bill cosby have immunity from the sexual assault charges he's facing? the former district attorney who declined to charge cosby wrote an e-mail to his successor. in it he told the prosecutor not to prosecute the comedian because of an agreement. that cosby statement about the alleged sexual assault would not be used against him in a criminal case. we've also learned that the former d.a. could now be a key witness in cosby's defense. >> well, the question a judge must answer before this case goes to trial is simple, was bill cosby promised criminal immunity in exchange for that sworn statement about pills and sex? it's a revelation that could derail the cosby case. former montgomery county d.a. bruce castor promised the

comedian he'd never face charges as long as he gave a deposition in a civil lawsuit. nbc 10 confirms castor said in that e-mail that any criminal case against the comedian could not use those sworn statements. he explained the deal last year to nbc 10. >> i created the scenario where he would have to answer questions under oath. obviously they got the information that they needed and she was compensated mo e ecompe. >> the case was effectively closed until two weeks ago when new district attorney kevin steele decided to file charges anyway. it's up to a judge now whether that sworn statement will be admissible in court. a hearing is scheduled in two

weeks. >> even if the court suppressed that it would still allow the district attorney's office to charge mr. cosby based upon the witness statements and other evidence. >> in those e-mails between bruce castor and the d.a.'s office he warns bill cosby could potentially sue the county if those sworn statements are used in court. meantime, castor will go in front of a judge under oath to talk about that immunity deal. new at 11:00 a south jersey home consumed by fire in monroeville salem county. firefighters responded to a house on groff road. the fire chief says there were people inside the burning home when they arrived but he would not confirm if anyone was hurt

18-year-old david ramos junior. police would not confirm if they're still looking for more suspects. in a major diplomatic break through tonight international sanctions against iran have been lifted. it happened just hours after iran agreed to release four american citizens as part of a prisoner swap. the u.s. agreed to develop charges against seven iranians accused of violating sanctions. a fifth american was released before today's exchange as part of a separate deal. later, the united nations announced iran made good on a promise to scale back its nuclear program. that led to the removal of harsh sanctions imposed by the united states, the u.n. and the european union. secretary of state john kerry
