on facebook by the man's girlfriend. melissa colorado from our nbc affiliate in minneapolis has the latest for us. good morning. >> reporter: good morning. what began as a routine traffic stop turned deadly wednesday. family members confirm that 32-year-old man has died. we want to warn our viewers what you're about to watch may be disturbing. police are investigating the shooting death of a minnesota man after shocking cell phone video going viral overnight. the video appears to show the moments following the shooting as it was streaming live on facebook. >> we got pulled over for a busted taillight in the back. >> reporter: a blood soaked man is seen slumped next to his girlfriend and moaning in pain suffering from an apparent gunshot wound. the man's girlfriend describing how it all unfolded.

>> he's licensed to carry. he was trying to get out his i.d. and his wallet out of his pocket and he let the officer know that he had a firearm and was reaching for his wallet. >> a uniformed police officer is seen holding a pistol outside of the car yelling that castille should have kept his hands visible. >> you told him to get his driver's license. please don't tell me he's dead. please don't tell my boyfriend just went like that. >> keep your hands where they are. >> i'll keep my hands where they are. please, officer, don't tell me that you just did this to him. you shot four bullets into him, sir. he was just getting his license and registration, sir. >> get the female passenger out. >> ma'am exit the car with your hands up. let me see your hands. exit now. keep them up. keep them up. >> reporter: authorities say st. anthony police were conducting a

traffic stop for an alleged broken taillight when the officer fired at least once at the man driving the vehicle. >> the initial traffic stop was initiated by a primary officer and then a backup officer responded. i do not know anything about the facebook video at this time. that was live streaming. i haven't seen the video. >> reporter: overnight a crowd of about 50 to 60 people gathered outside of the govern's mansion in st. paul chanting in protest. >> this is completely unacceptable. somebody say enough is enough. >> reporter: about a dozen or so protesters remain outside of the governor's mansion in st. paul. that's the latest. back to you. new protests in baton rouge, louisiana, overnight over a deadly police shooting there. new video emerging as the justice department launches its own investigation. nbc's gabe gutierrez is in baton

rouge for us. gabe, good morning. >> reporter: good morning. less than 36 hours after the incident the department of justice opened an investigation and is now taking the lead. state authorities as well will also be looking at surveillance video from this convenience store as well as body cameras that police say became dislodged during the incident. this morning after the death of alton sterling, the outrage is mounting but the protests are peaceful. >> some people say we couldn't come out here without burning up our own building, without flipping over cars. this is not ferguson. >> reporter: baton rouge police say a 911 call saying someone matching sterling's description threatened him with a gun outside of a convenience store. it's not clear exactly what happened before the cell phone started recording but police say when two officers arrived, they confronted sterling. the officers tackling and wrestling him to the ground. seconds later -- >> shots fired.

shots fired. >> horrifying. >> reporter: abdul muflahi said that sterling recently started carrying a gun for protection. at any point did you see mr. sterling reach for that gun or threaten the officers with that gun? >> no. no. they were on top of him. >> reporter: his video appears to show an officer pull an object from sterling's pocket although police have not said what that object is. >> there's a lot that we do not understand. like you, i am demanding answers. >> reporter: so is the aunt who helped raise him. >> they sat down and watched my child die. >> reporter: sterling's 15-year-old son grief stricken. >> i for one will not rest and will not allow y'all to sweep him in the dirt. >> reporter: sterling's name has become a hashtag in the heated

hillary clinton had done, you would not be prosecuted? >> reporter: house speaker here on capitol hill is formally requesting that hillary clinton be denied the classified briefings all presidential receive. all of it setting up what is sure to be a showdown later this morning. >> all right. hallie jackson, thank you. let's turn to republican congressman who chairs the committee on government reform. before we get to ins and outs of director comey's decision, let me ask you the predicate question. do you believe in his impartiality or do you think he's bias? >> i think the fbi director is a man of integrity. i'm interesting in his findings. he found that secretary clinton was extremely careless with information that we entrust to very few people to put people lives in danger. that's why we have them up to discuss his findings. >> we want to get into that no a moment. there are allegations particularly by donald trump that this is a rigged system and

