biggest hollywood celebrity trial in decades. >> the hearing for bill cosby will resume tomorrow morning in montgomery county. cosby is charged with drugging and sexually assaulting andrea constand in 2004. constand is a former temple university department employee. his attorneys argue there was agreement with a previous district attorney not to prosecute their client. >> we have live team coverage tonight with deanna and harry as well. let's begin with deanna. >> reporter: jim and jackie, what bruce castor said is similar to what he said in years past since deciding not to charge bill cosby. however, cosby's lawyers want to use bruce castor as a way to get this thrown out. he spent 30 years asking questions but bruce castor answered questions why he did not charge bill cosby in 2005.

castor's statements to the court mimic what he has said to nbc 10 in the past. back in november of 2014. >> at the time i remember thinking he probably diddo something inappropriate, but thinking that and being able to prove it are two different things. >> he told the court the victim in the case damaged her own credibility, he says the victim wait add year to report the crime, sought a civil attorney and now claims there had been illegal wire taps, he felt were to gain money from bill cosby. castor told the court that his decision not to prosecute cosby allowed for cosby to testify in a civil case with the victim. he would not be able to assert his fifth amendment rights and castor says his actions are why the woman settle add civil suit. and defended that decision to nbc 10 last summer. >> i created the scenario where he would have to answer questions under oth and obviously they got the information that they needed and she was compensated monetarily. >> a judge must now decide if p

castor's decision to avoid prosecution opened the door for cosby to answer questions that can now not be used against hip. and without the answers, should the case be thrown out. >> reporter: the judge says he's not going to decide at least not right now if the defense's other motion to have the district attorney on this case his office removed from the case. the defense is saying that the district attorney when he was running for office used this case in a campaign ad. he was elected to the office of district attorney. reporting live, "nbc 10 news." >> our coverage continues now with what happened outside the courthouse today. >> the hearing attracted onlookers, both supporters and critics. >> i just see a circus. i see -- and boggles my michbd, people screaming free bill cosby which i think is a joke. >> i think he was the corner stone of our community, i think this is a bit too much for him and i think he's innocent. >> nbc 10's harry hairston was

live in the courtroom today. >> you came down about 30 minutes ago. what did you learn before the judge recessed for the day? >> reporter: yes, just got out moments ago. here are key points the judge brought up. first he went back, he had his own questions for bruce castor and bruce said there was no written agreement whatsoever. he says he made the decision giving his word to bill cosby's attorney and bill cosby's attorney relied solely on his word. the judge went on to ask why didn't you write something down. there is a way to do that, a statute to use. why did you not use it. and then after he started to answer that question you could see on cosby's face and his attorney's face how they became very concerned. it was very different of them the way they looked from this morning at about quarter to 10:00 when this started. i want to show you video of cosby entering the court house this morning. the iconic comedian entered the courtroom. he was upbeat and embracing his

attorneys before the proceeding. then it was down to business for hours he sat quietly watching the former district attorney bruce castor testify about why castor didn't charge him. at times cosby shook his head side to side as he talked. there were some inkiptcy's in statements to police. when cosby's defense attorney caster paused. that caused a recess as the teams went to meet with the judge in the judge's chambers. currently constand is suing for defamation of character for previous statements he made about her. by midday well, more drama seems to unfold when all of a sudden castor in response to a question by the defense team blurted out, i'm not on your team. by late afternoon cosby seemed to be more enkbajed into what was going on with his attorney

monique pressley. she didn't say anything in court but she sat by his side for the entire day, they had conversations seeming to nod in agreement to their whispers. those whispers an those nods of agreement, that's all changed when the judge started grilling bruce castor late this afternoon, the judge says he wants to reconvene tomorrow and that's when he may make his decision. i talked to one of the nbc legal experts about what could happen once this decision is made. >> the judge says he's likely to make this decision tomorrow but you say it's far from over. why? >> right. i think any decision the judge makes can be appealable through the state appellate structure and then ultimately a petition for sirky airy to the supreme court. so appealing the judge's decision could bog this case down for a few months. >> so here's what we're going to see tomorrow. castor is all done, the prosecution or i should say cosby's defense attorneys tell me they have one more witness and the prosecution has at least

