off to a wet start. we found umbrellas out and hoods up here in radnor today. the rainy weather causing travel troubles as well as if the internationals, departures were running nearly an hour late this afternoon. >> you'll want to keep that rain gear handy too. the first alert weather team is tracking a wet mess for your morning commute. good evening i'm keith jones. >> i'm erin coleman. it was rainy and gray all day long and tomorrow looks even worse. >> new year's eve great conditions now we're starting this work week off with very wet conditions we saw it all day long, gray, and that's going to be round two for us tomorrow for those of you that didn't have to go to work today. early this morning we're talking 3 or 4:00 a.m., we saw -- the

rain is moving from west to east. and still some light to moderate rain falling there. elsewhere drying out but still gray and foggy in spots and still very wet out there. that moisture not going to dissipate because we have so much in the area that we're going to tap into tomorrow. pull this out and you can see where it's coming from. look down to the southwest of us, all this moisture is heading our direction, so round two should kick off as we go into tomorrow morning and last right into the afternoon. in fact, we may see some heavier rain by tomorrow than what we saw today. here's a look at the temperatures where they sit right now. almost all of us above freezing here aside from mount pocono at 31 degrees. only rain in the forecast. some very lingering light showers possible overnight. we're at 42 degrees in philadelphia right now. it's the same for northeast philly. atlantic city right now 44 degrees. so here's the interesting thing.

we're used to the temperatures starting to slip as we go overnight. that is not going to be the case for us tonight. we'll be damp and cloudy but good news is we will not be cold or below freezing. as we go into tomorrow, more rain is the forecast and then we're looking at a big cool down at the end of your first week of 2017. we'll get to all these details coming up. >> thank you. we have new details meanwhile about the delaware man who was shot during that new year's eve -- day nightclub attack in turkey. >> jake raak is home right now. we're following this flight back to the u.s. and we'll keep you posted on his journey. in the meantime isis has claimed responsibility but the terror group did not offer proof or provide details. turkish police detained eight people in connection with the violence but they said they are still hunting for the gunman who can be seen on this grainy video. investigators say he disappeared

amid the chaos right after the shooting spree that killed 39 people and wounded many others, most of them foreign tourists from muslim countries. nbc10 tim fur long is live in new castle county where raak lives. >> reporter: what would you do if you found yourself in the middle of a terror attack. he essentially played dead and that might be why he is new alive. >> i want to say, you know, this is a very good country and it's so unfortunate that this is happening to you guys and i really feel for everybody here. >> reporter: that was jake raak as he was getting to his plane in istanbul. he was celebrating his 35th birthday and the new year in turkey partying at the nightclub when a gunman came in and started firing. 39 people were killed, 70 were wounded. >> i got shot in the [ bleep ] leg. >> a camera caught jake as he

was getting put into the ambulance. the gunman was on a bench right above his head so he laid there silently hoping he passed by but the gunman shot him in the hip. >> i was probably the luckiest person in the whole thing. i do find myself very fortunate. i was with nine people, seven of us were shot. >> reporter: i stop by his mom's house nobody answered but she did tell the associated press she's praying for the other victims. jake is now on his way back to the united states. we have a crew at the airport there to meet him. live in greenberg. >> a pennsylvania state trooper shot and killed in the line of duty will be laid to rest on thursday. police shot and killed that suspect jason robertson

anti-inflammatory an 18 hour man hunt. weaver graduated from the police academy just last summer. he got married in june. >> a walk in the park led to a dangerous encounter for this dog and its owners. you can see the band ages left to this german shepherd. the owners say another dog's to blame but its owner is yet to come ford. monique braxton joins us now that's where this attack happened. that germany shepherd's owner was injured as well. >> reporter: that's right. he was he was bitten in the arm during the attack just days before christmas and tonight police want to talk to the owner of the pit bull involved in that attack. >> blood pouring out of bruno's mouth. i thought he was going to die because the dog would not let go. >> reporter: that's how he remembers the attack on bruno. he pulled his czechoslovakia

