>> i still don't know what to think. >> reporter: christy elliott said she's stunned and angry after investigators reveal her brother keith elliott was struck and killed by a new jersey transit bus christmas morning, the same bus he apparently wanted to take to the family's holiday celebration in lacy township. >> i'm mad because, you know, the kid lost his life for nothing. >> reporter: loved ones first spoke with us the day after the crash, which initially appeared to be a hit and run at highland parkway and herflicker boulevard, right up the street from the toms river bus terminal. ocean county authorities now say their investigation shows the 45-year-old toms river man tried to wave down the bus near the scene of the collision. the driver stopped, let elliott cross in front of the bus, but would not let him board. prosecutors say the bus made a turn to continue on. the driver believing elliott was walking away, but somehow struck him. the driver and passengers told investigators they didn't know

he'd been hit. >> you turn around and he's not there. people don't disappear. you disappear because he ran him over. >> off the side of the bus or you have to hear something. especially if you're sitting in the bus. >> reporter: authorities say the investigation is ongoing, but at this point no charges have been filed. when i called the driver's house today his wife told me the family has no comment. >> there's closure because we know what happened but at the sim time there's no closure because we don't know what happened. >> reporter: the bus driver has been with the agency for 22 years and will remain out of service until a thorough internal investigation is complete. in toms river, i'm ted greenberg, nbc 10 news. a high school student in the lehigh valley is facing charges of cyber harassment and ethnic intimidation for posting a racist snapchat video that led to a fistfight.

the 14-year-old white student at saucon valley high school harassed a 16-year-old black student calling the teenager the n-word and joking he was on welfare and posting that video on snapchat and that video led to a fight. initially only a black student was charged with assault. but today the district attorney announced the white student would also face charges of ethnic intimidation. >> harassment whether based on race or whatever is a crime. >> one student threw a confederate flag at him. there were other slurs. >> families at the school say black students have felt hara harassed for months. this sends a message that it will not be tolerated. three high school football players accused of hazing pleaded guilty today in chester county. the conestoga high school students admitted to a lesser charge before the trial began. they were accused of sexually assaulting a player with a broom

handle. the students insist the victim was only poked in the leg but they've now pleaded guilty to harassment. because they're minors, the district attorney did not reveal their punishment. the football coach resigned amid the controversy early last year. a philadelphia father fires back and protects his four children sleeping during a home invasion. the father ended up killing one of the two intruders late last night and the father was also shot defending his home. monique braxton joins us live from the frankford section of philadelphia. i know you spoke to neighbors who know him? >> that's right. police tell us the still unidentified father won't be facing murder charges for what happened here inside his home in frankford, but police tell us the thousands of dollars worth of drugs found inside this home could lead to drug charges. >> i've been in this neighborhood here nine years and i haven't seen anything like that. >> reporter: this is what he saw

when he looked outside his door here in the 1900 block of pratt street. investigators say a 26-year-old father was shot in the mouth and leg while fighting off two intruders. he killed one during a gun battle. the other got away. >> the police officers, they took the wife out. when they assist him in putting him in the stretcher, that's when they went in the house and they recovered the kids and they took them out safe. >> it happened so close to me. >> reporter: police say the shoot-out occurred just after 11:00 while the 24-year-old wife was putting their children to bed upstairs. when police went inside, they recovered a substantial amount of alleged marijuana packaged in separate plastic bags. we asked neighbors about that. >> we know in philadelphia a lot of people use marijuana. could have been for personal use or could have been for sale. >> reporter: investigators say drug charges are now pending against the father being hailed as a hero for protecting his

young family. the block captain tells us it had been quiet here until now. we spoke to neighbors about protecting their own families from violence. >> i'm a veteran myself. so not only do i try to prepare myself, i try to prepare my family and tell them, you know, what smart things to do in certain situations. >> reporter: now, along with the drugs found inside this house, police tell us they also discovered two semiautomatic handguns. the owner had a permit to carry. live for now, monique braxton, nbc 10 news. to our weather now. a damp and dreary tuesday. the rain's finally started to move out from the jersey shore. this is a live look down in cape may county. rained for most of the day there. wet in the poconos as well today. but later this week, that won't be the only area. it will feel like winter. after the rain, we are in for a big chill and some snow. >> a little bit of everything this week. nbc 10 first alert chief meteorologist glenn "hurricane"

