this arrest and charges. right now, though, it's unclear exactly how the boy was killed and why. questions that may begin to be answered as early as tuesday afternoon when creato will appear before a camden county judge. now creato, who was processed here, i can tell you took just under an hour because about 15 minutes ago a prisoner transport van pulled up and he's been hauled off to county jail. his first appearance before the judge will happen tomorrow afternoon at 1:30 in camden. i also have reached out several times this afternoon to d.j. creato's philadelphia-based attorney both by phone and e-mail, but we have yet to hear back. live in haddon township, cydney long, nbc 10 news. >> and shortly after brendan creato vanished last october, nbc 10 obtained the 911 call of his father talking to dispatchers about the disappearance. here's an edited portion of that call. >> 911, where's your emergency?

first alert meteorologist glenn "hurricane" schwartz is tracking the first snowflakes of the season. glenn? >> yes, certainly best chance we've had early this season. farthest into winter without any snowflake in philadelphia, it's certainly cold enough to snow. the flags blowing pretty hard and wind gusts over 30 miles an hour during the day. we'll also see to some degree we're going to be seeing the temperature not go up very much during the day. and not go down very much overnight. these are the numbers right now, 35 degrees in philadelphia, 29 north and west. look how much colder it is than it was 24 hours ago. 25 to 30 degrees colder. we still have ten to 20 mile an hour winds across much of the area, and look at the feels like

temperature. feels like 6 in mount pocono and 20 in pottstown, 19 in lancaster. and as we go through the evening hours you're going to see the temperature drop, but not a whole lot, and the wind is actually going to diminish, so there's going to be less of a wind chill issue as we go through the night. that's plenty cold. we'll talk more about the chances of snow and how much colder it's going to get wednesday with the seven day in a few minutes. this just in to nbc 10, governor chris christie and new jersey lawmakers reached an agreement to bring a casino to north jersey, requiring a $1 billion investment by anyone who wants to open the casino. the assembly must still give the okay by august and if they do, people in new jersey would vote on the casino in november. the new legislative session begins tomorrow. it's happened again, the world's largest lottery jackpot increased again today.

for more than 40 years. fans everywhere are remembering him as such today. ♪ known for hits like space oddity, changes, and under pressure. he turned 69 on friday, the day he released his latest album. on the same day bowie released a video, some are interpreting it as his farewell to the world. the video shows a frail bowie lying in bed. the song begins with the line "look up here, i'm in heaven." tributes are pouring in. "the rolling stones" issued a statement that says, "shocked and deeply saddened to hear of the death of a dear friend david bowie." they say he was an extraordinary or theist and true original. fans have been laying flowers at this address in london, where bowie posed for the cover of his

iconic album. but he has local ties, too, he recorded much of an album here in center city, philadelphia, sigma sound studios no longer in business, but a marker denotes the spot where it was on north 12th street. the legendary david bowie gone at the age of 69. live in the digital operations center, keith jones, nbc 10 news. other news now, to a robbery attempt with deadly results in south philadelphia. police say a store owner opened fire on three men trying to hold up his business this morning. officers say he killed one of the men along 12th street. another man's in custody, but a third is still on the loose. police believe that third man may be wounded. the store owner wasn't hurt, but schools in the area were put on lockdown after this morning's gunfire. investigators recovered two guns at the scene. police in chester county are

looking for a church pastor who they say seduced a teenaged girl across the country, then raped her at his house. jacob malone is wanted for rape, institutional sexual assault, and other offenses. a young woman told police she met malone when she was 12 years old at a church in mesa, arizona, where he was a pastor. in 2014 malone allegedly began inappropriate contact with the then-17-year-old girl as he served as a pastor in minnesota. shortly after, malone moved to chester county for another job as a pastor and invited the teenaged girl to live with him. the teenager told police malone began sexually assaulting her while she was living in his house. here's a follow-up for you, the mother of a camden boy killed last week says she knows who her son was with in the time leading up to his death. she told us her son was with a 16-year-old girl the day she was killed. the girl is now charged with a shooting on halloween weekend.

the football team. but more than a decade later, police say he is the man who attacked, who fired at one of their officers and called it in the name of islam. police patrolling the streets of philadelphia are not alone. they move in pairs now after this shooting that put a colleague in the hospital. >> my job and the job of the management of this department is protect the men and women served to protect and serve out there. >> reporter: richard ross saying quite simply -- >> we have a job to do. >> reporter: police say the man seen here with a gun is behind bars, but the threat is not over with edward archer arrested. a tipster telling them there are other men more radical and to be careful. >> we'd be remiss if we didn't cover every base. >> reporter: at the mosque just down the street at the shooting, frustration. >> bogus, they are trying to say that it's going by a terrorist