hillary clinton got preferential treatment by the federal government. do you suspect that? do you agree with that? >> it's a legitimate question for the fbi director. if you listen to the fact pattern laid out by the director, i'm mystified. there seems to be a double standard. if average joe had gone through that, they would have handcuffs on and be in jail. if your name is clinton and part of the powerful elite, there's a different set of standards. the department of justice has prosecuted people for far less and here hillary clinton they're just letting her go. >> mr. chairman, you said the fbi's recommendation surprising and confusing. based on the facts you heard the other day, do you believe hillary clinton committed a criminal act? >> i believe there are laws on the books that were clearly broken. you cannot put classified information in a nonsecure format. she did it for years. it put people in jeopardy. it may have been hacked.

she lied and misled the american people and the ultimate jury in this is going to be the american people. they get to make this decision. do they want somebody so untrustworthy to be the chief executive? >> from where you're sitting, did she commit a criminal act? >> i do believe she broke the law. that's what we want to ask. >> let me ask you because there will be people that look at this and see politics on both sides frankly. they may say, look, house republicans holding a hearing because they're disappointed there wasn't a criminal charge and they want to drag this out because they think it's politically beneficial. let me ask it this way. if she had been indicted, would you be calling director comey before your committee to ask him his rationale and his basis for that decision? >> absolutely. i spoke with the fbi director. he's coming up here less than 48 hours after he made his announcement. we need to understand that the american people should be able to see everything the fbi sees now that it's closed and now that the department of justice

is not going to prosecute. show the american people all of the information. if they had moved to indict her, i would have the same hearing. absolutely. >> mr. chairman, you just heard howie jackson say speaker ryan suggesting that hillary clinton as democratic nominee that does get briefings should be denied access to that briefings she's been receiving. do you agree with that? >> i do. the fbi director exclusively saying she's careless with this. classified information is classified for a reason. it puts people's lives in danger. this is not an innocent mistake. she knows better. she misled the american people. she lied under oath to congress. you can't do that without consequence. in this case she seems to just skate above it. >> just asking a tactical question. in some ways is having a hearing like this pushing it? if you listen to what director comey said, he did her no favors in that press conference. he called her extremely careless

with classified information and dismantled every excuse she offered as to why she needed a private e-mail server and now you're asking him why she didn't merit a criminal charge? >> exactly. the american people deserve to see this information. congress needs to see this information. if you're not going to prosecute this case, what case are you going to prosecute? and what is the message you send to millions of people that do have security clearances. go ahead and be lax and let that information out and there's no consequences. that's unacceptable. >> congressman, thank you very much for your time, sir. there are fresh signs that bernie sanders, hillary clinton's challenger in the democratic primary, may be getting closer to endorsing his former rival. nbc's kristen welker has more on that for us. kristen, good morning. >> reporter: willie, good morning to you. hillary clinton has been working to turn the page on her e-mail

popular former fox news anchor she claims she was let go after complaining about sexual harassment at work. cynthia, good to see you. >> gretchen carlson filed a lawsuit against roger ails, one of the most popular people in media saying he pressured to have a sexual relationship with him and when she refused, carlson claims that he fired her. ailes is firing back saying the lawsuit is a retaliation for the network's decision not to renew her contract. gretchen carlson says in her newly filed lawsuit it started when she complained about how she was being treated by her "fox & friends" co-host steve deucy. carlson said he was belittling her on air and off. attorneys for carlson allege fox

news chief roger ailes responded by calling her a man hater and telling her she needed to learn to get around with the boys. in 2013, carlson said she was removed as a co-anchor of "fox & friends" and given her own show. carlson accused ailes of ogling her in her office and asking her to turn around so he could view her posturety. carlson said she confronted ailes last september claiming he told her, i think you and i should have had a sexual relationship. adding that sometimes problems are easier to solve that way. carlson says she refused to have a sexual relationship with ailes and was fired nine months later. in a statement last evening, ailes said carlson's allegations were "offensive and defamatory

and would be defended vigorously. when fox news did not commence negotiations to renew her contract, ms. carlson became aware that her career with the network was likely over and conveniently began to pursue a lawsuit. carlson hasn't always been critical of ailes writing in her book roger was razor sharp and inskrutable and we seemed to have a real connection. we should make clear that carlson's lawsuit is only against roger ailes and not fox news itself. according to lawyers representing carlson, several female former fox employees contacted them since carlson went public yesterday with their lawsuit saying they want to discuss how women are treated at the network. the parent company of fox news says it stands by ailes but also has begun an internal review of the allegations. >> distinct feeling we have not heard the end of this yet. >> i think you're right.

