it? >> i think they've got some employees, no checkout counters. >> so many questions. i want to start with breaking news in los angeles. an unanimous tip about an imminent terror attack that has federal and local officials ramping up security this morning. pete williams is nbc's justice correspondent, pete, what can you tell us? >> reporter: matt, cities don't normally respond to threats like this to telephone threats. it was call from a pay phone in a western country, but because it came with little time to check it out, they decided to go public with it. this morning riders on the los angeles commuter rail system are urged to be vigilant. fbi and local authorities say they received an imminent, but unconfirmed threat against the subway station in universal city. officials say the threat came from an anonymous phone call to a public safely line. something would happen today at the station across the street from universal studios which is

owned by nbc's parent company. authorities called the threat very specific. >> because of the specificity and the imminence of the threat, we felt it was important that we provide this information to the public. >> reporter: the fbi declined to specify, but says it was delivered in english. >> we are right now looking at the credibility of the threat. we're continuing to work this investigation. and we're accord nieting that along with our local partners here in los angeles. with our international partners who provided the initial information. >> reporter: companies in los angeles are urging residents to use caution, but urge the public to go about their normal day today. >> i mean, there'll always just be a lingering feeling of fear, but i got to go to work. >> this could be real, it could be a hoax, but we must remain calm and vigilant. take the same precautions they would take on any other day. >> reporter: riders will see more uniformed police, sheriffs, and dog teams.

undercover officers will also be on the job. the fbi is work to learn more about the source of the information. >> justice correspondent pete williams, thank you very much. also this morning, new developments in the investigation of that deadly warehouse near oakland, california. last night an emotional vigil was held for the victims. the man who ran that warehouse in a moment. but first miguel al ma gear is at the scene, good morning. >> reporter: good morning, with most of the building clear, the death toll now stands at 36 and we are told by the sheriff's department they're optimistic no more bodies will be covered. this is now a criminal investigation. many are looking for answers, but are also grieving. overnight, hundreds paying their respects. unlit candles and flashlights, a flameless symbol of solidarity for so many lives lost. many victims in the 20s and 30s. their bodies recovered from this warehouse where a devastating

fire quickly spread during a late night party. dering almena released the warehouse. >> everyone knew that we lived there. >> reporter: he and his family as well as dozens of others have lived there for the past three years. >> this is basically renting it to be a school. dance culture. i build to suit. as is to city standard. >> reporter: but the city says this warehouse was, which fire officials say was jammed with flammable materials was never up to standard. or zoned for residential living. documents obtained by nbc news show a history of complaints for garbage piling up and illegal interior building structure. the owner has not responded to requests for comment, but her daughter tells the "l.a. times,"

it was leased a z a studio space, not a dwelling. >> i raise midchildren there, yeah. >> reporter: over the years, he was forced to make improvements. installing and electrical panel and a hot water heater. he's spoken to investigators, but not been charged with any crime. so you say the building wasn't up to code, did you make modifications that maybe shouldn't have been done? >> we can't talk about that. you can't say that kind of stuff right now. >> reporter: his partner wanted to stop our interview. but almena wanted to go on. >> did we modify? did we make changes? i would like to say we made improvements. >> reporter: allison says the family did the best they could. >> we doesn't have enough money to do the things that needed to be done there. and there was nobody helping us in the ways that we needed.

>> reporter: are you worried that you may be blamed? >> of course. i'm worried my kids are going to be taken away from me. >> and as a mother, i am having a terrible time -- i'm having a terrible time. and i'm so sorry. i'm so sorry. for what has happened. >> reporter: this morning, there is still no cause for this fire. again, no criminal charges have been filed here, but if they are, they could range all the way up to possible murder charges. tamron. >> miguel, thank you so much. >> as you saw in that piece, derick, he is at the scene of the fire this morning and joining us now. good morning to you.

>> good morning. not a good morning. it's not a good morning. what am i doing here? can i just say i'm sorry? can i just say -- the only reason why i'm here is to put my face and my body here in front. >> mr. almena, let me ask you a couple of questions, 36 lives were lost in that building over the weekend. the family members of those who were lost want answers. they want to know who should be held accountable for their loss of their loved ones. are you the man who should be held accountable? >> am i the man who should be held accountable? did i build something that -- i mean, what am i going say for that? should i be held accountable? i can barely stand here right now.

>> but it's a fair question, mr. almena. obviously there were some conditions in that building that may have led to a dangerous situation and led to what happened there. >> i laid my body down there every night. we laid our bodies down there. we put our children to bed there every night. we made music. we've created art. we opened our home. what became our home. it didn't start off as our home. it started off as an initial dream, an idea that we would have a facility and a venue that would host. everything from at-risk youth to the gay community. to artists that couldn't perform anywhere. to performance art and alternative arts. and eventually, when you can't pay your rent because your dream is bigger than your pocketbook, when the need for housing and the need for people to be able to sit down and be warm and make food and take a shower and take a bath and go to bed.

