some of those lower clouds coming in from the northeast. so we're not going to be seeing any sunshine today but we are still waiting to see any kind of precipitation on radar, at least close by. we see plenty of it in ohio and

west virginia and coming into western virginia right now. that's part of the system that's going to be moving our way. now, a little bit of moisture may make it up toward part of the poconos tonight. this is monroe county and there's a winter weather advisory until 7:00 a.m. tomorrow for the possibility of a little bit of light snow or freezing rain as temperatures are very marginal there and the precipitation is very light. so it's not a major threat. you can see temperatures not going very far during the day today or tonight tomorrow we'll see it climb up: a couple breaks in the afternoon will push the temperatures in the mid-50s in philadelphia. mid-40s in the north. here comes the rain. after dinner time on saturday night, in some cases after midnight but that's some heavy

rain coming in along with very mild air. that's 5:00. look at that heavy rain going into new jersey by 9:00. so it's moving fast and that may prevent significant flooding because it's moving so quickly but the temperature is just going up quite a bit and this model takes us up to 64 degrees by 11:00 a.m. amazing when you consider the forecast for monday. cloudy and cool this afternoon, high temperature in the low to mid-40s. still above average. way above average tomorrow. the rain generally comes in after dinner time and gets heaviest early sunday morning, you shape late enough, you'll miss the heaviest of the rain and maybe by afternoon you'll see temperatures in the 60s. on monday the arctic blast. temperatures dropping through the 30s.

eva longoria. and why some users say their fitbits aren't living up to the hype. we'll have that on nbc 10 news at 4:00. now to an update on our top story. a philadelphia police officer is recovering after being shot in the line of duty. officer jesse hartnett was driving his police cruiser in west philadelphia when a man came up to the car and started shooting. the officer was able to fire off a few rounds himself. the suspect was hit. 13 rounds were found at the scene, both men are in the hospital. also, a mother and child are dead after this house fire in north philadelphia. fire officials say the woman went back into the house to go after the child. investigators say six people escaped the fire. the fire commissioner says they were five portable heaters in use in that home. stay with nbc 10 news for continuing coverage of the investigation into the shooting of officer jesse hartnett. the police department is planning a 1:00 p.m. update. we'll bring you that news conference live when it happens
