11:00 am
nbc 10 breaking news. that breaking news at 11:00 this morning. bill cosby in court. the embattled entertainer and philadelphia native arrived at a norristown courtroom a little more than two hours ago in an effort to try to get a decade old sex assault case against him thrown out. and here's a live look from outside of the courtroom. nbc 10 reporters inside tell us that former montgomery county d.a. bruce caster, who was just on the witness stand told lawyers that he would only answer the judge's questions in this case. this all happened in the past half hour. the judge called a very short recess, but as you can see the doors are now closed and court is back in session. good morning. i'm vai sikahema.
11:01 am
bill cosby is in court for what could be a make or break hearing. lawyers are asking a judge to throw out the sex assault case against cosby. they're expected to argue that the former district attorney bruce caster had agreed not to prosecute cosby. the current district attorney says he has no record of such an agreement. caster had taken the stand as a witness for the defense. and we have live team coverage. nbc 10's drew smith. and matt delucia both are at the courthouse in norristown this morning. but we begin with drew. drew. >> reporter: and, vai, there is a huge amount of interest on this case. like you said the court is back in session right now, but outside you can see there's all sorts of security gates. dozens of officers out here as well making it clear this is not an ordinary court hearing going on inside. bill cosby arrived shortly before 9:00 today. reporters and cameras lining the access ramp as he made his way up with the help of some people that got out of the suv with him. we have video of cosby then going inside the court through the security checkpoint and then on to the courtroom.
11:02 am
there is so much interest in this case, people who wanted to park around the courthouse had to have special passes. most of them are taken up by large media trucks. and police had guarded off entryways here that are normally accessible. we spoke with some of the local people who came out here to watch all of this happen. >> i just see a circus. and what boggles my mind i see people screaming free bill cosby which i think is a joke. >> i think bill cosby was the cornerstone of our community and i think this is a bit too much for him. and i think that he's innocent. >> reporter: and there was a brief recess, we did not see many people coming out of the main doors here. there is an area set up where they're going to be taking questions a little bit later on, or at least we hope someone will come out and take the podium to answer some questions. that could happen just as soon as the hearing wraps up. right now it is still going on. live in norristown, drew smith, nbc 10 news. >> drew, thank you. our live team coverage continues now with nbc 10's matt delucia. matt, you were also there as
11:03 am
cosby arrived this morning. what will he and his legal team be hoping for? >> reporter: well, vai, it comes down to this. cosby and his lawyers want this case thrown out today. they do not want this thing going to trial. some legal experts we've been talking with think he has a shot. i was able to get a quick question out to bill cosby as he was walking into the courthouse today. take a listen. mr. cosby, how are you feeling this morning? a smile and a nod walking into the courthouse. that was all. no words. seemingly in good spirits about the hearing today. it all comes down to a supposed agreement between former d.a. bruce castor and cosby. the comedian's attorney in court this morning told the judge that there was an agreement made that prevented cosby from ever being prosecuted. that deal was supposedly made with castor in exchange for a deposition for a civil case. in that deposition cosby admitted to drugging a woman and engaging in sexual contact with her. fast forward and the new
11:04 am
district attorney, kevin steele, he decided to file criminal charges back in december right on the edge of that statute of limitations. so at issue here is whether or not that alleged agreement 11 years ago holds up. and what was that deal really about? bruce castor as we've been talking about he took the witness stand not long ago. he is still being questioned. and what happens next with the case that is up to the judge. we're hearing from sources that this could take the bulk of the day. and we may not even get a final decision from the judge today. but you see all of these cameras behind us. we have media from around the country watching and waiting to hear what happens. and we have our reporters in the courtroom as well. so we'll be sure to let you know. live in norristown, matt delucia, nbc 10 news. >> and as matt said, nbc 10 is inside the courtroom for this morning's hearing in montgomery county. we've got you covered. stay with us on air and online for the latest developments. and of course you can get updates any time with the nbc 10 app. and breaking news, a judge has handed down a sentence for