dickinson. police are searching for the female driver. the family is recovering at the hospital. nbc 10 on the campus of muhlenberg college in allentown, milder temperatures helped melt more snow today but still quite a bit out there. we're tracking warmer weather and heavy rain. you can see that rain on radar tonight. we have issued a first alert for tomorrow. glenn "hurricane" schwartz joins us now. when is that rain going to arrive? >> we could see a couple showers in the morning, but the worst of it is going to occur late in the day especially during the afternoon rush. and that's why we have a first alert out for tomorrow for late wednesday and wednesday night, we're going to be getting some heavy showers, maybe even thunderstorms. we've got a flood watch in effect. not only for the heavy rain but also related to the snow that's still on the ground in parts of the area as the snow melts, that puts more moisture into the

ground and on its way into the streams and rivers. the flood watch in effect, until thursday afternoon. you can see most of the area affected. now, showers and storms are biflding in the ohio and tennessee valleys, tornados on the ground right now in alabama, we're not necessarily expecting severe storms but we expect a lot of rain. temperatures in the 30s to the mid-40s now. and watch as we go through the morning tomorrow, the heaviest of the rain starts to get closer as we get near record warmth. more on the hour by hour rain fall with the rest of the 7 day in a few minutes. >> the son of a local congressman is now serving his 5-year sentence on fraud and tax evasion charges a. judge sentenced chaka fattah jr. prosecutors say he lied to banks to get business loans to support an extravagant lifestyle. fattah jr. is the son of congressman shacka fattah. he was at the sentencing and contend this is is nothing but a

smear campaign against his family. >> let me say this. that i am a person of great faith, and our family is stronger than any of the forces that are against us. >> congressman fattah is accused in an unrelated case of misusing federal grant money, he is mar i ared to nbc 10 anchor renee chenault-fattah, she is on leave from nbc 10. >> to decision 2016. now that the first of the nation caucus is over the presidential candidates are focusing attention on new hampshire. hillary clinton was back on the campaign trail with her husband after what the iowa democratic party called the closest in caucus history. all precincts reporting clinton topped sanders by less than .3%. cruz came out on top in the

republican iowa caucus. donald trump landed in second place, just ahead of marco rubio. chris christie finished tenth with 2% of the vote there. near the bottom. christie says he looks forward to a strong showing in new hampshire. and nbc 10's ted greenberg has been gathering reaction in the garden state live at our jersey shore bureau. what are people saying about the governor today? >> reporter: well, jim, the majority of those we spoke with today believe it is time for christie's campaign to call it quits. >> needs to get out. >> reporter: govern ter christie showed no sign of ending his bid for the white house. the day after his dismal showing in iowa. >> now is game time. >> he needs to back out and take care of new jersey. >> he says his goal as it's been from the beginning is to do very well in the granite state in next tuesday's republican primary. >> i wish him the best in the coming months and hopefully he can bring it off.

>> i got asked this morning by someone how do i feel about iowa. i said well heck, i did exactly what i thought i would do. >> just prior to the caucuses christie told nbc 10's lauren mayk about an aspiration he ultimately failed to achieve. >> success if we can be a number one governor. >> insaid tenth place came in behind three other governors. >> that's a problem. there's room perhaps for a fourth candidate after the big three and he needs to find a way to squeeze into that role. >> i think christie sealed his own fate. a lot of people can see through christie's character. he doesn't have it. to be president. >> he told his supporters in new hampshire this is the time to work to find more voters and reminded them that 50% of the people there are still undecided. live in our jersey shore bureau in atlantic city, ted greenberg. >> nbc 10 is also looking ahead to new hampshire. george spencer will follow the

last month's blizzard was not kind to the beaches of delaware. crews are working to rebuild sand dunes destroyed by the storm. the blizzard of 2016 battered beaches up and down delaware. >> now the race is on to get everything back in order before the busy summer season. tim furlong surveys the shore and looks at what's being done to rebuild. >> it was very windy. >> debby was in bethany beach when the storm came through, it was a blizzard up north but a rainy windy expensive dune buster for spots like bethany and dewey beach. hit hard. >> looks like 75% of the dunes are gone. >> reporter: crews are pushing sand back but beach access ramps

