at some point before the alleged assault, cosby tried to make a move on her, touching her breasts, but she told him to stop. the prosecution suggested this was the motivation for giving her pilling and wine on the night in question because she would be incapable of saying no. she told police she was paralyzed, couldn't speak, and before she knew it, cosby had hands up her shirt, down her pants, and placed her hands on him. >> the point of this is that it was intoxicating to her, and she was unable to consent. that's the crime that is charges. we look forward to handle this in court. >> there was no evidence of a crime here, and inconsistencies plagued the case from the beginning continue to plague it now. this case should end end immediately. >> cosby will stand trial. you just heard from his defense attorney that he alluded to the

statements to police calling them inconsistent. he tried to attack those statements today in court, trying to raise questions about them. we'll have more on that coming up at 5:00. live outside the montgomery county white house, rosemary connors, nbc 10 news. >> some thought she would testify at the hearing. that did not happen. do we know why it did not? >> reporter: well, we know she could have been here to testify, but it really wasn't necessary. this was one of the issues that was first presented to the judge this morning. should this hearing continue forward without andrea being here? however, technically, hearsay is allowed, and for that reason, detectives interviewed her and read the statement she gave when she reported the incident 12 years ago. >> rosemary, thank you for the first part of the team coverage. >> another famous face in the crowd of people at the norr

norristown courtroom today. high profile civil rights attorney at the hearing saying this case is just one more example of cosby's pattern with women. nbc 10 investigative reporter harry hairston continues coverage. >> more on what was said. harry? >> reporter: well, that's right, the california based attorney, she was attending the proceedings. you might remember, she's representing 30 other women in a civil suit against bill cosby. she's also a philadelphia native. she says she is monitoring all of cosby's legal activity and starting to hear the same thing from all the other women. now, after today's hearing, she had this to say about andrea and what she could expect from cosby in the days ahead. >> yeah, i think that she is very brave and i would expect she'll testify and endure what's a vigorous cross examination. mr. cosby appears to have limitless fun, hiring a law firm

that has 700 attorneys, literally 700 attorneys. he has other attorneys in addition to that law firm, so he can question anything and everything and i expect that he will for millions into his defense. >> reporter: now, other legal experts i spoke with say they anticipate they'll be more lee ma nooefring before a trial even gets started from cosby's camp. one prosecutor says he does not expect this thing will go to trial this year. reporting live from montgomery trial, harry hairston, back to you guys. >> so here's what's next for cosby. today, he waived his right to appear at a formal arraignment in july. that means he automatically enters a not guilty plea. now a judge needs to be assigned to the case, and that's when a trial date can be set. that typically happens within a few days. we now have the counts of the ninth in question from both bill

cosby and andrea. coming up, we compare their stories and point out differences. count on nbc 1 to follow the case as had heads to trial bringing you the latest on the air and on the nbc 10 app. new information right now about this morning's deadly hit-and-run in a septa bus stop in northeast philadelphia. police say the driver got out of his car, looked at the victim, and then ran away leaving the man and this mangled mess seen there behind. nbc 10 has learned the driver turn himself in, and you spoke with the victim's wife? >> reporter: oh, i did. you know, it was heart breaking just to talk to her. i can tell you police tell us it was raining early this morning when molina was hit under this flattened, now flattened canopy. police officers believe the driver was speeding and took off. >> i just wish he was here with

me, and i miss him, and i love him. >> reporter: grieving, heart broken, she breems with pride speaking of her husband of 13 years. >> hard worker. he was always there for our family. my family, his family. he was just an excellent, funny, outgoing man. >> reporter: telling us the 50-year-old was waiting a bus ride home just after 12:30 when he was hit and killed. he just got off work at a local warehouse. investigators say he probably didn't see the car coming when it mowed him down as he sought shelter from the rain under a septa canopy. he suffered severe trauma when thrown 120 feet. the canopy was destroyed. >> he was just there at the wrong time, unfortunately, and i just wish he would come home to me, but i know that i'm just

