saved his life. >> not only did the officer survive, but he chased down and shot his attacker. tonight the gunman claims this was all done in the name of islam. that suspect's name is iz ward archer. fbi agents took items from his west philadelphia home this afternoon. investigators say archer fired more than a dozen shots at officer hartnett at point blank range and the gun used in the crime was a police firearm stolen back in october 2013. officer jesse hartnett was shot three times but is expected to survive. we'll have more on officer hartnett's injuries and what lies ahead for his recovery, but our team coverage begins with nbc 10's george spencer who's been gathering the latest updates from police. do police know anything else about the motive? >> reporter: that's what they are working with the fbi right now to figure out. at this point, though, investigators say they simply do not have hard evidence that would directly connect him to a

larger network. nor do they have evidence, though, that would indicate he strictly acted alone. it is the clearest shooting video some detectives have ever seen, the suspect in the flowing white robe approaches with arm extended. the flashes of gun fire popping until the man's arm is inside the police patrol car window. that officer protected only by a bullet proof vest and a will to live. >> my god, i mean, the way he's got his arm inside that vehicle, i mean, he knew what he was doing. he was trying to assassinate this police officer. >> reporter: newly sworn police commissioner richard ross tells us jesse hartnett was caught completely off guard and hit three times. we're told the 30-year-old suspect's only explanation so far is his islamic faith, an explanation that city leaders find troubling. >> this is a criminal with a stolen gun who tried to kill another officer, has nothing to do with being a muslim or following the islamic faith. >> according to him, he believe

the police defend laws contrary to the teachings of the koran. >> reporter: on the scene last night around midnight, nbc 10 cameras saw the patrol car covered in bullet holes and the suspect's gun laying on the ground. today we learned that gun had been reported stolen from another philly cop two years ago. witnesses say archer approached as if on a mission and said nothing. >> boom, boom, boom, boom! and the cop was like, you know, trying to -- his best to block from the head and stuff getting hit. >> reporter: wounded and bleeding heavily, officer hartnett still chased the suspect, fired on him and radioed for help. other officers tackled the suspect minutes later on this block around the corner, only steps away from a home he was known to frequent. shortly before 2:30 this afternoon we watched as investigators carried out bags of evidence from this home. one of the homes in this neighborhood where archer was known to frequent, they are trying to piece together his motivations in all of this. investigators say besides

repeating his allegiance to islam, archer was largely evasive and he has repeatedly stopped just short of implicating anyone besides himself. reporting live in west philadelphia, george spencer, nbc 10 news. >> george, thank you. officer jesse hartnett was shot at 13 times, three of those bullets hit him in the arm, yet he was still able to chase down and shoot his attacker. nbc 10's lauren mayk is live at the hospital where doctors are treating officer hartnett right now. lauren, how's he doing? >> reporter: good evening, keith. well, we are told he's had surgery and he is in good spirits, but these are serious injuries, three gunshot wounds in one arm. he lost a lot of blood and there is quite a recovery ahead of him. but his family, they are making sure they are right here next to him. >> he's a tough guy, he's going to be in good shape. keep praying for him, everybody pray for him.

>> reporter: bob hartnett's plea is for his son, officer jesse hartnett, he's the 33-year-old whose actions after an ambush, running after and firing at a suspect amazed even his boss. >> the bravery he demonstrated was absolutely remarkable. his will to live undoubtedly saved his life. >> reporter: taking fire from the man coming toward his car, jesse hartnett was hit three times and has already undergone surgery. when you hear that many rounds were shot at him, what do you think? >> the guy had a major problem, the guy was nuts or something. >> reporter: he's leaving the investigation up to law enforcement, while the close family still reeling is focusing on jesse. >> made sure i was there until my other son showed up, oldest son is there to take care of him now. >> reporter: how's everybody feeling today? >> pretty down, pretty down. >> reporter: wasn't long ago his uncle tells me they all joined together for a christmas party. >> everybody there having a good time, and now this. it's a shame.

