>> do you not talk? i'm going to ask you one more time. >> the driver refused to say anything. >> you're going to be placed under arrest if you don't answer my questions. >> so she was taken away in handcuffs. tonight a new lawsuit. do you have to answer a police officer's questions? good evening, i'm jim rosenfield. >> and i'm jacqueline london. the driver in that video is a lawyer who lives in philly. she says she knows her rights and she did not have to speak. nbc 10's brandon hudson is here with details. >> jacqueline and jim, she is an attorney who grew up in a law enforcement family. after this arrest, she feels her civil rights were violated and now feels nervous around police. >> get out of the car. >> reporter: nbc 10 obtained this dashcam video from new jersey advance media of rebecca musera's traffic stop last october in warren county, new jersey. for rebecca, it's tough to watch. >> it's not comfortable watching

it. it really is not. when this happened, i was scared. i was frustrated. i was angry. i was shaking. >> reporter: new jersey state police troopers arrested and charged her with obstruction. rebecca says it's because she didn't answer the state trooper's questions after she was suspected of speeding. >> i said i had a right not to answer his questions. i was an attorney. i knew i had a right not to answer his questions. >> reporter: now rebecca filed a civil rights suit against the state of new jersey, state police and the trooper who af d arrested her. she wants to hold police accountable for violating her rights. rebecca's attorney says this violates her civil and federal rights. >> they had every right to stop her and give her a speeding ticket if they wanted to but did not have a right to arrest her simply for not answering questions. >> rebecca, whose parents were in law enforcement and grandfather was a sheriff wants answers. she wants to know why a trooper arrested her. and if it's a policy that needs to be changed. >> police have a really hard job

to do and i respect that job. but it's made more difficult when there are troopers and police officers out there who don't respect the law. >> the public has to trust the police who carry badges and guns, know their limits and when police exceed those limits -- >> we reached out to new jersey state police and the attorney general's office which represents them. because this is pending litigation, they have no comment but to say, "the traffic stop is the subject of an internal review." live in studio, i'm brandon hudson, nbc 10 news. a mother's final act could help convict her accused killer. >> prosecutors say before her boyfriend shot and killed her, she hit record capturing her own murder. nbc 10's drew smith reports from chester county. >> reporter: schuylkill township has gone decades without a murder case until now after an argument inside this home turns deadly. investigators say keith smith fired his shotgun at girlfriend

wesley webb then reloaded and shot himself in the face but he's expected to recover. >> like me coward, he flinched. >> reporter: chester county district attorney says webb seen here from a memorial page used her phone to record audio. court documents show smith cursed after shooting and said, how's that, that's where we just went. three kids came downstairs, saw the bloody scene and called 911 to. >> hear the kids' reactions is as a parent something that's hard to listen, to very disturbing. >> reporter: webb was on the board for the west end fire company in phoenixville. there's a bar next door where she worked for ten years. >> she was friendly. she worked here for a long time and everybody liked her. >> reporter: dick says he saw webb and smith here together just hours before the crime. everything normal? >> yeah, it surprised me. surprised everybody i guess. >> reporter: a recent change to the state wiretap act means her recording is admissible in court. >> it really is, like, her voice

coming from the grave and reaching out to make sure justice is done to the man who murdered her. >> reporter: a final act which the d.a. says is now powerful evidence. in chester county, drew smith, nbc 10 news. the man accused in last week's road rage shooting on the blue route is behind bars tonight. officers arrested anthony richardson on attempted murder charges. state police say tips from the sketch on the left led them to richardson's home in overbrook. this video of richardson being led out of the state police barracks in wynnefield earlier today. he is accused of shooting into another driver's car just before rush hour near conshohocken. the bullet did not hit the victim. in decision 2016, hillary clinton is focused on new jersey with less than a month before the garden state's primary. >> she made two stops today in camden county. clinton made a surprise stop at anderson cancer center in camden and earlier in the day she spoke

