nbc 10 news starts now. today a vote on what caused last year's amtrak derailment in philadelphia that killed eight people and left behinds of others hurt. the focus is on what the engineer was doing right before the crash. caught on camera, that's a man taking a picture underneath a woman's skirt in upper darby. the search is on for the brazen criminal who police are calling dangerous. in atlantic city, taking booze public to ease some money problems for the financially strapped city. ç it's 4:00 a.m. good morning. this is "nbc 10 news today." i'm tracy davidson. let's get right to meteorologist bill henley with his first alert neighborhood forecast. a close look at conditions in communities across pennsylvania, new jersey and delaware. it's warmer this morning than

yesterday for sure. >> clouds have moved in overnight. those clouds, right now it's dry. no sign of any rain just yet. that will be changing during the day. 55 in philadelphia. it will cool down a little bit more and warm into the upper 50s by 9:00. still staying dry at 9:00 this morning. that's when things start to change. rain will be coming down. we'll see a warmup but not a huge one today. 40s and 50s, the suburbs warm into the low 60s this afternoon. this afternoon, that's your best chance of rain for today. clouds are over philadelphia. the new jersey area, to the west you can see the rain moving into d.c. it's going to make its way to delaware and into south jersey first but it will be also falling in philadelphia, too. parts of our area will be rain-free today. we'll go through it neighborhood by neighborhood when i'm back in ten minutes. jessica boyington is watching your first alert traffic. we're watching the vine street expressway right now. we're closed for construction.

the cameras around 24th street, the schuylkill expressway and 95, you'll have limited access to those areas. if you're headed eastbound or westbound on the vine you won't be able to do it. you'll have to take local vine. more construction as well, this one on the pa turnpike. the left and center lanes are closed. 23 minutes westbound or eastbound from route 1 to valley forge. we're watching septa, route 101, that trolley is busing passengers and that will be until friday, june 17th that they will replace trolleys on the route 101 between providence road and orange street stations. tracy? happening today, the ntsb will meet on the probable cause of the derailment last year in port richmond. according to a source, radio interference played a role in the train crack that killed 8 and injured more than 200

others. nbc 10's matt delucia is live in center city to walk us through what will happen today. matt? >> lawyers will be meeting later on today at their offices at liberty place. no matter what the ntsb ultimately revuls in their meeting later on today, they ultimately want the accountability to be held on the part of amtrak and the engineer. brandon bostian. the train expert tells nbc 10 that the theory that radio interference played a role does not change the fact that the crash was avoidable. one rail safety expert says two things would have saved the eight lives and kept hundreds of others unharmed. one would be a second person in the locomotive. that person could monitor the radio dispatch. that combined with positive train control which stops a train when it is exceeding the speed limit. amtrak 188 was going 106 miles per hour when it hit the curve at frankford junction.

that's more than twice the speed limit for that stretch of track. radio interference has always been a problem and will continue to beç unless amtrak takes mor preventative measures. >> certainly it could have contributed to this accident, nevertheless, it could have been preventible. >> unfortunately, this provides interference and a distraction from the major cause of the accident which was human error. >> reporter: amtrak 188, engineer brandon bostian says he barely remembers the events leading up to that derailment that happened last may. the ntsb will likely consider the radio interference theory as part of their fine al report. they're scheduled to vote on that later this morning. we'll be on top of that for you. mitch blocker will be in washington today for the meeting of the national transportation safety board. see his report on nbc news this

afternoon. nbc 10 news this afternoon and on the nbc 10 app. 4:05. 55 degrees outside. police in delaware county are looking for a man who stood pictures up a woman's skirt as she stood at the counter. the suspect took pictures with his cell phone four times before the victim caught him. >> the thing that bothers me about these dirt balls is the fact that if they have that much guts to do something like that, what can they do beyond that. >> the victim took a swing at him and he ran out the front door. if you recognize him, you're asked to call upper darby police. a woman's casino winnings have been recovered after a woman followed her home and stole her money. the woman won nearly $7,000 at harrah's on sunday. a man followed her to her upper darby home, pushed her and stole her percent. police caught the suspect. it is an honor that

philadelphia police sergeant robert wilson earned for his courage under fire. president obama yesterday awarded the fallen philadelphia officer the medal of valor at the white house. sergeant robert wilson iii was one of 13 law enforcement officers given the medal. he was the only one that received the medal posthumously. >> i miss him a lot. >> he was ambushed in 2015. prosecutors are pursuing the death penalty against the two suspects charged with his murder. now to decision 2016. primaries in kentucky and oregon. one again will pit hillary clinton against bernie sanders. clinton is looking to move closer to the nominee.

