because of a cell phone and a text message. in this newly released surveillance video from a corner store on west 49th and walnut you see the suspect with a red umbrella and khaki pants. >> at one point you see the father walk past this individual as he's standing in the rain. >> what you don't see is what was inside of the 2013 white town and country minivan, a 4-month-old baby boy, his faeft left him and his cell phone in the running vehicle. when he steps out and back to the van, the suspect is watching. >> he probably doesn't want to wait for a bus, it's a rainy morning. sees the engine running. >> as the father walks back in the store for a second time his van with his sleeping infant is driven away. it was a frantic few moments for the father. once he realized his child was gone he used a traininger's phone to text his. >> gets a text back to a phone he borrowed.

>> reporter: police rushed to the area. leaving neighbors stunned and sad. >> horrible. i mean, anybody who would just leave a child out in the rain, that says volumes that they have no concern. >> reporter: and police are still searching for the young driver as well as the van. anyone with information should give police a call. they tell us this is a reminder why you never leave your car running especially if your children are inside. the good news is that child is at home with his parents. reporting live, pamela osborne for "nbc 10 news." >> we have breaking developments in the shooting death of a maryland police officer originally from delaware county. in the last hour police reveal that officer colson who was killed in southern maryland was killed by friendly fire. right now three brothers are

under arrest in the case, they are looking for a fourth. investigators say evidence shows the gun men intended to die during a gun battle. they called officer colson a hero. >> he took action and in doing so demonstrated extreme heroism because it was his actions that allowed officers to take a position where they could intervene and neutralize the threat. >> the officer's family was attending the news conference a short time ago. tim furlong has more on officer colson's life and the legacy he leaves behind in his hometown. >> was like a punch in the stomach. >> reporter: word spread among the faculty this morning, lots of people remember 2005 graduate jacai colson and can't believe he was the understood cover officer killed outside of washington. they remember the student council member and athlete as a respected leader among his peers. >> did it the way we want our students to do things, graduated

>> a live look from the camera atop the loews hotel. it's raining and somewhere you can see the ben franklin bridge in the distance. it's tough to see anything through all of the clouds and the rain. nbc 10's glenn "hurricane" schwartz with his first alert forecast. >> glad you're feeling better and back. you know, losing that hour of sleep what is supposed to make it better is the extra hour of sunlight which we're not getting today. >> yeah. and the scene behind me and the scenes that you saw don't exactly make for a bright start to the week. but it's not going to stay like this the whole week. we have a wet commute home, but at least we can see the visibility may not be that good tomorrow morning for the morning commute. so, might be a little more difficult then. right now we don't see very much on the radar. just some tiny drizzle drops too small to be detected by radar.

and in other places cloudy. we don't have the significant rain that has moved off into new england. the temperatures generally in the 40s, across the area. kind of uniform when you have cloudy skies and persistent east wind. and the temperature, it starts creeping up a little bit as the wind comes down. but the temperatures go way up and yes, the sun will return and i'll let you know when with the seven-day in a few minutes. new at 6:00, a scary ride for septa passengers when their bus crashed into a philadelphia bank this afternoon. nbc 10's denise nakano is live with more on what happened here. >> reporter: one look at the aftermath of this crash and it's a wonder no one was seriously hurt. it happened around noon at old york road in the city's fernrock section. septa says 7 to 10 passengers were treated for minor injuries and you can see the bus coming within feet of the bank's

entrance. no one was outside the bank at the time of this crash. no word on what caused the driver to go off the road. officials were called in due to concerns of structural damage to the building. denise nakano, "nbc 10 news." police say an argument over a sports team led to a deadly stabbing at rittenhouse square. police released the mug shot of the suspect today, there he is, steven simminger charged with murder now, police say he was walking by as the victim and friends were getting out of a cab. someone made fun of simminger's devils cap that sparked a fight. >> the decedent is actually on top of the suspect and he stabs him a couple of times from underneath him. >> simminger showed up at a hospital with a cut on his hand which helped lead to his arrest. new at 6, a judge in

harrisburg will make a ruling that could decide whether john kasich can stay on the ballot in pennsylvania. marco rubio supporter filed an objection because he said kasich did not have enough signatures to be on the ballot here. the kasich camp argues that was filed about 15 minutes past a deadline and should not count. today both sides haed to file arguments with the judge before a ruling was made. it's important to note that right now kasich is on the ballot in pennsylvania. in the race for the white house stom mega tuesday with primaries in five big delegate rich states. the biggest battles in florida and ohio. the in wither of those gets all of the delegates and they are also the home states of marco rubio and john kasich so it's critical for them to rin. donald trump starting his day in north carolina with new jersey governor chris christie. christie announced he was endorsing trump after dropping out of the race. criticism continued over violence like this. at some of trump's rallies.