to a packed house at camden county college in blackwood. clinton issued a challenge to new jersey voters. >> i don't want to put any pressure on anybody, but we did really well in pennsylvania and delaware. we will have a big victory on june 7th that will take us all the way to the white house. >> clinton focused more today on donald trump than on bernie sanders. and tomorrow donald trump is planning to meet with house speaker paul ryan. >> ryan still hasn't endorsed trump. tonight trump campaigned on long island hours after he defended himself on taxes for the first time today. trump suggested that an irs audit may not be wrapped up before the general election. trump may end up the first major party nominee in 40 years not to release his tax returns. that as his fellow republicans remain divided on many of trump's positions like immigration reform and trade. >> combine that with all these

incendiary comments. all these issues have obviously unsettled a lot of us. >> today paul ryan met with members of congress who support trump before he meets with trump tomorrow. as we said, with all this political turmoil, some voters are looking for a third party alternative and they're leaning libertarian. >> nbc 10's keith jones is here with a closer look. >> jim, jackie, new jersey is seeing a dramatic increase in libertarian, only trouble, many people couldn't name their presidential candidate. have you ever heard of gary? >> no. >> no, i'm not familiar with him. >> no, i have not actually. all i've heard about was the three candidates. >> reporter: they know trump, hillary and bernie. you voting for gary? >> oh -- >> reporter: scary as in gary johnson the libertarian party's presidential candidate. the choice for voters tired of the big three. >> we're the only growing party. >> reporter: patrick mcknight chairs new jersey's libertarian party. >> about 40% of voters are independent which is a record number, and we're getting a

large number of those because people are disenfranchised with both major parties. >> reporter: mcknight said they've seen a 23% drop in membership in the mast ten weeks so why the confusion? have you ever heard of gary? >> gary? >> the biggest obstacle is we're not allowed to participate in the debates even though we are on the ballot in all 50 states. >> reporter: and that makes it tough to reach frustrated undecided voters like victoria simon. >> i'm not happy with no one that's going for president this year. >> reporter: if you were to lean forward one of the other, trump or the presumptive nominee, hillary -- >> i wouldn't vote. >> reporter: as for those on the fence -- >> i would lean toward bernie but if hillary gets it, she's all right, but i'm interested in seeing what other options there are, if there are any. >> yet there are. a lot of people we talked to tonight didn't know it, yet momentum is growing in one north jersey county. voters registering as libertarians increased 41%. keith jones, nbc 10 news.

>> all right, keith. two days ago, donald trump named nrch new jersey governor chris christie chairman of his white house transition team, a move having some in the garden state calling for him to resign. they feel state issues could fall to the wayside as the governor takes on more responsibilities but today christie insisted his job as governor would come first. he said working for trump would not keep him out of the state that much. >> as some of you may know about presidential transitions, the chairman's running the show and i will do that and i will make the major decisions that need to be made. in the end, a lot of the work will be done by men and women who will volunteer their time as traditionally has happened. >> governor christie stopped short of naming any other advisers being considered for a possible trump white house. an update on a story we first brought you last night. a father accused of barricading himself inside his home with his 5-year-old son is now facing a slew of charges. philadelphia police say stanley

rikowski pointed a gun at his wife and said if you won't walk away, i'm going to shoot you. skyforce 10 was above the scene as police arrested him in frankford last night. police found a loaded gun at the home. tonight, we have learned the man accused of going on a stabbing spree in massachusetts sought help for a mental illness the day before those attacks. family and friends talked about the suspect, arthur derosa today. police say he stabbed at least four people in two separate attacks at a house and a shopping mall in taunton. two victims died. derosa told his family he was suicidal and checked himself into a hospital on monday but he was treated for anxiety and sent home. >> the ambulance picked him up at 5:00 p.m. on monday. they discharged him at 4:00 a.m. on tuesday. they didn't treat him for what his sickness was or his mental illness. they treated him for something else. >> an off-duty deputy shot and killed derosa ending the

stabbing spree. a deliberate criminal act, that's what the federal investigators are calling the deadly 2013 explosion at a west, texas, fertilizer plant. cell phone video captured the moment. the fire caused chemicals at the pla plant to explode killing 15 people. officials originally blamed the blast on improper storage of the fertilizer but say they eliminated accidental and natural causes. the force of the blast was equivalent to a 2.1 earthquake. tonight chester county residents are fighting to keep the chemical plant out of their town. nbc 10 there tonight where those against the plant presented their arguments to township officials. day fear the plant would store toxic and extremely hazardous chemicals near ball fields at hickory park. tomorrow marks exactly a year since the deadly amtrak derailment in port richmond and today we learned the national