the man demanded money, then ran off with a bag of trash heading south on 55th street. check out this guy pulling up to an atm in roxboro. last thursday morning he ties the rope from his suv to the atm and breaks the machine free, then he tosses it in the back of the suv and drives off. call philadelphia police if you know anything about the crime. now to an attack at a berks county detention center that landed one of its staff in the hospital. two teenagers facing attempted murder charges for the assault in morgantown saturday. police say the two lured a staff member into their room, punched him, kicked him, and tried to strangle him. police say the victim got them to stop after telling the teens he could help them escape. other staff members eventually restrained those teenagers. now to our delaware bureau

reporter tim furlong live this afternoon in wilmington with more on how ramsey could help them out. tim? >> reporter: some state leaders in delaware question the way wilmington uses its crime fighting resources, saying they withhold money, the mayor calls them armchair quarterbacks and says he's brought in the expert to fix the problems, yes, it's a name we all know from right up i-95. some people chillm out once retire. charles ramsey hasn't done that for long. >> it's been five days, so i have chilled out since i retired. >> reporter: officially helping wilmington. in the last few years wilmington has broken homicide records and produced a tv pilot based in the city called "murder town." the city's mayor says ramsey is the guy to help change things. >> i felt when he left the philadelphia police department it was time for him to help us out by bringing in a super aide to show you the way.

>> reporter: ramsey says he's happy to help wilmington and any other city that could use the help. he held the same job in chicago and d.c. and post-ferguson he was hand picked by president obama to come up with ways to improve police-community relations. in wilmington he'll work on that, as well as ways to more effectively deploy city resources and will try to help decipher violent crime patterns here. >> we know where they are, what they are doing, and, certainly, doing everything we can to prevent them from engaging in criminal activity. >> reporter: and as part of the deal, wilmington is going to pay charles ramsey and his staff up to $16,000 a month for the next seven months. there have been experts and consultants here before, everyone trying to figure out how to cut crime down. the mayor says he has his guy. we'll wait and see if they take the advice from charles ramsey and do anything with it. live in wilmington, tim furlong, nbc 10 news.

new video which first aired in mexico shows the police raid and mexican drug lord el chapo guzman's hideout. police say he was hiding in the house by managed to get away with a shootout with the mexican navy. he was later captured on a highway. with el chapo in custody, extradition proceedings are under way, officials planning to send him to the u.s. mexican officials are now focusing on a secret meeting between the drug kingpin and actor sean penn. this is the photo of their encounter back in october of last year. according to penn, the meeting happened somewhere in the middle of the mexican jungle and was set up by a mexican actress. mexican authorities are saying they are looking at whether sean penn will face charges in mexico. officials say el chapo's

multibillion dollar cartel has been a major supplier of illegal drugs to the u.s. now your nbc 10 first alert weather. >> finally feels like winter here at home and also look at this in ohio. this video from toledo, where people are seeing their first significant snowfall of the season there, led to slick roads this morning, school delays throughout that area. you know what, they don't make ice scrapers for jobs like this. this car in buffalo coated in several inches of ice. problem was the driver left it in a parking lot along lake erie and waves slashed up overnight and you see what happened there, kept spraying the car over and over and this was the result when the sun came up this morning. here at home we haven't seen the snow just yet, at least not at this point. you're taking a live look outside, that could be about to change, though, jackie. are we ready for our first flakes of the season? that's the big question. >> i guess we were saying that. >> bring it on.

glenn's here to tell us when. >> well, if we're going to be seeing any this week it's going to be late tomorrow or into tomorrow evening. this is not a big storm, and, of course, if this was a typical winter, we would not be talking that much about it and you would not get that excited about it, but we haven't seen any flakes yet. officially in philadelphia, we have the arctic blast, so got some cold air in here first. we could see the first flakes at least in parts of the area. not everybody is going to see it tomorrow, then it gets even colder as we go into wednesday. another arctic blast. you can see the flags still blowing nicely out there. 35 degrees, despite all that sunshine. that's a cold air mass. humidity is very low, and that could be a factor tomorrow. the wind, 17 miles an hour, make it feel like it is 25 degrees. 29 in pottstown now, and 30 degrees in allentown and reading and lancaster. 34 in wilmington, 35 millville,

into the south here we're going to be seeing the temperature not drop a whole lot during the night tonight. it's going to be in the 20s for much of the night, then tomorrow we go up into the 40s. so when the precipitation first starts, if we do get the first showers, could start off as a rain shower, but cold air higher up bringing the colder air down and changing any rain showers to snow showers. there we are 5:00 in the afternoon and you can see some areas of snow. you can also see the temperature above the freezing mark, so even if it snows later in the afternoon or early evening in most places, it would just melt. and that's why you can't get too excited about it, but it hasn't happened yet. we haven't seen any flakes yet. clouding up tonight and cold. 24 for the low in philadelphia, 14 in some of the coldest suburbs. and then tomorrow we warm up into the low 40s with that southerly wind, and the late day