drop off and a piece of a new bike trail is closed. the question, will the beach towns be ready for the tourists back here in just a few months. >> i'm very confident that the beaches will be restored to their normal summer vacation appearance. >> reporter: crews getting the sand back. i'm told lots of the sand is not lost completely but this summer the dunes i'm told will be noticeably smaller than in other years. so everyone seems confident delaware will have beaches ready for the summer season but what if a nor'easter hits before that and what about the upcoming hurricane season. how much more can these beaches really take? from fenwick over the indian river and on up through lewis the delaware beach towns know it's not if it's when another storm will hit here, but everyone hopes mother nature takes her foot off the gas.

workers are pushing to make the repairs from the last storm. >> shingles blown off, siding blown off. fascia blown off. >> a storm back in october and then the blizzard, a nasty one-two punch. would be nice to get a reprieve before the next round of destructive weather. you've got the reprieve from winter storms this week. the pattern is coming back and i think we're going to see cold and snow before february is out. we're not done with winter yet. the first alert weather day for tomorrow. not so much for winter weather but for rain. and the melting snow. we've got a flood watch in effect, also it is not really good timing. timing for the afternoon rush tomorrow making things even more complicated trying to get home. 47 degrees now. the wind is dead calm. it's going to be windy tomorrow.

it's going to be quite a different type of day. down to 39 in pottstown, 40 in allentown, but in the 40s across much of the rest of the area. we've got up to 53 degrees today, that's 12 degrees above average. and tomorrow we're going to be more like oh, about 23 degrees above average. this we go. and how do we know it's going to be warmer? look at this. 59 cincinnati, 67 in nashville, 71 in little rock. that air headed at us. so yeah, there's plenty of warm air to come. at least briefly. this is a flood watch area goes until thursday afternoon, doesn't really start until wednesday afternoon. moisture really building up here and unfortunately, a bunch of tornados down south. real large one on the ground now in parts of alabama, but we've got snow on the cold side of it. we're going to be on the warm side. not necessarily expecting severe thunderstorms, but we do have

the threat of flooding and possibly some lightning with heavy line of storms that would come through and some brief gusty winds. the main threat is the rain. as we go through the night tonight it's dry, it's not that cold. so temperatures don't drop below freezing. if anything they rise toward day break. then here comes the rain. some showers in the morning, then the heavier rain coming later on during the day. there's 2:00, and pennsylvania our counties are getting blitzed there. and as we head to rush hour, there we are getting some pretty heavy rain. look at the temperatures. in the 60s and even tomorrow night it's in the 60s. so we really have some mild weather for a while. clouds increase, not as cold as last night. 40 for the low in philadelphia. tomorrow, a windy day. 10 to 20, gusts to 40 by afternoon with record warmth and high temperatures getting into

the 60s. but that's a different story. by thursday morning, 54, then temperatures fall during the day to 48. a chilly day friday, and then a pretty nice weekend but early next week there could be a coastal storm that brings snow to parts of the area. >> thanks, i'm john clark we hear from doug pederson, the periods are not going to hire a head of player personnel for now. why? that is next.

player personnel but suspended the process, they are probably going to fill that after the draft in april now. new eagles head coach doug pederson will have a part in picking the players. it's going to be a collaboration. today doug was on comcast sportsnet sports talk asked what if he and howie disagree on what player to take? >> i think at the end of the day you have to rely on the football guys, you have to rely on the ones that are going to be coaching them, i think you have to rely on the guys that are going to be with them every single day in meetings, on the practice field, on the bus ride, on the plane trips. leave it up to the football guys to make those decisions and then you go from there. >> how about quarterback sam bradford, the eagles can put the franchise tag on him starting in three weeks, that would be $20 million plus for one year or can sign him to a deal. doug says sam is a top notch quarterback and would like to have him here. >> you know, if he's our guy,
