nbc 10 news starts now. students charged. delaware's department of justice charged three students with the death of a classmate. funding crisis 101. cheney university has a $19 million deficit. and tracking showers right now temperatures are in the 50s with a chance of light rain this morning and this afternoon. it's 57 degrees. 4:00 a.m. good morning. this is "nbc 10 news today." i'm tracy davidson. let's get right to meteorologist bill henley with his first alert neighborhood forecast, a close look at conditions at communities across pennsylvania, new jersey and delaware and bill, tell us about the showers. >> not too many of them. lots of clouds. a few scattered light showers. you have to look close to see

the few sprinkles that are coming through the philadelphia area right now. those are extremely light showers that are in gloucester and camden counties. those showers are moving to the east. there are more showers in our future. but most of the day it is going to be dry. especially this morning. better chance we'll see showers around midday and into early this afternoon. the temperatures, that's another story. it's a cool start this morning. it's going to be a chillier day overall. 40s and 50s right now. we'll see afternoon temperatures only in the upper 50s to low 60s. 57 now in society hill in the not much warmer this afternoon than it is right now. parkside, 53 degrees. cool in northeast philadelphia at 51. seven-day forecast at the bottom of the screen. there's a better chance of seeing rain later in the week. the futurecast when i'm back in ten minutes. katy zachry has the traffic right now. >> a smooth commute if you're

getting out early for work or school. the schuylkill expressway right at city avenue, a few early commuters on the roads but nothing to tell you about that will issue you any delays on 76. 676, the vine street expressway is closed between 76 and 95. we'll have a live picture of that coming0up in about ten minutes. there are detours in place. that should be in effect until 5:00 a.m. other majors, 95, 476, everything free and clear. there may be overnight construction on 95. it's not tieing anything up. new jersey on the 42 freeway, this stretch gets very busy as we come into the morning commute. your drive times between 95 and the walt whitman bridge, just about five minutes. we'll following breaking news out of germany where one person is dead at an attack at a train station near munich. this is video just into our newsroom at the scene. the man was quickly arrested.

the authorities have not called this a terror attack but are looking for a motive. new from overnight, philadelphia police are looking for the driver who hit a bicycle rider and took off. you can see the mangled bike at 52nd and spruce in west philadelphia. the man riding the bike was taken to the hospital. now in critical condition. three wilmington high school students face charges in the death of a 16-year-old classmate. police say the bathroom brawl was planned. matt delucia is live in wilmington and, matt, tell us about the charges that these suspects are now facing. >> tracy, all three are under the age of 18. prosecutors say only one of them hit the victim. she faces a charge of negligent homicide and two others face criminal conspiracy charges. prosecutors are also telling us that the 16-year-old amy joyner-francis, the attract against her was planned. they say she was repeatedly hit in the head and torso with a closed fist.

prosecutors are hoping to try that one suspect, a 16-year-old, as an adult. if convicted she could spend up to eight years in prison. the other two are expected to be tried as juveniles. wilmington councilwoman and family friend sherri dorsey walker says the victim has a strong and loving family that has come together in the midst of a tragedy. >> the family is in a state of grief at this point. and understand that people have to do their jobs and get the story but at the end of the day, there's still a life that's lost and that life belongs to that family. right now they're heartbroken. >> prosecutors tell us the medical examiner found amy had a pre-existing heart condition that is how she died but that the physical and emotional stress of the attack contributed to her death. we are not naming the three suspects because they are under the age of 18. coming up at 4:30, what the school district is saying about this and a call to end bullying. live in wilmington, matt

delucia, nbc 10 news. a man from allentown will not face the death penalty if he's convicted of murdering his girlfriend. prosecutors announced that decision at william bratville's arraignment yesterday. the woman's body was found inside a recycling bin in february. he's accused of shooting at police while they investigated the murder. funding for cheney university will be the topic of a public hearing with three state lawmakers. cheney is the nation's oldest historically black college. it runs a deficit ofç $19 milln and enrollment continues to fall. today's public hearing on funding will be hosted by three state lawmakers. the philadelphia streets commissioner charged with assault is off the job until further notice. police say donald carlton attacked another man after an argument escalated into a fight

at this home in olney last december. sources close to the investigation told nbc 10 carlton thought the man kissed his wife. the alleged victim said he suffered a black eye and fractured rib. a neighbor told us she witnessed the attack. >> i heard a loud noise and people screaming. when i looked out the window, as you can see from there. >> carlton faces simple assault and reckless endangerment charges. both misdemeanors. he'll face a judge next month. in south jersey, an escaped inmate is back in prison after nearly a week on the run. arthur buckle was caught in lacey township, ocean county. he dodged search teams since breaking out of the ancora unit in bayside state prison last week. he previously present 14 years in prison for killing a baby. neighbors told us they're relieved the manhunt is over. >> we're glad they got him.