30 feet off the path here when he saw the pit bull and its owner approaching. then the pit bull charged them. >> as i was reaching down to get the other dog away i was punching the dog to get him away. he would back up and come forward again. this is going on like three, four times rnks how long was the attack? >> it seemed like for ever ten minutes or more. >> he showed us his arm wound but bruno's gashes are covered. >> he had a puncture wound that was on his right side. he had a gash that was all the way in the back of his mouth that was about two inches deep. >> reporter: bruno has spent several days in the hospital. he's also being treated for an eye injury as well as pain and inflammation. >> it's just really difficult on the family too because not just with him being injured but also my husband and, you know, the stress of both of us. >> reporter: part of the stress they say is due to the owner of the pit bull grabbed her dog and

vanished. they don't know if bruno was exposed to rabbis. now bruno's bills are more than $5,000. >> this is a dangerous dog to come after a man and a dog who is in a sitting position unprovoked. this is a dog that shouldn't be out in the street. >> reporter: and they are offering a $500 reward. vincent says he remembers a woman in her 50s with blonde hair and 5 feat 8 inches tall. her dog was solid brown. if you recognize the description you're asked to wall waterford township, police. live for now nbc10 news. in south jersey glassboro police have arrested an alleged peeping tom. we first showed you the video on friday. a tip from the public helped lead police to dar nel howard. he admitted to being in that area of the home when the crime

happened. he's salem county jail until his first court appearance. jurors return to the courtroom in the civil trial of deadly 2013 building collapse. a salvation army was crushed in that collapse. lawyers are trying to prove officials with the charity knew about the potential of a collapse at the construction site next door and never told store employees or customers. 91-year-old new york real estate investor richard bessiano is also being sued. he owned the four-story building being torn down. six people died and 14 others were injured. it will now cost you 1 .5 cents per ounce for sugar drinks. it's officially in effect the sugar tax. creating about 6,500 new slots

another chunk of the revenue will help revital cries regulation rags centers. that's not the only change coming to p.a. residents. the state will no longer require registration stickers a move that will free up more than $3 million for other state funded projects. now it will also koflt more to ride on the pennsylvania turnpike a 6% toll will increase goes into effect january 8th. the turnpike commission says annual hikes of up to 6% are possible through 2044 and six packs for sale will soon be a reality. the new law goes into effect january 14th. >> two more candidates have entered the race for district attorney. both are former assistant drikt attorneys. they entered a crowded field running in the primary. four candidates are now looking to replace current d.a. seth williams who is seeking a third

term in office. >> pgw crews are digging up a sidewalk because someone reported the smell of glass. witnesses on the scene say a few residents were asked to leave their homes for a short time. pgw is trying to locate the source of that leak. and insect infestation is forcing crews to remove dying ash trees from bucks county. the emerald ash bore damaged those trees. the tree removal is expected to start wednesday morning. once those damaged trees will remove, crews will plant new vegetation. it is an asian beetle once the insect infekts a forest they kill every tree there and the only option is to remove the tree. >> if you're ready to part with your christmas tree, the city is ready to help. the street department will start a tree recycling program tomorrow that will run through

the new year means a fresh start and that includes politics as well. >> state lawmakers head back to work in harrisburg tomorrow and they hope to break some of their old habits. >> lauren mayk. >> reporter: old habits of not getting along that month long budget impasse, memories of that are still fresh and while nobody is claiming it is going to be easy this year, lawmakers on both sides of the aisle tell me they hope to work together. in west philadelphia, vincent hughs preparing to head back to harrisburg for a new year. tuesday starts his sixth term as a state senator, the priority his says, education and address disparities in funding. >> causing tremendous unequal outcome so we got to work more on that and driving more funds to struggling school districts because they deserve it, those kids deserve it. >> reporter: hughes is a