there were scuffles at several events over the weekend. trump rejects claims that he's the one inciting this. fellow republican ted cruz was pressed whether he reconsidered backing trump if he's the gop nominee. >> that is a question the voters are asked. at what point do we say enough is enough. if donald trump is the nominee he is a disaster. and the answer is to beat him. >> marco rubio expressed confidence that he'll win his home state tomorrow, saying he plans to beat the republican field in florida and carry on with his campaign. as for the democrats bernie sanders is denying trump's claims that sanders supporters are to blame for the problems at his rallies. hillary clinton is calling on democrats to unify around her presidential bid. clinton told the crowd the party must focus on the threat of donald trump. for complete decision 2016 coverage including the latest delegate counts and primaries and caucuses, tap the nbc 10

taxes. top republican lawmakers are committed to dealing with the state's deficit without raising taxes. >> the pennsylvania house is considering a bill that would legalize medical marijuana. supporters of the bill rallied in the state house, the senate passed the bill in may. if it's approved patients with certain conditions could use medical marijuana for treatment. a final vote could come later this week. 23 states have legal itzed the use of medical mirna including new jersey and delaware. four states have legalized marijuana for adult recreational use. >> next at 6, a local woman fights to get out of jail early for her role in an attack on a gay couple in center city. why a local judge is sticking by her decision and how long she'll remain behind bars. >> a proposed hike to new jersey's minimum wage is facing a wave of opposition at the jersey shore. >> it would be tough doing business as usual. >> why some say the increase could put them out of business.

a judge refused to cat jail sentence for the woman convicted of assaulting a gay couple. catherine knott will stay behind bars and continue her term. the jury convicted her for the attack and a judge says that sentence imposed was not excessive. considering the injuries to both the victims and the city's image. knott has been in jail for just over a month. state lawmakers continue the push to raise the minimum wage in new jersey. >> but adding money to workers' pockets could cost you. right now the minimum wage in the garden state is $8.38 an hour. the highest in the tri-state region. but if democratic lawmakers get their way pay would nearly double to $15 an hour in the coming years. >> as ted greenberg tells us it's a jump some business owners say they'd be forced to pass on to you. >> reporter: when the surf mall opens in less than a week for the first time this year, wes

tomorrow morning too. along with perhaps denser fog than what we have been seeing. we have warm weather coming in on wednesday but it's not going to be as warm as last wednesday or last as long. you can see across the delaware river, the clouds are very low. and by tomorrow morning you may not even see this well. 46 degrees, a it wille drizzle now. the wind 14 miles an hour but it's not gusting as much as it was just an hour or so ago. the temperature today only got up to 50 degrees compared to that 69 on friday. 61 over the weekend, saturday and sunday. and then tomorrow we're going to jump back up to 60. it's that east wind that has kept the temperature down. otherwise this is pretty warm weather pattern over much of the country. so, we're one of the few places that are chilly. temperatures in the 40s across the region, except for the 36 in

mount pocono. and many places 10 to 20 degrees colder than at this time yesterday. while it's pretty close to the same temperature in delaware and south jersey. the visibility giving us an idea how dense the fog is. less than 2 miles in coatesville and blue bell. that's still i mean that's fog but it's not dense fog. and we don't have any of that reported yet. three miles for international that could slow down some of the air traffic but it doesn't stop it. tomorrow morning, again, visibility should be lower than this across much of the area. as the wind diminishes. we have a couple of sprinkles coming up from the southwest in addition to the drizzle that has been lingering and we have another area of showers in the ohio valley, tennessee valley a spin with that moving in our direction. we could see a little more activity tomorrow morning as well. the temperatures tonight if anything they go up a touch. and you can see some of those

showers coming in by tomorrow morning. and then it warms up. 46 degrees in philadelphia, 42 north and west. the fog develops toward daybreak, continues through the morning hours, maybe a couple of showers in the morning. and then by afternoon might get sunshine and if we do, temperatures go up near 60. the average high is 52 so wednesday, 71, pretty warm, st. paddy's day 62 with a chance of showers. then the shower chance continues on friday before we get really cold over the weekend and some cold windy rainy conditions by sunday. >> i'm john clark. march madness is here. we'll hear, they are all getting ready and we'll show you which phillies slugger is tearing it up this spring.
