that was the contention earlier on by cosby's legal team is this deposition should never take place in the first place, because they're private conversations between a husband and wife are protected by law, but as you say she was his business manager for years and the lawyer for the plaintiff says he will respect those conversations between husband and wife, but that he is going to question her about what she might have heard in her business capacity about these alleged sexual misconduct cases and you do have cosby's legal team fighting this every step of the way late sunday night when a judge ruled that there would be no more delay. vai? meanwhile, investigators today could release the cause of a delaware house fire that claimed a woman's life. a neighbor shot video of the flames shortly after they broke out. residents say the victim had lived at the home for years and

was known throughout the street. her husband was not inside when the fire started, but he was seen outside the home yelling her name and trying to get past the flames to rescue her. >> it's very painful. especially when someone just a half hour prior to that i saw her with her beautiful blond hair out in the backyard playing with her grandchild and then to see her on a stretcher. >> officials won't release the victim's name until all relatives have been notified. the fire marshall tells us he has a good idea how the fire started, but they won't release information until autopsy results are complete. >> philadelphia detectives released new video this morning they hope can help them catch the suspects in a home invasion robbery. the trio stole money and video game consoles from a home on cambria street in kensington and they took off in a red pickup truck with the word "drywall" on the tail gate. been suspect hit the victim in

the back of the head. it all started when the victim led a woman whom he thought he knew inside to use the phone. she then let the other suspects inside. northeast detective division is looking for this man in connection with the robbery attempt at a dollar general store in oxford circle. investigators are asking for the public's help in identifying the man they say approacheded a cashier back on november 20th and demanded cash. when the worker said she couldn't open the register. he pushed herd head down and tried to open it himself. he failed and took off. are. if you recognize him you are asked to call police. a masked man jumped over the counter at the bustleton avenue store back in december and tried to pry open the register. he grabbed some cash and was last seen running east toward fillmont avenue. now your nbc 10 first alert weather. mild weather is continuing into

the workweek. sunshine, blue skies and pretty nice february day out there. here is a live look at the jersey shore from our cape may camera and enjoy it while it lasts, though. nbc 10 first alert meteorologist bill henley is here with the forecast. we had a beautiful weekend and today is a beautiful day today and we're not going to reach into the 60s like we did saturday and sunday and this sunshine is having an impact and we're up to 48 degrees and the wind is calm. what wind we will have will be coming out of the north and that's a dry wind for us. visible satellite shows clouds are completely out of the picture and the nearest clouds are in southern delaware and sunshine and a warm afternoon for this time of year. the normal high temperature is 45 degrees and we're past that. 49 degrees at 1:00, 50 at 4:00 and still mild into the evening hours at 46 degrees and notice a few clouds this evening and i won't see cloud cover during the afternoon, but then tomorrow it's all going to be clouds and

spring schedule today and if you head over any of the area bridges and watch out on the bend headed eastbound back into new jersey and two lanes blocked with construction there. vai? >> people in one northeast philadelphia neighborhood are voicing their concern after someone broke into more than a dozen cars and emptied out their consoles. a smash and grab spree happened overnight on tyson avenue between summerdale and algom. police say 17 cars and suvs were hit help block after block. passenger side windows were smashed out and random belongings were taken with each of the car and everything from sunglasses to cigarettes and the thief or thieves took anything they could get their hands on. >> whatever they could reach for they got. >> so i think they did it quick and just got out of here. you do it right in front of somebody's house, like, it don't make sense to me. >> police believe security cameras in the neighborhood may have captured a face or perhaps a clue. >>.