this is nbc 10 news. >> look at this, a pair of window washers stuck on a broken scaffold 71 stories up in houston today. firefighters knocked out that window there, pulled the two into safety. investigators still trying to figure out what caused the scaffold to break in the first place. new information on a strip mall fire in bucks county early this morning in the kitchen of the hong kong cafe. it also damaged a david's bridal store next door. the store told nbc 10 it is assessing the damage and wants to assure all customers that it will meet all order obligations that are due in the near future and will be reaching out to those customers within the next 24 hours. no one was hurt in this morning's fire, it's unclear how it started. the playboy mansion is up for sale, but hugh hefner wants to stay put. >> the west los angeles estate

nbc 10 breaking news. >> yes, we continue to follow that breaking news out of camden county this afternoon. the father of a 3-year-old boy found dead is now in police custody. d.j. creato will be charged with killing his son brendan, who disappeared back in october. creato told police his son wandered off alone. the child's body was found a few hours later. investigators are not saying how the boy was killed. getting a driver's license means giving out a lot of personal information and it turns out all of that data isn't exactly locked away. >> in fact, the nbc 10 investigators found pennsylvania sells it. nbc 10 investigative reporter mitch blacher dove into who's in charge of making sure the practice is not abused. what did you find out? >> a viewer claimed she was solicited after penn dot sold her information, including the make and model of her car. pennsylvania officials assured us they have tight control over who gets to see the data being

sold. our investigation found few documented problems, but little oversight. your name, address, and date of birth, just some of the information you give up if you want to drive in pennsylvania. what you don't know is it's then sold to private companies. >> scams going on today, things in the world, i think it's a bad idea. >> reporter: the drivers we talked to -- >> it's outrageous. >> reporter: had no idea this was happening. >> i have a problem with that. >> reporter: many had just given penn dot their personal information and were surprised to see how much the state was making. >> $41 million? wow. >> reporter: the nbc 10 investigators found penn dot sold driver information to more than 32,000 companies. the state charged $9 for each record. since 2010, the commonwealth has earned more than $157 million. >> we just are not aware of any current abuses with it, and we believe we would be aware. >> reporter: penndot

spokesperson rich fitzpatrick told us credit agencies, insurance companies, buy records and use them to perform background and credit checks. as we looked deeper into how the commonwealth monitors how the information is used, we discovered since 2009 the state has revoked five of the more than 32,000 accounts because of abuse. >> we would argue, as i said, they have a huge stake to abide by the law and use these records for the cited purposes. >> reporter: according to state law, there are specific reasons penndot can share your records, including credit and employment checks, insurance purposes, if a driver or their attorney requests it, or through a court order. penndot says it protects you by making the driver sign contracts guaranteeing only to be used by legal purposes. >> they are not doing the necessary diligence to make sure that that's what's actually happening. >> reporter: allen butler isazzo with the washington, d.c., based

electronic privacy information center. he doesn't believe penndot or other state dmvs are protecting drivers and says they should stop selling driver information. the group has gone to the u.s. supreme court to question how states can track your personal information once it's out of their control. >> in order to drive, in order to register a car, we have to give this information. >> reporter: penndot says it has not been actively monitoring the program, but instead depends on consumers to come forward to report abuses of information. >> again, we feel we're not aware of any abuses. if we were, action would be taken. >> reporter: kirkpatrick told us the state is running two audits right now, but they are not finished. he couldn't tell us when they would be, but said soon. >> if there were problems, we would know about it. >> reporter: how would you know about it? >> people would complain to us, and they haven't. >> reporter: do you think enough people know penndot is selling this information to be able to complain? >> well, if their records somehow was being abused, they would more than likely than not

media. abigail kemp is her name, she's due in court in atlanta today. police say she was captured swiping jewels from stores in five states in recent months. we first told you about the story earlier this month. the fbi says it's found her by analyzing cell tower data, found one phone number showed up near all robbery scenes. agents si they used that number to identify kemp and found a car that matched one seen in surveillance video. president barack obama will deliver his final state of the union tomorrow night and one delaware boy will have a front row seat. 11-year-old braden mannering will be a guest. braden is from newcastle county. it won't be his first trip to the nation's capital either, attending a state dinner in 2013. after that he started the nonprofit called brown bags. we caught up with mannering today and he explains how it all got started. >> i got to go to the white

