this weekend the phillies have a night game on friday, day game on saturday and then a concert afterward. sunday the maikel franco batting gloves given out to fans 14 and under. so although it's just three games, there's a lot going on at the ballpark this weekend. 1-2 pitch. to left field and slicing toward the seats. >> john: so the concert is on the second day of the home stand? so you'll get to see them if you want? >> tom: yeah. i will probably stay and just give you a full report as whether you should use them as part of your song list. >> john: yep. >> tom: hopefully the weather is clear.

phillies will wrap up the month of may with only six wins, as this one is popped foul. the worst may they have ever had in a long storied history of this franchise was 1928 when they were 3-22. >> john: ouch. >> tom: this month counting the last two games, 6-22, which winning percentagewise is the second worst. one ball, two strikes to altherr. and 2-2. >> john: wonder what we're going to talk about on the postgame show? >> tom: anything you want to run out there? they could build a graphic for you. >> john: i'm at a loss.

hence the collective malaise the phillies have been in. >> john: i was just explaining to someone that it was a malaise. >> tom: that's right. strike three called. altherr down looking and the ball game is over. the marlins have swept out the phils in this brief three-game series. don mattingly's team limping going into their series against the angels have now won back-to-back and five of six. it's their first three-game sweep since august of last year at pittsburgh, and their first three-game sweep of the phils since june and july of 2012. they win it today comfortably in the final game of this three-game series. the first month with six or fewer wins since june of 1997. when the phillies were 4-22. dan straily today 6 2/3, 8 hits an 10 strikeouts.

he was our chevrolet player of the game. he had it going on from the get-go. not only with his fastball but also his breaking pitch. it had an awful lot of movement on it. aaron altherr going fishing on that one. howie kendrick tried to check and could not. pretty good movement on the outside breaking ball. went back to it a couple different times. right there he freezes aaron altherr. i thought that was one of the best pitches of the day to freddy galvis. he was all smiles when don mattingly took him out, but he is our chevrolet player of the game. so the phillies lose it by a final of 10-2. the marlins sweep the series. we'll be back to south florida to wrap it up right after this. ♪ ♪ ♪ ♪

to schedule a new trial. nbc 10's cydney long has been following the trial from its start some six weeks ago. >> what's the reaction to the outcome this afternoon? >> reporter: i can tell you certainly shock and sadness. more disbelief than relief for all the parties involved. you can tell you that jurors left the building from a side door under the closed supervision of sheriffs officers today and the dead lock decision. it comes just one day after the birthday. he would have turned 5 years old tomorrow. dj creato first let's out a deep breath and looks up as if in prayer before turning around to see his parent's reaction to a

dead locked jury. the father is not found guilty or acquitted on the murder or child endangerment charges. instead the reality that he will have to move through this trial process all over again. >> dj is upset. e he wanted to go home today. he wanted to be with his family. he hasn't seen his family in person for a year and a half other than in the courtroom. >> any comment? >> reporter: the prosecutor and lead homicide detective left court surrounding brendan's mother, who was also speechless after this outcome. the rgs announcing an b hour later they will retry the case. brendan's grandmother cried in court. once outside. >> any comment your family might like to say? >> they are having a tough day. they certainly want to see their son home today and that's unfortunately not the way it went. >> both the prosecution and defense attorney a part of the

jury for their hard work since april 20th. >> i think the nature of a a hung jury suggests they can't prove the case beyond a reasonable doubt. that's why very well intentioned people disagree on thrks but 12 people couldn't say guilty. >> dj creato at this hour remains locked up in the camden county jail. this building directly behind the courthouse. his attorney plans to ask for a reduction of the $750,000 bail. that's a hearing that could come early as next week. this case has also obviously rip ed the community and we did speak to residents there today. we will have more on their reaction coming up at 5:00 and 6:00. for now, i'm cydney long, nbc 10 news. >> as you just mentioned, our coverage continues at 5:00. nbc 10's lauren mayk is talking to experts about what's next and what the chances are there will be another trial. that's coming up at 5:00.