a former miss new jersey died this morning. carra mccollum passed away. mccollum's organs were donated and already helping save lives. the arkansas native graduated from princeton and anchored a cable news show in southern jersey. cara mccollum was just 34 years old. >> asa acel moore, family members are remembering moore in germantown. he was former editor of the philadelphiaen choirer and co-founded the national association of black journalists. acel moore was 75. today atlantic city's mayor and city council will share their thoughts about a state proposal to take over finances. new jersey lawmakers planned to introduce a bill that would give the state broad powers over the

city's operations. the mayor blasting the proposal saying the city would be left out of the decision making process. just last month the guardian agreed with the governor and the state senate president on a preliminary partnership plan to save the city from bankruptcy. parishioners of a montgomery county church will soon need a new place to pray. the archdiocese announced plans to close in conshohocken on march 16th. the church is part of st. matthew parish. officials said funding that would have gone for repairs and seeing damien will not pay for an expansion project at the parish church nearby. happening today, new jersey lawmakers will reconsider a bill to ban smoking on beaches in the garden state. in approved smoking will be prohibited with public parts and speeches and the place will create designated smoking areas under the proposal and the governor vetoed a similar bill in 2014. >> massacre in kalamazoo.

breaking news at this hour. the united states and russia have agreed for a plan for a cease-fire that starts saturday. o fishings say the two sides have agreed on the terms and conditions for the cessation of hostilities as they call it. the truce includes attacks on the islamic state group al nusra front, al qaeda's affiliate. the uber driver suspected of killing six people during the weekend shooting rampage in kalamazoo, michigan. investigators have recovered a gun and surveillance video. as nbc's blake mccoy shows us they still don't have a motive. >> reporter: good day to you. it is later this afternoon that we are expecting the suspect in this shooting jason dalton to make his first court appearance and the county prosecutor says he believes they have the right man and he is ready to file charges.

this is a person who is accused of going on a shoots rampage across the city saturday night and three separate shootings apparently shooting his victims at random, killing six of them and injuring two others. those two remain in the hospital, we are told with very serious injuries this morning. last night there was a vigil for the victims here in kalamazoo and people are hoping that those two who are seriously injured will pull through. >> when you see this on the news you don't think about it because it doesn't affect you and when it hits your community, but your friends. >> reporter: as for a motive we just do not know at this point and that is what's so puzzling about this all along. we're hoping to maybe glean more information today in this court appearance, but by all accounts this was a normal guy. neighbors say thee never showed signs of being erratic before. he was a husband, father of two and an uber driver who was even reported to be giving rides between the first shooting and

when he was arrested six hours later. a lot of unanswered questions in kalamazoo hoping to get some of them answered in this court appearance. in kalamazoo, nbc news. the fbi director james comey says the agency owes it to the victims of the terror attacks to try to gain access to that iphone as a matter of justice. the tech giant refused the fbi's request to hack the phone of shooter syed farooq. on friday a federal judge in california gave apple one week to comply. apple executives and tech experts say the court order could affect the balance between security and privacy. >> it's just one phone now, but if you build that pathway, others will come looking for it and you cannot control who those people are and whether they're going to use it for good purposes. >> federal prosecutors call that an overstatement. they say apple could keep custody of its software without

henley. here it is, by a quarter after 11:00 and the temperatures well into the 40s and still climbing. bright sunshine sending our temperatures above normal today and enjoy the sunshine today. i'm tracking rain that will be arriving during the day tomorrow. the first round will be pretty light, but heavier downpours later on wednesday, even into thursday along with gusty winds. this morning can't beat it, 44 degrees in allentown and northeast philadelphia and 47 and bright sunshine at the shore and 48 degrees in atlantic city and look at that, a beautiful, sunny view from cape may from the lafayette hotel. a little bit of a breeze going and it's been staying below ten miles an hour for most of the morning and millville and wildwood. over the next several days, the coming storm will bring much dustier winds to our area come mid-week. right now the clouds and the nearest are to our south and farther to the south we'll find the rain that is falling from texas into arkansas, louisiana,

mississippi and alabama. there is the potential for severe weather in the deep south tomorrow and then it will be marching our way, in fact, first thing tomorrow morning we'll start off dry. this time tomorrow morning at 11:00 and a little bit of rain in delaware and spreading into south jersey arriving in philadelphia midday. we'll be watching one area in the allentown area and upper bucks county and there may be snow mixing in, but the temperatures at the surface should be above freezing. it doesn't look like it will pose a problem and then it changes over to rain and there will be a lot of warm air coming into the system. but if you're looking for sunshine, today is the day to enjoy it. it's a beautiful day for skiing. upper 40s in allentown and redding. doylestown and mount holly. at the shore, sunshine has taken over and is upper 40s while it s out in vineland and you'll see sunny skies in dover and for wilmington and drexel hill and

