steven floyd was killed. his widow is also part of the lawsuit. the state failed to protect the guards. didn't provide staffing or a safe work environment. george spencer says the state ignored security concerns tr years. >> reporter: the legal complaint is 52 pages focused on troubling allegations about security in the prison itself and focused on the state leaders who attorneys say could have prevented the death of lieutenant floyd. her husband last year's correctional officer of the year was killed in february's 18-hour uprising at von correctional center. these officers also held host alk tried to save him but could not. >> they are not recovering well. >> attorney tom calls his client

the walking wounded saying they still suffer flashbacks and nightmares. the federal lawsuit filed this morning alleges that the deadly standoff occurred because former governors ignored recommendations to increase staffing after a 2005 revolt at the same prison. >> instead they spent up to $23 million a year forcing understaffed officers to work 16-hour shifts overtime to save money. state leadership did have warning signs. it was widely discussed that building c was unmanage bli dangerous and had become a powder keg that was about to explode. and yet attorneys say searches for weapons were rare and security technology almost nonexistent. >> how many cameras do you think

there were at that building? >> their own review of the uprising and proposed budget increases to add 50 new officers. tr floyd's family and the surviving officers, the lawsuit is expected to take years in the federal court system. reporting in wilmington, george spencer, nbc 10 news. a facebook murder manhunt ends. an accused killer took his own life during a police chase this morning. the manhunt started in cleveland. but a mcdonald's worker recognized the killer in a a drive-thru in pennsylvania this afternoon. the restaurant manager says stephens pulled up to the drive-thru and ordered a 20-piece chicken nuggets and french fries. workers tried to buy time for lifrs saying his order of fries was delayed. stephens said he had no time to waste and drove off. >> from what my supervisor and

didn't want to wait and said had e had to go. i'm thinking at that point, he might have been thinking that somebody in the store recognized him and was trying to get out of here. >> state troopers then started to chase steempbs he shot and killed himself during the pursuit. no one else was injured. police are still searching his car. an off duty police officer is accused of shooting her husband in the groin. investigators tell us that shooting happened in the driveway of the couple's home while the children were inside. police say the husband was taken to the hospital and had surgery. neighbors didn't realize anything happened until they heard helicopters in the skies above their street. >> good neighbors, no noise, no problems. very polite kids. >> police say the officer did not use her service weapon to shoot her husband.

a call in camden to end gun violence that is plaguing the city. to find out just how big of a crisis it is, nbc 10 got a look inside the police department's evidence room. >> those are some of the guns that officers are pulling off the streets. >> police say many of these guns are coming from out of state. >> reporter: that's right. in more than 80% of these deadly crimes, theelt guns are purchased outside of new jersey. often times at gun shows and without background checks. today residents hit the streets to reverse those staggering numbers. moms, sisters, students, aunts, uns and neighbors made noise marching today. it's an effort to quiet the sound of gunfire in their neighborhoods and encourage people to find their moral voice. >> when we see things, we need to report it.

>> his killer emptied the gun. >> reporter: it still feels like yesterday. >> feem are sick and tired of what's going on in their neighborhood. >> every gun you're locking at. >> a step beyond the march right into the evidence room. these are the hundreds of guns used in crimes and seized on camden streets in recent years. 800 over four years, 100 year alone. >> every legal gun we can get means one more person gets to kiss their kid good night. >> 80% weapons were purchased outside of new jersey. 12 people were killed in homicides in camden. this year it's far less at two murders. thompson is hopeful we can save lives. >> we can start to change the dynamics of neighborhoods. he wants guns seized before crime os cur. >> there's more people out here

the courthouse. a jury will decide if eric frein is gmt of murder and if he should face the death penalty. the prosecution rested after ten days evidence included e emotional testimony from trooper alex douglas who was wounded in the ambush sniper attack. the defense team didn't present evidence or call any witnesses. if frein is found guilty they will try to convince the jury to spare his life. and jury selection is und underway in a case that got a lot of attention. a man accused of killing his 3-year-old son. prosecutors say david killed him in 2015 because the child got in the way of his relationship with a teenage girlfriend. they say he then called 911 to his son missing. the past half hour we learned jury selection is about half way through ask could be completed by the end of the day tomorrow. opening statements would start thursday. a warning for parents tonight. the wildwood crest police department is looking for a suspicious man preying on middle school kids.

they say a man walked up to them and asked why didn't you say hi. in another case the boys playing outside asked if a man asked if his father was home. this drexel hill woman is accused of trying to kidnap a man. she responded to an ad in january placed by a man on craigslist seeking companionship. she showed up to the victim's home with two other men and tried to kidnap the guy. the victim fought back and called 911. all new at 6:00, a third high school student is joining a civil rights lawsuit against the boyerer town area school district. the lawsuit says three boys had their rights violated when they saw a transgender student who was transitioning from female to male getting changed in the lock er room. the school district has a policy that allows students to use the bathroom of the gender they identify with. we are getting a more detailed look at what the set up would look like for the nfl

on thursday we could see rain showers and also on friday. maybe some isolated thunderstorms. this is going to be widely scattered. it's not going to be an entire washout. then we get to the good stuff. that's the heat. 80s return on friday. 70s on thursday. it's going to be very pleasant out there both days. even with a brief shower. i don't think it's going to last all day. we're going to have some quiet periods with some sunshine as well. the weekend is is a mixed bag. sun on saturday. foggy and chilly on sunday. e we may struggle to make 60 degrees across the area. doppler radar sweeping the sky. nothing going on here in our area, but off the west, we have a couple more storm systems in the pipeline. we'll start to see clouds increase from the first one by tomorrow and then we'll have several of them rotate through during the week. here are the temperatures. look at the 70s across the area right through the midwest through the ohio valley. the te valley, we were near 70 today. very comfortable. but we did have this on shore flow. the east winds is what kept us

from reaching the mid-70s. 69 was our high. you're coming in at 57 degrees. . tonight we're going to dip to the 40s. but pretty much the mid-40s across the area. 43 in reading. wildwood at 46 degrees. when you wake up tomorrow morning, you'll need a sweater or light jacket. hour by hour, the easterly winds continue. tomorrow when you wake up, we'll still be in the east winds, but clouds will have moved in. by tomorrow afternoon, a sprinkle in the lehigh valley and mount pocono, we see things quiet down. overnight into thursday, we're looking at rain showers moving through. early on thursday, it kind of quiets down. we're going to make it into the 70s. we see rain returning early, but it gets out of here. look at that clearing in the afternoon. and what do you know. the 80s return. it isn't going to be too bad. but it's the weekend that's most interesting. i'll have that in your ten-day