trump plans to goen yod his previous shots at clinton, targeting her character, e-mail controversy and her response to her husband's infidelities. the clinton camp says she will ignore trump's personal jabs while trying to capitalize on his negatives, especially with women. clinton envisioned their first debate. >> let's suppose here's the question. what is your plan to create jobs? his answer is,ç i'm going to create them, they're gonna be great. i know how to do it. but i'm not telling you what it is i'm gonna do. >> clinton said her husband, former president becoill clinto will be in charge of revitalizing the economy. it's $8.38 myth wage in new jersey. the assembly has not taken up

the issue at all and governor christie has expressed disapproval of the bill. now your nbc 10 first alert weather with meteorologist bill henley. >> 4:08. 55 degrees. we are running warmer than yesterday. clouds are over the airy, includes wildwood but it is completely dry this morning. that will change later today. so will these numbers. 55 in philadelphia, low 50s for delaware, the suburbs at 50 degrees and now in the 40s in south jersey. still falling at this hour. with clouds around, it's not going to get much chillier than it is right now. washington township is 53 degrees. mt. laurel reporting 52 and hopewell township is 54 along with cinnaminson. we're starting in the 40s and 50s. the numbers in the 60s this afternoon. but it's not going to be a huge warmup. we have rain moving in. those showers are to the southwest moving into d.c. steadier rain into west virginia. that will be coming into our area. the first rain drops but

steadier rainfall will wait until this afternoon. that's when clouds will take over completely. cloudy skies for the lehigh valley, you may be out of the rainfall for most of the day. steadier rain to the south is going to be heading to the south. futurecast shows by lunch time, very light rain in delaware and south jersey and philadelphia. isolated shower is possible in the lehigh valley but most of the rain, look, just stays to the south of allentown, berks county getting a little bit of rain in southeastern berks county. steadier rain through chester, delaware, in pennsylvania, new castle, kent and into sussex county and delaware and for most of new jersey we'll see that rain from central new jersey to south jersey. by 5:00 this afternoon, the rain starts to taper off. umbrellas will still be going up, windshield wipers will still be on in delaware and south jersey at the 5:00 hour for the evening commute. as we go into the evening, skies become drier. clouds will still be around. we'll see the rain come to an end. that should clear the way for a

drier day tomorrow. neighborhood by neighborhood calling for a rainy day. later this morning, mainly this afternoon, rainfall for university city. somerton, chestnut hill temperatures in the 60s. low 60s for the suburbs and in the lehigh valley, any rainfall will be brief, mainly it's just going to be cloudy. temperatures not quite as cool, into the middle 60s there. steadier rainfall for new jersey and at the jersey shore, though not as windy as yesterday. there will be a lighter breeze blowing into delaware. a quarter inch of rain for dover, 61 degrees. lewes up to 64. rainy day later in the morning and the afternoon for wilmington at 61 degrees. maybe you've been checking out the seven-day forecast at the bottom of the screen. there are drier days ahead. got the ten-day outlook when i'm back in ten. >> look forward to that, rill, thanks. 4:10. let's check the schuylkills for starters. nbc 10 first alert traffic reporter jessica boyington has

that. >> there's construction on the schuylkill expressway, headed eastbound right around the blue route, the right lane is closed. even moving through our drive times here, though, they're unaffected by that. eastbound from the blue route to the vine street expressway, still a 13-minute trip. if you're heading into center city, watch for that right lane being closed. otherwise you should be just fine. not a lot of cars into the roads right now. 295 over in west deptford, new jersey, right around route 130, no problems in either direction. a southbound drive time from the 42 freeway headed up and over the delaware memorial bridge. average speeds into the 60s there. roads are dry right now. emergency construction over the delaware memorial bridge so coming from new jersey heading into delaware, the left lane is closed. no backups, as you can see, we're still in the green on to 295 and the new jersey turnpike.

