london. >> i'm jim rosenfield. one family filed the lawsuit today saying the president's order violates the constitution. >> lauren mayk spent the day with the family at philadelphia city hall. she joins us from there now with more live. >> reporter: the one family we're talking about, they're from allentown. we told you their story. their family members had been working for years to get here to live, and they are the ones who have just filed this lawsuit. now, today we learned about another family not looking to move here, though, just to visit. a visit between a mother and two daughters that didn't happen. >> i saw my mom. she said that would be good that would let me to meet you for just a few minutes. >> reporter: she said she was waiting for her mom at the airport when she got word that her mother would have to go back to iran because of the president's executive order. how long had it been since you

have seen her? >> about a year. >> reporter: they are students at the university of delaware and michigan. >> we're working to make america better in the future for your families, for your children and this is not the way to treat us. >> reporter: we talked to them on the day they joined another family at city hall, both with loved ones turned away at the airport. the asalis have now filed a federal lawsuit claiming the order violates the constitution and asking the government to pay for a return flight. >> this is not human. it was just not human. >> reporter: the sisters whose visas don't allow them to go back and forth had been looking forward to a six-month visit with their moem, including her birthday. >> we had a surprise planned for you. >> reporter: you didn't know about that? >> no. >> reporter: the developments here have her concerned about more than just their mother's visit. >> we don't know if we're going to be sent back to our country or not. >> reporter: while there is no

evidence of that, the sisters remain uncertain about their future while their mother remains far away. and since i saw you last hour, i have heard back from the trump administration. i had reached out to them to get a response about this lawsuit that has been filed today in federal court. they sent me this, quote, we cannot confirm the receipt of these documents at this time, and without proper evaluation, cannot respond. if we get more information on this, we'll keep you updated. live in center city, i'm lauren mayk, nbc 10 news. white house press secretary sean spicer is insisting president trump's executive order on immigration should not be referred to as a ban, that's despite the fact that the president has called it a ban himself. >> this is not a muslim ban. it's not a travel ban. it's a vetting system to keep america safe. that's it, plain and simple. >> the order temporarily halts the u.s. refugee program and bans citizens of seven muslim

majority countries from entering the u.s. for 90 days. yesterday the president tweeted if the ban were announced with a one-week notice, the bad would rush into our country during that week. a lot of bad dudes out there. now to breaking news in philadelphia and a verdict in the civil trial of the deadly building collapse on market street. i want to go live to nbc 10 investigative reporter mitch blocker who is at city hall. what can you tell us about this verdict? >> jim, you know this trial at this point took 4 1/2 months, four hour hs of deliberation here in courtroom 653. the defense has been found liable. we want to take you to video that we shot just a couple of minutes ago as the attorneys exited the courtroom. we can tell you that the plaintiffs' lawyers walked out with smiles on their faces. this dates back to 2013 when a building collapse, a demolition building collapse on market street collapsed on to a

salvation army building on market street killing six and injuring 13. at this point that verdict just reached within the last hour. defendants had been found liable. we're live at philadelphia city hall. i'm mitch blacher, nbc 10 news. to bucks county tonight. a 92-year-old woman is dead and her son was critically hurt after a fire ripped through their bensalem home. firefighters say they struggled to put out the flames because of hoarding inside that house. deanna durante joining us live in bensalem tonight. what's the scene like there now? >> reporter: well, at this point the house is boarded up and has been turned back over to the family who did not want to talk today. neighbors say they had no choice but to sit and watch as the flames sprouted out through the rooftop. they were praying that everyone would make it out okay. >> this would be a terrible way to good. >> reporter: from her living room, bertha can only watch. her neighborhood friend is gone. >> it was chaos. i mean, there were trucks and

suvs and fire trucks. it was very upsetting. >> reporter: she knew her friend julia had collections, piles of clothes and other items were stashed everywhere. >> all of a sudden i saw a bunch of flames and said, oh, my god. i just couldn't imagine that she would get out of there. >> reporter: firefighters were able to get the 92-year-old woman to the hospital but she died late today. her son is listed in critical condition. at one point firefighters say it was too dangerous to keep rescuers inside the house. >> the fire department had extreme problems fighting the fire. it was a hoarding issue here. the house is full with debris, trash, trash bags, clothes. >> reporter: she says she hopes her friend didn't suffer. she's praying for the family. >> but that fire. i just thought all those things lined up against from the floor to the ceiling.