going to be strong for him and my family and just do the best that i can raising our children. >> reporter: along with his widow, he leaves behind a 20-year-old daughter, a 2-year-old son, and coming up in the next hour, his widow addresses the fact that the driver took off and then turned himself into police headquarters eight hours later. live now from the northeast, monique braxton, nbc 10 news. now your first alert neighborhood weather. >> and in our weather, the heat is turning up. we are at the start of the fast track to the 90s. it was cloudy and cool as work continued at the vietnam memorial. when you say big -- >> these are big staggering temperatures. glen "hurricane" schwartz with a look at the warm forecast, glen? >> we talked about it for over a

week how it would warm up this week, and into the weekend, we talk about temperatures near 90, and it's in the 80s now. 83 in lehigh valley, a west wind brings in the warmer air, but this is a beautiful sea breeze setting up at the jersey shore. you can see those winds converging. you can see it in delaware too. it's 83, and further south, we have temperatures in the upper 70s and 80 degrees, lincoln and louis at 79 degrees, but nearby, at the beach, 67 with a little sea breeze coming in. we have temperatures going up to the 80s tomorrow, and 87 degrees, 90 thursday, friday, and hotter on saturday. as far as rain is concerned, most of the showers were offshore, but one or two developed just south of philadelphia.

you see this. moving right down the atlantic city expressway. we'll follow that and changes coming in a few minutes. all right. investigators try to figure out what sparked a fire in a montgomery county high school. we were over north high around noon. fire broke out in a maintenance room. no one was hurt. a nanny is accused of stealing $15,000 in cash and jewelry from the family she was working for. police say she wore the jewelry in pictures she posted on facebook. investigators recovered some items in a pawnshop in the area. she say she swiped it working as the family's nanny for the last four months. a warning impacting an entire camden county community. >> a group of women are on the prowl preying on the elderly. they are wanted for targeting at least one couple in winslow

township. >> reporter: shut your doors, lock them. that is the message from winslow police. on friday, a group of three women driving a white van with florida tags scammed their way into an elderly couple's home on pump branch road near route 73. >> a group of three females, white or hispanic females. >> reporter: convincing them they knew them from previous health care visits. >> they kind of talked their way to come inside the house. >> reporter: police fear the motive is to steal cash, jewelry, or medicines. >> as two talk, one breaks free and meanders the house. the husband followed her. >> it's frightfrightening. people pull up, high hi, how are you, or a cute baby, it's lead-ins. be very, very careful.

>> reporter: police don't believe anything was stolen, but pushing the warning on facebook and want to hear from other neighbors who saw anything suspicious. carol is a grandmother and great grandmother, savvy on facebook, but did not catch the post. >> i'll be more alert. we have two dogs that don't let anyone get past the front door. >> girls were in the 20s and 30s. >> reporter: this is a mile from the expressway, so police are checking toll road cameras and comparing notes with neighboring departments to see if this is happening anywhere else. from winslow, nbc 10 news. prosecutors bring the fattah family into the congressman's corruption trial in center city today. a professor testified about his son's unpaid debts. he's serving time for a federal conviction on fraud charges. prosecutors say congressman

fattah used campaign money to pay a consulting company that paid off his son's student loans. nbc 10 is in the courtroom with a wrap up ahead at 5:00. > decision 2016, sanders requesting a review of voting totals in kentucky. he trails clinton by less than one-half of a percent following the collection. he says his campaign will have voting machines and ballots reviewed in the state. meanwhile, sanders has a warning about the democratic national convention in philadelphia as he campaigns in california today. he says the convention could get messy. the dnc agreed to give him a key role in shaping platforms even if hillary clinton wins nomination. sanders says the voices of his campaign will be heard in july. the dnc is two months away, held

in philadelphia from july 25-28. a new poll shows americans are nearly split when given a choice between donald trump and hillary clinton. clinton leads trump by four points in a hypothetical matchup, according to the latest survey monkey tracking poll out today. the margin is nearly unchanged from last week's results. make sure you have the free nbc 10 app to follow the latest news from the campaign trail and decision 2016, a free download right now on our website, nbc10.com. egyptian officials are denying a report that new evidence suggests an explosion brought down the e egyptair flight last week. searchers found human remains among the debris, and one examined the remains saying they were small and had burn marks suggesting a blast, but egypt's head of forensics strongly denied the report today. 66 people aboard the flight were killed in last thursday's crash.