11:16 am
another proceeding where he predicts there will be a much different outcome. live in federal court. doug shimell, nbc 10 news. meanwhile today in washington president obama and house speaker paul ryan are set to meet. this will be the first face-to-face the men will have since the wisconsin lawmaker became speaker of the house last october. the men are expected to discuss issues like isis, the budget and the nation's heroin epidemic. and people who dislike snow got a welcome news from pennsylvania's most famous groundhog this morning. punxsutawney phil did not see his shadow. according to legend that means there will be an early spring. thousands stood on cobbler's knob to hear phil's forecast translated by his human handlers of course. >> is this current warm weather more than a trend or chance this winter has come to an end? >> that's exactly what
11:17 am
punxsutawney phil told those guys. this is only the 18th time phil has seen his -- not seen his shadow. though with clear skies in the area his shadow should have been visible. analysts in 2011 looked at records and found the groundhog's prediction was wrong about two-thirds of the time. now your nbc 10 first alert weather with chief meteorologist glenn "hurricane" schwartz. how can it not see a shadow on a sunny morning? unless they brought it out while it was still dark. they're just making stuff up there. all right. we've got a flood watch in effect for parts of the area. record warmth on the way during the day tomorrow, but it is going to be getting colder toward the end of the week. look at that bright blue sky out there now. 48 degrees, a very light wind. three degrees cooler than it was this time yesterday, but yesterday was pretty warm. up close to 60 degrees. it's 44 in reading, 44 in
11:18 am
allentown. still snow on the ground there. 48 in atlantic city, 47 in millville. so these temperatures are already above the average high for this time of the year. so it's going to be another mild day as you can see temperatures going up closer to the 50 degree mark by 3:00. and then we start to go down during the night tonight. but it's not going to stay down. snow cover, none left in south jersey and delaware. and not much left in philadelphia. not a whole lot left in chester county either where lower portions of montgomery and bucks. but we are seeing more farther to the north. now, the dark blue is six plus. the light blue here that's three inches plus. and this is important because we've got a lot of rain. and this snow is going to melt. and the more moisture that's in here, of course the greater the threat for flooding. fortunately we have seen the snow pack really go down in the lehigh valley and that may help
11:19 am
us a little bit. flood watch in effect for much of the area late wednesday into thursday. and just for proof there's the satellite picture. there are no clouds over punxsutawney this morning. i don't get it. all right. this is a big storm. you see snow from iowa down to the rockies. thunderstorms building farther to the east that's the storm that's going to be moving our way. we're going to be on the warm side of it. as we go through the afternoon and into the evening hours it's not all that cold tonight, but a little chillier than it has been. and then by tomorrow morning temperatures already starting to rise. we're generally dry for the morning rush. it could be a couple little white showers, but the main action is coming much later in the day. here we are at noontime. there are the temperatures getting well into the 60s. and there's that really heavy rain coming in late during the day could affect the afternoon rush tomorrow.
11:20 am
and that could make things pretty messy. how much rain? computer models in general agreement of around an inch of rain. and it will take probably a little more than that to produce flooding. so it's going to be kind of a close call there. sunny and mild today. high temperatures around 50 or into the low 50s. and seven-day forecast there's the record warmth tomorrow with wind and some heavy rain. then on thursday temperatures start falling during the day. 50s to start and then dropping into the 40s. and then it's going to be chilly on friday, but not as cold over the weekend. all right. thank you, glenn. this is one of glenn's favorite players remember chocolate thunder. he was a legend who brought us moments like this. the team is getting ready to honor daryl dawkins. up next i'll talk about the life and legacy of his friend. many people clean their dentures

11:25 am
and i remember me and him we came in and i said we're not going to play because doug collins and those guys are playing, daryl, we ain't going to play. no, i'm going to put my warm up over my top, with my pants and stuff on. that's a good idea. yeah. we're not going to play anyway. low and behold gene shoe calls me. and then he calls daryl. we both got our pants on, full clothes instead of uniform. >> you don't even have your shorts on. >> no. we have pants. we just had the sneakers on. we had the shirt and tie underneath. we didn't play for about a month after that. >> well, what a shock that is. tell us how the team plans to honor daryl this saturday. >> we're going to have billy cunningham talking, daryl dawkins, t-shirts and everything given out with chocolate thunder on it because that's who daryl dawkins was.

courtroom right now fighting to get those charges tossed. nbc 10's drew smith was at the courthouse when cosby arrived for that hearing this morning. and he joins us live now with an update. drew, what can you tell us? >> reporter: well, vai, we're just getting updates from some reporters in the courtroom. we know there was a recess and that bruce castor, the former district attorney, had asked to consult with the judge. and that's the reason for the recess. we want to show you the courtroom here where there was some tense media interest here today. the whole point of this is cosby's legal team trying to keep this from going to a trial. cosby arrived in a black suv here at the courthouse just before 9:00 this morning. he was smiling. he spoke with his assistants as they helped him up the access ramp to the front doors to the courthouse and in through security. among the people on the witness list includes former district attorney bruce castor, as i was saying. we know from our reporters inside that castor was on the stand this morning. and cosby's attorneys wanted to persuade the judge that in 2005 castor promised not to prosecute in exchange for a deposition.
11:32 am
in that deposition cosby admitted to drugging a woman before engaging in sexual contact with her. and there's a lot of attention on this court appearance today. we spoke with people reacting to the huge amount of media here in norristown. >> celebrities warrant that kind of attention so that's what happens. it's pretty much similar to o.j. trial, same stuff. same fascination with celebrity. >> reporter: and we have a live picture from inside the courtroom. and we just got word that the court has once again gone into recess. i want to just read a few quick notes from our reporter who is inside. castor who was on the stand, you know, said that there was difficulties for a prosecutor who has those statements and had been going back and forth with the defense team in there. they were trying to point out a number of inconsistencies among statements of the victim in this case had given to bruce castor. and he said, you know, it had caused him concern. so there's a lot to dig through here. our reporters are just getting us information right now as to

effect, combination of that heavy rain and the melting snow helping to cause that threat. we have record warmth that's likely to occur during the day tomorrow. but it will be colder by friday. this is not going to be an extended warm spell. look at that blue sky out there. 48 degrees. the wind is east-northeast at 7 miles an hour. it's not going to be as warm as the last two days, but still way above average for this time of the year. you can see we're getting closer to 50 degrees we go into the afternoon. and then dropping to, oh, maybe a little bit above the freezing mark during the night tonight. and then tomorrow the temperature really skyrockets as the southerly winds come in. we're in the 40s across much of the area now. 36 in lancaster, 38 in mt. pocono, those are places with significant snow cover still. as far as records are concerned, philadelphia's record is 62 degrees. i'm predicting 66. in southern delaware, a place like hairington, i'm predicting