turning to our weather. finally some sunshine after days of dreary weather, temperatures return to normal today and found return to normal today and found people enjoying the slightly warmer weather as they ate outside in newark, delaware. it was a better day at the be h beach. a live look down the shore where conditions are much better than they were over that holiday weekend. but we are tracking changes for tonight. stormy weather moving our way. let's bring in chief meteorologist glenn schwartz. >> what's the timing of these showers right now? >> it does look like over the next few hours, these showers as they move closer to the lehigh valley and poconos going to weaken. they have been weakening as they have gotten farther to the east. these are the only showers in our area very small. other showers moving to the east could affect the lehigh valley and the poconos. but a lot of this stuff isxl ju

going to weaken as the sun goes down. as you can see on the futurecast, there's 8:00. there's not much going on, but later on this evening, for the lehigh valley, poconos area, maybe extending to parts of bucks county and then we start out again. no repeat of the fog from this morning tomorrow morning. it's going to be a really nice start to the day. 78 degrees, that's exactly the average high for this time of year. but it's still in the 60s to near 70 at the beaches. we have that chance of a a shower or thunderstorm by late this evening. again, the highest chance is farther to the north. tomorrow morning, starting off sunny. we're going to finish the day sunny. we'll see how long the stretch lasts even into the weekend, comie ining up. the first ever for philadelphia, but it turned out to be a trip to a spot no one

students got a hands on lesson behind the wheel about the dangers of drinking and driving. the dui safety simulator creates scenarios in which the driver or other cars ob the rod are being operated by someone under the influence. the demonstration included a mock crash which students say was very emotional. >> students got to see firsthand what it was like to see somebody essentially lifeless in a motor vehicle accident as well as the other injuries involved with that. >> the school held the event ahead of tomorrow night's prom.

in central and western pennsylvania for the most part. that's where they are going to stay and generally die out. we have sunshine today. 78 degrees, we have the fog this morning. that broke up and temperatures have gotten way up into the 70s. lehigh valley has a little more cloud cover. that's the area with the best chance to see any kind of showers later this evening. still wind off the ocean. it's only in the 60s in holgate. it has made it to 70. and that's the first time it's done that in quite awhile. the afternoon highs over the last several days, 64 e degrees. monday, 62. 78 so far today. and look at that. the next couple days near 80 degrees. and the radar, again, not showing you much in the area. two tiny showers, one of them near westchester and they will continue to weaken.

these in western pennsylvania will continue to weaken. not concerned about that. certainly not for tomorrow. up to 80 degrees. reading at 76. you see all the sunshine all over the place. even at the shore near 80 degrees tomorrow because it will be more of a land breeze. as we go to the 5:00 hour, we'll see what the weekend is looking like. now a look at the stories making story county by county. they are offering patients help getting a ride to their appointments. they are using an app to cut down on the time it takes to order a ride. and allow patients to request a ride from the transportation company prefer red by their insurance provider. in cape may county, late night sidewalk dining won't be coming to the city. a proposal to extend the hours failed to get enough votes from city council. a law allows restaurants to serve food and alcohol outdoors

now to the fallout from an historic flight from philadelphia that did not go as planned. a water canon salute marks the beginning of nonstop flights to iceland. yesterday the mayor was on board as the plane took off for the capital. but technical problems caused the plane to turn around over canada and it landed in boston. rosemary connors is following the story for us. >> what did they find out about that plane's problem? >> reporter: iceland air tells me that mechanics inspected the plane today and didn't find

anything. the pilots aren't satisfied. they wanted to do a test flight just to be sure. the passengers are on a new plane that's already enroute to iceland and should land within the next e three hours. it was quite the send off for a special occasion. the first direct flight from philadelphia to a foreign land known for its natural beauty and off the grid appeal. only the iceland airplane never made it. perhaps it was the one thing the public relations team didn't expect. the floigt had to be diverted to midair. >> victor seen here is a a reporter for philadelphia magazine flying to iceland curtesy of the airline. they are now on their way from boston. icelandair will only say a technical issue caused the

nbc news begins with breaking news. police are about to hold a news conference in the investigation of a a girl found with a plastic bag over her head. >> we are life at police special victims unit with the breaking news. this is a complicated story. explain to us what is happening here. >> lots of twists and turns in the case that we're hoping police can clear up. a mother believes her 18-year-old son stole her car. so she called police. she went to get paperwork about the car, but instead of finding the paperwork, she finds her daughter unconscious.

>> crime scene investigators took bags of evidence from the home in the 5500 block of north american street. although police say it's unclear if a crime was committed. >> my niece is 6 years old. she went to school crying because she couldn't believe what was going on. >> a 7-year-old was found unresponsive in the basement. a plastic bag was found over the child's head. the mom rushed the child to officers who were outside and started cpr. >> i just saw her this past saturday. the family had a huge cookout and she was running around playing, having fun. i'm in shock. this is not supposed to happen. >> officers came to the house around 1:00 this morning for a much different reason. the mother called to report her car stolen, possibly by her 18-year-old son after they had an argument. the mother went to the basement to get the paperwork for the car. that's when she told officers she found her 7-year-old daughter unconscious. >> i received a phone call from her mother around 1:30 thi