>> now to the jersey shore bureau where there's good news in the battle against heroin. the prosecutor robert taylor announced the number of overdoses in cape may fell 9% last year compared to 2014 and overdoses continue to go down. authorities say it's good news, but they know the fight against the epidemic is far from over. >> we recognize there's going to be some upticks and down ticks in the statistics as we go along. we're not naive about what's happening. >> authorities believe a combination of law enforcement efforts, intervention, and educational programs in schools reduced overdoses in the county. >> a vote tonight could put the narcan drug in the hands of school nurses. they decide at 7:30, if the policy goes through, schools in the district receive free

supplies. district officials say the uptick in the lehigh valley leads to more children overdosing. the digital team spent months investigating the heroin crisis. watch the report, "generation addicted" right now on nbc10.com. lawmakers are pushing legislation that ban smoking on beaches and parks throughout new jersey. the president sweeney is talking about renewed efforts. christie vetoed a similar plan in the last session even though it won bipartisan support. the latest version exempts golf courses and permits local and county officials to set aside 15% of a beach as a smoking section if they choose. atlantic city open for business this holiday weekend. >> that's the message from city leaders this afternoon as ac grapples, of course, with its financial situation. they gathered at the steel pier today to talk about the upcoming summer season in atlantic city. new jersey lawmakers reached

agreements monday to prevent the city from going broke. the mayor expressed relief today. >> i'm very happy to see the governor, the senate president all coming together with a plan that helps atlantic city. >> steel pier unveiled a car that's part of a new 227-foot high observation wheel. that wheel is expected to be ready a year from this memorial day. very soon, that area is crowded as will the beaches with the holiday weekend. >> yeah. we have to remind people that when we talk about the heat in philadelphia and much of the area, that does not include the beaches. the ocean is cold at this time of the year, so -- >> still nice, though, right? >> still nice, but that slightest sea breeze cools it down. be prepared for the sweaters. >> yes. >> and sweatshirts and all that if you're headed down it cape

may. beautiful. beautiful this time of the year or any time of the year when you have nice weather, but weather gets very tricky there. inland, temperatures are in the 80s. lehigh valley, philadelphia, northern delaware. at the jersey shore, it's warm inland, and it's 77, and we got a sea breeze coming in. atlantic city itself, 72 degrees, that's warm, and the weekend is cooler than that as the ocean temperature, 57 degrees. the seabreeze just came in in the last couple hours. it warmed up into the 70s today. mostly dry across the area, but we have one or two showers coming through the philadelphia area, and this one, right along atlantic city expressway. right about to crush williamstown here, and right at that exit at the ac expressway, but it's going to be very, very brief, moving fast. we are heating up, and have been

pretty fast. we are up to 82 today, 87 tomorrow, and 90 thursday and friday, and even hotter saturday. that's part of the memorial day weekend. it starts off hot. friday, if you get out early, it's hot. saturday, hot everywhere other than jersey shore at 78. that's nice. it may be the nicest day of the holiday weekend at the shore because it drops to 68 sunday, winds come from the east. that cools other areas too. it's just a chance of a shower on sunday, and more likely rain on monday urgs and lower temperatures, you see, philadelphia down to 75, and south jersey to 71, and jersey shore down to 66 degrees. there was the complication of a tropical development from the southeast coast that brings a little moisture here for mondays