investigating this, it's called generation addicted, available on the nbc 10 app. both sides are claiming victory after the u.s. supreme court refused to take a stand over access to birth control. the court sent the affordable care act contraceptive challenge back to a lower court. the obama administration says a group's religious freedom does not include the right to restrict access to health care. the president says this ruling means women can still get contraception while opponents say this means religious groups can still fight the law. as you're preparing to send your kids off to school this morning, there's something they might not be learning and it's something that could save their lives. the nbc 10 investigators uncovered some philadelphia city schools failing to conduct the right amount of fire drills. here's mitch blocker with the preview of an investigation you'll see only on nbc 10 news.

>> reporter: because every second counts, we're counting how many fire drills philadelphia schools are doing. >> this is one of the most important things you can do for students and faculty. >> reporter: they're supposed to do ten. we foned that rarely happens. and the person in charge had no idea. why haven't schools been following the fire code? >> we're trying to find out that as well. there's a code in place, the code is there for a reason. it is to keep children safe. >> reporter: coming up tonight on nbc 10 news at 11:00, philly fire drill failures and how the district is reacting to our investigation. for the investigators, i'm mitch blocker, nbc 10 news. 4:16. booze on the boardwalk. atlantic city could soon become the first jersey shore town to allow alcohol on the boardwalk. city council will consider allowing people 21 or over to carry a drink on the boardwalk.

into the 60s. the suburbs, this is where you'll see showers developing later this morning and a steadier, light rainfall as we go into the afternoon. west chester, phoenixville, both into the low 60s. in philadelphia, yes, rain will be moving in late this morning, staying well into the afternoon hours. temperatures in the 60s and for the shore, the temperatures will be climbing only into the lower 60s today with steadier rain for glassboro and haddonfield. trenton, borderline. just a few sprinkles are possible. while atlantic city and galloway and avalon gets steadier rain during the day. yes, rain for delaware, too. temperatures in the low 60s for wilmington and dover this afternoon. satellite and radar shows a few sprinkles right now in southern lancaster county. look at all that rain to the west, moving through kentucky, that's where the steadier rain is. we're not going to last all that long for our area. it will be coming in to play as we go into the noontime hour. stand by to use your umbrella today.

glenn schwartz, citizens bank park tomorrow. we're following breaking news in philadelphia's bella vista village neighborhood ap l april. a police officer was sent to the hospital after her cruiser collided with a box truck. right now, let's check the roads in the area, including the garden state parkway. first alert traffic reporter jessica boyington has that. jessica? >> yes, tracy. we're watching the parkway just for some construction. this is in summers point around the great egg toll plaza. construction vehicles on scene right here. we only are losing a lane headed southbound. not a lot of volume or traffic heading that direction. not causing a big tie-up. this is the vine street expressway where we're still closed. looks like there's a vehicle coming through right now. not sure if that's a construction vehicle. looks leak a regular truck or so. they may be opening some of the ramps. typically they start to in a

4:24. a little known organization in north philadelphia is helping ex-offenders get back to normal life. connection training is ofs help more than 100 men and women every year become working and reliable members of society.ç katy zachry is live in the digital operations center with how this organization also helps you. katy, explain. >> that's right, tracy. there's a clear public safety connection to this organization. it works to make sure that ex-offenders don't commit crimes once they're out of prison. it also helps them become working members of society. we sat down with a case manager for connection training services who says he sees firsthand how the north philadelphia program changes lives. every few months they work with a new set of convicted felons, mostly men but a few women who have served time for crimes and are ready to get back to

society. they help their clients get rid of that prison stigma and connect them with companies who need to fill positions but also want to give people a second chance. by the end of the program, these people are changed. >> a better person all around. somebody that gained confidence in themselves, understands they have to make connections not only with themselves but back with their families, back with their children and eventually back with the community. >> reporter: it's not as easy as it sounds. coming up in the next hour, we tail a closer look at this organization, what exactly they do to help these men and women re-acclimate to society. you'll actually meet a couple of them. reporting live from the digital operations center, katy zachry, nbc 10 news. a new study shows more than eight people are killed every day by distracted driving, six of them teens. a mother who lost her daughter in a terrible crash brings her warning right to the people who