new questions over the death of a navy s.e.a.l. trainee in california now that the medical examiner's report has been released. joe fryer has been following this story. good morning. >> reporter: good morning. the sailor drown in may during a training exercise at the naval base here in coronado. the coroner's report says some may view this as an accident, the medical examiner is calling it a homicide. it was his first week in the grouping six-month navy s.e.a.l. program. lossle loveless died. loveless and other trainees were swimming in fatigue and boots. medical examiner shows loveless appeared to be struggling before an instructor is seen to dunk loveless under the water and follow him around the pool for approximately five minutes. he continually splashes loveless and dunks him at least one additional time. eventually loveless was pulled

from the water still breathing but hours later he was dead. the medical examiner writes it's our opinion that action and inactions of the instructors and other individuals involved were excessive and directly contributed to his death and the manner of death is best classified as homicide. >> water training is always dangerous. for some it's a defining moment and instructors don't know where different students stand. >> reporter: navy s.e.a.l. training is so demanding 80% don't make the cut. that includes kevin. >> i'm a good swimmer. i was a swimmer in high school. there was one incidence when i thought i would drown when i was in the pool. >> reporter: the navy is still looking into it saying it's important to understand that homicide refers to death at the hands of another and a homicide is not inherently a crime. the instructor was removed from duty after nbc news and a

back at 7:44. you may be surprised to learn that despite the explosion of texting, a lot of 911 dispatch centers, in fact most of them, cannot receive a text message. >> why aren't more departments using the potentially life saving technology? nbc's tom costello has been looking into that. he's a firestation in tyson's corner virginia. >> reporter: good morning. fairfax county, virginia, has a reputation for embracing technology and they can receive text messages if they can't talk on the phone for a medical reason or a suspect they don't want to alert but 90% of 911 centers nation wide cannot receive a text message. walk into any major 911 center, the tempo is the same.

>> i'm going to stay on the line with you until help comes. >> reporter: in this age of instant messaging, only a handful of 911 centers can receive text messages. in orlando, eddie justice was trapped in the nightclub restroom with the gunman fast approaching. he texted his mom. >> call police. i'm going to die. >> reporter: while orlando police were flooded with 911 calls, the department wasn't able to receive text messages. out of nearly 6,600 dispatch centers nationwide, only about 10% can accept text messages. new york, l.a., miami, and seattle are among big cities where people can't send a text. >> if we're waiting for police departments to spend the money to do this, they don't have the money. it's not in their budgets. >> in loudon county, virginia, text messages began in march.

they get several each week. >> this is what we see. we click on this. screen pops up. >> reporter: along with the message, the caller's gps coordina coordinates. dealing with caller over a text message instead of a voice call can take much longer. 90 seconds or longer. precious seconds lost in an emergency. dispatchers say text messages often don't convey the urgency or emotion that they can pick up from a caller. >> they take control of their emotions and say listen to me. we're going to deliver a baby. listen to me. we need to get everybody out of the house. you can't do that on the text machine. it's definitely the human interaction is what's missing with the text. >> reporter: the message from 911 centers that are text enabled, call if you can. text if you can't. and text messaging can be used to send police photos or video

recommendation, a sunscreen must be 30 spf or higher, have broad spectrum protection and has to be water and/or sweat resistant. the fda regulates sunscreens and requires rigorous testing but the northwestern university researchers who conducted the study found that 26 of those 65 top consumer rated sunscreens didn't meet all three criteria. the reviews suggest consumers paid more attention to how the sunscreen smelled and felt rather than whether or not it was water resistant. nbc news reached out to amazon. it politely declined to comment. we get more on findings. doctor, good morning. good to see you. these are some of the products that did not meet aad standards. what's the takeaway? >> the consumer needs to be shopper savvy. these products didn't meet the standards because they are not water resistant. most of them. now some of them were an appropriate spf.