and maybe tuesday. we talk about that about the rest of the weather later. >> all right. last year, more than 42,000 calls to pennsylvania's child abuse hotline went unanswered, according to a new report finding critical problems with the state's childline service that could have put kids in danger. pennsylvania's auditor general released findings of the report today. >> any single one of those calls could have led to a life or death situation for a child. again, 20% -- more than 20% of the calls unanswered. that means there is a significantly high chance that some of these calls were of critical nature. >> governor wolf says he's been working to improve the child line service since he took office saying the service is now responding to all calls within two days, and he says there's new leadership overseeing the program. an ohio man accused of keeping his stepdaughter

shackled in the basement for months is breaking silence. >> he's behind bars on kidnapping charges saying his 13-year-old stepdaughter escaped from the family basement last week after being locked there for as long as a year. the girl told investigators she was chained up, fed old food because she wet her bed. in an interview, he says he's wrongly accused. >> i want my children to know that i love you with all my heart, and just trust in god. read his word daily. he'll guide you all the time, and we will see each other again in heaven forever and ever and ever. >> police are looking into weather several other children in the home were also held against their will. back to the weather, time to break out the bug spray, but this year's mosquito season poses a threat for zika. >> the level of protection

this is bill cosby leaving the montgomery county courthouse this afternoon moments after being ordered to stand trial on sexual assault charges. cosby is accused of drugging and violating a woman in his home in 2004. a judge today rule that prosecutors do have enough evidence to bring the case to trial. today, we learned more about what happened on that night in question. >> we heard new statements from both cosby and his accuser today. nbc 10 keith jones is live in the digital operations cementer with both sides in their own words, keith, this is really interesting. >> statements were read on the record and we have new

information from cosby's deposition given in the case. we wanted to put the statements side by side so you can see how they compare. we warn you, some is graphic. the first set of statements has to do with quaaludes. he says, quote, the reason why i gave them and offered them to andrea, which she took after examining them, was because she was talking about stress. now, this jives with the statement in court today where she says cosby went upstairs, came back with pills, urging her to help her take the edge off. the next statement has to do with what happened that night. according to cosby, he did not verbally ask for consent, but, quote, didn't hear her say anything, and i don't feel her say anything, so i continue to the area that is somewhere between permission and rejection, i am not stopped, end quote. here's what andrea said about this. cosby put his hands on her breasts, put his hands in her pants, and makes her touch him

sexually, saying, quote, i was unable to speak. i was paralyzed, end quote. timely, there was talk of a phone call between cosby and where he apologized to her and her mother. cosby says, quote, i'm not going to argue with somebody's mother who accusing me of something, and then when i apologize, she says to me that's all i wanted to know, bill. and i'm apologizing because i'm thinking this is a dirty old man with a young girl. i apologized. i said to the mother, it was digital penetration and she said, cosby told them, i'm sorry to you, andrea, and i'm sorry to your mom. cosby waive his formal arraignment automatically entering a guilty plea. a judge could announce a trial date soon. we have much more on the cosby story ahead. at 5:00, rosemary connors takes us inside the courtroom to talk about the other major development that came out of today's hearing, and at 5:30, a

she says diamond furniture says the manufacturer discontinued making the couch. the good news? she could get the floor model or store credit. she wanted a refund. >> i would prefer to have my money back, and he stated that that's something that they couldn't do. >> reporter: she reached out to nbc 10 responds. we got right back to her. >> i was so surprised. pleasantly surprised that you responded so quickly to my concern. >> reporter: when nbc 10 responds looked at the paperwork, we couldn't find anything about the product being discometed and getting a refund. she was frustrated. >> i like them to be fair enough to give it back to yes because they couldn't deliver on what they promised. >> reporter: we reached out to diamond furniture, and the store's ceo responded to us right away. he says the sofa was not discontinued and was scheduled to arrive in four weeks. we past that message along, and

