and so the excessive heat warning may not continue into saturday. i'll be back to talk more about the relief and timing of those storms in a few minutes. right now, we have new information about breaking news we've been following this afternoon in philadelphia's port richmond section. the coast guard searching for someone who disappeared after jumping into the delaware river. witnesses telling nbc 10 the victim is just 16 years old. we're told he jumped into the water. was in the water for about ten minutes, and then went under. we'll continue to follow this breaking news. we'll have more information as soon as we get it. a win for prosecutors in bill cosby's sexual assault case today. the judge said andrea constand does not have to testify before the trial. aundrea cline-thomas is joining us outside the courthouse.

what was cosby's reaction in court today, aundrea? >> reporter: cosby did not have any comment when he walked out of court. this is shaping up to be one of the biggest trials we have ever seen. during the trial, bill cosby will face his accuser as the jury decides if the once beloved tv dad is guilty of sexual assault. mr. cosby, do you have a response? bill cosby had no comment after the defense was dealt a big upset. >> someone who has given so much to so many had his constitutional rights trampled upon. >> reporter: after three hours of arguments by both sides, the statement given 11 years ago are enough to send the case to trial. cosby's attorneys wanted constand to be present and testify during the preliminary hearing. so they could question her. they hoped to get the case thrown out. >> this isn't a place to have a person that is a victim of sexual assault revictimized

again. >> reporter: but constand will testify against cosby during the trial. until then, the legal maneuvering is far from over. >> we are confident that our state's highest court will right this wrong, will reverse this decision. >> now, this is being watched around the country. as other women have come out publicly accusing cosby of assaulting them. the outcome of this case could bolster their own. now, a trial date has not been set. reporting live in norristown, aundrea cline-thomas, nbc 10 news. turning now to septa. the septa slowdown continues into day three. hot and muggy on the platform at suburban station tonight as commuters wait for a ride home. no air conditioning on that underground platform. septa has pulled 120 trains from service after finding cracks underneath the rail cars, and

it's all adding up to big delays and a lot of standing. are you getting home a lot later? >> much later. >> we had three trains pass us by in the morning but we eventually got here. >> drinking lots of water. try to stay calm and patient, i guess. >> septa told nbc 10 the delays could last until the end of the summer. we're tracking the delays right now today. we can tell you there are actually fewer delays than earlier in the week. the 609 is nine minutes late. but it looks like most trains are running on time. it took septa's commuter chaos and the influx of thousands of democratic convention visitors, but uber is officially legal in philly, at least until the end of september. >> routine riders likely won't notice a change here, but the sudden about-face will have big ramifications. george spencer has been tracking this story and is joining us now on this story. >> jim and jacqueline, many riders likely had no idea at all, but until today uber-x had

not been operating legally in philadelphia, operating without official approval from the state. after two years of turning a mostly blind eye, the parking authority said trying times demanded this big change. and outraged taxi leaders are already promising a big response. >> welcome, john, into our family, by presenting him with a vase. >> reporter: a parking authority baseball cap and apparently a peace offering. this morning uber and the tpa were suddenly friends. and the ride-sharing service suddenly free to operate without fear that the authority might enforce state laws. even though such enforcement didn't happen much anyway. >> basically we're going to stand down for a three-month period on enforcement actions. >> reporter: what actually changes, though? the ppa's enforcement around this has been very limited up to this point. >> it has been somewhat limited. but what does change now is uber

can attract more drivers, okay? and more cars. >> reporter: executive director vince said the authority and uber expected harrisburg lawmakers to pass a bill legalizing transportation networks like uber. but when that bill stalled as septa's regional rail chaos ensued, two years of fighting ended with the 90-day plan. uber agrees to pay $350,000 to settle all its existing legal disputes. the company's 12,000 drivers across southeastern p.a. can work legally in philly. with the driving history and criminal background checks that uber is already required to perform. >> is the tpa going to go back to review your driver checks or leaving that up to uber? >> during the 90-day period, uber will be doing them themselves. >> leaders in the taxi industry say taxi drivers were, quote,

blindsided today. the values of their pricey taxi medallions eroded by ride sharing, some are threatening a mass return of those medallions, and even road closure protests during the democratic convention. it is worth noting, so far this 90-day agreement applies only to uber, not to any of its competitors like lift. but it is open to working with some of the other companies. >> that may change as well. >> exactly. >> what happens, george, october 1st? will the city then begin enforcing the state laws then? >> that's the question we asked, would uber be going from illegal to temporarily legal and then back to illegal? they hope harrisburg will come through with statewide legalization on this before the 90-day period is up. these bills have stalled in the past. as to if that happened again, the entire situation will be shaken up. >> george spnser, thank you. >> yeah.