>> reporter: jesse hartnett is the guy who always wanted to help people. now they are pulling together for him, the nephew, son, brother, fulfilling his dream to be a police officer. >> he's going to pull through. it's going to be -- i'm sure he wants to get back on the job. >> reporter: that's who he is? >> that's who he is, exactly. >> reporter: now officer hartnett is not married, he does have a girlfriend. he has siblings, he has a dog, as his father was sure to mention to me today. you know, when i talked to his dad, he was tired. it's been a long 24 hours, but he was very anxious to get right back here to the hospital to be with his son. live in powellton village, lauren mayk, nbc 10 news. >> thank you, lauren. as we heard earlier, mayor kenney says this attempted assassination has, quote, nothing to do with being a muslim and that it in no way represents the teachings of islam. those with the council on american-islamic relations say they are appreciative kenney made a point to reject what's being called islam phobia and

say islamic teachings reject such senseless violence. >> the quote from the koran goes like this, if allah, if god had wished to make all of human society, all of human kind one religion, god would have done so, but he chose to make us different. >> the council on american-islamic relations also says philadelphia stands out as a place where islam is accepted. our team coverage continues ahead on nbc 10 news at 5:00. nbc 10's aundrea cline-thomas has been in the suspect's neighborhood and will take a closer look into his past. in the meantime, let's go to your first alert weather. nbc 10 tracking rain that will move in over the weekend. first alert meteorologist sheena parveen joins us. sheena, rain is coming, but we're also going to see a huge warmup. >> yeah, that's right. a big warmup across the weekend, but that is going to come with rain, especially overnight saturday, into early sunday. for now, though, we are rain free, temperatures mostly in the mid 40s, but if you look up to

the north and west, allentown is at 39 and mount pocono is at 32 degrees. so freezing temperatures in the poconos, this is a live look out at blue mountain where they have done a great job of making snow and the snow will be staying on the ground and with the poconos still being so cold at this hour and some wet weather moving in later tonight, we have a winter weather advisory for the poconos and north hampton counties, so this is for elevations above 1,000 feet mainly in the poconos. freezing rain, some snow possible, 10:00 p.m. tonight to 7:00 a.m. tomorrow morning. for the rest of the area you can expect cloudy skies tonight and rain back off to our west. a little snow trying to develop in parts of central pa with colder air, too, but for tonight most of us seeing very light rain. here's what it looks like if you are heading out this evening, 9:00 p.m. most of the area will be dry and in the low 40s, but then you see light showers moving in. this is 2:00 in the morning, so this will be through the overnight hours, poconos closer to freezing at that time, then

we start off your weekend with cloudy conditions and warmer temperatures in the 50s. more rain moves in late saturday night, early sunday. some of that rain will be heavy, so coming up a closer look at the timing of that. a philadelphia mother is being called a hero tonight after she died trying to save her young child from a fire. there were no smoke detectors. nbc 10's cydney long is live at the home in north philadelphia. firefighters are still investigating what happened here. they've also been going door to door checking on neighbors. >> reporter: keith, that's right. you can see the home behind me is boarded up, but the investigation far from complete, and we went door to door, accompanying firefighters this afternoon and a majority of the cases these home owners, some of them needed three detectors installed, one on each floor. this, take a look as this community is coming together, mourning the loss of this mother and son, two lives, they say, could have been saved.

cell phone footage captured the early morning horror witnessed by dozens. she is heart broken over the death of her young neighbor, elizabeth perez, and her 2-year-old son nathaniel. >> sure, my grandson is 6 years old. something like this happened to my family, they destroy my life. >> reporter: she says if there is any shred of something positive to come from this terrible tragedy, it's happening now. philadelphia fire department spent the afternoon knocking door to door to check for properly working smoke detectors, proven to save lives. >> makes a big difference if there's a fire in your house and don't know what to do or how to do it, you start to panic. >> reporter: not all of your smoke detectors are working in your home? one of dozens who got new ones installed today after her neighbor went back inside her burning home to save her son, it cost them both their lives and that of her unborn daughter.

a devastated arroyo showed us and officials her other fear, a 5x5 patio surrounded by a wall, she said the secondary escape route would trap her in the moments that matter the most. >> terrible, terrible, i don't have no way to escape. you look over there. >> if you practice home safety plans and home escape plans and how to get out of your house, when something tragic does happen, how to react and get out of your house. >> reporter: space heaters when used correctly need at least three to five feet away from anything that could catch fire to include a curtain or any other material. again, no official cause yet from the fire marshal's office, but the fire department does say as many as five space heaters were being used by the family to keep warm last night. they were being used improperly. live in north philadelphia, cydney long, nbc 10 news. >> thanks. now to an update on pennsylvania's budget battle.