transportation safety board will announce the probable cause of the crash during its board meeting next tuesday. the train was going 106 miles per hour around a curve where the speed limit was 50 miles per hour. eight people died. more than 200 were injured. and nbc 10 will have complete coverage tomorrow. we will talk with passengers who survived the crash. we're also looking into what's changed with sast cifety on thes in the past year. a dog shot and left to die. the search for the person responsible and who's stepping in to help him recover. also, doctors arrested accused of pushing pills. how investigators say they made the city's drug problems even worse. the facelift coming to the iconic statue on top of city hall. and we have more showers in the forecast before the week is over. even thunderstorms. i'll show you which part of your weekend you can also expect it. that's next.

this pit bull is being called a miracle. it survived being shot in the head and leg and left to die in cumberland county. the dog was found back on may 2nd lying on a road in rural commercial township. the millville-based tlc animal rescue is working to get the dog. who's named mr. biggs healthy enough for adoption. >> i could not believe somebody would do this to this dog. he's so sweet. he just wants love. he wants to crawl in your lap and just hug you. >> animal cruelty investigators are still looking for whoever attacked the dog. three local doctors accused of pushing prescription pills to addicts and dealers. >> nbc 10's denise nakano is in south philadelphia where prosecutors say they put a stop to a mastermind behind a well-known pill mill. >> reporter: a medical clinic that was supposed to help people drove them further into addiction according to prosecutors. >> the doctors who were charged

in this indictment are alleged to have become simply drug dealers. >> reporter: prosecutors say dr. alan somers sold prescriptions for cash out of an office on south broad street near wolf which is now shut down. a 47-page indictment says he enlisted the help of two other local doctors to make $5 million off customers. many people i spoke with tonight were very familiar with the doctor's practice and those who did not know him firsthand knew about the line that stretched around the building all hours of the day. >> the line would be from that door all the way around the corner. >> lines. security guards out here and everything. yeah, they had security guards, armed security guards. >> reporter: the doctors sold prescriptions for a drug used to treat addiction and an antianxiety medication. it was run without exams for patients required by law but the attorney for dr. somers says the medical treatment he provided was medically necessary and that the generally accepted standards

tomorrow afternoon. bethlehem, 77 degrees. reading 77. you'll just see about mostly cloudy skies. so still some sun peeking through. phoenixville, 76. tomorrow, newtown, coming in 75 degrees. philadelphia area, mostly mid 70s. 76 biberry. tomorrow, new jersey, like haddonfield, glassboro, around 70 degrees. trenton coming in at 76 tomorrow. closer to the shore you'll have quite a bit more cloud cover in some spots. aftvalon 61. in delaware we expect a little more in the way of cloud cover there. rehoboth beach, 65. wilmingt wilmington, 69 degrees. quite a difference with woith te temperatures across the region tomorrow. thunderstorms as we go into friday and rain will be lingering as we go into the weekend. here's a look at tomorrow morning, though. no rain around, but, again, maybe some patchy dense fog in delaware and south jersey. tomorrow afternoon we're going to be a lot drier and, again, warmer with more sunshine. then here comes friday's rain. we see it starting early in the

morning for the morning commute. there's a possibility we could see some showers around. we're still going to be warm friday. then you notice those showers and storms approaching by 1:00 in the afternoon. we'll see a line approaching philadelphia. we could see more off to the west. 3:00 p.m., that could be kind of the primetime when it will be a little more organized and then head into south jersey and delaware by 5:00 p.m. for the evening commute, possibly, so as of now looks like that would be pushing along the shore and into the delaware beaches by then. so we'll be watching that very closely. going into your weekend, though, like i mentioned, the rain's going to linger into saturday. for philadelphia, pennsylvania suburbs, lehigh valley, new jersey, 70s for friday with those thunderstorms. mid 6 0s along the shore. saturday, though, we're going to see the rain in the forecast still. temperatures will be in the 70s, but then we'll have some afternoon showers move in. can't rule that out at all for your first half of the weekend. sunday, though, that's when we see more sunshine. look at the temperatures. we'll be in the 60s. so a little bit cooler. but it is that time of year,
