bill cosby gets a double dose of defeat. >> like to say anything? >> a judge decides the sex assault case will proceed and cosby's own words could be used against him. tonight, why other accusers could also take the stand. good evening. i'm jim rosenfield. >> i'm jacquiline london. drivers in havertown, forced to keep the speeds down with visibility a major issue there.

>> a rough commute for drivers tonight, a day's worth of rain causing larger than normal puddling like here in bridgeport, montgomery county and drivers crossing the center line to avoid that rain water. the worst of the flooding yet to come. >> let's bring in meteorologist sheena parveen. >> rivers and creeks flooded may be a worry for the morning commute and north and west that we have seen some minor flooding and the roads so we'll start with brandywine creek and honeybrook and river over flood stage and a warning and this is going to continue as we go overnight tonight. most likely with that river still being over flood stage and now the advisory for upper bucks, montgomery, chester county. this is still ongoing because of minor flooding on the roadways from today's rain. even though the rain is gone and the flood watch still continues until 5:00 p.m. tomorrow. that flooding is still possible

because, remember, we had all that snow melt, too. so the rain is out of here. we are clear but like i mentioned river flooding, here's perkiomen and graterford. above flood stage and then dropping down and now we look at the schukyll river at norristown and expect by 7:00 a.m., a foot above flood level and could be water on kelly drive and that could be closing part of it. aside from that dense fog advisory in effect until 7:00 a.m. tomorrow. areas north and west especially with the snow cover visibility, quarter mile or less. talk more about this and the morning commute coming up. tonight, bill cosby's lawyers are saying they'll appeal a judge's decision today to let his sex assault case proceed. cosby's lawyers trying to get

that case thrown out. arguing that montgomery county's former d.a. promised not to prosecute the comedian. >> tonight, live team coverage on where the case goes from here beginning with randy gyllenhaal live in norristown outside the courthouse. >> reporter: when this decision was read, bill cosby held his head in his hands but he did not speak. it comes after two long days of testimony and it means that it's now much more likely that bill cosby will face a jury. comedian bill cosby left court knowing the sex assault case against him could now go to trial. his supporters upset by that decision got a wave from their childho childhood hero. cosby never said a single word. >> showing him that we care and don't believe the accusations made. >> reporter: the judge refused to throw the case out and ruling that a possible deal that was promised ten years ago is not valid.

in another blow, the judge also ruled current district attorney kevin steel can continue prosecuting the case despite objections from cosby's attorneys. now, cosby's camp left court without giving any interviews but late tonight they sent us a statement saying the decision reached by the court was wrong and we will appeal. cosby's next move could be to suppress a deposition he gave ten years ago during a civil lawsuit where he admits he gave drugs to women before having sex. a judge must decide if that evidence gets thrown out. >> he could, but that would definitely cripple the prosecution's case here. >> reporter: legal analysts say without it the case becomes more of a he said she said relying on the accuser's credibility which the jury might not believe. >> so basically, what you are doing is leaving the prosecution only being able to use the evidence from 2005 which there was no physical evidence and all these other things about the

accuser. >> reporter: that accuser is temple employee constand claiming cosby drugged and assaulted her. this appeal process could take months and it could go all the way to the supreme court. live in norristown, randy gyllenhaal, nbc 10 news. and bill cosby could face further set-backs. there's a possibility other accusers may be called to testify in the montgomery county case. >> keith jones continues our team coverage. keith? >> reporter: more than 55 accusers and a retired judge told me he thinks some of them could take the stand. >> you raped her! you know you raped her. >> reporter: bill cosby facing the public outside the courthouse but his case inside could get harder to defend. >> he drugged me without my knowledge. >> violently raped me. >> flipped me over. >> drugged and raped. >> reporter: countless accusations of women, 46 to 80.