democrat. he will once again be in the minority party in harrisburg as the new session starts and budget negotiations begin. >> reporter: are you optimistic? >> i am. when you don't have a budget that's passed it hurts everybody. we all know that the residual effect of that is not good for any district in the commonwealth of pennsylvania. >> reporter: governor to have wolf makes his official budget address next month, a spokesman tells nbc10 we'll look to streamline government and address pennsylvania's budget deficit without increasing broad based taxes like personal income tax. >> i got to hear it out. i've always within one that's been willing to sit down and listen. >> reporter: he's on the house appropriations. he's heading back for his second term with his own priorities too. >> property tax reform. >> reporter: especially he says to help seniors. they're not able to maintain or stay in their homes and that

shouldn't be. >> reporter: each law maker they're really all coming back with their own priorities. one thing they all have to do is get that budget done and one option that could be up for debate this year, expanding gambling. coming up at 6:00 we'll take a look at what that could mean for you and existing casinos in pennsylvania. live in fair mount park, nbc10 news. tomorrow is the last day in office for pennsylvania representative leslie acosta. the democrat who represents sections of north philadelphia resigned over the weekend. she was urged to make the move by a number of her colleagues and pennsylvania governor tom wolf. the reason, well in march, she pleaded guilty in a sealed court case to one county of conspiracy to commit money laundering. a special election will decide her replacement. >> pennsylvania could lose one, possibly two after the census.

pennsylvania was named one of nine states that stands to lose at least one seat in the house congressional seats are based on population. the number of congressional seats in delaware and new jersey aren't expected to change. 2017 will also be be a big year for politics in new jersey. voters will choose who they want to succeed governor chris christie and in delaware they're getting a new governor this month. inauguration ceremony will be held for democratic governor elect on january 17th. >> let's turn to your first alert weather now. a drab and dreary morning here in montgomery county and around the region. these guys needed an umbrella just to stay dry. take a live look outside. the blue cross river rink, not the best day to go skating, earlier the rink was packed over the weekend, celebrating the new year and watching those fireworks. our viewers saw those early fireworks show right here on nbc10. >> the river rink is open

throughout the winter so you can stop by pens landing from now until march 5th. >> meteorologist krystal klei here with your neighborhood forecast. >> that's exactly right. you think winter, you think really cold and snow. we got that in the forecast just not yet. today it's been all about the rain, early this morning this rain moved in just as we expected and we did even see some icing potential over parts of the mostly northern edge of our viewing area. temperatures started to boost up above freezing and throughout the day we saw that rain move in and out. it's really starting to move out here, just some very spotty lingering showers and still hanging along shore points as well. look into philadelphia. the rain's mostly out. the clouds are going to stick around and so is the moisture. so the ground is going to be wet and the road is going to be wet. just a damp and dreary evening ahead of us and we may still some lingering spotty showers

overnight. only in the form of rain. these temperatures are not going down. here's where our philadelphia neighborhoods sit right now. low 40s across the board. 42 degrees right now in riten house, society hill, a lot of 42s and 41s and same deal in areas like torresdale. i said these aren't going to be going down, we're going to see them steady throughout the night and into tomorrow morning. these numbers start to climb a little. by tomorrow afternoon temperatures will be warmer today. in fact, they'll be much warmer than average. the average is 41 degrees. a few spots across the region may be able to make it to the low 50s but we've been pulling back on this because of the cloudiness that we are experiencing and expect to experience into tomorrow. 45 for shh ranksville and reading as well. notice every icon showing us rain because temperatures will all be above freezing. we're not concerned about

wintery mix, just rain. 48 degrees in robbinsvile, for new jersey, egg harbor township, 43. in delaware some ice spots just as well. 50 for dover with those rainy conditions. expect the rainy conditions to last throughout your tuesday, we are not expecting any snow quite yet, though. and speaking of that, 2016 ended up with the second warmest year on record just under 2012 with an average temperature of 58.4 geez. third came in 1931. if we look at the ten warmest years on record, seven of them occurred in the 2000s so we're talking the majority happening in the last 16 years and the second warmest just 2016. here's look at the temperature trend. we're going to continue with this as we go through the next few days here. today we stay in the low 40s, upper 40s by wednesday, low 50s, this is all above average.

