cleared, jurors acquitted two philadelphia police officers charged with wrongly beating a man. the two accused of baetding a 23-year-old rivera in a traffic stop in may of 2013. prosecutors say rivera was attacked for no reason after he was mistaken for a drug courier. video found by a girlfriend allegedly shows the officers beating rivera and attorneys claimed they only used the force necessary to subdue rivera. rivera died late last year after he was shot in a street fight in kensington. tonight philadelphia has a new fire commissioner. the mayor named adam teal the latest commissioner today. teal most recently was deputy secretary of public safety and homeland security in virginia. before that, he was fire chief for the city of alexandria, virginia and replaces derrick sawyer appointed two years ago. also today, the mayor blannamed

blanched carney the new prison commissioner. a battle over philadelphia's proposed soda taxes brewing and it's now headed to a movie theater near you. thanks to this ad. you might remember the mayor unveiled the tax proposal during his budget address earlier this year. the goal to raise money for universal pre-k and rec centers and not everyone agrees with the approach. aundrea cline-thomas is tracking the backlash. >> reporter: the ad paid for by the american beverage association. they're putting the money where their mouth is by spending more than a million dollars to defeat this proposal. moviegoers at the pearl theater in north philadelphia won't just be seeing the newest flick. now, think veal to watch this first. some movie theaters are joining a coalition opposing a proposal

to implement a 3-cent per ounce tax on drinks like sodas and some teas. >> we're paying a 5% amusement tax to the city on every ticket sold and an 8% sales tax on beverages that we have and the candies. >> reporter: the mayor has been touring recreational centers emphasizing the tax is for improving education. >> a tax on distributors. >> reporter: some small butzs fear distributors will pass that cost on to them and they would eventually pass it on to you. the consumer. >> to me, it feels like a penalty. to us. >> reporter: concessions and not ticket sales how theaters make a profit. a small soda is already $4. >> paying a fair share to help programs to help people in every neighborhood in this city. >> reporter: while the need is undeniable, for some, it leaves them with a bitter taste.

>> unfortunately, this tax could jeopardize our existence here. >> reporter: now, a similar proposal failed during former mayor michael nutter's administration but he focused on obesity. contrary to that, mayor kenny is to custing on all of the money for children. city council is just starting its budgeting process. live in north philadelphia, aundrea cline-thomas, nbc 10 news. a proposal to place new limits on abortion in pennsylvania is in limbo tonight. republican house leaders pulled that bill from a final vote today amid a veto threat of democratic governor wolf. the measure would ban elective abortions after 20 weeks instead of current ban at 24 weeks and also outlaw procedures that abort fetuses by removing body parts. >> we can get the baby to 24 weeks and have a shot outside the womb. >> incredible the legislature pushes it forward so quickly without any hearings and

opportunity for a reasoned discussion. that to me demonstrates how politically motivated this is. >> no word on when the voting session is rescheduled. a final vote could be close on pennsylvania's medical marijuana legislation. a senate committee made changes to the bill today and backers hope to see it pass in both houses this week. the bill would let patients suffering from a list of ailments use marijuana for they are puttic purposes. the welcome home celebration today was filled with excitement and hope. before the game, the players paraded into the stadium through center field. the team isn't expected to be a playoff contender this year but there are plenty of new, young players to pull for. the phillies lost the game to the padres by one run today. and even though the team didn't win, fans tell us they believe better days are ahead. >> we're in the rebuilding stage so we're heading in the right direction. a couple of years we'll be where

new video tonight of a crime caught on camera and check this one out. three men pried off the door of a business on east huntington. after they got inside, they wheeled out 24 cases of cigarettes worth an estimated $64,000. tonight at 11:00 nbc 10 investigators are holding new jersey leaders accountable. back in february, we exposed delays keeping thousands of hurricane sandy victims from rebuilding more than three years after the storm. and today, investigative reporter george spencer brought their concerns to the commissioner in charge of the largest rebuilding program.

>> can you see the difference? >> reporter: at this home, sandy impacts still linger but they say the program intended to help them rebuild actually caused many delays. a frustration repeated by joe today. >> three and a half years a long time. we are starting to fall through the cracks. people, sandy? you know? it's a long, long time. >> reporter: at a state budget hearing this morning assembly members pushed for answers. >> i'm not trying to be combative. that makes no sense to me. >> reporter: according to state data on the rehe believation elevation and mit take program or r rem 7,781 homeowners have agreements signs and 361 homes or 39% actually complete. the leaders said today he doesn't expect most to be finished until a year and a half from now. >> that will be five years after the storm is that an acceptable timeline? >> no, of course not.

>> the commissioner attributes delays to federal and local governments, more than to his state agency. he says municipalities have changed zoning rules and the feds spread out hurricane relief payments over two years. that sounds like a lot of the blame goes to the federal government then. is that your perspective? >> you know, i don't want to characterize it necessarily as blame. >> delays. >> delays. i think it's legitimate to talk about delays. we have expressed that to the federal government. >> reporter: he said it's in the hands of homeowners and completions spiked in the past five months and after nbc 10's story with this family, they have been assigned a new project manager. >> we have reached out. and i believe finally done it better. >> reporter: joe is still waiting and worried. >> they're micromanaging this so bad and defeating the purpose of this program which is to get people back asap.

than it was at this time yesterday. and we only got to 43 on saturday. remember the snow? 50 on sunday. 69 today. only 62 degrees tomorrow. and that may be in the morning and then temperatures might fall in the afternoon and then only 58 on wednesday. so a little bit below average temperatures. nothing too extreme. nothing like the weekend. temperatures in the mid-50s to near 60 degrees right now which is pretty warm for this time of the night and all because of those southerly winds. 15 to 20 miles per hour from philadelphia southward and that's going to start the day off pretty, pretty warm. it's not going to end up as warm as it starts. look at the zone of rain. solid area of rain coming in just in time for the morning rush. there we have 5:00 a.m. look how warm it is. 60 degrees plus. still 60 at 8:00 a.m. still raining. and then as we go toward 10:00, 11:00, it is ending at philly

and already getting sunny. in the lehigh valley and burks county here. and then by 1:00 it's ending at the shore. and the temperature doesn't really go up a whole lot. now, for the phillies, totally different kind of weather pattern. it is going to be dry tomorrow night for the game and this time the wind blowing from the left field to right. and the temperature, of course, not nearly as high as it was today. we're dropping through the 50s into the upper 40s tomorrow night so won't be as easy to hit the ball out. windy and warm tonight with a chance of rain by dawn. 56 degrees for the low. and then tomorrow these high temperatures generally occur early. may drop in the afternoon. rain in the morning. sunshine in the afternoon. the rest of the week is dry. temperatures a little bit below the average of 62. until we get to sunday. and then we get to 70 and then monday 76.