schwartz is here with the weather forecast for your neighborhood. >> all the neighborhoods got rain today. and all the neighborhoods are going to get bitter cold as we head toward the end of the week. there's not much on the radar around close by. just a little drizzle and some fog. the main area of rain has moved up to the northeast. but we have more coming in from the west, as you can see, through ohio. that's going to come right in our direction as we go through the evening. not as much rain as what we had during the day today, but we can't give you the all clear until that area comes through in the middle of the night. but it will be clear by morning, at least the rain will be clear. there's 1:30 in the morning and we still have showers from pennsylvania and central new jersey northward. now, the temperatures are kind of mild for this time of the night at this time of the year. and it's going to be even milder tomorrow because, look at this.

the temperature really isn't dropping overnight. we have a few showers as we see late this evening and early tomorrow morning, but by 6:00 a.m. things should be dry. but it's going to get bitter cold and some places will see snow. that's coming up. >> new details in the case involving wrestling legend jimmy "superfly" snuka in lehigh valley. today a judge dropped a homicide charge against snuka. prosecutors say snuka killed his girlfriend at a motel back in 1983. his attorneys now say the wrestler is in hospice care and has six months to live. the judge dropped the charges today after reviewing snuka's medical records. many of us returned to work today. so did lawmakers on capitol hill. the 115th congress got to work by first re-electing republican paul ryan as speaker of the house. all but one republican voted for ryan.

he'll lead with an ambitious agenda. replacing the affordable carable. pat toomey was sworn into the senate this afternoon by vice president biden. his wife chris held the bible there. >> we'll be working hard. we'll hit the ground running. it starts tomorrow. we'll be working long days, long weeks because there's a lot of work to be done. i think we'll accomplish a lot. >> toomey's been a senator since 2011 as a sign of bipartisan. democratic senator bob casey was toomey's escort. donald trump blasted the proposed move by house republicans to limit the power of the office of congressional ethics. a few hours later the gop reversed course and did not weaken the ethics office. mr. trump tweeted, with all that congress has to work on, do they really have to make the weakening of the independent ethics watchdog, as unfair as it may be, their number one act and priority. focus on tax reform, health care

and so many other things of far grater importance. now a few hours after that tweet, the republicans dropped plans to gut the independent ethics office. representative tom cole of oklahoma said people didn't want this story on opening day. add two more former presidents and first ladies attending the presidential inauguration in washington later this month. this afternoon bill and hillary clinton confirmed they will go to the inauguration. hillary clinton hasn't been out in public much since losing the presidential election. and this morning president george w. bush and first lady laura announced they will also be at the inauguration. president carter said he is going. as for president george h.w. bush and barbara bush, they are not able to attend. a south jersey man accused of killing his estranged wife in front of their children will face a judge tomorrow. for fist time we're heari ining

calls that came in. monell is accused of stabbing tara o'shea-watson to death inside her home in commercial township. police say the couple's 12-year-old son and 4-year-old daughter witnessed that murder. the boy then ran to a neighbor's house for help. listen now as that neighbor makes the call to 911. >> her son just came down to my house saying his mother is dead. >> is dead? >> yes. >> okay. and is she -- are you there? can you see if she's breathing? >> my wife is inside right now. i'm walking through. i'm not touching anything just in case. >> eventually the neighbor's wife finds tara o'shea-watson's body, but it takes some time before she realize she was killed. listen now to that part of the call. >> oh, my god, she was murdered. >> it was a murder? what kind of injuries? >> i am on the phone with state police right now. >> what kind of injuries does she have, sir? >> jeremiah monell took off in

back to work in harrisburg for pennsylvania lawmakers. a new session but a lot of the same faces. >> what will be different this year, lauren mayk reports from the state capitol. >> reporter: it's pennsylvania house session number 201, but for chris nab it's day one. what was going through your mind when you were sitting in there? >> i was thinking all of the people that got me to this point. >> reporter: he was amongst 23 new house members sworn in today. >> i was campaigning for a year and a half as an outsider,

originally raised in chicago. >> reporter: he comes in at a challenging time for his party. the november election left democrats with fewer seats in the house and senate. >> here in pennsylvania things got a little harder for democrats like me in the statehouse. there are fewer of us starting this new session than any time i've been up here. >> reporter: republicans can drive the agenda, though. they have the majority in the house and a veto-proof one in the senate. he's looking for public pension reform. >> even though it might not save us any money today it will take the risk away for taxpayers in the future. >> reporter: lawmakers new and returning also start today with their own priorities. are you coming in thinking that you're going to break through that and get specific things done? >> you got the play the long game in politics.