philadelphia all reaching upper 40s and low 50s this afternoon. but tomorrow, we'll start off colder as clouds move in overnight tonight. it should be dry first thing in the morning at 33 degrees and then warm air pushes in before the rain arrives and we're looking for rain through the day on tuesday through the afternoon and into the evening hours and then it takes a break and then we get another round of wet weather and this time heavy rainfall coming through wednesday night and thursday morning along with strong, gusty winds likely to top 30 miles an hour, but it keeps us warm. 52 degrees wednesday and 55 degrees. thursday, we'll be drying out on thursday. the clouds finally break and the wind stays with us and bring you the chill back for friday and saturday. by sunday, though, sunshine and up to 50 degrees. thank you, bill. stopping the spread of the zika virus. we'll take you inside the texas lab which says it's the first in the country to run its first tests for zika.

on saturday, another one of our communities was terrorized by gun violence. as many of you read, six people were gunned down in the rampage in kalamazoo, michigan. before i joined all of you i called the mayor, the sheriff and the police chief there and told them that they would have whatever federal support they needed in their investigation. their local officials and first responders, by the way, did an outstanding job in apprehending the individual very quickly, but you've got families who are shattered today. earlier this year i took some steps that will make it harder for dangerous people like this individual to buy a gun and we need to do more if we'll keep innocent americans safe and i've got to assume that all of you are just as tired of seeing this happen in your states. so that's an area where we also need to partner and think about what we can do in a common sense

way and in a bipartisan way without the ideological rhetoric that so often surrounds that issue. a second area of threats that we're focused on is cyber threats. the technology that connects us like never before also allows our adversaries to do us harm. hackers and nations have targeted our military, our corporations and the federal government and state governments. they're a threat to our national security. they're also a threat to our economic leadership. they're a threat to our critical infrastructure. they're a threat to the privacy and public safety of the american people. this is a complex challenge and we're not going to be able to meet it alone. we've made a lot of progress these past serve years including sharing more information with industry and with your states, but all of us are still vulnerable. this is why earlier this month i

running on the lower level of the house and the family had turned it on during a power outage friday night. a driver is credited for saving lives when his bus burst into flames and the mega bus caught fire on an illinois highway yesterday. all 40 passengers got off the bus without injury and one passenger heard a boom and saw black smoke and investigators are looking into the cause. several recent rock slides have closed part of the central west virginia highway. no one was hurt. state officials brought in heavy machinery to move the boulders off the roadway and break them down. snow melt and rainfall often cause rock slides in the area this time of the year. the supreme court is meeting for the first time this morning since the death of justice antonin scalia as speculation swirls over potential successor. scalia died in texas on february 13th. he was buried on saturday. president obama whas vow to nam

a candidate to take his seat and they say the choice should await the next president. two lancaster county artists say they are nearly finished with two staff us of joe pate o paterno. these are replicas of this statue that was removed after the sex abuse scandal involving jerry sandusky. penn state won't tell them where it's being kept right now. that's one reason why they're making new ones. they posted video of their work on facebook and the new statues won't be exact copies and one statue will go to the paterno family and the other will travel around for penn state fans. >> it's being called a game changer and the texas health department opened the first lab for the zika zire us virus with faster results. the results are back within 24

this is nbc 10 news. new evidence shows heavier teens may have an increased risk for one kind of cancer and israeli studies suggest obesity raise the risk of developing non-hodgkin's lymphoma by 25%. overall excess weight is is for non-hodgkin's lymphoma cases. >> new research suggests drinking more coffee could help reduce liver damage.

and is hoping to raise awareness for hope of a brighter future. justin is here along with brad marsh who is taking part in the charity hockey game coming up this weekend. and i'm not sure i pronounced the diagnosis correct it's an inflammation of the colin, very similar to the crohn's disease and it's very difficult to tell the difference between them and it causes very bad diarrhea and tremendous weight loss, loss of energy and children have problems with size from it and for me it was developing into full-blown colon cancer. >> what's your life been like with it? >> the last 12 years have been very differ culicult. a lot of ups and downs and being invited to parties and not being able to go. asked to do things like go skiing and you can't be near a bathroom and you can't go skiing and very limiting. >> but you helped this foundation to raise money and awareness so tell us about that, that foundation.