and i just couldn't imagine, you know, she's so tiny. she's a tiny little lady. very fragile. >> reporter: we can tell you one firefighter was also treated for minor injuries. again the woman's son is listed in critical condition at a philadelphia hospital. and firefighters say this should serve as a warning tonight, if you know people who are hoarding items, help them clear them out. reporting live in bensalem, deanna durante, nbc 10 news. to another fire. residents of this old city apartment building say they never heard fire alarms when the building went up in flames this morning. the fire department says it's looking into the matter. but nbc 10 found the building along market street has had no violations in the past, no one was hurt, but for people who live here, the reality of what could have happened is just setting in. >> they sent out my last working e-mail and if i slept literally a minute ago where my bedroom is, i wouldn't have been able to make it out. >> investigators are still

trying to figure out how the fire started. new at 6:00, a philadelphia police officer has been cleared in an investigation of a tattoo that mayor kenney once described as incredibly offensive. this picture of officer ian lichterman caused a social media firestorm late last year, that showed a tattoo of an eagle that some identified with nazi german and above that is the word "father land." philadelphia mayor jim kenney released a statement today saying he's deeply offended by the tattoo and he looks forward to a new department policy. an employee fighting back after a robbery suspect bursts right in with a handgun. this video shows a suspect pointing a gun at a worker on saturday. it happened over the weekend at this takeout restaurant along wayne avenue in germantown. another worker who is licensed to carry, fired at suspect who

then ran away and in ono one wa hurt. it is dry in center city after passing showers. a live look at broad street from our kimmel center campus camera. chilly today but warmer tomorrow. let's get the forecast from chief meteorologist glenn "hurricane" schwartz. >> we'll be seeing some places in the 50s tomorrow. you remember yesterday right around this time it was snowing so you couldn't even see the ben franklin bridge the way we can see it now. right now 38 degrees in philadelphia, 45 in dover. well into the 50s there today. only 32 degrees in trenton. 42 in atlantic city. they got up near 50 degrees as well during the day today. we have just a few returns on the radar, some right in berks county. we're still not reporting anything hitting the ground in reading yet. mostly activities around the great lakes and not coming over the mountains. so it looks like it's going to be dry overnight. it also looks like the temperatures are not going to be

going anywhere. whatever you see now is pretty much going to be what you're going to have tomorrow morning within a degree or so even with the mostly clear skies. that's an indication that the atmosphere overall is warming up and we're starting the day off with mid to upper 30s at this time of the year you know it's going to be a mild day. it won't start that day for the rest of the week. we'll tell you about that roller coaster in temperatures coming up. we have some breaking news coming into the nbc 10 newsroom right now. take a look at these pictures from skyforce 10. an accident involving a police officer. the location of this rash is at ninth and maryland av mew in wilmington. what we know is that a police car collided with another car. you see the cars there with all the other police cars that drove to that scene. we know that one person was trapped as a result of this accident. no word if it was the officer. our newsroom is going to keep working the phones and trying to get some answers for this. we'll keep you updated. we have new details on the

shooting death of a philadelphia man last month during a preliminary hearing today for martina westcot, it was revealed that she and the victim were arguing over having a baby when the fatal shot was fired. westcot told police she just wanted to scare bruce when she picked up the gun and pulled the trigger. new details tonight about a woman accused of beating her husband to death. a defense lawyer now says 42-year-old tinsley was acting in self-defense. she shut douglas tinsley in the head several times with a fire extinguisher. this happened at the couple's home yesterday afternoon. her lawyer says tinsley's husband was trying to suffocate her at the time. money's on the way to help fix the closed delaware river bridge. more than $9 million in contracts awarded to prepare the bridge for permanent repairs now. that bridge connects the pennsylvania and new jersey turnpikes. it was closed two weeks ago after a big crack was

pocono. well into the 50s in atlantic city earlier and chester, bucks, montgomery counties, we're still love freezing. exton at 36, malvern 35, chadds ford 39. washington, waurington, new hope, newtown at 32 degrees right now. of course, that's not that cold for this time of night, this time of the year. we got up to 42 today, near 50 tomorrow, then down to 40 on thursday, then even colder than that on friday and saturday. we have a few little showers earlier, now we're watching this area come across. a little bit of light mixed precipitation, though not reaching the ground. reading is not reporting anything hitting the ground yet. now, what's going to be happening here with the temperatures that's going up tomorrow? many places are going to be over 50 degrees, but it won't stay

that way. late this week 30s during the day, 20s at night. even some teens in many of the suburbs by especially friday night and into saturday morning. saturday itself's going to be sunny and cold. sunday a little bit of snow and rain with relatively weak system moving through. it does not look as impressive as it did a couple of days ago. 50 degrees at fairmount tomorrow. schwenksville up to 47, even allentown, 44, remember barely at freezing today. voorhees township in new jersey, up to 50, 52 in longport, way above average this time of the year. now we're talking about it going down, wednesday to thursday to friday. look at friday high temperatures, 29 degrees, the lehigh valley and temperatures will be in the teens friday night. it's cold everywhere, but it looks dry for the rest of the week. not necessarily all weekend.