and the long game is you're not going to get everything you want in one term. maybe two terms. it's going to happen over a long period of time. >> reporter: while some legislators start their terms philadelphia lawmakers end theirs. the speaker can set a special election. i'm lauren mayk, nbc 10 news. also the chairman of the republican party in pennsylvania is stepping down after ten years. gree gleason steps down today. a new leader will be announced. a follow-up to a story we first showed you last night. new details on the fight between a philadelphia police officer and a 16-year-old girl caught on video. yesterday afternoon there was a large fight in southwest philly. a teenager argued with officers. today that teenager slapped the officer in the face and broke the officer's glasses.

that was not on the video. both the female officer and the teenager threw punches until the officer got help detaining her. the teenager has not been charged. the officer is under investigation by internal affairs. now your nbc 10 first alert weather. after a day of steady rain heavy at times, wee now down to a little bit of drizzle and some fog especially at the shore. it is kind of mild across the area. you see everybody's reporting cloudy skies. it's near 50 degrees at the jersey shore with the west wind now. 50 at woodwine and upper township, close to that in ventnor and cape may point at 44. more fog there and that area is actually one of the ones most likely to see snow later on during the week and the weekend. can see, has moved out, but we

don't have enough wind to clear things out. we also have this other area of showers in ohio, west virginia moving straight to the east that we'll have to watch tonight. as we go through the night especially north of the mason dixon line, we're going to be seeing some of those showers late tonight but it should be all gone by tomorrow morning even though the clouds may be hanging around. the wind will be picking up. and that will be clearing things out. the next thing we're watching, well, we've got cold air coming in. then we've got this area of snow coming right from the west coast straight to the east combining with this weak storm off the southeast coast. and by late thursday night and into friday morning, it looks like it's going to combine just enough to produce some snow especially in southern delaware and the jersey shore. accumulation of maybe a couple inches depending on how intense

this gets and, of course, the exact track. but the farther north you go, the less likely there is for any snow at all. here is a closer version. middle of the night thursday night. here's some of that snow in central and southern delaware and the jersey shore for a portion of the morning rush. that's pretty impressive here. but it's certainly not oppressive. berks county, you don't get anything out of that. then another system that looks like it will be affecting parts of the jersey shore and delaware. this is the northern edge of a pretty nasty southern storm. it will bring rain and snow and ice in parts of the deep south. but jersey shore delaware early friday and during saturday, some snow, perhaps a little bit of accumulation, but look at the lehigh valley. partly sunny. those are high temperatures. that is bitter cold plus we have

joel emblid. he's the conference rookie of the month for december. he was also rookie of the month his first month. he's going to win it every month. he's the runaway rookie of the year probably. sixers host the timberwolves. looks like starting emblid to okafor is over. it went over as well as mariah carey's new year's eve performance. they'll start ersan ilyasova. he wants to win games. >> ilia has allowed joel to play. these pairings we talk about, it affects joel. and keeping him and growing joel should maybe be our number one goal. i feel likers ersan ilyasova allows us to do that and keeps joel in more of a natural position. >> some of the eagles assistants could get interviews. the bills will interview frank wright. john defilippo may interview with the jets.

carson will take time off mentally, do some time hunting. his rookie season was okay. but he's won everywhere he has been. he's not used to having a losing record. he'll have to change that next season. >> that locker room will never be the same. that's kind of a crappy feeling, but we're going to use that now. i know i'm going to personally use that. i never want to have that feeling again. i want to be playing into january for the rest of my career, god willing. and we're going to see what happens. >> we hope so. steve mason is still the flyers main goalie but his backup is back, so they've sent anthony stole ars to lehigh valley. big game against one of the top teams in the east. the rangers. the flyers have lost six of seven. they want to get back on track in the new year. >> we're fine. a long season. we're not even halfway through. i know we're about three games to the halfway point. but we're fine, we're confident in here.