>> i started last year and checkmate's charitable foundation and want only money as important as it is to raise money for these diseases and it's awareness and we played against the flyers' alumni and this is the second year doing it, and i know it's too late for me to find a cure, and i have two little girls who were at a much higher risk of doing and that's why we're doing this. >> so, brad, tell us about your association with this event. >> the flyers' alumni there are a whole bunch of guys who have lived in the area and joe watson has done a great job for a number of years keeping us all together and we're more than happy to help out with charitable causes such as this one on saturday night and we played a dozen games a year in and around the area and it's a lot of fun to get out on the ice and bank some bodies. as the hockey fan is one of a kind and bob callie is playing from the boy days and everyone wants to get hit, and it feels like the old crashing into the

board. >> i'm a former eagle and i have to say, of all of the local sports teams, the flyer alumni is by far the best alumni of all of the local sports teams, and i think part of it is because you guys do stuff like this. you guys help out with charities like this. >> and we love it. you know? we love the dressing room. as a former player, everyone asks what do you miss about the game and it's great fun and before the game and after the game we're ripping each other on how slow we actually are now, but justin has a great party and they are lined up afterward and that's where it's fun because not only do we see each other again, but we get to meet like-minded athletes and fellow hockey players. >> and you shared some stories. >> as former flyers, you guys associate more and do a better job with that than folks like justin and people out there. the rank and file and your fans

just for former flyers players and everybody ought to enjoy sunshine on a perfect afternoon and it opens up at 1:00 this afternoon. temperatures are climbing 48 degrees in philadelphia. we will go a bit warmer into the 50s this afternoon and look at the spring skiing conditions in the mountains and this is camelback. bright sunshine and the temperatures are above freezing and the perfect day for skiing. dry today. we saw rainfall overnight with the rain out of the way and the clouds have warmed up, 38 degrees in mount pocono and already 50 degrees in cape may. everybody seeing sunshine. this is where we saw skies clear out first thing this morning. we got cold tore start with and we have another round of cold coming in tonight, but it stays dry overnight tonight. see the clouds in the south? we're looking for wet weather we have to go much farther to the south into louisiana, mississippi, alabama and that is a storm system that will work its way our way tomorrow morning and we will start the morning

commute and by 11:00 in the morning that's light rainfall falling in philadelphia and delaware and south jersey. it's still colder in the atmosphere north and west and we may see a brief period of snow coming through 1:00 in the afternoon, but i'm expecting temperatures to be above freezing and eventually the warm air wins out and it has rained by 5:00 in the afternoon and a steadier rain at the shore and we can see an inch of rain by 5:00 at the shore and then we get a break later in the evening. the first round of rain will be out of here and then we'll be watching for the next one and potentially a heavy rainfall coming through later on wednesday. today, though, nothing, but sun shooib and mostly sunny skies, nice and mild, temperatures in the low 50s and that little bit of a breeze that we've had so far, that continues and we'll continue drying out today. tomorrow we go the other direction. 33 in the morning and a colder start, 44 in the afternoon, rain arrives during the day, but the warm air moves in first so we should be doing fine on the

roadways tomorrow. >> wednesday, even warmer and windier and heavier rain, too. and that heavier rainfall comes through wednesday night into thursday morning and look at thursday's temperatures. 50( in the morning and 55 in the afternoon and it will stay mild all day and the rain comes to an end on thursday. sunshine will break through the clouds on friday, but the wind will still be here. it's going to keep us chillier heading into the weekend. down into the 20s over the weekend to start with and even though it will be chilly on saturday we'll see a nice warm-up sunday afternoon to 50 degrees. we'll be right back.