governor tom wolf and the state legislature are the target of a new lawsuit now. the pennsylvania school board association has filed a lawsuit that claim it's illegal and unconstitutional to withhold state and federal school aid during the budget impasse. the group is asking commonwealth court to prevent the state from withholding that money and seeks damages. just last week governor tom wolf freed up $3.5 million in emergency funding forv schools and social services. that action by the government prompted montgomery county to cancel a planned $75 million loan. we're told the county's finance director received about $20.7 million in payments yesterday. much of that money will go into the county's pocket. the rest will help pay the bills for human services groups. pennsylvania's been without a budget since july 1st, that's nearly 192 days. it took three years and two arrests, but tonight the families who lost loved ones in

capture of el chapo guzman, the dea took to twitter to say it is, quote, extremely pleased el chapo was caught today after a shootout with mexican marines. five suspects were killed, six others arrested. el chapo was not hurt. he sparked a man hunt last july when he escaped from a tunnel through mexico's highest security prison. right now at 5:00, the men facing charges for this deadly building collapse in center city are headed to prison. both were sentenced today and admitted some responsibility for what happened, but as nbc 10's deanna durante reports, they believe others still deserve to be punished. >> i got two words for the african-american community, wake up, because black lives don't matter in the city of

philadelphia. >> reporter: an angry defense attorney says his client was an easy target and should be in a jail cell with many others responsible for a deadly building collapse in 2013. >> the only two people convicted of this horrible tragedy had two things in common, they were black and they were from north philly, and everybody who's white and got money and got contacts has got a pass, and i'm going to prove that in my second trial. >> reporter: vowing to appeal, william hobson says wealthy developers should bear some of the blame of the collapse that trapped people inside the salvation army thrift store, killing six and injuring 13. >> there was a full public trial for two defendants and homicide charges and an extensive civil investigation that went on concurrently, so all of the information relevant in this case that we looked at to hold everybody accountable that could be accountable was done in this case. >> reporter: prosecutors say the two on trial are the two

responsible. a plea deal, seven and a half to 15 in prison, they say he was using machinery on a back wall when the collapse happened. despite numerous pleas by family and friends for leniency, he was sentenced to 15 to 30 years in state prison. campbell sat with his head down, eyes closed as victims told what life was life since loved ones were killed. he cried when his daughter spoke. prosecutors say this was no accident, they say campbell had stripped down the building and made it impossible to bring it down safely and that's why it collapsed. they do say they are satisfied that the sentences handed down today. deanna durante, nbc 10 news. turning to this now, a bill to let retired police officers help make new jersey schools safer is now one step closer to becoming law. state lawmakers unanimously voted to move this bill forward this week. it allows class three officers to provide security in schools.

class three, by the way, means they are former full-time officers. they must be younger than 65 years old. the bill would also allow them to carry guns. the mother of the so-called affluenza teen is hoping to get out on bail soon. tanya couch was arraigned in texas today. the judge agreed to consider her request to cut her $1 million bail. she's accused of helping her son, ethan couch, escape to mexico to avoid a probation violation. ethan killed four people in a drunk driving crash in 2013. he became notorious for his affluenza defense at trial. his lawyer's arguing he didn't know right from wrong because of his privileged upbringing. ethan couch remains in custody in mexico. got to take a look at this tonight, california dealing with mudslides after drenching rains poured over the drought stricken state this week. check it out, driver tries to outrun major flooding on a highway near fillmore,

california. debris filled water started covering the roadway. finally the water slowed enough for the driver to make a u-turn and get away safely. now your nbc 10 first alert weather with meteorologist sheena parveen. >> well, we have some rain heading for our area over the weekend and some of that rain will be heavy. this is mostly going to be overnight saturday, into early sunday, so you'll notice waking up sunday morning a lot of rain around, but even with the rain in place, temperatures will get into the 60s on sunday. it is going to be unseasonably warm around 25 degrees above normal for this time of the year. now once this leaves over the weekend we're going to get another arctic blast next week, so 60s aren't going to hang around, it's going to get colder monday and by the middle of next week. 32 degrees in the poconos, most areas north and west in the mid to low 40s right now. 42 in philadelphia, 44 millville, 45 degrees in dover.

only going to keep getting warmer into tomorrow. for now, though, we have mid 40s for a high temperature today, same thing as yesterday, but as we go into the weekend, low 50s saturday, mid 60s into sunday, so the average high 40 degrees, we're going to be way above that as we end out the weekend. a lot of cloud cover in place tonight. most of the area will stay dry tonight, but we are watching rain to the west, even snow trying to fall in parts of central pa, some of that heavy, wet snow there, but through areas like the poconos tonight, we could see some freezing rain or even a little bit of snow, but not going to be anything we'll have to worry about into tomorrow, because we will be getting warmer tomorrow. temperatures as we go through tonight, not really dropping off too much. this is by 8:00 this evening, still in the 40s. you see some rain approaching from the west. areas like the poconos cold enough to support freezing light rain or like i mentioned a bit of a wintery mix there, but that's by midnight tonight. this is very late, light showers moving in.