>> i pushed him away and i said, what are you doing? >> reporter: cosby never had to answer. that could change in a few weeks. >> listen. you have one person saying something happened. you have four? >> reporter: retired new jersey supreme court judge said prosecutors will fight to allow other alleged victims to take the stand. >> because there's strength in numbers. otherwise it's one victim. he said, she said, that's it. >> we believe the women! >> reporter: accusers whose voices quiet for decades could finally be part of the case against cosby. >> by standing up and showing how important it is for everyone to stand up and tell the truth. >> reporter: the judge told me it could take days to decide in court whether these other accusers can testify and that would have to happen in the coming weeks. keith jones, nbc 10 news. want to go to breaking news in philadelphia's frankfurt

neighborhood right now. fillmore street, a man died after someone shot him. the victim ran inside the restaurant after the shooting and then collapsed. no word yet on any arrests here but we'll stay on top of this story and bring you updates as we get them. this just in from allentown. a plane's tires deflated after it landed at lehigh valley international airport. alley janet flight from orlando. they say two of the plane's tired deflated and passengers were bumped to the runway. mechanics are examining the plane. new at 11:00, the parents of pace say they know who killed and kidnapped their son and want a prior judgment thrown out. 6-year-old etan disappeared in 1979 on the way to school in new york city. he was later declared dead. in a 2004 civil case, a judge ruled jose ramos responsible for the death.

now the boy's parents say they're convinced a more recent suspect pedro hernandez killed their son. hernandez who lived in new jersey was tried last year but jurors deadlocked. his retrial is set to begin later this month. now to our decision 2016 coverage. the iowa caucus proved the democratic presidential race couldn't get much closer. and with just six days before new hampshire voters head to the polls, tonight hillary clinton and bernie sanders stated their cases in a nationally televised town hall. they answered questions from new hampshire voters at the event hosted by cnn. clinton said the core is as liberal as sand erps but he disagr disagrees. >> share a lot of the same big progressive goals but we have different ways of going about them. >> i do not know any progressives who has a superpac and takes $15 million from wall street. >> the democratic national

committee announced today it is adding four additional debates. the first one set for tomorrow in new hampshire on msnbc. one will happen in flint, michigan, in march. and "the washington post" said in pennsylvania in april and california in may. whoever wins the democratic nomination will accept it in philadelphia this summer. you're looking live at the wells farlgo center hosting the democratic national committee. the race has two fewer candidates tonight. former pennsylvania senator rick santorum announced he is suspending his campaign and endorsing marco rubio. and rand paul announced earlier today he is also dropping out of the white house race. ted cruz unloaded on donald trump today after trump accused cruz of cheating and fraud in the iowa caucuses. >> cruz accused trump of losing it after trump fired a series of tweet this is morning calling for a new election in iowa. cruz said the trump insults get

the campaign trail. george spencer picks up our coverage this weekend in new hampshire. you'll see his reports starting sunday night right here on nbc 10. president obama is trying to correct what he insists is a distorted impression of muslim americans with the visit to a baltimore mosque today. it's the first time the president has visited a mosque in the u.s. he spoke about the discrimination and threat that muslim americans face and warned that the growing antagonism of the community tears at our nation's fabric. >> we've seen too often people conflating the horrific acts of terrorism with the beliefs of an entire faith. >> the president also talked about what he calls inexcusable political rhetoric against the muslim faith. the zika virus threat continues to grow across the globe today. the cdc expanded a travel advisory warning to jamaica and tonga. an indian bio technology firm said it's working on two

a convicted murderer once the focus of "serial" is hoping for a new trial. he was in court today for a hearing that will decide if he'll get a new trial.

he is serving a life sentence after a jury convicted him of strangling a high school girlfriend 16 years ago in baltimore. in 2014, the hugely popular "serial" podcast uncovered new evidence that convinced an appeals court to consider a new trial. new at 11:00, the irs is scrambling to fix a computer problem. the irs says a hardware failure forced several tax return processing systems to shut down including the e-file system. the agency says you can still file your returns through other companies like turbo tax or h & r block and hold on to the returns until the system is back up which is tomorrow at the earliest. footsteps in the rain as casino workers marched in atlantic city. >> a show of union solidarity battling an economic crisis that could lead to a state takeover. nbc 10 reports.