so we created something together. you know. this stopped being me, this wasn't about me. i signed a lease. and i got a building that was to city standard, supposedly. i was lured into something that i had to constantly -- >> mr. almena, it may have been a dream and all of that may be true, you provided a space for some people to live, but according to to the city, was not under code. and we have someone who lived there, an artist who lived there for two years, shelley mack, she rented a space if you. you knew it was dangerous. you profited from this and never spent a dime on anything, but partying. what did you do -- >> i don't want to talk about it. i don't want to talk about me. i don't want to talk about profiting. this is profit? >> what can you tell me you did to ensure the safety of those people -- >> i'm a father, i laid my three children down there every night. >> we understand that. >> this is not profit. this is loss.

this is a mass grave. >> so for the families, can you -- >> i'm only here to say one thing, that i am incredibly sorry and that everything that i did was to make this a stronger, more beautiful community. and to bring people together. people didn't want walk through those doors because of the horrible place. people didn't seek us out to perform and express themselves because it was a horrible place. >> nobody is -- >> i'm 47 years old, i'm the father of this place. >> mr. almena, no one is saying it is a horrible place -- >> on the night of the fire -- on the night of the fire -- did i know there was going to be a fire? did i remove my children from the space and get a hotel because i wanted to avoid this? because i wanted to cast blame on other people, no. because i wanted to get a good night's sleep with my children. i wanted to let the young people do what they needed to do. i'm not going to answer these questions the way you're presenting them. >> mr. almena --

secretary official. and the question out there this morning as well, is vice president joe biden already thinking about 2020? nbc's kristen welker is there with more on all of it, kristen, good morning. >> reporter: tamron, good morning to you. president-elect donald trump is set to meet with former secretary of state henry kissinger today, just back from a trip from china. and it comes on the heels of mr. trump's controversial phone call with taiwan. meanwhile, later today, mr. trump will travel to north carolina, another leg on his thank you tour. a chance to tout his pick for secretary of defense. president-elect donald trump tout dinner with his family last night. poised to make more habited announcements this week. today, he's making one of his most critical nominees official. james mattis, secondary of defense. nicknamed mad dog during the iraq war. term of high praise for his courageous actions. >> mad dog mattis.

>> reporter: and while mattis largely has bipartisan support, mr. trump's pick for housing and urban development is drawing fire from democrats who are slamming his lack of experience. senator chuck schumer writing, i have serious concerns about dr. carson's lack of expertise. senator sherrod brown, his appointment raises questions about how serious he is about actually getting anything done. the trump team insisting the neurosurgeon is the right fit. >> we're excited to have dr. carson as our intended nominee. >> reporter: meanwhile, more fallout this morning after president-elect trump took a congratulatory call from the leader of taiwan breaking with decades of u.s./china policy. a source familiar with the issue telling nbc the call was in the works for a while. and transition officials say, arraigned by former republican senator and presidential nominee bob dole. the apparent goal, sending a signal, trump is going to get tough with china. >> we can't continue to allow

china to rape our country. >> reporter: during a foreign policy forum last night, former secretary of state and clinton supporter madeline albright said there could be diplomatic fallout. >> it is not negotiating for a hotel. >> reporter: albright sat with henry kissinger who is meeting with trump today and crafted nixon's china policy. >> i really hope that my good friend henry kissinger has a very strong influence on president-elect trump. >> reporter: and trump tower got one of it's most surprising visitors monday, former vice president al gore. there to discuss climate change. >> it was very interesting. i do think it was productive. >> reporter: the current vice president, joe biden, raising eyebrows last night during an event on capitol hill. saying he was considering another presidential run in 2020. and when asked if he was joking -- >> i'm not committing not to run. i'm not committing to anything. i learned a long time ago, fate has a strange of way of intervening. >> reporter: a lot of buzz about

that. the focus here at trump tower today will again be on secretary of state. mr. trump will meet with rex tillerson, the ceo of exxom mobile and a possible candidate for press secretary. conservative radio host, laura ingram, matt, tamron. >> over at trump tower, thank you, kristen. prosecutor now vowing to retry the former police officer charged in the fatal shooting of an unarmed black man. on monday, a judge granted a mistrial for michael slager after a jury could not reach a verdict. walter scott's death was captured on video by a bystander, the mayor of charles tornz, community leaders and south carolina's governor are urging a calm response to that ruling. i wonder if we could go back to the derick almena interview. i think you can agree or disagree, what we're asking mr. almena was a series of questions

that investigators are going to be asking over the coming days. either of mr. almena or of other people about the conditions inside that building that may have led to a dangerous circumstance. >> and some of those allegations come directly from people who lived in that building. and we spoke with women yesterday who said they slept with an extinguisher. there were concerns about the safety. mr. almena leases, someone else owns it. however when asked about modifications he made and safety precautions, he's been unable to answer them at this point. >> and we understand that with a lack of resources and money, sometimes it's not possible to do things the way you want, but there are building codes and there are inspections and there are permits for a reason. and that is what the investigation is going to focus on in the coming days. >> we hope he'll provide those answers because there are families, 36 of them and many more. meanwhile the transition to the forecast. you've been standing here patiently. >> obviously questions that need to be answered. and of course other questions, what happens when you have a

on the scene over to the shoulder though. 28 minutes for your trip. the frankford apartment fire around frankford and seller street. back to you. nearly a dozen people including four children are hurt after fire ripped through their philadelphia apartment building. flames broke out at the scene around 4:00 this morning. fire crews rescued up to 20 people. victims are in stable condition. investigators looking into the cause of the fire. and breaking overnight, new jersey state trooper frankie williams died after a head-on crash. the driver of the other car was killed. police are investigating that crash. i'm katy zachry. we'll have another live update for you in about 25 minutes.