but it is pretty scary it's this close. >> it was unnerving that he was just getting away. now that it's over, thank god. >> buckle was just days away from a parole hearing when he escaped. he faces new charges and could spend an additional three to five years in prison. the franklin institute says it will explore all its options after a judge ruled it has to change the way it treats the disabled. the judge ruled the museum violated the rights of disabled guests by forcing them to pay an extra entrance fee for their caretak caretakers. the policy takes away their right to full and equal access. the court ordered the franklin institute to waive double entrance fees. the institute says it serves the community in many ways and decision agree s -- disagree with the court's realing. now your first alert weather

with meteorologist bill henley. >> clouds coming into area today. those clouds are already here. we're going to see a nice shower or two. light showers in the area this morning. currently 57 degrees at 4:08. the temperatures are going to be holding steady to start with, mostly cloudy skies. not too many showers around this morning or this afternoon. there is a chance you'll run into a few showers. right now, 57 degrees in philadelphia, 40s in the suburbs. and the shower activity will be very limited for unionville, exton where it's 53 degrees right now. but also limited, the warmup this afternoon. warrenton is at 50 degrees currently. satellite shows the clouds are moving in. they're not complete cloud cover. not like we saw for much of the day yesterday. there are a few scattered light showers, moving through south jersey. the chance of showers will be with us this morning. really later this morning and early this afternoon. that's when we'll see a better chance of showers, a few rain drops in clayton head, towards

winslow and mullica çtownship. while the steadier rain is to the southwest. this will be affecting d.c. before it gets into philadelphia. around 11:00 this morning, scattered, very light showers in northern new castle county and delaware and in central delaware and into the cape may area, mostly cloudy skies for philadelphia. at 11:00, a few rain drops as well. as we go into the afternoon, not everybody seeing the rain. you can see many of the suburbs staying dry. philadelphia dry at 1:00 according to this computer model. a chance of scattered showers in south jersey and delaware. you might need umbrellas at times. it won't be a heavy rain and it won't last that long. by 9:00, the clouds are starting to break. here's a breakdown of your day, philadelphia, cloudy skies to start with. through the commute, most areas will stay dry. 53 degrees. much cooler this afternoon. won't see the 70s today. 58 degrees with scattered light showers during the afternoon hours. for the suburbs, clouds will

hang in there and a chance of an afternoon shower, 56 degrees at 3:00. mainly dry for the lehigh valley. but mostly cloudy, too. 47 this morning. by 11:00 this morning, 54 degrees. and to the south, delaware, new jersey and the jersey shore, there's a chance of some showers in delaware and at the shore. less so in interior new jersey. can't rule out a shower completely. clouds, those will be going to staying for most areas, keeping temperatures cool. it's a one-day cooldown. something you may have noticed. there's 70s there. take a look at their arrival with the ten-day outlook when i'm back in just a few minutes. >> we'll see you in a few minutes, bill. thanks. ten minutes after 4:00. let's get you to work. first alert traffic reporter katy zachry has that. what are you seeing there? >> when i last saw you, we showed you some of the majors in the pennsylvania area. now we'll focus on delaware. 95 in and around the delaware

area. your drive times between 295 and 495 on 95 northbound just about 11 minutes, just a minute less if you're headed southbound. not too bad. a live look outside, this is 76 -- actually 676 at 24th street where you can see the absence of any cars, that's because of vine street expressway is closed until 5:00 a.m. between 76 and 95. so there again, the vine is closed. no traffic. i'll let you know when that opens. finally for our viewers in the lehigh valley, a live look at 78 at cedar crest boulevard. a few cars on the road. very light volume. imagine having your neighborhood trashed. that's the reality for some people living in the small town of centerville, new castle county. next, phone out what they're doing to stop a serial litter bug.