the dnc in philly won't have as big of a headache for commuters compared to the pope's visit. the secret service revealed what roads will be closed two days before the dnc. it starts july 25th and runs through the 28th. here's the map of those closures. about three-quarters of a mile of broad street will be closed for two days before the convention begins. traffic will also be limited on parts of 95. city leaders are working with protest groups to make sure the convention goes as smoothly as possible. >> a lot of protesters will be in the park. buses will drive right by them. they will be seen add heard. that was important. >> we don't really have an interest in criminalizing a bunch of people who are out peacefully protesting. it doesn't really serve a purpose. >> we're told secret service will lift what protesters can and cannot bring once we get that information, we'll put it

on wbs and the nbc 10 app. democratic candidate hillary clinton is back in our area tomorrow. her speech will begin around 6:30. the delegates around the world come to this convention every four years. about 30,000 people are expected to attend this week for the bicentennial of the a.m.e. hillary clinton won't be the first presidential candidate to attend the conference. it's actually a ritual that dates back decades. >> eleanor roosevelt spoke to this general conference in 1944 in west philadelphia. there's a long-standing tradition of politicians coming. we want them to come. we want to hear the plans that they have. we represent people's interests, not only in heaven, but also on earth. >> the conference inside the convention center runs through the 13th. live over center city. two black men were shot at the

hands of police in other parts of the country. among them are the members of the national methodist episcopal church. they're condemning the death of the two men killed, one in minnesota, one in louisiana. a police officer is on leave near st. paul, minnesota, after shooting and killing a man in a traffic stop yesterday. the man's girlfriend recorded the stop on a cell phone. two officers in louisiana are on leave as well. president obama plans to address both shootings once he arrives in poland for the start of nato meetings. a south jersey woman's murdered inside her home. police haven't revealed a lot of information about her death. but detectives are asking help to find out who was responsible. a bucks county woman who faked having cancer and even fooled her own family must pay $50,000 in fines.

target plans to open a new start next march, located in the shopping center at the corner of ridge and domino lane. showboat is ready to right the ship in atlantic city. tomorrow the former casino is expected to open as a hotel only. showboat plans to have 850 rooms available, a restaurant bar, coffee house will open. we checked their website and found rooms available for about $250 for tomorrow's reopening. the showboat closed back in 2014. this week's dangerous heat serves as a reminder not to leave pets or children inside a car. >> we can't say it enough. when it's close to 100 degrees outside, you can only imagine how hot it is inside. one man has made it part of his mission to get the word out. cydney long joins us live from cherry hill on this. >> reporter: ten minutes, the time it takes for the interior of your car to become 80% hotter than it is outside. recent studies have shown that

87 in glasgow. it is still scorching hot at bethany beach. 9 a degrees. the highest temperature in the yoel area. 96 an hour ago. 93 at rehoboth. 90 in mills boro. the heat wave is going to continue. and it is hot, it is humid. you can combine the two and it feels like 100 degrees today. that's as high as it got. 97 tomorrow, with even higher tumt, may feel like 104. so going to feel worse tomorrow. then on saturday, even though the temperature may get to 95, the humidity will be lower. check your own area temperature at the bottom of the screen at any time. you don't have to just wait until the end of the weather, or not just for philadelphia anymore either. we have a first alert out, the red symbols, for much of the

area tomorrow, for this extreme heat. we do not have the first alert out for reading and the lehigh valley where it's barely going to get to 90 degrees tomorrow. then you'll get some relief maybe early afternoon relief in the form of thunderstorms. robbinsville at 94. easton township 95. the first alert does continue for much of delaware, including the beaches. nothing significant on radar anymore. we had some thunderstorms moving off ocean county. we have the next area that's fairly significant in kentucky. so it's pretty far away. i don't expect to see any activity tonight, tomorrow morning's going to be sunny. we're going to be baking. by noon, we're in the 90s. in the afternoon, some scattered showers and storms break out. we're not talking about widespread rain, but it is going to be an issue tomorrow. and then another area comes in

on saturday. not during the morning, but in the afternoon, we may see some more showers and thunderstorms. as we go through the ten days, there's saturday that's hot. but not as humid. a beautiful day on sunday. lower humidity. creeping up with the temperature monday and tuesday. and then the extreme heat may come back toward the end of next week. breaking news over center city, where we're shown pictures of hundreds of people now taking part in a protest of the shooting deaths of the two black men by police officers in other states. minnesota and louisiana. but this protest happening right here in center city, philadelphia. the group plans to stop at several different locations. you can see here they're at the pennsylvania convention center right now. there was a similar protest last night. we'll keep an eye on this, and we'll be right back.