if you want the cooler conditions, though we do have them. 37 degrees, that big drop for thursday and an even bigger drop for friday. take a look at that. the forecast temperature only 30 degrees by the end of this first week of 2017. so we're talking a huge cool down and when you see temperatures at 30 for the high, any precipitation that moves through has got to be snow. there's the warmer than average temperatures and also expect wednesday into thursday for winds to increase. that front brings us the colder air. so friday we're going with a chance of some snow moving through, saturday a bit of a break but look at those temperatures over your weekends. highs only at freezing and the potential for snow yet again on your sunday. thank you. christmas is over but that doesn't mean the shopping has to end. next at five, see which items will have the best deals for the new year. but you won't find any deals at

oil analysts say drivers can expect to say between 25 and $0.50 more for gas than they did last year and local gas tax increases are making it even more costly to fill up your tank. pennsylvania's gas tax went up $0.08. new jersey's gas tax went up $0.23 in october. so here's what you'll pay where you live. in philadelphia it's now $2.57 a gallon. in new jersey it's $2.42 and in delaware you'll pay $2.31 a gallon. if you have some money left over to pay after the holidays there are some steals and deals out there right now. a lot of them are geared toward the new year and getting healthy as you might imagine. there are bargains on fitness equipment to help you stick to those healthy resolutions. treadmills go on sale this time of year as well as digital scales. you'll find discount on winter clothing and retailers clear out for spring inventory.

tomorrow because we are still tracking more rain. there's the rain that hit us today, most of it's been slowly moving on out but there's the next round. you can tell there's some strength to it. that's going to be moving our direction overnight and should make its way in by tomorrow morning, which means that commute going to be a wet one because the roadways are already wet and we're just bringing in more rain. here's a tighter look at what's going on currently. there's still some light, lingering rain across our region, the more steady showers, even some of the heavier showers, that has all moved off. even along our shore points now we're starting to see those showers scoot on off. still going to be cloudy and damp. you can tell from these live cameras, they're blurry because there's still water on them. 42 degrees the temperature in philadelphia right now. 40 in the suburbs. we have dropped to the upper 30s in the lehigh valley and delaware at 42 degrees but we're not going to see these temperatures fall overnight. they're going to plateau for the

next few hours and actually start to climb as we go into tomorrow. this is actually for your tuesday. it should say and look at those numbers getting into the upper 40s here but that's about it. there's not a lot of change in your temperature through tomorrow because we're going to be cloudy and gray and dreary again. in fact, with it there's the look when those showers start to move in right around 8, 9 in the morning and it could be heavier than what we saw today in some spots. so coming up we'll take this hour by hour. time it out for your tuesday and talk when the heaviest rain will be hitting your neighborhood. >> thanks. also tonight indecent exposeure. >> police say a man wearing nothing but sneakers has exposed himself to teenage girls and women in burlington county. so far he showed up in medford and evesham township and they are worried what he might do next. nbc10 reporter sidney long joins us now.

>> reporter: that's right. police say the 14 and 15-year-old girls were frightened at about 1:00 in the afternoon. they took off running from this small park. they say the man didn't say anything or threaten them but only wearing sneakers he chased them before jumping in his jeep and driving off. >> i don't go in the trail at night to walk my dog. i stay around here. especially now. >> reporter: residents of evesham and medford are a bit on edge about the bizarre and lewd actions of a man driving an older model like this one. on friday investigators say the naked man who was light skinned chased two teenage girls from the park near the condo min yulz. and it's not the first start of him in recent weeks. >> he's shirtless. kind of odd. catches your attention. >> reporter: on november 30th and then on december 21st in the huntington neighborhood, both times driving around naked during the day. >> a female was out walking her