4:14. 57 degrees outside this tuesday morning. from our delaware bureau, home owners in new castle county want to find out who is trashing their neighborhood. route 52 in centerville is one of delaware's prettiest roads. for some time, someone has been randomly throwing trash along a stretch of the road from centerville to greenville. neighbors have called the county but they haven't been able to track down the people responsible. >> people who live here take great pride in the community. it makes us sad. >> we have a tough time understanding why they're doing it. >> one resident started a catch the trash bomber facebook page. a reward is being offered for information. now to decision 2016. two more presidential primaries today will move us closer to the general election in november. nebraska republicans head to the

polls for a primary. so do voters in both parties in west virginia. all eyes will be on the democrat ek candidates who are still fighting it out for the nomination. senator bernie sanders is looking ahead to the primary on june 7th. he cam paned in atlantic city yesterday. sanders took aim at the city's casino industry for its greed and mistreatment of workers. he also called out presumptive republican nominee donald trump, who once owned three of the casinos in town. >> oh, i get it. you don't think he is a brilliant, successful businessman? who can bring the kind of prosperity to america that he has brought here to atlantic city. is that your point? >> sanders says his campaign is not overç despite a narrow pat to the nomination. democratic front-runner hillary clinton is also targeting donald trump. campaigning in virginia yesterday, she called him dangerous. >> i was asked the other day what i mean by calling him a

tornados had wind speeds higher than 100 miles an hour. and this is the damage that same store caused over the weekend in wyoming. rising water washed out roads and flooded several homes. no one was hurt. that massive storm system will continue moving east today. leaving millions of people in several states at risk for severe weather. >> now your nbc 10 first alert weather with meteorologist bill henley. >> cloudy skies and dry at the shore. that's wildwood. lots of clouds around today. just a few scattered showers at times. through it all, it's going to be cool. 57 degrees right now in philadelphia. 40s for the suburbs. not quite as chilly as yesterday morning. the temperatures are still falling at this hour. clayton is 54 degrees. cinnaminson, 43 degrees and pemberton at 53 degrees. temperatures, upper 50s for philadelphia. lots of clouds and just a few scattered light showers. the suburbs upper 50s for

lansdale, bethlehem, 59 degrees this afternoon. and south jersey and at the shore, just into the 50s today. delaware, same story. a few scattered showers. lots of clouds and 50s, nowhere near the 70s that we saw yesterday afternoon. the futurecast joined cloudy skies at 10:00 for philadelphia. you can see the scattered showers that are just to the southwest that will be moving in at times during the afternoon. that's 1:00 in the afternoon. as we go into the later afternoon hours, showers are staying to the south. that's 2:00 in the afternoon. for the evening commute it will be largely dry. that won't be the last chance of showers. there is a possibility with clouds around tomorrow, late in the afternoon, another round of showers. though it will come with a warmup. first thing tomorrow morning about this time, partly cloudy skies. the clouds won't completely clear out tomorrow. during the morning hours, it's dry. but during the late afternoon hours, a chance of some showers. that's tomorrow. so looks like heavier showers for tomorrow. today it will just be some of

drive times southbound between wood hhaven and the vine, a 13-minute drive. for the northbound drive during that same stretch is only about 13 minutes. a little slow up on route 100 in chester county, probably due to construction. i'll check the camera. that just changed since i came out here. route 30 and 202 all clear. chester conte drivers, all clear. and 295 and 42 freeway, everything is looking good. you're headed southbound between route 38 and 168, that drive will take you 20 minutes. that will only take you five minutes. for drivers in and around philadelphia, i've been reminding you about of the vine street expressway between 95 and 76. the vine street expressway is closed. that should lift around 5:00 a.m. i'll keep an eye on it and let you know. >> thank you for that.

24 minutes past 4:00. today gloucester county will go fishing for mosquito larva that could grow up to spread the zika virus. officials plan to release thousands of mosquito eating fish like this one into retention ponds around the county. one of those pounds is at the west deptford library. state officials provide the mosquito eating fish each year. we checked the cdc website. as of now, the zika virus has not been spread by mosquitos inside the u.s. but it has turned up in people

two traveled to places where outbreaks are common. zika virus is linked to severe birth defects. eagles quarterback sam bradford is back to work two weeks after he asked the birds to trade him. you're looking at bradford at the nova care complex for volunteer workouts yesterday. one eagles player told comcast's john clark that everyone is happy to have the starting quarterback back. his agent and bradford tried to force a deal when the eagles drafted carson wentz. the business side of football is sometimes a necessary. fan reaction to bradford's return was mixed. >> it'sç definitely a situatio. you come in and work and prove it, you show them this is why they pay me the money. >> i hope he does well.