it doesn't mean they're bad products. it means they're not water resistant and water resistance is key when you spend time at the beach or going outdoors for long periods of time. there are times when products like these might be beneficial. >> we reached out to personal care products council and call into question because the requirement that effective sunscreen be water resistant and not all consumers need that. i guess the point is if you're going to wear sunscreen every day under your makeup in winter, maybe you don't need water resistant. >> that's correct. make sure you use a product that's good for your skin type and you want to be personal about it. you want to look at the active ingredients and make sure what you're using is good for what you're looking for. it doesn't necessarily mean that the product has to be water resistant if you're going to and from work and you're indoors most of the time. make sure it as an appropriate spf. >> some products were

moisturizers and not sunscreens. what do you recommend as a dermatologist? >> all sunscreens contain an spf of 30 or higher, water resistant and broad spectrum to cover both uva and uvb. these criteria are best used for products going to be used on the beach, whether you're going to the park, spending long periods of time or going to be near the water. if you're going to use a moisturizer with an spf, it's okay to use one that's not water resistant. it's still important to use a broad spectrum product and one with a high spf. >> higher you go, better sunscreen is? >> less likely you'll make a mistake with your sunscreen. if you use lower spf, you don't apply the correct quantity. 25% to 50% of people do not apply the right quantity. if you don't apply enough, you're not getting spf on that bottle. >> these are products that did meet the requirements. it was interesting to see

>> exactly. go to your local nursery. they are great resource. farmer's market. they'll really, really help you. >> what are we looking at here? is this perennials versus annuals conversation? >> a lot of these are perennials. plants that come back every year for us. annuals you replant every new season. they don't stay around in the garden. i like a combination of both. really great. again, plant what you love. >> how do you take care of these in the winter by the way? >> every plant has different needs in the winter depending on where you live. for example, this hydrangea if you have it in a pot, if you have it in the ground, the same kind of care for winter. before the first freeze. a lot of people have hydrangeas and love them. if you live in a place where it gets colder than 15 degrees, you want to bring the hydrangea if it's in a pot in the house.

you can also protect it in the ground with covering or in either case, what you want to do is trim it back before the first freeze. a lot of people get confused. how do i trim my hydrangea. what you want to do is the wood -- you never want to cut the part that looks like dead wood. that's where new growth comes out of. you want to go up two nodes and make the cut just above. >> great tips. thank you so much. great to see you. up next, a better way to slice watermelon and drinks in a flash. hacks you need to know right now. first it's "today" on nbc.

so much easier to take out. isn't that wild? >> let me try it to make sure it tastes the same. okay. talk about peaches. they're in season. >> one of my favorite things to get at the farmer's market. so you want to depit it. you cut around one half comes off. easy. you place that no biggy. what about the stuff that's attached to the pit? i like to again cut a grid on the pit and then all you have to do is slice next to the pit and there you go. you don't even have to deal with it. >> cut the grid around and cut the pit out and it's all ready to go. this is the tricky one here. let's say i want to get skin off. >> for peach pie, you want skin off. cut an x on it and pop it in boiling water and leave it in there for 30 seconds. you can see where the x was.

the skin starts to come off already. we'll shock it in ice water so we don't burn our fingers off for five or ten seconds and then with fingers take it off. >> it looks super fun. >> it's easy. >> it is. okay. there you go. this one is ready for the next person. >> definitely put it in the cold bath. it gets toasty. corn. >> corn. all right. whenever you try to take kernels off they fly everywhere. when you cut it off, it falls into the bunt pan instead of on your counter. >> do you sit around an think of clever ideas? >> it's a thing called the internet. >> you googled it to us. >> throw it in a bowl. you don't have to scoop it off the counter.
