nbc news wall street journal poll taken after sunday night's debate. in a four-way race, clinton draws 46% support to donald trump's 37%. pennsylvania will play a key role in this election, but time is running out to make your voice heard. the state's voter registration deadline is at midnight wrshs nbc 10 in old city where some people were registering before it's too late. the city commissioner's office tells us they received at least 25,000 voter registration applications today alone. the deadline to register in delaware is this saturday. the 15th. if you are voting in new jersey, you have until next tuesday, the 18th. hurricane matthew may be gone, but its impact is still being felt. florida residents now have until 5:00 p.m. tomorrow to register to vote in the wake of last week's storm evacuation orders. the storm has been blamed for at least 33 deaths in five states. north carolina has been the hardest hit with 14 deaths alone. at least six communities there

remain under evacuation orders. a federal disaster has been declared in 31 counties there so far. locals are pitching in to help victims in the south. 80 volunteer members of new jersey nnl's urban search and rescue team have been in hard hit areas since the weekend. the american red cross jersey region is adding to its team of nearly two dozen already in the southeast. >> you see people in distress, and i'm fine myself, but you want to help those people. >> i have been through this before with hurricane sandy, so i'm glad that i was able to come here and help. >> the team members expect to return home tomorrow, but state officials say they're ready to send a different group to the flood zone if if needed. police say it happened around 8:00 tonight in the city's oxford circle neighborhood. according investigators two men broke into a home on hellerman

street and stole $275. one of the suspects put a gun to the male homeowners owner's neck. the suspects left in a black jeep wrangler. the incident was caught on home surveillance. a scare involving two planes at newark airport. a united airlines flight was arriving from beijing this evening when it clipped wingds with an empty luftansa plane that was parked. no one was hurt, but both planes have minor damage. the faa is investigating what happened. the city of philadelphia is launching a new initiative to end youth smoking. mayor jim kinny says it is set to unveil the details tomorrow. we told the plan will try to limit the number of stores offering tobacco in low income neighborhoods. it's also expected to increase the annual fee for retailers selling tobacco from $50 to $300. new at 11:00 grave concerns in burkes county. a shuddered cemetery is denying families the right to see their loved ones.

nbc 10 joins us with the details. janine. >> jacquelin, families are demanding access to rock cemetery where their loved ones are buried, but officials say the owners are claiming the cemetery is closed and not allowing any more burials. >> reporter: a cemetery battle is brewing in burkes county. beyond the grave stones at rock cemetery are signs telling people to keep out. >> the dead are there. they're ours. they're not their property. it's not real estate. >> reporter: the brooks county residents say the owners of rock stem taer have rocked visitors and future burials. hazel hamm has a plot awaiting her next to her husband who died more than 20 years ago. >> and now we're told that we -- i can't be buried there? i think that's cruel. i have that right to be buried there. >> this is one of the most atrocious things i have ever, ever heard. >> only way that this can be described as heartless insanity. >> reporter: the owners of the

cemetery filed a lawsuit several months ago seeking to permanently bar people from the property. they also gave people the chance to exhume the bodies of their loved ones. lawmakers used words like vague and antiquated to describe current cemetery laws in pennsylvania with most agreeing those laws need to be updated. the property sold at public auction in 2010. an attorney for the owner says they did not know this was a working cemetery when they bought it. nbc 10 news. jury selection is underway in the civil trial of a former penn state assistant football coach who filed a lawsuit against the university. mike mccreary claims he was wrongfully terminated after reporting that assistant coach jerry sandusky sexually abused a boy in 2001. the pool of 219 jurors will be trimmed to 28 before a jury is seated. the school says mccreary was let go, but a new football coach was hired. mccreary is seeking $4 million in damages. the trial date is set for

october 17th. one day after carl icahn closed down the taj ma hall in atlantic city, lawmakers are trying to see to it he loses his casino license for the property too. steve sweeney introduced a bill that would prevent icahn trying to reopen the taj next spring as a non-union facility. the bill needs approval in the state assembly. if passed, icahn would need to reach a deal with union workers in order to reopen. members of the jewish faith are observing the start of yam kippur tonight. ♪ >> nbc 10 in spring garden where services were held this evening. yam kippur is known as the day of atonement. it's a time of intense prayer and fasting. it includes the high holy days that began with a near celebration the rosh hashanah. calcium concern. why doctors say a daily

an bankrupt ending to a high speed chase in texas today. the driver left his truck and tried to run across the highway when an officer tasered him. the suspect went down just inches from oncoming traffic. police managed to detain the man and he was later arrested. if you were one of the millions of americans who take a daily calcium supplement, you

those pesky and often dangerous potholes in the road, you need a crew of workers in a truck. often stopping traffic in the process. philadelphia councilman david oh says he has better ideas than a faster, less expensive, and permanent, including a self-contained spray injection unit. only requiring one worker. s he says it would cost $13 a pothole and take three minutes to fill. >> the new technology allows us to fill these potholes more safely, more cheaply, and more permanently. >> reporter: the councilman says infra-red repair would work in a similar manner and is hoping a city council hearing on the proposal will spark change. >> there's always a resistance to change, and it'd think that's one of the things that we have to show people is that our government is going to adjust and make changes so that we're solving the public's problems as quick as can be. >> reporter: he says between the request for potholes to be repaired and faulty repair methods, the city is struggling