temperatures still in the 40s by tomorrow morning and they keep going up through the afternoon. now here's saturday, 4:00 p.m. most of the area will be dry, just cloudy, and these clouds hang around through most of your saturday and it's really not until overnight going into sunday that we expect a lot of rain to move in, a lot of this heavy rain shown by the oranges and the reds here, this is 7:00 a.m. sunday, temperatures in the mid 50s, even in the poconos above freezing with the heavy rain around, not good for skiing, obviously. then we go into noon sunday, a lot of this starts to taper off, but look at the temperatures, mid 60s, staying that way for really the rest of sunday with some scattered showers possibly later in the day, but a lot more clearing as we go through the afternoon. so we'll see most of the heavy rain sunday morning. tonight, though, cloudy and mild, temps around 40s, areas north and west, tomorrow a mild day. cloudy, then the rain comes later at night. temperatures low 50s for your saturday. sunday mid 60s. but the arctic blast comes

this is nbc 10 breaking news. >> a philadelphia police officer ambushed and it's all captured with these surveillance images. a gunman rushed at the officer as he sat alone in his police cruiser, his gun firing the entire way. and even though the officer was hit three times, he was still able to chase after the gunman and shoot him down. officer jesse hartnett was hit

in the arm three times and is now recovering in the hospital. philadelphia's brand new police commissioner richard ross says he's amazed by the outcome of the shooting. for the officer to only sustain gunshot wounds to the arm is nothing more than astonishing. >> absolutely amazing that that's all he sustained. i cannot explain how he escaped that, nothing short of miraculous, and we're thankful for that. my god, the way he's got his arm inside that vehicle, i mean, he knew what he was doing, he was trying to assassinate this police officer. it's both confounding and astonishing that he was able to escape it like this, and i can't say enough for his bravery and how he conducted himself. we're ever so thankful to god that he's here today, because this could have easily been a police funeral. >> now to the suspect, he is 30-year-old edward archer. investigators say he fired more than a dozen shots at officer hartnett at point blank range and pledged his support to isis.

we also learned today the gun used in the crime was a police firearm stolen back in october 2013. nbc 10 is digging into the suspect's past. nbc 10's aundrea cline-thomas spent the day in archer's neighborhood. aundrea, what have you found out about him? >> reporter: well, looking into edward archer's prior record, he is no stranger to law enforcement in yaiden and philadelphia. earlier today the fbi spent hours at two of his known addresses. you see them here walking out of a home on 61st and pine street in west philadelphia with boxes and bags of evidence. they also searched a home in yaiden. since archer allegedly told police he shot the officer in the name of islam, law enforcement continues to investigate whether he acted alone or if he was part of a larger network connected to terrorism. right now they do not have answers to those questions. archer's prior record shows arrests for aggravated assault, firearms offenses, and making terroristic threats in

philadelphia in 2013, and he served less than two years in jail. more recently, though, he was found guilty of fraud and forging documents in delaware county. he was supposed to be in court on those charges on monday. >> god says in the holy koran, no bearer of burden can bear the burden of another, so we don't try to take the burden of other people, we don't try to force it to them. >> reporter: meanwhile, muslims across the area are condemning the shooting and are re-enforcing their solidarity with police. their main message is that the muslim faith has nothing to do with it. reporting live in west philadelphia, i'm aundrea cline-thomas, nbc 10 news. >> aundrea, thanks. we crunched the numbers to see how many other philadelphia officers have been shot in the line of duty. according to the philadelphia police website, four officers have been shot and wounded while on the job in the last 11 months and one of those officers was killed. sergeant robert wilson iii was shot during a gamestop robbery

got trapped there. investigators say there were five improperly used space heaters in the home. space heaters are one of the top causes of death and not just because of the heater itself, it's mostly due to home owners not using them properly. nbc 10 went looking for answers that could save your life. >> reporter: fire trucks rolled up early wednesday morning to this home. inside, this space heater was running connected to this extension cord. >> there was a weak link in the system. the obvious weak link in this was the extension cord itself. >> reporter: in this case, the extension cord required more power than it could handle. space heaters not only generate a lot of warmth, but use a lot of juice. that combination is the perfect cocktail for a fire. >> there's labels on a space heater, supposed to be plugged directly into an outlet, not with an extension cord. >> reporter: firefighters showed us just how dangerous it can get. we plugged a common space heater

