7:06 am
executive order to ban people from seven predominantly muslim countries. >> let's focus more on the president's immigration policies. could they lead to mass deportations, as we just heard? we'll get a fact check in a moment. first, here are the basics. there are an estimated 11 million people in the united states illegally. of that number, experts say 800,000 have committed crimes here. >> can you realistically deport that many people? the obama administration deported more than 2.5 million people, the highest of any prior presidency. now, as promised, let's bring in ari melber for today's fact check. >> good morning. >> senator chuck schumer of new york says this sets the table, the new policies for the mass deportations that many people feared in a trump presidency. is he right? >> no. we don't know exactly what is going to happen. this is certainly a bigger hammer, but how hard they swing it is not detailed in the policies.
7:07 am
there is more they can do to deport more people faster. >> one of the big aspects of this has always been the so-called dreamers. these are the children who were brought into this country illegally by their parents but who did nothing wrong on their own and are now living here. during the campaign, then candidate trump said he was going to crack down on this. he now says it is a difficult situation. what are the new guidelinie ins telling us about what? >> this was a debate during the campaign. the guidelines exempt those children who were brought here. that basically means for now, the obama era policy stays in place. because this is executive, done by the president only. that could change any time. >> one of the terms we've been hearing the last 24 hours or so is expedited removal, meaning this is going to happen quickly for people who fall under the new policies. if i'm already in the criminal system, do i lose my due process rights now? >> you basically probably have less rights. this is done in a civil way. what that basically means is the
7:08 am
government doesn't have to do as much to make sure that it is getting the process right or proving its case because you don't have as many rights to be here in the first place. >> the rules surrounding expedited removal changed under obama. it was anybody you found within 14 days and 100 miles of the border. now, it is anywhere you find them up to two years. >> that's right. this is basically one of several ways that this set of policies tries to give those border agents, ice agents and even now, even more local police, opportunities to catch and deport people. that is a big process. it can be expensive. typically, not everyone that we have undocumented in the country is thought of as a priority for that. that's where the rubber meets the road. over the long haul, how many people do they want to deport? as you pointed out, 2.5 million plus under the past administration. the numbers have been rising. >> ari melber, thank you very much. >> appreciate it. we are now learning more about that deadly attack on the half brother of north korea's

7:10 am
in pyongyang. north korea's ambassador said nothing about the suggestion a senior diplomat might somehow be involved, in a mystery that for ten days has added new twists and characters that played out in real time in airport security video, purportedly showing the apparent attack. police say the two women in custody, who appear to wipe something on kim's face, knew it was poison. >> the indonesian did it first followed by the vietnamese lady. who wiped the face of the deceased. after that, they went to clean their hands. they know it is toxic. >> reporter: contradicting claims the women were duped into thinking they were part of a tv prank. meanwhile, at the morgue, they've had to step up security since an apparent break-in. >> as for that dna sample, police say they've asked north

7:14 am
student as part of what is known as the senior salute, where older students asked out younger students before graduation, sometimes for sex. he maintained he never had intercourse with his accuser. he was accused of misdemeanor sexual assault and child endangerment, as well as a felony charge that requires him to register as a sex offender for life. that wasn't enough for his accuser, who revealed her identity in an exclusive interview with savannah last summer. >> they said they didn't believe that he did it knowingly. and that frustrated me a lot because he definitely did do it knowingly. >> reporter: labrie claims his previous lawyers failed to lower the felony charge. his new lawyers argue the conversations took place over the campus intranet, not the internet, a difference that his lead attorney, carney, never brought up in court. in court documents responding to
7:15 am
labrie's claims, carney wrote, i don't consider myself to be knowledgeable about internet communications. going on to say, i did not hire an expert to investigate this subject because it never occurred to me it was an issue to explore. the local attorney says she didn't see the red flags at the time. >> looking back on it, as a whole, i would say, no, i wish i would have done more. >> not only is labrie asking for a new trial but appealing his convictions to the state's supreme court. matt and willie, this hearing is set to continue for several more days. back to you. >> gabe, thank you very much. let's head to hawaii where the dramatic rescue of a young boy was caught on camera. a grandmother was recording her grandsons playing in the water along oahu's north shore. a wave knocked 8-year-old kim off his feet. the undertow begins to pull the boy away as his mother and grandfather struggle to reach him. a group of good samaritans

"today's" craig melvin is here with more. >> the landing mistakingly on a taxi way, not the run way, is now the focus of an faa investigation, and the video you're about to see will likely be at the heart of it. >> reporter: overnight, nbc news obtained video of the moment harrison ford accidentally flew his single engine plane over a 737 filled with passengers. it happened two weeks ago at john wayne airport in orange country, california. from another angle, you can see ford's yellow husky coming dangerously close to an american airlines flight preparing to
7:17 am
take off with 116 people on board. ford had been cleared to land on a short runway. instead, as you can see in the distance, he mistakingly landed on a parallel taxi way where planes taxi before take off. experts say that is a clear faa violation. >> operating in and out of this airport, it's a small airport. there's a lot of traffic going in and out of it. it is a complex bit of air space that requires a lot of concentration. >> reporter: once on the ground, ford radioed air traffic control. was that airliner meant to be underneath me? the controller told ford he hadn't landed on the runway. instead, you landed on taxiway c. w to which ford replied, i landed on c. two years ago, ford was injured when his plane crashed on a santa monica golf course. >> engine failure. >> reporter: investigators blamed the crash on an engine failure. ford later joked about it on the