>> the church taught to give is so important. >> reporter: the fight for better paying jobs for casino workers in atlantic city getting a dose of divine intervention thanks to support of the catholic church. >> great restaurants and hotels mean nothing if people aren't earning a decent living wage. >> reporter: the mayor is showing solidarity as he and others are meeting with state lead earls behind closed doors. they're crafting a bill that will outline state intervention to help the cash strapped city. the first meeting was held on friday where the mayor says 50 items were discussed. definitely in the bill -- >> i can't tell you that. it's inappropriate for me as we discuss it behind closed doors. >> reporter: that lingering uncertainty is why so many union workers took to the streets in the pouring rain. >> i work at taj mahal and the benefits were cut a year ago. you know? took away the pension, severance participate. >> reporter: they have marched

before and say they'll do it again. until something is done. >> we dealt with hurricanes, floods, closings. we've dealt with an environment where the city is on the verge of bankruptcy. the workers just want a stable environment to do their work in. >> reporter: we're told that state and local leaders continue to meet behind closed doors to craft a bill to determine exactly how the state will intervene. now, that draft of that bill must be complete by february 11th. reporting in atlantic city, nbc 10 news. new jersey lawmakers are getting set to announce plans for a bill to raise the minimum wage in the garden state. a news conference is scheduled for tomorrow morning in trenton to introduce legislation to raise the state's minimum wage to $15 an hour. right now it's $8.38. meaning a full-time worker makes less than $18,000 a year. even without an increase, new jersey has the highest minimum wage rate in the area.

delaware is slightly behind at $8.25 an hour. pennsylvania workers make the national minimum at $7.25 an hour. more resources for schools, that was the focus of a meeting between philadelphia's mayor and more than a dozen school principals tonight. the mayor said more nurses and guidance counselors frees up teachers to focus on classrooms. there will be similar meetings in the school year. local scientists showed off the creations today. they held the school wide science fair and competition and open to students of all grades. well, the rain is finally gone. we have several hours of rainfall today but now it's moved offshore. we are drying up but the only thing now is with all the rainfall around and this is from today on the ground combined with the snow and the mild temperatures, we have a lot of fog.

here's a look at the rainfall that fell today because this is creating problems still, north and west under the flood advisory to 11:30 and seen rainfall and north and west of philadelphia. so these are the areas, too, seeing creek and stream flooding and may be the case again tomorrow morning but with this dense fog advisory up. over the same areas that still have the snow cover and the rain today. and the mild temperatures, so these are all very good ingredients creating very thick fog across the area. until 7:00 a.m. tomorrow morning, visibility a quarter mile or less and just be careful driving. here's a look at the visibility right now. we are down to 3/4 mile in pottstown, allentown and as we go into tomorrow morning this will be the case, too. so there you see it. we have snow in these areas, too. this is how much snowfall is left on the ground. less than earlier today with the melting and the rain. this is really a biggest flood

concern today because of it and contributing to the fog forming across the area. something definitely watch out for in the morning hours. now, as we go into tomorrow morning, that fog will be staying mainly north and west of philadelphia and mild start. 50 by 10:00 a.m. by noon and then it's mild and windy at times, too. at least we'll be dry. here's a look at future weather tomorrow morning. dry. rain stays offshore and take a look at the day. the weather system will stall, offshore and by tomorrow night we watch it very closely to see if it starts to swing any precip on shore because if it did early friday morning there's a chance it could be snow or wintry mix. here's a model going into friday. there's an area of low pressure an changing over to possibly a wintry mix or snow. we'll watch that very closely and then bego into next week. we'll be watching a couple of areas of low pressure pass by and could see a clipper system