the popular ringling bros. and barnum and bailey circus is ending its elephant act. the circus' parent company says the 11 elephants on tour will retire in may. they will live at the company's center for elephant conservation in central florida. it costs about $65,000 a year to care for each of its 42 elephants. the circus will be here in philadelphia next month and in trenton in may. the north american international auto show under way today in detroit began with an awards ceremony. during that ceremony the prizes for north american car and truck utility were handed out. honda and volvo were the big winners. and, so, here they are with a closer look for you right here right now. the volvo xc-90 was named north american truck utility of the year, this is for the second time. first came back in 2003. and the top award for north

the eagles chocked up a win today, despite the fact the season is over. swoops team in with verizon to hand out hundreds of backpacks to domestic violence agencies today. the backpacks are filled with hats, gloves, scarves, socks, to help warm the lives of kids staying at the shelters. the kids will also find plenty of toys and games in the backpacks when they open them. and now the eagles search for a new head coach. today the team is interviewing one of the most accomplished candidates yet. >> former giants coach tom coughlin. comcast sportsnet's john clark has the latest on the search. a lot of jockeying going on, john. >> the eagles did interview tom coughlin today. he, of course, won two super bowls with the giants, but he's coming off three straight losing seasons, and here's an interesting wrinkle, the 49ers have reportedly requested and been granted permission to interview tom coughlin, as well. so if the eagles determine that

tomorrow. we have an arctic blast, obviously, that came in overnight and into today. the first flakes of the season likely to fall at least parts of the area tomorrow, then it gets even colder as we head towards the middle of the week. a lot of sunshine out there today. the camera still shaking a little bit because it's pretty windy. it's 35 degrees, the wind 17 miles an hour gusting close to 30. the relative humidity is pretty low, so the lower parts of the atmosphere are low and sometimes as snow tries to fall, never reaches the ground. that's why the snow is just in the chance category. well, this is a guarantee, with 65 yesterday for a yesterday, down to 35 today. 42 for the high tomorrow, and then down to 29 on wednesday. kind of this roller coaster that we've got going here. that's going to continue in through the seven-day period, as you'll see. only 29 degrees in pottstown now, but it's 30 in allentown, reading, and lancaster.

warm spot, 36 degrees in dover. and it feels like it's in the 20s just about everywhere. 19 in lancaster and 6 degrees in mount pocono. nothing on the radar around our area. we've had nothing but sunshine during the day today, but back to the west, patches of some generally light snow. this is kien of an upper air disturbance combined with a cold front at the ground that is producing this threat. not a real storm or anything. and now as we get specific tomorrow, let's go through the night tonight. first of all the temperatures not dropping a whole lot during the night, but cold enough in the poconos for snow tomorrow. they could get some toward the midday hours, as you can see there, and the temperatures below freezing so it sticks. elsewhere in the afternoon temperatures above freezing, so probably melt as it fell, and in philly it could start as some rain showers and then change over. by 9:00, it's over with in the

northern and western areas. as we go through the philadelphia i-95 corridor and to tomorrow morning, temperatures below freezing, but it doesn't stay that way. it warms into the 40s, but we could still get snow at 40 degrees. it's just not going to stick. there we are into the evening, dinnertime hours while it's dark we could start seeing a little bit of that snow coming through the area. we're not talking about a lot here, but the first flakes is always a big deal. clouding up and cold tonight, 24 for the low in philadelphia, 14 north and west, and perhaps millville, new jersey, too. not as cold tomorrow with the afternoon snow showers and the high temperature in the low 40s with that southerly wind. of course, temperature goes down as soon as any snow starts falling. then the arctic blast and temperature goes down then with the wind, but then it starts warming up just in time for the next storm. friday night and into saturday looks like basically rain and then we get another arctic blast early next week.

nbc 10 breaking news. >> right now at 5:00, a father arrested for the murder of a 3-year-old son. nbc 10 was there as authorities brought d.j. creato into the haddon township police department this afternoon. now, the story we've been following for nearly three months now. back in october police found the body of brendan creato about a mile from his home. his father now charged with murder called 911 to report him missing that morning. >> i just woke up, i don't know if he wandered out or what happened, i don't know where he is. >> nbc 10 is following the latest developments on this breaking news story. >> nbc 10's cydney long is live in haddon township. sydney, you've been following the investigation since the beginning and now this big

arrest. >> reporter: keith and denise, this has very much been an open wound and very tragic, very tragic set of circumstances, tragic mystery for this entire town. this week marks three months, but very quietly just before 3:00, and we were the only cameras here, d.j. creato got out of an unmarked detective's car, he was walked by detectives right here into the haddon township police department to be processed. we asked him why he did it, but he said not one word. he is the same father who dialled 911 and was inconsolable, according to police, the morning his son vanished and was found dead in october. 22 year old d.j. creato is said to have murdered his 3-year-old son brendan, but how and why he did it, they didn't say. wearing a jacket, hood, and handcuffs, five detectives led creato into police headquarters to be processed for a crime that left this community in shock.