into two extension cords, using a thermal imaging camera we can see in just a few minutes the cords start heating up. that's the blue color you see. the temperature of the cords well exceeded 100 degrees. we could even smell them burning. >> when you're not in the room, space heater is not supposed to be on and you're not supposed to have a space heater on when you're sleeping. >> reporter: he has already been called to several heater fires this season. >> i don't get it. people need to really, you know, wise up and figure out what they are doing and not do that. listen to people that do this every day. >> reporter: stats from the national fire protection association show that space heaters account for one-third of home heating fires and four out of five home heating fire deaths. home owner who fell victim to this fire on wednesday is still in the hospital in critical condition. nbc 10 news.

were still above normal for this time of year. heavy rain over part of the weekend, mostly right through the middle of it saturday, overnight, going into early sunday. and by sunday we will be in the 60s, around 25 degrees above normal for this time of the year, but it's not going to last because starting off the work week next week we have an arctic blast moving in with temperatures dropping into the 30s for daytime highs. right now in philadelphia mostly cloudy, 42 degrees, not much colder than this tonight, so if you are heading out, this is what it's going to feel like for most of tonight and warming up as we go into tomorrow. 32 degrees right now in the poconos, most areas north and west in the mid to low 40s, low 40s most of new jersey. if you are closer to the philadelphia area, 44 in millville, 45 dover, 43 degrees right now atlantic city and wilmington. and these numbers will be jumping into the 50s tomorrow. clouds are pretty much locked in, that's the way it's going to stay today and tomorrow and most of sunday. we have some wintery weather back off to our west, that's

mostly moving north, but we have rain heading this way and if you are in the poconos or lehigh valley, could be cold enough for freezing rain late tonight. i think most people should already be off the road, but again if you are up in those areas keep in mind that it may be cold enough to support that. right now the clouds are around but as we go through later on tonight, 11:00 p.m., light showers moving, mostly north and west of philadelphia. at that time we could see freezing rain possibly in the higher elevations. tomorrow maybe some light showers around, but most of the day will be cloudy and milder. then we go into saturday night and early sunday, we're talking about the overnight hours, heavy rain moves in, it clears out by noon through most of the area, then the rest of the day doesn't look too bad, maybe leftover showers, but after that monday, windy, colder, so we are looking at that next arctic blast moving in. tonight, cloudy and mild, chance of showers late tonight around 40 for the low in philadelphia.

more than $1 billion. it's not just lottery winners who benefit, either, states use that money to pay for all kinds of programs and in pennsylvania those programs benefit older residents. nbc's barbara bar explains. >> reporter: sales of powerball tickets have been so brisk the pennsylvania lottery says as many as 10,000 a minute were being rung up. >> for every dollar that goes for the purchase of a ticket, 27 cents is contributed to senior citizen programs, including low cost prescription drugs, property tax, and rent rebates and services provided by area agencies on aging. >> these are important programs that are the reason the lottery is here. >> reporter: senior centers like this one benefit from lottery money. >> better than sitting home in the corner. >> reporter: one of the services the money supports is the share a ride program, providing transportation to seniors to get to the center and take them

home. >> it's an invaluable service, keeps them independent. >> reporter: with an historic jackpot looming, these older pennsylvanians are ready to help their own cause. >> a lot of the seniors have bought tickets, i know. >> the pennsylvania lottery says it's the only one in the country to designate all proceeds to benefits and programs that benefit the older residents. we also looked into where new jersey and delaware lotteries send their money. the new jersey lottery gave $965 million to the state in 2014, that money goes to schools, human services, and military programs. in delaware the state received more than $202 million for the lottery last year. that also goes to a variety of programs including public safety, education, and health services. here's another interesting tidbit about delaware, it's one of the only states that still allows lottery winners to remain anonymous. good to know if you're buying a ticket in the next few days.

nbc 10 breaking news. >> officer ambushed. new video showing a gunman's attempt to execute an officer on a west philadelphia street. authorities say the suspect carried it out in the name of isis, but the wounded officer was able to get out of his cruiser and return fire. new still images show the ambush under way. the shooter fires away as he sprints towards the officer's car there. the gunfire continues when he reaches the cruiser, he fires 13 shots from what police later learned was a gun stolen from a philadelphia officer two years ago. three bullets his officer jesse hartnett in the arm, but he found the strength to chase down his attacker after radioing a dispatcher.