dog. the gentleman pulled up in a black colored jeep, believed to be a patriot. with a white sticker in the back window and exited the vehicle completely naked. >> reporter: he said nothing but police fear there could be more incidents they don't know about. the woman who saw him november 30th standing nude by a trash can only called authorities after she heard about the evesham incident friday. it happened foot steps from this woman's yard. >> i'm little. someone could think i'm a little kid. he'll be sorry he comes this way. >> reporter: police want to know his motive. >> is he looking to have a confrontation with somebody or simply just an exhibitionist. >> he did it in broad daylight this guy. so he wants attention. i would think, you know. maybe he wants to get caught. maybe he needs some help. >> reporter: now the young teenage girls who took off running were not harmed. police don't yet have a sketch of the man's face. they also do not have a license

platd number for that car. if that changes we will let you know right away. nbc10 news. >> in philadelphia a gunman is on the loose after a fight ended in a deadly shooting. police say an off duty officer saw it all happened. they say two men were fighting and the loser of that fight pulled a gun, killing the other man. it happened just after 8:30 this morning at park avenue and somerset street. the offduty officer was not involved in any way. >> close call in berks county in new year's eve, a bullet went into a house and just missed a baby's crib. they were standing by a back window right there trying to get a better glimpse of a fireworks shot. the husband was covered in glass. the bullet just missed hitting them. it landed next to the crib of their nine-year-old. the bullet was likely fired by someone celebrating new year's

eve. >> clearly there's no-fault involved. they think their celebrating, they think that it's fun to make a lot of noise and the bullets end up some where. what goes up comes down and innocent people can be effected and hurt or killed by that. >> everyone is doing okay. the family is talking about this scare with hopes of preventing others from firing weapons during any kind of celebration. police think the shot came from one, maybe even two miles away. leaders in philadelphia have warned about incidents like this for years now. he was hit in the head by a bullet in 1998. he was just 11 years old. someone fired the gun during a new year's eve celebration. philadelphia police said they got more than 130 calls for gunfire last new year's eve still waiting for updated numbers for this year. >> dillon roof was back. if the 22-year-old is competent enough to represent himself

during the penalty phase of his trial. that hearing is still ongoing so we don't know what the judge has ruled. roof was convicted of killing nine people at charleston ame church. the penalty phase begins tomorrow morning. >> four children are dead after what authorities are calling an accidental poisoning. officials in texas say someone tried to wash a pesticide out from underneath the home with water but when the water mixed with that pesticide, it created a toxic gas. one of the kids died at the scene, three more died at the hospital, officials -- the officials -- the official cause of their death, i should say, has not been confirmed. search teams were back out today searching the water of lake erie looking for a small plane that crashed on thursday. private drivers were seen searching the lake about two miles off shore where the plane was last seen on radar. the six passengers on board attended the game and were heading to columbus when the

plane went down. >> snow, thunderstorms and ice are what thousands of travellers had to face today as they headed home after a long holiday weekend. overnight severe storms moved through texas with damaging winds, hail, even a tornado. in the northwest many are digging out from feet of snow and it was all umbrellas in new orleans where rain put a damper on new year's eve festivities there. president obama only has three weeks left in office and he's going to lose every last minute to save his signature healthcare law. more on the battle over obamacare next at five. plus a lot of girls got them under the christmas tree this year, now there is a new american girl in town and she is representing philadelphia. we're going to tell you all about her.

degrees right now mays landing and the rain was pretty steady in areas like the shore and parts of delaware so as a result some of those rain numbers were pretty impressive through the stores. areas over half an inch and you see that up through parts of new jersey as well as around a quarter of an inch for voorhees township, so we're looking at numbers that weren't too bad and in the next day we could see in some spots in shore points and delaware maybe another half an inch or so. but just not in the form of snow like you might be wanting for winter time. here's a look at the forecast as we go through the night and into tomorrow morning. some lingering showers are possible. what you saw is the most rain moved out. notice the temperatures they're going to rise a tad as we go throughout the night. low mid-40s even into tomorrow morning. we will not be seeing any precipitation fall in the form of snow or icing. it will all be rain as we move