it's often one of the hardest things for parents to hear, their baby crying itself to sleep. now researchers say they have proof it's actually okay. according to australia researchers, letting babies cry themselves to sleep will not cause emotional or behavior problems. they base findings on saliva samples showing babies did not produce stress hormones crying to sleep. scientists say crying it out helps babies fall asleep is 13 minutes sooner with fewer times waking up in the middle of the night. now lawsuit alleges domino's pizza stole from the workers' paychecks. today, the new york attorney general filed suit against the pizza maker for what they call rampant wage violations. they knew for years they underpaid workers, but they did nothing about it. officials say the company worked to help franchises comply with wage loss. a new study climbs the

popular fitbit trackers are highly inaccurate breathing new life into a class action lawsuit against the fitness technology company. california researchers compared results from fitbit devices and data from an ekg machine. studies found fitbit miscalculated heart rates up to 20 beats per minutes on average the the report commissioned by the law firm behind the action lawsuit claiming the devices are inaccurate. >> twitter's giving users more room to express themselves as it stands right now, there's a 140 character limit on all tweets, but twitter today announced that in the coming months, photos, videos, and other media, that's not going to count against that limit, so more wordy tweets may be on the way from all your friends. >> they have a lot of competition. there's so much social media out there that i think all of the giants feel like they have to keep up to make themselves better. >> being flexible. as summer approaches, a lot of people think of protecting

on nbc 10. something to watch. experts have a new warning today that zika carrying mosquitos could hit the u.s. soon. >> at the same time, where many insect repellants will not keep bugs away for very long, wee are finding out. consumer reports put 16 popular sprays to the test, a third of the brands tested lasted only an hour or less against zika spreading mosquitos, and even worse, plant based bug sprays whose all natural appeal make them popular, they were not as effective as other repellants. >> if you wanted to go with a more natural product, the oils help men eucalyptus is the best choice. in addition to the lemon, consumer reports says the most effective repel lanlts tested include soyer, and ben's 30%

as hot it will be a couple days later, so you can get some outdoor stuff down tomorrow that might be a little more uncomfortable a couple days later. phoenixville at 86 degrees. westchester at 86. and byburry at 86. trenton at 87 degrees, and haddonfield with lots of sun, no rain anywhere in the area. atlantic city 74 and warmer inland, galloway at 81 degrees. in delaware, temperatures in the 80s again. 84 degrees in wilmington. cooler at the beach because of the sea breeze that's going to be coming in. now, we're going to seeing temperatures go up as we go into the rest of the week and then the weekend and the temperatures are going to peak out at 92 degrees as we go into saturday,

then on sunday, things change. we're going to be seeing an east wind come in, and that's going to help push the temperatures down. we're going to be seeing moisture come up. the east coast, a little increase in the clouds and probably bring a little rain, perhaps to memorial day. hottest is early in the weekend. the coolest and cloudiest comes the end of the weekend. so plan accordingly. >> really, you can drive to whatever you want, so if you're inland and think it's too hot, go to the shore. if you're shore and too cool and you want heat, come in. >> that's the purpose of -- >> it's nice to have that. >> it's nice in the summer time. in the middle of the summer when the ocean is in the 70s -- >> warms it up? >> it's 90 at philadelphia and 80 at the shore. there's nice relief there.

today. >> this afternoon, a judge ruled that prosecutors had enough evidence to put an american dad on trial. rosemary connors was in the courtroom and is live with more from today's hearing. rosemary, we were waiting to see if cosby's accuser would take the stand, but she was not in the courtroom. >> reporter: that's right. she did not take the stand today. in fact, she did not really have to. it was not necessary for this kind of preliminary hearing. it was enough for the prosecution to present her previous statements to police as evidence. we expect her to testify at trial, though, and on that note, we have a preview from the defense how they will try to attack and tear apart her story. the only witnesses to take the stand were the detectives and police chief who interviewed andrea and bill after she reported the alleged incident. on cross-examination, the defense raced questions about questions about possible inconsistencies to the statement to police. for