stepping up security after subway stations across the city this morning. after an anonymous phone call to a public safety line. the caller claimed a terror attack was planned for today. officials say they aren't taking any chances as they work to determine the credibility of that call. and president-elect donald trump heads to the next stop of his post-election thank you tour. tonight he'll hold a rally at a coliseum in fayetteville, north carolina, where mr. trump will officially announced that james mad dog mattis is his choice for secretary of defense. similar events planned for thursday night in iowa and friday in grand rapids, michigan. meantime, here's a question as you get ready to head out the door, how much sleep did you get last night? new research suggests if you missed just one hour of sleep were your conservation and reaction time on the road can suffer. sometimes with terrible consequenc consequences. tom costello is in maryland with

that story, good morning. >> reporter: good morning, we've all done it, zoned out as we drive down the road, miss the exit. the new research suggests that if we are operating on four to five hours of sleep, thanks have the same effect as if driving under the influence. watch the team drifts off, some catching themselves the moment before impact. others not. but it's not just teenage drivers. a sleep-deprived nation too often asleep at the wheel. this morning aaa warns too many aren't getting enough z's. seven hours isn't enough. significantly elevating the risk of a crash. the cdc says more than a third don't get that much rest. sleep just five to six hours a night and aaa says you're twice as likely to crash. >> getting only four to five hours a sleep at night is the same as driving legally drunk. if you sleep less than 24 hours, you are as impaired as you would be if you were twice the legal

limit of alcohol. >> reporter: this happened to carrie warn. >> i did that a lot. and thought it was just because i'm a little a.d.d. >> reporter: but it was her son, 18-year-old tyler who veered off this interstate, flipping his car four time us. he never hit the brakes. so tired at 2:50 in the afternoon. he didn't realize he was in the wrong state, illinois, not missouri. a graduating senior, tyler was hoping to walk on to his college football team. >> it's hard because his friends are all starting to buy houses and get married. and he's 18. like he's just always going to be 18. >> reporter: tyler's parents now on a crew said, warning others of the sleeping danger. aaa says one hour less than normal rest can raise the risk of a crash. sleep fewer than four, and risk increased ten times. >> we've all said it, you know, i don't need sleep. i'll sleep when i'm dead. >> i'll sleep when i'm dead. >> unfortunately, it results the

gamut, he also cast other blame. he also was angry. and he also was very remorseful for the lives lost. almena said he had lived here at this property for roughly three years. he started this warehouse as an artist collective and over time he tells us, other artists began to live here and pay rent. the lease here costs $5,000 a month according to almena. he says that money was raised by the 20 to 25 artists that lived here every month. they paid different rent. he also says while his name was the leaseholder here, that everyone shared the responsibility for collective living. that investigation still continuing here. again, matt, it's unclear if anyone will face criminal charges, matt. >> miguel, thank you so much. security has been ramped up across los angeles transit system after authorities got a tip about an imminent bombing a the a subway station there. the fbi and local law enforcement agencies say they are not taking any chances. the threat came from overseas through an anonymous phone call to a public safety line.

good. >> i smell brownies. >> right. this is a very easy hack. you make your brownies lie in the pan. i usually take them out and use a biscuit cutter. go ahead and press that in. it comes out. and then i made a -- you can't use regular whipped cream because it'll follow apart. this is just an italian cream cheese, and then just do a dollop. do you want to do one? >> you're doing great. i cut the brownies out. >> pipe a little thing on. if you have a plastic bag, that'll work too if you take the tip and add a whole strawberry to the top, rest it on there and cap it off with a little santa hat. >> that's nice. >> super easy and great -- >> strawberry and chocolate. >> so this is just a fun way to zip up a solo cup. basically red solo cups or plastic cubs, rub bonn and the buckles that you can find at stationary stores. and they're usually used for

wedding invitations and use like a little bit of tape and just like double stick tape and tape it on there and make a santa belt. now i'm going advice you, do not use a hot glue gun, it will melt the plast pick. >> good idea. got some wine glasses that you've made fancy for the holidays. >> well, it's more you know how you forget what drink is yours. you pick -- these are window clings, and they just cling to glasses. take one and cling it on and take it off, and it's great for kids too if you want to put those on and pick whichever, i think you're probably a burgundy drinker or red wine. >> red wine at this time of year. >> you stick that on and remember what your glass is. cool, very nice. >> finally we're going to make this very beautiful -- i mean this is a super festive thing to do. you basically take a bucket, like -- >> nice bucket. >> you can use two liter plastic, you know, like a soda bot physical you cut the top off. you fill it up with -- can you pour a little water in there, like about an inch or so of
